Property Registration (Sale Deed) in Maharashtra
Maharashtra state government scheme
Property registration in Maharashtra is done by the Department of Registration and Stamps through igrmaharashtra.gov.in, where a buyer pays stamp duty on the higher of the agreement value or the Annual Statement of Rates, pays the registration fee, books an e-Stepin slot and appears before the Sub-Registrar. Registration is normally completed the same day at the Sub-Registrar office.
What is property registration in Maharashtra?
Property registration in Maharashtra is the process by which the Department of Registration and Stamps, headed by the Inspector General of Registration (IGR), records a sale deed in the public register maintained under the Registration Act, 1908. Until that entry is made, a buyer who has paid the full price and holds the keys is still not the legal owner on record.
Maharashtra runs the whole process through igrmaharashtra.gov.in. The portal carries e-Registration 2.0 and iSarita 2.0, the department's faceless registration module, e-Stepin for booking a Sub-Registrar appointment, e-ASR for property valuation, e-Search for retrieving registered documents, e-Filing for notices, and e-Praman for digitally certified copies. Payment of duty runs through GRAS, the Government Receipt Accounting System.
Registration achieves three things at once. It transfers title in a form courts will accept. It creates the Index-II entry that every bank, housing society and municipal office asks for. And it puts the transaction on the public record, which is what protects you from a second sale of the same property.
Who can and cannot register a sale deed in Maharashtra?
You can register if:
- You are the lawful owner of the property, or a person holding a valid registered power of attorney from the owner, selling to a buyer.
- You are the buyer, of any age above 18, an Indian citizen or an NRI, buying property permitted to you under FEMA.
- The property is within the jurisdiction of the Sub-Registrar office you approach, or within the district for offices with district-wide jurisdiction.
- The full stamp duty on the higher of the agreement value or the Annual Statement of Rates has been paid.
You cannot register if:
- The stamp duty or the registration fee is short-paid. The Sub-Registrar will refuse to admit the document, or will impound it and send it for adjudication.
- The transferor is a minor or a person of unsound mind without a court or guardian's authority.
- The property is agricultural land and the buyer is not permitted to hold it under Maharashtra's tenancy laws. Maharashtra restricts purchase of agricultural land, and a non-agriculturist buyer is a genuine legal bar rather than a paperwork issue.
- The land is tribal land under restricted transfer, or is subject to a court injunction, attachment or a statutory freeze.
- The document is presented beyond four months of execution without paying the penalty for delay allowed under section 25 of the Registration Act.
Foreign nationals who are not of Indian origin cannot buy immovable property in Maharashtra without Reserve Bank of India permission, so a deed in their name will not clear.
What does it cost: stamp duty and registration fee?
Two separate payments are due, and both are made before the appointment.
Stamp duty is charged under Article 25 (conveyance) of the Maharashtra Stamp Act on the higher of the agreement value or the Annual Statement of Rates (the ready reckoner value) for that locality. Reported rates in Maharashtra sit in the 3 to 6 per cent band, because the base conveyance rate is topped up by a metro cess and local body levies in the larger municipal corporation areas such as Mumbai, Pune, Thane, Nagpur and Nashik, and reduced by a concession where the buyer is a woman. Rural and gram panchayat areas fall at the lower end.
Registration fee is a separate charge, calculated on the same value and subject to a monetary ceiling.
Do not take either figure from a broker. Open the stamp duty calculator and e-ASR module on igrmaharashtra.gov.in, enter the district, village, survey number and built-up area, and use the number the department's own system produces. That is the figure the Sub-Registrar will apply, and any shortfall becomes a penalty later.
Two further costs are not the department's: document handling charges per page at the office, and, where consideration is Rs 50 lakh or more, 1 per cent TDS under section 194-IA of the Income Tax Act, deposited in Form 26QB before registration.
How to register a sale deed in Maharashtra online
- Verify the title first. Use e-Search on igrmaharashtra.gov.in to pull the property's registered document history, and take the 7/12 extract for agricultural land or the Property Card for city survey land. Confirm the seller's name appears as owner and that no encumbrance is recorded.
- Value the property on e-ASR. Enter the district, taluka, village and survey or CTS number in the department's valuation module to get the Annual Statement of Rates value. Compare it with the agreed price; duty is on the higher figure.
- Get the deed drafted by an advocate, naming both parties, the exact property description, the consideration, the mode of payment and the possession date. Errors in the schedule of property are the hardest to fix after registration.
- Pay stamp duty through GRAS. Open the Government Receipt Accounting System from the IGR portal, select the Department of Registration and Stamps, enter the Sub-Registrar office and the amount, and pay by net banking or at an authorised bank. Print the e-challan, or obtain an e-SBTR from a designated bank branch.
- Pay the registration fee through a second GRAS challan and print it.
- Deposit TDS in Form 26QB if the consideration is Rs 50 lakh or more, and keep the challan with the file.
- Book an e-Stepin appointment on igrmaharashtra.gov.in for the Sub-Registrar office having jurisdiction over the property, choosing a date and time slot.
- Attend with everyone. All buyers, all sellers and two witnesses must appear on the slot date with Aadhaar, PAN and the original deed. The clerk captures photographs and thumb impressions of every party.
- Execute and admit the document before the Sub-Registrar, who verifies the duty, checks identity, records admission of execution and endorses the deed.
- Collect the receipt and the document number, then download the scanned registered deed and the Index-II from the portal once it is uploaded.
How to register through a Sub-Registrar office without doing it yourself online
- Visit the Sub-Registrar office for the taluka or ward in which the property lies, and confirm jurisdiction at the enquiry counter before paying anything.
- Have the deed drafted and franked, or pay duty at an authorised bank branch against an e-SBTR, if you are not paying through GRAS yourself.
- Present the document in person with all parties and two witnesses during working hours, take a token, and complete the photo and biometric capture.
- Pay the document handling charge at the counter and insist on the printed receipt.
- Collect the endorsed document the same day where the office is current, or on the date written on your receipt.
The offline route feeds into the same iSarita system. The counter operator is entering your file into the department's software either way.
How do I check the status of a registered document?
- e-Search on igrmaharashtra.gov.in retrieves registered documents by year, district, village and party name, and shows whether your deed has been indexed.
- e-Praman issues a digitally certified copy of the registered document.
- Index-II is available for download once the deed is scanned; it is the document your bank and society will actually ask for.
- The Sub-Registrar office can trace a document by the receipt number if the online copy has not appeared.
Is a registered sale deed valid forever?
Yes. A registered sale deed does not expire and needs no renewal. It is a one-time transfer of title, and the register entry is permanent.
Two follow-on steps do remain, and they are the ones buyers most often skip. Mutation, getting your name entered in the revenue record, the 7/12 extract or the Property Card, through the Talathi or the city survey office — is a separate application after registration. And for a flat, the society transfer of the share certificate is a third, separate step. Registration alone does not change the revenue record or the society's books.
Why do property registrations get rejected or impounded in Maharashtra?
- Under-valuation. The agreement value is below the Annual Statement of Rates and the duty has been paid on the lower figure. The Sub-Registrar refers the document for valuation, and the shortfall attracts a penalty.
- Short-paid stamp duty, including duty paid to the wrong office code in GRAS.
- A missing party or witness. Registration cannot be completed if one co-owner does not appear and has not given a registered power of attorney.
- An unregistered power of attorney produced in place of the owner.
- Name mismatch between the deed, PAN and Aadhaar.
- Restricted land: agricultural land sold to a non-agriculturist, or tribal land transferred without permission.
- Presentation after four months of execution without the delay penalty.
- A defective property schedule, with survey numbers or boundaries that do not match the Property Card or 7/12 extract.
What does it cost, and what should you refuse to pay?
The only legitimate payments are the government's own: the stamp duty challan, the registration fee challan and the printed document handling charge. All three are paid on GRAS or at the counter, and all three generate a receipt.
Maharashtra's stamp duty figure is produced by the department's own e-ASR system. No agent can lower it, and anyone who claims to can only do so by under-declaring the value, which is the buyer's liability, not the agent's, when the document is impounded. There is no paid priority queue at a Sub-Registrar office; e-Stepin slots are free. Never hand over your Aadhaar OTP to a middleman, and never sign a deed with a blank consideration figure.
Grievance and helpline route
- IGR Maharashtra helpline: 8888007777, 7 AM to 9 PM, all days
- Complaint portal: crm.igrmaharashtra.gov.in for registering and tracking a complaint against an office or a delay
- Office level: the Sub-Registrar, for a refusal to register or a valuation objection
- District level: the Joint District Registrar, who hears appeals against a Sub-Registrar's refusal under section 72 of the Registration Act
- State level: the Inspector General of Registration, Pune, for systemic complaints and stamp duty refunds
Carry your GRAS challan number and the receipt number to any of these. Without them, no office can trace the transaction.

Frequently asked questions
Which department registers property in Maharashtra?
The Department of Registration and Stamps, headed by the Inspector General of Registration (IGR), registers property in Maharashtra through its Sub-Registrar offices and the portal igrmaharashtra.gov.in. The department operates e-Registration 2.0, iSarita 2.0, e-Stepin slot booking, e-ASR valuation and e-Search on the same portal.
Is registration of a sale deed compulsory in Maharashtra?
Yes, section 17 of the Registration Act 1908 makes registration compulsory for any transfer of immovable property worth more than Rs 100, which covers every real sale. An unregistered sale deed cannot be used as evidence of title, so an unregistered "purchase" gives you possession but not ownership.
How is stamp duty calculated in Maharashtra?
Stamp duty is charged on whichever is higher of the agreement value or the Annual Statement of Rates (the ready reckoner value) for that locality. The department's own e-ASR and stamp duty calculator on igrmaharashtra.gov.in generates the figure; never rely on an agent's verbal estimate.
How do I pay stamp duty online in Maharashtra?
Pay through GRAS, the Government Receipt Accounting System linked from igrmaharashtra.gov.in, using net banking, card or an authorised bank branch, and print the e-challan. The e-SBTR (electronic Secured Bank and Treasury Receipt) issued by a designated bank is the other accepted route.
Do I have to visit the Sub-Registrar office in person?
Yes for a normal resale deed — the buyer, the seller and two witnesses must appear before the Sub-Registrar for photographs and biometric capture. e-Registration 2.0 on the IGR portal removes that visit only for specified categories such as first-sale documents from a developer and certain leave-and-licence agreements.
What is Index-II and why does it matter?
Index-II is the Sub-Registrar's official summary of your registered document, listing the parties, the property, the consideration and the duty paid. Banks, societies and the Property Card office ask for Index-II rather than the full deed, and you can download it through e-Search on the IGR portal.
How long does registration take in Maharashtra?
Registration itself is normally completed the same day once you appear at the Sub-Registrar office with a booked e-Stepin slot and paid challans; the scanned deed is usually available for download within a few working days. Delays almost always come from unpaid duty, a valuation dispute or a missing party, not from the counter.
What should I refuse to pay an agent?
Refuse anything beyond the stamp duty challan, the registration fee challan and the document handling charge printed on the receipt. There is no legal "speed money", no paid priority slot, and no agent can reduce your stamp duty — the e-ASR value is generated by the department's own system.
