Who is eligible for the freedom fighters' pension?

Swatantrata Sainik Samman Pension Scheme recognises three broad categories of freedom fighters, each with its own proof of suffering.

You can apply if you fall into one of these categories:

  • Ex-Andaman political prisoners, freedom fighters who were imprisoned in the Cellular Jail at Port Blair, Andaman. This category draws the highest slab of Rs 30,000 per month.
  • Freedom fighters imprisoned or who went underground. Those who suffered a minimum period of imprisonment, detention or an underground existence in mainland India, or who suffered loss of property, caning, or dismissal from government service for participation in the freedom struggle. This category draws Rs 28,000 per month.
  • INA and other categories: members of the Indian National Army and other recognised categories who suffered as defined in the scheme, drawing Rs 26,000 per month.
  • Eligible dependents: after the death of a freedom fighter, the widow or widower, and thereafter unmarried and unemployed daughters and dependent parents, in the order of succession set out in the scheme.

You cannot apply if:

  • You cannot furnish acceptable proof of imprisonment, detention, underground existence or other qualifying suffering during the freedom struggle.
  • You are a dependent outside the recognised order of succession, married or employed daughters and other relatives are generally not eligible while a nearer eligible dependent survives.
  • The freedom fighter was already availing a similar freedom fighter pension from another source that bars a second grant.

Applicants who cannot produce primary jail or detention records are not automatically rejected: the scheme allows a prescribed secondary-evidence route, described below.

Where official imprisonment records are not available, the Ministry of Home Affairs accepts a Non-Availability of Records Certificate (NARC) from the concerned State Government, supported by certificates from two co-prisoners who are themselves drawing the samman pension and who were imprisoned with the applicant.

How is the pension passed on to dependents?

Swatantrata Sainik Samman Pension Scheme continues after the freedom fighter's death in a defined order of succession. The widow or widower receives the same pension the freedom fighter drew, for life, and this is treated as the first claim. Only after the spouse has also died do the next categories become eligible: unmarried and unemployed daughters, and then dependent parents. The scheme caps eligible daughters and sets conditions. A daughter must be both unmarried and unemployed to draw and continue drawing the pension, and the entitlement stops on her marriage or on her taking up employment.

Dependents do not inherit the pension automatically. A fresh claim has to be filed after the freedom fighter or the preceding beneficiary dies, with the death certificate and proof of relationship, routed through the same State Government verification channel as the original application. Any gap or error in this succession paperwork is a common reason family pension is delayed, so dependents should apply promptly and keep the freedom fighter's original sanction order safe, since it is the anchor document for every later claim.

Why samman pension claims get delayed or rejected

  • Insufficient proof of suffering. The most common reason. Claims without acceptable primary records or the prescribed secondary evidence are held for verification.
  • Co-prisoner certificates from persons not drawing the pension. The two co-prisoner certificates must come from freedom fighters who themselves receive the samman pension.
  • Gaps in the order of succession. A dependent claim from someone not next in the recognised order is not entertained while a nearer eligible dependent survives.
  • Incomplete State verification; applications forwarded without full State Government verification are returned for completion.
