What is the Stamp Duty Reimbursement Scheme for Goa start-ups?

Stamp Duty Reimbursement Scheme is a financial incentive notified under the Goa Start-up Policy 2017, administered by the Start-up Promotion Cell of the Department of Information Technology, Electronics and Communications, Government of Goa. It reduces the stamp duty payable by a Goa start-up, incubator or accelerator on a property transaction to a token Rs 100 and reimburses whatever was paid above that.

The clause in the policy reads: "In case of land / developed area purchased / leased by start-ups / incubators / accelerators, the stamp duty for land / built up area lease / sale transaction for start-ups will not exceed Rs. 100/-, and the excess amount paid to the authorities concerned will be reimbursed. This incentive is available only once in the life time of a Start-up. Funds for the same would be provisioned from the One-time Grant Fund."

Two design points follow. First, the mechanism is reimbursement, not exemption. The start-up pays the duty to the Registrar in the normal way and then claims the excess back. Second, it is a once-in-a-lifetime benefit, which in practice means a start-up should use it on its main premises rather than on a first small office.

Is the scheme still in force?

This is the question that matters most before anyone plans a transaction around it, and the honest answer requires care.

The incentive appears in the Goa Start-up Policy 2017. It does not appear in the scheme lists of the Goa Start-up Policy 2021 (amended) or the Goa Start-up Policy 2025. The Department of IT's schemes and policies page lists twelve schemes under the current start-up policy, IPR Reimbursement, R&D Reimbursement, Skill Enhancement, Trademark Reimbursement, Leased or Privately Owned Premises, Incubation Centres Grant, Seed Capital, Salary Reimbursement, Co-Working Space and Incubators Subsidy, Campus Innovation, Promotion and Marketing Assistance, and Women Entrepreneur Vitality, and a stamp duty incentive is not among them.

Separately, the Goa Information Technology Policy 2018 carries its own Registration & Stamp Duty Subsidy Scheme for IT units, under which registration and stamp duty charges will not exceed Rs 100. That is a different scheme, aimed at IT units rather than at certified start-ups.

Anyone relying on stamp duty relief should therefore confirm the operative notification with the Start-up Promotion Cell on 1800-233-5060 before signing a lease or sale deed.

Who can and cannot claim this incentive?

You can claim if:

  • Your entity is a start-up as defined in the Goa Start-up Policy 2017 β€” up to seven years from the date of incorporation or registration in the State of Goa; annual turnover not exceeding Rs 25 crore in any preceding financial year; and working towards pure-play innovation, development or improvement of products or services powered by engineering or internet-based software or technology.
  • Or your entity is an incubator or accelerator purchasing or leasing land or developed area in Goa.
  • You are certified by, and applying through, the Start-up Promotion Cell, the Goa government appointed governing body that runs the single window.
  • You have actually paid stamp duty above Rs 100 on a land or built-up area lease or sale transaction, and can produce the deed and the payment proof.
  • You have not previously used this incentive. It is available once in the lifetime of a start-up.

You are not eligible if:

  • Your entity is engaged in retailing, wholesaling or distributing software, hardware or IT peripherals. The policy expressly says such entities "will not be considered as a start-up for availing the incentives under this policy".
  • Your entity is more than seven years past incorporation or registration in Goa, or its turnover has exceeded Rs 25 crore in a preceding financial year.
  • It was incorporated or registered outside Goa. The definition requires incorporation or registration in the State.
  • Your business provides no distinct value addition through commercialisation of an innovative idea. The policy groups qualifying start-ups into product, service and hybrid categories built on IT, ITES or ESDM.
  • You are an individual seeking personal stamp duty relief on a house or a plot. This is a start-up incentive, not a citizen benefit, and individuals cannot apply in a personal capacity.

Note the separate definition of a local start-up in the policy, one in which at least 50 per cent equity or shareholding is held by one or more Goans continuously since inception. Some benefits in the policy are reserved for local start-ups; the stamp duty clause is written for start-ups generally.

How to apply for stamp duty reimbursement

  1. Get certified by the Start-up Promotion Cell. Certification as a Goa start-up is the gate to every incentive in the policy. Goa's own count records 149 start-ups certified by the Start-up Promotion Cell and 140-plus certified by Startup India, DPIIT.
  2. Confirm the incentive is currently operative. Ask the Cell in writing whether the 2017 stamp duty clause still applies to your transaction, given that later policies do not list it.
  3. Execute and register the lease or sale deed for the land or built-up area in the normal way, paying the stamp duty assessed by the authorities concerned. Keep the challan or receipt.
  4. File the reimbursement claim on the online single window. The 2017 policy states that through the online single-window "the cell shall receive, process, approve and disburse the following incentives eligible under this policy".
  5. Upload the supporting set, certificate of incorporation or registration in Goa, the registered deed, the stamp duty payment proof, turnover evidence showing you are under Rs 25 crore, and the entity's bank account details.
  6. Await processing by the Cell, which is also the single point of contact in respect of all permissions, grievances and queries under the policy.

How is the amount worked out?

The arithmetic is simple: the start-up bears Rs 100 and the state refunds the rest. On a lease deed where Rs 1,20,000 of stamp duty was assessed and paid, the reimbursement claim is Rs 1,19,900. The policy places no rupee ceiling on the refund, but funds are provisioned from the policy's One-time Grant Fund, so disbursal is subject to that fund's availability.

Because the incentive can be used only once, the size of the transaction matters more than its timing. A start-up that uses the benefit on a small first office cannot use it again when it takes a larger facility.

What commonly goes wrong?

  • Assuming exemption at the Registrar's counter. The duty is paid first and reimbursed later; no sub-registrar will accept Rs 100 on the strength of the policy alone.
  • Applying without Start-up Promotion Cell certification. Incentives run through the Cell's single window, and an uncertified entity has no route in.
  • Being a trading business. Software and hardware resellers and distributors are excluded from the definition of start-up for incentive purposes.
  • Crossing the seven-year or Rs 25 crore line before filing.
  • Using the once-in-a-lifetime benefit early on a small transaction.
  • Relying on a policy clause that later policies do not carry forward. This is the biggest practical risk with this particular scheme.

Where do I raise a query or a grievance?

The Start-up Promotion Cell, IT HUB, 2nd Floor, Altinho, Panaji, Goa 403001, is the single point of contact for all permissions, grievances and queries under the start-up policy. It runs a helpline on 1800-233-5060, Monday to Friday 10:00 AM to 5:30 PM, and the email address spc-dit.goa@gov.in. The parent department is the Department of Information Technology, Electronics and Communications, Government of Goa.

How to check your application status

The Stamp Duty Reimbursement claim runs through the same single-window portal that handles every other incentive under the Goa Start-up Policy, so status tracking follows the Start-up Promotion Cell's standard process rather than a separate stamp-duty helpdesk.

  1. Log in to the single-window portal at startup.goa.gov.in with the credentials issued at the time of start-up certification. Reimbursement and grant claims filed through the Cell typically show a status against each application, such as received, under review, approved or disbursed.
  2. If the portal does not show a clear status for your stamp duty claim, email the Start-up Promotion Cell at spc-dit.goa@gov.in with your start-up's certification number and the date the claim was filed, and ask for a written update.
  3. Call the helpline on 1800-233-5060, Monday to Friday, 10:00 AM to 5:30 PM, and quote your application or certification reference number when asking for an update.
  4. Visit the Cell in person if the claim has been pending for an unusually long time. The office is at IT HUB, 2nd Floor, Altinho, Panaji, Goa 403001, and it is also the designated single point of contact for grievances under the policy.
  5. Keep your own paper trail while waiting. Retain the registered deed, the stamp duty challan, the acknowledgement generated when the claim was submitted online, and any email correspondence with the Cell. Because this incentive can be claimed only once in a start-up's lifetime, these records are also what you would need if a query is raised about the transaction or the claim needs to be resubmitted.

Given that the stamp duty clause itself does not appear in the scheme lists of the later Goa Start-up Policy 2021 or 2025, a status check is also the right moment to reconfirm with the Cell, in writing, that the claim is being processed under the 2017 provision rather than being held up because the incentive is no longer listed as active.
