Property Mutation (Transfer of Ownership) in Chandigarh

Chandigarh state government scheme

Quick answer

Property mutation in Chandigarh runs on two separate tracks. Sector property allotted under the Capital of Punjab (Development and Regulation) Act, 1952 is mutated by the Estate Office at estateoffice.chd.gov.in, where change of ownership on a sale, gift or transfer deed is a notified 30-working-day service. Village land is mutated by the Patwari and Tehsildar under the Revenue Department.

What is property mutation in Chandigarh?

Property mutation in Chandigarh means getting the ownership record changed into the name of the person who has bought, inherited or been gifted the property. Registration of a sale deed at the Sub-Registrar's office does not do this by itself. Registration proves a transaction happened; mutation is what makes the Administration's own record say that you, and not the previous owner, own the house, flat, booth, shop or plot.

Chandigarh handles this differently from an ordinary Indian district, and this is the single fact most people get wrong. In a normal district, all property mutation goes through the Patwari and the Tehsildar. In Chandigarh, most of the city's built property sits on land the Administration itself allotted or leased under the Capital of Punjab (Development and Regulation) Act, 1952. For those properties the ownership record is kept by the Estate Office, not by the revenue staff, and the mutation application goes to the Estate Office at Town Hall Building, Sector 17C.

Village and agricultural land inside the Union Territory is the other track. There the record of rights is still maintained by the Patwari, checked by the Kanungo, and mutations are attested by the Tehsildar acting as Assistant Collector Grade-II under the revenue law extended to Chandigarh.

Who can and who cannot apply for mutation in Chandigarh?

You can apply if you are:

  • The buyer named in a registered sale deed of a Chandigarh property.
  • The donee in a registered gift deed or family transfer deed.
  • A party to a registered exchange deed.
  • A legal heir of a deceased recorded owner, applying on the basis of a death certificate with a will, a succession certificate or a court decree.
  • A person in whose favour a court decree or an arbitration award has transferred a Chandigarh property.

You cannot apply; or your file will not move, if:

  • The transfer document is not registered. An agreement to sell, a general power of attorney or a receipt is not a title document and will not support mutation.
  • Dues are outstanding on the property. Ground rent, lease money and penalties must be cleared; the Estate Office issues a No Dues Certificate as a separate 15-working-day service.
  • The property is under litigation or attachment, or the claim is contested by another heir. The notified time limits published by the Estate Office apply expressly to uncontested cases.
  • Building violations or misuse proceedings are pending against the property and the resumption or penalty question is unresolved.

How to apply for property mutation in Chandigarh (Estate Office route)

Follow these steps for a property in the planned sectors:

  1. Get the deed registered first. Execute and register the sale, gift, family transfer or exchange deed. The Estate Office's own Standard Operating Procedure is written specifically around these four deed types.
  2. Clear the dues and get a No Dues Certificate. Use "Know Your Dues" and "Pay Your Dues" on estateoffice.chd.gov.in to check the account statement for the property and settle ground rent or lease money. Issue of the No Dues Certificate is notified at 15 working days.
  3. Log in to the Property Management System. Open estateoffice.chd.gov.in and use the Citizen Services login to register and start an application for change of ownership.
  4. Fill the mutation application and upload the documents. Attach the registered deed, the allotment letter or conveyance/lease deed, the No Dues Certificate and the transferee's identity proof. For a death case, attach the death certificate together with the will, succession certificate or decree.
  5. Pay the fee shown on the portal and save the acknowledgement number. Pay only what the portal or counter demands against a receipt.
  6. Track the file and respond to objections. The Assistant Estate Officer is the designated officer. Where a public notice is required; typically in death, will and decree cases, the file waits for the notice period to run before the final order.
  7. Collect the mutation order and check that the name, property number and sector are correct before you use it anywhere else.

How to get mutation done for village land in Chandigarh

For agricultural or village land inside the UT, the file runs through the revenue staff instead:

  1. Register the sale, gift or exchange deed, or assemble the inheritance papers.
  2. Report the transfer to the Patwari of the halqa, with a copy of the registered deed and the khasra or khata details from the jamabandi.
  3. The Patwari enters the mutation in the register and the Kanungo checks it. Chandigarh's Right to Service list also notifies certified copies of manual revenue documents by the Patwari at 3 days for under 5 pages, 5 days for 6–14 pages, 7 days for 15–30 pages and 15 days beyond that.
  4. The Tehsildar (Revenue), acting as Assistant Collector Grade-II, attests the mutation after hearing the parties. Verifications carried out by revenue officials, Patwari, Kanungo or Tehsildar — are notified at 30 working days.
  5. If the land also has to be divided, note that private partition by mutual consent is notified at 90 days, and the Chandigarh list records that it is finalised "at the time of attestation of mutation".

What are the notified time limits in Chandigarh?

The Estate Office publishes its Right to Service commitments openly, and they are the most concrete numbers available for Chandigarh property transfer:

  • Change of ownership on sale / gift / transfer deed (uncontested): 30 working days, Assistant Estate Officer.
  • Transfer on death / will / court decree (uncontested): 40 working days where a public notice is issued, and 20 working days after the public notice.
  • NOC for sale, gift or transfer: 50 working days.
  • Conversion from leasehold to freehold: 35 working days.
  • Execution of lease deed or conveyance deed: 30 working days.
  • No Dues Certificate: 15 working days.

Every one of these limits, as the Estate Office states, runs "from the date of submission of application alongwith the entire requisite documents/papers correct & complete in all respects". An incomplete file does not start the clock, which is why document preparation, not the officer's speed, is usually what decides how long your mutation takes.

How do I check my mutation status in Chandigarh?

Log in to the Citizen Services section of estateoffice.chd.gov.in with your application details. The same portal carries Know Your Property to search property details and Know Your Dues for the account statement, so you can confirm independently whether the record now shows your name. For village land, the status is checked with the Patwari and the Tehsildar's mutation register at the Tehsil office of the Deputy Commissioner's establishment; the district site chandigarhdistrict.nic.in and the e-District portal at chdservices.gov.in carry the Administration's other citizen services.

Why do mutation applications get rejected in Chandigarh?

  • Unregistered transfer documents, an agreement to sell or a power of attorney presented in place of a registered deed.
  • Outstanding ground rent, lease money or penalty on the property.
  • Name mismatch between the allotment letter, the registered deed and the applicant's identity documents.
  • Competing heirs in a death case, which takes the file out of the "uncontested" category the notified time limits apply to.
  • Unresolved tenure, a leasehold property whose conversion or lease deed execution was never completed.
  • Pending building violation or misuse proceedings against the property.

What does mutation cost, and how do I complain?

Pay only the amount the Estate Office portal or the Tehsil counter demands, and insist on a printed receipt or the portal's own payment confirmation. The Chandigarh Administration does not publish one flat mutation fee covering every property category, so the correct figure is the one the official system generates for your property, not a number quoted by a middleman. Agents, "property consultants" and touts outside the Town Hall building have no role in the process and no ability to speed it up; every step above can be done by the owner directly.

If the file stalls, the Estate Office runs an online grievance facility with Lodge Grievance and Track Grievance options on estateoffice.chd.gov.in. Under the Right to Service framework, the first appeal against the Assistant Estate Officer lies to the Estate Officer and the second appeal to the Secretary Estate. For village land, the first appeal against the Tehsildar or Assistant Collector Grade-II lies to the Assistant Collector 1st Grade / SDM, and the second appeal to the Collector.

The Estate Office is at Town Hall Building, Sector 17C, Chandigarh 160017, landline 0172-5046634.

Documents required

Registered sale deed, gift deed, family transfer deed or exchange deed
The Estate Office publishes a dedicated "SOP for Auto Mutation Application on the basis of Sale/Gift/Family Transfer Deed/Exchange Deed", so the registered deed is the document the whole application is built around.
Allotment letter or conveyance/lease deed of the property
Establishes the chain of title back to the original allotment made by the Estate Office under the Capital of Punjab (Development and Regulation) Act, 1952.
No Dues Certificate from the Estate Office
Ground rent, lease money and any penalty must be cleared before ownership moves. Issue of a No Dues Certificate is itself a notified 15-working-day service.
Identity and address proof of the transferee
Aadhaar, PAN, voter ID or passport, matching the name on the deed.
Death certificate of the recorded owneroptional
Required only where the transfer follows a death. Chandigarh treats transfer on death, will or court decree as a separate notified service.
Will, succession certificate or court decreeoptional
For an inheritance transfer. Where the claim rests on a will or a decree, the Estate Office route includes a public notice stage.
Affidavit and indemnity bond by the heirsoptional
Standard in death cases where several legal heirs exist and some are relinquishing their share in favour of one.
Copy of the jamabandi and khasra numberoptional
For agricultural or village land inside the Union Territory, where the record is kept by the Patwari and not by the Estate Office.

Frequently asked questions

Who mutates property in Chandigarh?

The Estate Office of the Chandigarh Administration mutates property in the planned sectors, and the Revenue Department under the Deputy Commissioner mutates village and agricultural land. Chandigarh is unusual this way — most of the city's houses, flats, booths and shops were allotted by the Estate Office under the Capital of Punjab (Development and Regulation) Act, 1952, so ownership change is an Estate Office matter, not a Tehsildar matter.

How long does mutation take in Chandigarh?

Change of ownership on the basis of a sale, gift or transfer deed in an uncontested case is a notified 30-working-day service at the Estate Office. Transfer on the basis of death, will or court decree is notified at 40 working days where a public notice must be issued, and 20 working days after the public notice period ends.

Can I apply for mutation online in Chandigarh?

Yes, the Estate Office runs a Property Management System with a Citizen Services login at estateoffice.chd.gov.in where applications are filed and dues paid online. The Administration has also published a Standard Operating Procedure for "Auto Mutation" on sale, gift, family transfer and exchange deeds.

What does mutation cost in Chandigarh?

Pay only the amount the Estate Office or the Tehsil counter demands against a printed receipt — the Administration does not publish a single flat mutation fee for every property type, because the charge depends on the property category and any dues outstanding. Do not pay an agent a "processing" or "speed" charge; nothing beyond the official receipt is legitimate.

Do I need a No Objection Certificate before selling in Chandigarh?

An NOC for sale, gift or transfer is a separate notified Estate Office service with a 50-working-day time limit, and it is the longest step in the chain. Plan the sale around it, because the buyer's mutation cannot be completed while the seller's NOC and dues position are unresolved.

What happens if the property is still leasehold?

Conversion from leasehold to freehold is a separate Estate Office service notified at 35 working days, and execution of the lease deed or conveyance deed is notified at 30 working days. Many Chandigarh mutation files stall because the underlying tenure question was never settled.

Where do I appeal if the Estate Office does not act?

The first appeal against the Assistant Estate Officer lies with the Estate Officer, and the second appeal with the Secretary Estate. Both appeals are part of the Right to Service framework published on estateoffice.chd.gov.in, and the clock only starts once your application is complete in all respects.

Is mutation the same as registration of the sale deed?

No — registration and mutation are two different steps, and buying a property in Chandigarh is not finished at registration. Registration records the transaction; mutation changes the owner's name in the Estate Office record or the village revenue record, which is what the electricity board, the municipal corporation and any future buyer will check.
