Legal Heir / Succession Certificate in Jammu and Kashmir (eUNNAT)
Jammu and Kashmir state government scheme
A legal heir certificate in Jammu and Kashmir is issued by the Revenue Department through the eUNNAT portal at eunnat.jk.gov.in, where the service is listed as "Application for Issuance of Legal Heir Certificate by Tehsildar". The Tehsildar signs it and the notified timeline under the J&K Public Services Guarantee Act is 15 days. A succession certificate for large financial claims comes separately from a civil court.
What is a legal heir certificate in Jammu and Kashmir?
A legal heir certificate in Jammu and Kashmir is the Revenue Department's official record of who the legal heirs of a deceased person are. On eUNNAT, the Union Territory's single-window e-services portal at eunnat.jk.gov.in, the service is listed as "Application for Issuance of Legal Heir Certificate by Tehsildar", a Government-to-Citizen service of the Revenue Department, carrying a notified timeline of 15 days under the Jammu and Kashmir Public Services Guarantee Act.
J&K is one of the few jurisdictions that uses the plain phrase "legal heir certificate" as its own official service name. Many states bury the same document under names like "surviving member certificate" or "family member certificate"; in J&K you search eUNNAT for exactly what you are looking for.
The Tehsildar signs it, after the Patwari and Naib Tehsildar verify the family on the ground. At district level, the Assistant Commissioner (Revenue) in the Deputy Commissioner's office oversees these services, the Srinagar district administration, for instance, names the Assistant Commissioner Revenue as the officer concerned for this certificate and points applicants to eUNNAT.
Families in Jammu and Kashmir need it for:
- Family pension, arrears and gratuity where a government employee has died.
- Provident fund and group insurance claims.
- Compassionate appointment in UT government service.
- Mutation of agricultural land and property into the heirs' names, alongside the Jamabandi and Fard extracts that the same eUNNAT portal issues.
- Release of bank balances, deposits and scheme dues.
Legal heir certificate or succession certificate, which do you need?
Two different routes exist, and choosing wrongly costs months.
The legal heir certificate (Tehsildar route) is administrative. It records who the heirs are. It does not fix shares, does not resolve a dispute, and does not by itself transfer ownership. It is the correct document for pension, provident fund, gratuity, compassionate appointment, land mutation and most routine departmental claims. eUNNAT gives it a 15-day PSGA timeline.
A succession certificate (civil court route) is an order of the competent civil court under the Indian Succession Act, 1925. The court publishes notice, hears objections, and then authorises the holder to receive the debts and securities of the deceased. It carries court fee assessed on the value involved, needs an advocate in practice, and takes months. Banks releasing substantial deposits, depositories transferring shares and mutual fund registrars normally insist on this order rather than the Tehsildar's certificate.
Where the deceased left a will, the executor may need probate or letters of administration from the court. Neither the Tehsildar's certificate nor a succession certificate replaces probate.
Note also that succession among Muslim families in Jammu and Kashmir is governed by Muslim personal law, and the Tehsildar's certificate simply records the surviving heirs, it does not compute each heir's share. Shares are worked out separately, by the parties, by the personal law applicable, or by the court.
Who can apply, and who cannot?
You can apply if:
- You are the surviving spouse, son, daughter, mother or father of the deceased.
- You are another legal heir under the personal law applicable to the deceased.
- You are the legal guardian of a minor heir, applying on the minor's behalf.
- The deceased ordinarily resided in the tehsil you are applying in, which fixes jurisdiction.
You cannot apply if:
- You are not an heir of the deceased. A creditor, employer, neighbour or landlord is not eligible.
- The deceased resided outside Jammu and Kashmir. Apply to that jurisdiction's revenue authority instead.
- You are applying in order to exclude another heir. Patwari verification exists to find every heir, and a suppressed heir is grounds for cancellation.
- Heirship itself is disputed between family members. The Tehsildar cannot adjudicate that; it goes to the civil court.
- You need authority to collect large bank deposits or securities, which only a succession certificate confers.
- The death has not been registered and no death certificate exists yet.
What documents are required?
| Document | Mandatory | Notes |
|---|---|---|
| Death certificate of the deceased | Yes | From the registering municipal or panchayat authority |
| Applicant's identity proof | Yes | Aadhaar, voter ID or passport |
| Identity details of every legal heir | Yes | Name, age and relationship for each |
| Residence proof of the deceased in J&K | Yes | Fixes the correct tehsil |
| Affidavit / self-declaration of heirs | Yes | Confirms no heir has been omitted |
| Proof of relationship | Sometimes | Nikahnama, marriage or birth certificate |
| Fard / Jamabandi extract | For land mutation | Also available on eUNNAT |
| Service or pension record | For pension claims | Quoted by the employing department |
Scan each document as a clear file. Illegible uploads are the easiest way to lose your place in the 15-day queue.
How to apply for a legal heir certificate in Jammu and Kashmir online
- Open eunnat.jk.gov.in and register a citizen account with your mobile number, verifying the OTP. One eUNNAT account covers every UT e-service, from certificates to Jamabandi extracts.
- Search the service list for "Legal Heir Certificate" and select "Application for Issuance of Legal Heir Certificate by Tehsildar" under the Revenue Department. Read the service description page, which states the 15-day PSGA timeline and the designated officer.
- Enter the deceased person's details — full name as printed on the death certificate, date of death, and the district and tehsil of ordinary residence. The tehsil you choose decides which Tehsildar receives the file.
- List every legal heir with name, age and relationship to the deceased. List all of them. An omitted heir is what gets certificates challenged years later.
- Upload the documents, death certificate, residence proof, identity proofs and the affidavit, into their labelled slots.
- Pay the application charge shown on the eUNNAT payment screen, if one is displayed for your district, and save the receipt.
- Submit and note the application reference number on the acknowledgement. The PSGA clock runs against this number.
- Cooperate with field verification. The Patwari and Naib Tehsildar will verify the family and report to the Tehsildar. Answer your phone; this is where most files sit.
- Download the digitally signed certificate from your eUNNAT account once the status shows it as issued.
How to apply offline at the Tehsildar's office
- Visit the Tehsildar's office of the tehsil where the deceased ordinarily resided, or the Deputy Commissioner's office, where the Assistant Commissioner (Revenue) handles certificate services.
- Ask for the legal heir certificate application and fill it in, listing every heir.
- Attach self-attested photocopies of the death certificate, residence proof and identity proofs, along with the signed affidavit, and carry originals for verification.
- Submit at the counter, pay any notified charge, and take a printed receipt with the application reference.
- Follow the file with the Patwari of your halqa, who carries out the ground verification, and collect the certificate from the tehsil office or download it from eUNNAT.
A Common Service Centre can also file the eUNNAT application for you for the notified service-centre charge, which is small and printed on a rate card.
How do I check the status of my application?
- Online: log in at eunnat.jk.gov.in and track the application against the reference number on your acknowledgement.
- At the tehsil: ask the Tehsildar's office whether the Patwari's report has been received, which is the usual bottleneck.
- At the district: the Assistant Commissioner (Revenue) in the Deputy Commissioner's office. The Srinagar district administration, for example, publishes the Assistant Commissioner Revenue's office address and contact details for exactly this purpose.
Under the Jammu and Kashmir Public Services Guarantee Act, the 15-day notified timeline is a right, not a target. If it passes without a decision or a recorded reason for refusal, file a first appeal with the designated appellate authority, quoting your eUNNAT reference number.
How long is it valid, and does it need renewal?
A Jammu and Kashmir legal heir certificate records a fact fixed at the date of death. It carries no expiry date and no renewal process.
Some banks, insurers and employers apply their own freshness rule and ask for a copy issued within the last six months to one year. That is the receiving institution's requirement rather than the Revenue Department's; if you are asked, apply again on eUNNAT rather than argue at the counter.
Why do applications get rejected in Jammu and Kashmir?
- An omitted heir discovered during Patwari verification.
- Name or spelling mismatch between the death certificate, ration card and Aadhaar, particularly common where names are transliterated differently across documents.
- Wrong tehsil selected, where the deceased did not ordinarily reside.
- Unregistered death, or no death certificate yet issued.
- Missing or unsigned affidavit from the heirs.
- Illegible uploads.
- A contested heirship, where the Tehsildar declines and refers the matter to the civil court.
What does it cost, and what should you refuse to pay?
Apply directly on eUNNAT and pay only the charge the portal's payment screen displays for the service, or the notified counter charge at the tehsil office. Every payment must come with a receipt. If you use a Common Service Centre, the operator may add the notified service-centre charge on top, which is small and printed.
Agents offering a "legal heir certificate in three days" for thousands of rupees are selling something the Revenue Department does not sell. There is no paid priority queue under the Public Services Guarantee Act. The 15-day timeline is the same for every applicant, and the Patwari's field verification cannot be bought out. Apply yourself on eUNNAT, or use an authorised service centre and take the receipt. Never give your Aadhaar OTP to an agent; no revenue official needs it to issue your certificate.
The genuinely expensive route is the court. A succession certificate carries court fee calculated on the value of the estate plus advocate's fees, and you should only take it on if a bank, depository or registrar has actually asked for one.

Frequently asked questions
What is the legal heir certificate service called in Jammu and Kashmir?
Jammu and Kashmir lists it on eUNNAT as "Application for Issuance of Legal Heir Certificate by Tehsildar", a Revenue Department G2C service. Unlike several states, J&K uses the plain phrase "legal heir certificate" as the official service name.
How long does a J&K legal heir certificate take?
Fifteen days is the timeline notified for the service under the Jammu and Kashmir Public Services Guarantee Act, as published on eUNNAT. That is the period within which the designated officer must decide the application or record reasons for refusal.
Which portal do I apply on?
Apply on eUNNAT at eunnat.jk.gov.in, the Union Territory's single-window e-services portal, where the Revenue Department's certificate services are hosted. The service description page sits on the linked JanSugam service directory at jansugam.jk.gov.in.
Who signs the certificate?
The Tehsildar signs it, which is why the eUNNAT service name says "by Tehsildar". At district level the Assistant Commissioner (Revenue) in the Deputy Commissioner's office oversees these certificate services — in Srinagar, for example, the district administration names the Assistant Commissioner Revenue as the officer concerned.
What is the difference between a legal heir certificate and a succession certificate?
A legal heir certificate is an administrative document from the Tehsildar that names the heirs, while a succession certificate is an order of a civil court under the Indian Succession Act, 1925 authorising the holder to collect the deceased's debts and securities. Pension, provident fund and land mutation run on the Tehsildar's certificate; banks releasing large deposits and companies transferring shares normally require the court order.
Does the certificate expire?
No, a legal heir certificate records who survived a person at a date of death, a fact that does not change, so there is no expiry and no renewal. Individual banks and insurers may still ask for a recently issued copy under their own internal rules.
Can I apply if the deceased lived outside J&K?
No, the Tehsildar's jurisdiction runs to the tehsil where the deceased ordinarily resided. If the deceased lived in another state or Union Territory, apply to that jurisdiction's revenue authority instead.
What happens if the office misses the 15-day timeline?
The Jammu and Kashmir Public Services Guarantee Act gives you a right of appeal to the designated first appellate authority when the notified timeline passes without a decision. eUNNAT records the application against the PSGA clock, so quote your application reference when you appeal.
