What is the Advocate Graduate Stipend in Gujarat?

Advocate Graduate Stipend Gujarat is a monthly stipend paid by the Government of Gujarat to a newly enrolled advocate during the first three years of practice, together with an allowance to the senior advocate under whom the junior trains. According to the scheme's listing on the Government of India's myScheme portal, the junior advocate receives Rs 10,000 a month in the first year, Rs 8,000 in the second year and Rs 6,000 in the third year, and the mentoring senior advocate receives Rs 5,000 a month.

The problem the scheme addresses is specific to the legal profession. A newly enrolled advocate in India cannot practise meaningfully alone: the craft is learnt in a senior's chamber, drafting, filing and appearing under supervision. Those years are close to unpaid. A graduate from a family with no lawyers and no savings therefore either leaves the profession within a year or takes a salaried job that ends the possibility of building an independent practice. A stipend for three years, on a reducing scale as the junior's own briefs begin to come in, is designed to hold that person in the profession long enough to become self-supporting.

The allowance to the senior advocate is the less obvious half of the design. Chambers take on juniors at a cost: desk space, supervision time, the risk of a mistake in a filing. Paying the senior Rs 5,000 a month makes it worth a chamber's while to take a junior who brings no family connections with them.

Who is eligible for the advocate stipend?

You can apply if:

• You hold an LL.B. degree from a Bar Council of India recognised institution.
• You are enrolled as an advocate with the Bar Council of Gujarat.
• You are practising under a senior advocate who is willing to certify that you work in their chamber.
• You are a resident of Gujarat practising in the state.
• You fall within the social category for which this scheme line is reserved. The myScheme listing records the eligible category as Scheduled Tribe, and Gujarat runs parallel lawyer stipend lines for other categories through other directorates.

You cannot apply, or are not eligible, if:

• You have not yet enrolled with the Bar Council. A law degree alone is not enough; the stipend follows enrolment.
• You are not practising under a senior advocate, for instance if you have set up independently from day one or joined a company's legal team.
• You are in salaried employment, a corporate legal department, a public sector law officer post, or a judicial services appointment, rather than in practice.
• You are outside the social category the scheme line covers. Check the other Gujarat lawyer stipend schemes before concluding you have no option.
• You have already drawn the stipend for three years. The benefit is not renewable for a fourth year.

How to apply for the advocate graduate stipend

1. Complete your enrolment with the Bar Council of Gujarat and obtain the enrolment certificate. Nothing in this scheme moves before that.
2. Join a senior advocate's chamber and obtain a signed certificate from the senior confirming that you practise under them, stating the senior's years of practice and their consent to be the mentoring advocate under the scheme.
3. Assemble the documents — degree, enrolment certificate, senior's certificate, caste certificate, Aadhaar, residence proof and bank details, and have the copies self-attested.
4. Obtain and fill the prescribed application form from the concerned department office in your district, and submit the completed set there against a dated acknowledgement.
5. Complete verification. The department checks the enrolment with the Bar Council and the chamber attachment with the senior advocate before sanction.
6. Draw the stipend monthly into your bank account, and file whatever continuation certificate the sanction order requires, the stipend is conditional on continuing in practice, so a lapse in the certificate stops the payment.

When should you apply?

Apply as soon as you are enrolled. The comparable Gujarat scheme for Scheduled Caste lawyers, run by the Director, Scheduled Caste Welfare, requires the application to be filed within two years of Bar Council registration, and the same logic applies here: the benefit is meant for the earliest years of practice and cannot be claimed retrospectively for years already spent.

Why applications get rejected

• Enrolment certificate not produced, or the applicant is still awaiting enrolment.
• Senior advocate's certificate incomplete; unsigned, undated, or silent on the senior's years of practice.
• The senior already mentors the maximum permitted number of stipendiary juniors.
• Applicant is in employment, which the verification stage picks up and which disqualifies the claim entirely.
• Caste certificate from another state, or from an authority that is not competent under Gujarat's rules.
• Application filed too late after enrolment.
• Bank account details wrong, which does not reject the claim but stops the monthly credit until corrected.

How does this compare with Gujarat's other lawyer stipend schemes?

Gujarat runs more than one stipend line for young lawyers, and applicants regularly apply under the wrong one. The Dr. P. G. Solanki Financial Assistance Scheme for Lawyers, administered by the Director, Scheduled Caste Welfare, pays a trainee Rs 1,000 a month in the first year, Rs 800 in the second and Rs 600 in the third, with Rs 500 a month per trainee to the senior lawyer. That scheme requires the senior to have ten years of practice, caps a senior at two juniors at a time, applies no income limit, and requires the application within two years of Bar Council registration.
