Property Registration (Sale Deed) in West Bengal

West Bengal state government scheme

Quick answer

Property registration in West Bengal is handled by the Directorate of Registration and Stamp Revenue through the e-Deed workflow on wbregistration.gov.in. A buyer files an e-Requisition, gets an e-Assessment of stamp duty and the 1 per cent registration fee, pays online through GRIPS, books an e-Appointment, and signs the sale deed before the Additional District Sub-Registrar, usually on the appointment day itself.

Benefit
A sale deed registered under the Registration Act 1908 that gives you legally recognised title to the property and a permanent entry in the West Bengal registration records
How to apply
Both — the e-Deed workflow online at wbregistration.gov.in, with final execution in person at the ADSR or DSR office

What is property registration in West Bengal?

Property registration in West Bengal is the act of presenting a sale deed before the Additional District Sub-Registrar (ADSR) or District Sub-Registrar (DSR) of the area, paying the stamp duty and registration fee, and having the deed recorded permanently in the state's registration records. The department that runs it is the Directorate of Registration and Stamp Revenue, under the Finance Department, and its portal is wbregistration.gov.in.

Registration of a sale of immovable property is compulsory under Section 17 of the Registration Act, 1908. Until the deed is registered, the buyer does not get legal title, however much money has changed hands. That single fact is why the West Bengal registration counter matters more than any other step in a property purchase.

West Bengal runs the process as an e-Deed workflow. The deed is drafted and uploaded, the market value is assessed online, stamp duty and registration fee are paid electronically, an appointment is booked, and only the final execution happens face to face. Kolkata city properties are registered at the Registrar of Assurances, Kolkata; everywhere else the ADSR or DSR office with territorial jurisdiction over the land handles it.

Who can and cannot register a sale deed in West Bengal?

You can register if:

  • You are the buyer and the seller of an immovable property situated in West Bengal; land, a flat, a house, a shop or agricultural land.
  • Both parties are competent to contract: adults of sound mind. A minor's property is transacted through a legal guardian, with court permission where the law requires it.
  • The seller actually holds the title and can show the parent deed and, for land, the Record of Rights in their own name.
  • A registered power-of-attorney holder appears where a party cannot attend in person. The power of attorney itself must be registered, not merely notarised.
  • The buyer and seller are companies, trusts, societies or firms, appearing through an authorised signatory with a board resolution or authorisation letter.

You cannot register if:

  • The stamp duty and registration fee are unpaid or short-paid. The registering officer will not accept a deed that does not match the e-Assessment.
  • The seller cannot establish title, or the Record of Rights and mutation stand in someone else's name.
  • The property is under a court injunction, attachment, or a statutory prohibition on transfer, including agricultural land ceilings under the West Bengal Land Reforms Act.
  • Either party fails to appear and has not executed a registered power of attorney.
  • The deed is presented to the wrong office. Jurisdiction follows the property, and a deed presented outside jurisdiction is refused.

What documents are required?

Document Mandatory Notes
Draft sale deed Yes Uploaded with the e-Requisition
PAN of buyer and seller Yes Form 60 where PAN is absent
Aadhaar of both parties and witnesses Yes Used for identification and biometrics
Photographs of both parties Yes Affixed and captured again at the counter
Parent deed / chain of title Yes Proves the seller's title
Record of Rights (Porcha), mutation, khajna receipt Yes for land From the Banglarbhumi record
Municipal tax receipt For built property Current year
e-Assessment slip Yes States the exact duty and fee
GRIPS challan Yes Proof of payment to the state
Two witnesses with ID Yes Must attend in person

Keep the query number and query year from the e-Requisition safe. Every subsequent step in West Bengal; assessment, payment, appointment, tracking, runs on that pair of numbers.

What does it cost?

Two separate government charges apply to a sale deed in West Bengal:

  • Stamp duty, charged on the higher of the stated consideration and the government market value of the property. West Bengal applies a lower rate to rural properties than to Kolkata, Howrah and other municipal and corporation areas, and a higher slab once the property value crosses ₹1 crore.
  • Registration fee, which is 1 per cent of the market value for a conveyance across the state.

Do not work from a rate you read on a broker's website. The stamp duty and registration fee calculator on wbregistration.gov.in is the only figure that matters, because it applies the current rate, the correct locality classification and the department's own market valuation. The e-Assessment step then converts that estimate into the binding demand for your specific deed.

Both amounts go to the Government of West Bengal through GRIPS, the Government Receipt Portal System. Nothing is payable in cash at the counter.

How to apply for property registration in West Bengal

  1. Get the deed drafted. Engage a licensed deed writer or an advocate to prepare the sale deed with the full schedule of property, the consideration, the mode of payment and the parties' particulars. Errors in the schedule are the hardest thing to correct after registration.
  2. Search the records first. Use the query search / deed search facility on wbregistration.gov.in to check what is already registered against the property, and check the Record of Rights on Banglarbhumi. Do this before paying any advance.
  3. File the e-Requisition on the portal. Enter the deed type, the parties, the property description and the consideration. The system issues a query number and query year; write both down.
  4. Complete the e-Assessment. The portal assesses the market value of the property from its own valuation database and computes the exact stamp duty and the 1 per cent registration fee payable. Print the assessment slip.
  5. Pay online through GRIPS. Pay the assessed stamp duty and registration fee by net banking or the other modes GRIPS offers, and save the challan and the Government Reference Number.
  6. Book the e-Appointment for the ADSR, DSR or Registrar of Assurances office having jurisdiction over the property, using the same query number.
  7. Attend on the appointment date with the printed deed on stamp paper or with the e-stamp, the payment challan, original identity documents, the parent deed, and two witnesses. Both buyer and seller must be present.
  8. Execute and present the deed. Sign before the registering officer, give thumb impressions and photographs, and let the office capture the biometrics of both parties and the witnesses.
  9. Collect the registered deed after the office endorses and scans it. Keep the deed number, book number, volume and page, they are how the deed is traced for the rest of its life.

Is there an offline route?

Yes, but it is a narrower one than it used to be. A citizen who cannot use the portal can have a licensed deed writer or an advocate at the ADSR office complete the e-Requisition, e-Assessment and GRIPS payment on their behalf, then attend the office on the appointment day. Many district registration offices also have facilitation counters and nearby Bangla Sahayata Kendra (BSK) centres that help citizens with online government forms.

What cannot be done offline is the payment. Stamp duty and registration fee in West Bengal are paid electronically into the government account, and a receipt that is not a GRIPS challan is not a government receipt.

How do I check the status of my registration?

  • On the portal: use the query number and query year on wbregistration.gov.in to see the status of the e-Requisition, the assessment and the appointment.
  • Payment status: verify the GRIPS challan through the payment status facility using the Government Reference Number.
  • After registration: use the deed search / certified copy service with the deed number and year to confirm the deed is on record and to order a certified copy.
  • At the office: the ADSR or DSR office can trace the file by query number.

What do I do after the deed is registered?

Registration transfers title, but it does not update the land or municipal records by itself. After registration you should:

  1. Apply for mutation — through the Land and Land Reforms department for land parcels, and through the municipality or corporation for a flat or house, so that the record of rights and the tax record show your name.
  2. Pay khajna / land revenue in your own name for the next cycle.
  3. Get a certified copy of the registered deed from the registration office and keep it separately from the original.
  4. Update the electricity and water connection to your name.

Skipping mutation is the single most common mistake. A registered deed with an unmutated record causes trouble at exactly the wrong moment, when you next sell, or when you apply for a loan.

Why do property registrations get refused or delayed in West Bengal?

  • Under-valuation. The consideration in the deed is below the government market value, so the e-Assessment demands more duty than the parties expected.
  • Wrong jurisdiction. The deed is presented at an office that does not cover the property.
  • Name and PAN mismatch between the deed, Aadhaar and PAN of a party.
  • Defective schedule of property, boundaries, plot number, mouza, khatian or flat number that do not match the parent deed or the Record of Rights.
  • Seller's title not established, or an existing mortgage or encumbrance not disclosed.
  • Witnesses absent on the appointment day, or witnesses without photo ID.
  • Short payment of stamp duty, which makes the instrument liable to impounding.

What should you refuse to pay?

The only compulsory government charges are the stamp duty and the 1 per cent registration fee assessed on wbregistration.gov.in and paid through GRIPS. Both appear on the assessment slip and both leave an electronic receipt in your name.

A deed writer or advocate legitimately charges a professional fee for drafting the deed. That is a private service. What nobody can lawfully charge you for is "getting an earlier appointment", "getting the valuation reduced" or "clearing the file at the counter". There is no paid priority queue at an ADSR office. Insist on paying stamp duty through GRIPS in your own name, keep the challan, and never hand your Aadhaar OTP to an intermediary.

Grievance and helpline route

  • Portal: wbregistration.gov.in, for e-Requisition, e-Assessment, e-Payment, e-Appointment, deed search and certified copies.
  • Local office: the Additional District Sub-Registrar or District Sub-Registrar where the deed was presented, quoting the query number.
  • District level: the District Registrar, who supervises the sub-registrar offices in the district.
  • State level: the Directorate of Registration and Stamp Revenue, Finance Department, Government of West Bengal, which is the appellate and supervisory authority on valuation and refusal to register.
  • Valuation disputes: a party dissatisfied with the market value assessed can seek review before the designated valuation authority under the West Bengal Stamp Rules: ask the ADSR office for the current appeal route in writing.

Carry your query number and year to any of these offices. Without it, no registration office in West Bengal can find your file.

Documents required

Draft sale deed / conveyance deed
Prepared by a licensed deed writer or advocate and uploaded as part of the e-Requisition. The draft must carry the full schedule of property, the consideration and the names of both parties exactly as in their ID proofs.
PAN card of buyer and seller
PAN is compulsory for both parties in a conveyance. Where a party has no PAN, Form 60 is filed instead.
Aadhaar of buyer, seller and witnesses
Used for identification at the Sub-Registrar office and for biometric capture during presentation of the deed.
Passport-size photographs of both parties
Affixed on the deed and captured again at the registration counter.
Parent deed / chain of title documents
The seller's own purchase deed, and earlier deeds where the office asks for the chain. This proves the seller has the title being transferred.
Record of Rights (Porcha) and mutation record
The Banglarbhumi record of rights in the seller's name, plus the mutation and khajna (land revenue) receipt for the current year for land parcels.
Latest property tax / municipal receiptoptional
For flats and buildings in a municipality or corporation area, the current tax receipt is normally asked for at the counter.
e-Assessment slip
Generated from the West Bengal e-Deed system after the market value is assessed. It states the exact stamp duty and registration fee payable.
GRIPS payment challan
The Government Receipt Portal System challan proving stamp duty and registration fee have been paid to the West Bengal government.
Encumbrance certificate / query search resultoptional
Not demanded by the registering officer, but a buyer should search the records on wbregistration.gov.in before paying anything.
Two witnesses with photo ID
Two witnesses must attend the Sub-Registrar office in person on the appointment day with their own identity proof.

Frequently asked questions

Which office registers a sale deed in West Bengal?

The Additional District Sub-Registrar (ADSR) or District Sub-Registrar (DSR) office in whose jurisdiction the property lies registers the sale deed, under the Directorate of Registration and Stamp Revenue. Kolkata properties are registered at the Registrar of Assurances, Kolkata. The office is decided by where the land is, never by where you live.

What is the registration fee for property in West Bengal?

The registration fee for a conveyance in West Bengal is 1 per cent of the market value of the property, charged separately from stamp duty. The exact rupee figure for your deed is generated by the e-Assessment step on wbregistration.gov.in, and that assessed figure is what you pay through GRIPS.

How is stamp duty calculated in West Bengal?

Stamp duty in West Bengal is charged on the higher of the sale consideration and the government market value, with a lower rate for rural properties than for Kolkata, Howrah and other municipal or corporation areas, and a higher slab once the value crosses ₹1 crore. Run your figures through the stamp duty and registration fee calculator on wbregistration.gov.in before signing anything.

Can I register property fully online in West Bengal?

No, the deed drafting, assessment, payment and appointment are online, but the execution and presentation of the sale deed still happen in person at the ADSR or DSR office. Both the buyer and the seller, or their registered power-of-attorney holders, must appear with two witnesses for biometric capture and signature.

What is e-Requisition on the West Bengal registration portal?

e-Requisition is the online form on wbregistration.gov.in where the deed details, party details and property details are entered before registration. It generates a query number and a query year, which become the reference for the e-Assessment, the GRIPS payment and the e-Appointment.

How long does registration take in West Bengal?

The signing and presentation at the ADSR office is normally finished on the appointment day itself, and the endorsed deed is returned after the office completes scanning and recording. The realistic delay is in the steps before that — drafting, assessment and getting an appointment slot — not in the registration counter.

What happens if I do not register the sale deed?

An unregistered sale deed does not transfer title to immovable property worth more than ₹100 and cannot be used as evidence of the transfer, because compulsory registration under Section 17 of the Registration Act 1908 applies. You also cannot mutate the property in Banglarbhumi records or get a home loan against it.

Do I have to pay an agent to register my property in West Bengal?

No, the only compulsory payments are the stamp duty and the 1 per cent registration fee assessed on the portal and paid through GRIPS to the government. A deed writer or advocate charges a professional fee for drafting, which is a separate private charge; nobody can lawfully charge you for "getting the appointment faster".
