It is a refund of a real, documented payment, not a grant, so the ceiling is simply the amount on the stamp duty certificate and registration receipt. The reimbursed amount cannot then be counted again as part of eligible Fixed Capital Investment when calculating other incentives under the same scheme.
The scheme is operative for ten years, from 5 October 2022 to 4 October 2032. The detailed operating rules sit in the "Aatmanirbhar Gujarat Scheme for assistance to Mega Industries – Guidelines", approved under letter No. PRCH-102022-1271-I dated 25 July 2023, which states plainly that where the guideline and the Government Resolution differ, the Resolution prevails.
Alongside stamp duty, the same Mega Industries scheme carries other components: reimbursement of net SGST, reimbursement of input SGST paid on capital goods, interest subsidy and EPF reimbursement. A unit registers once and then files separate claims for each component it wants.
Who is eligible for the mega industries stamp duty reimbursement?
A unit qualifies if:
- It is an industrial undertaking in one of the thrust sectors defined in the Aatmanirbhar Gujarat policy document.
- It has invested at least Rs 2,500 crore in plant and machinery.
- It provides direct employment to at least 2,500 persons. The guidelines clarify that this count includes both employees on the unit's own payroll and direct contractual employees engaged through contracting agencies registered with the labour and employment department.
- It has commenced commercial production, evidenced by the first sale bill.
- The land was purchased or leased during the eligible investment period and carries valid non-agriculture permission for industrial use.
- It holds a Provisional and/or Final Eligibility Certificate issued under the scheme.
Who cannot apply:
- Individuals, farmers, salaried persons and households cannot apply. This is a capital-investment incentive for industry, and there is no personal or family benefit inside it.
- Units below the Rs 2,500 crore or 2,500-employee thresholds are not eligible under the Mega component. Smaller projects fall under the separate Aatmanirbhar Gujarat schemes for Large Industries and Thrust Sector, or for MSMEs.
- Stamp duty paid on agricultural land is not eligible. The guideline restricts reimbursement to land duly converted for non-agricultural use for the project.
- Trading and service activities are not covered; the scheme is for manufacturing undertakings.
- A unit that has not obtained registration or an eligibility certificate cannot file a stamp duty claim, however large its investment.

At the registration stage the checklist is longer and includes the company incorporation certificate or partnership deed, IEM Part-A / IL / LOP, GST registration with annexures, GPCB Consent to Establish where applicable, a detailed project report, the bank sanction letter and the first sale bill.
How to apply for the Aatmanirbhar Gujarat stamp duty reimbursement
- Register on the Investor Facilitation Portal. Open ifp.gujarat.gov.in, choose New Investor Registration, complete the registration form, submit it, and verify the email link sent to the address you entered.
- Log in and apply for a Registration Certificate under the Aatmanirbhar Gujarat Scheme for Mega Industries. The application must reach the Industries Commissioner within one year of the date of first disbursement of the term loan, or one year of the date of commencement of commercial production, or one year of the date of the Government Resolution (5 October 2022) — whichever is later. A unit may also apply before either of those dates.
- Apply for the Provisional Eligibility Certificate (PEC) to the Joint Commissioner of Industries, Large-INC Branch, Office of the Industries Commissioner, Udyog Bhavan, Gandhinagar, with the Annexure-B checklist. A team appointed by the Industries Commissioner physically verifies the assets before the PEC is issued.
- File the stamp duty and registration fee claim in the prescribed format with the Annexure-H documents: the registered deed, the stamp duty certificate and registration receipt, Index-2, the certified project layout and the authority letter.
- Apply for the Final Eligibility Certificate once the investment is complete, so that all incentive components are settled on final figures.
- Track the file and respond to queries from the Large-INC Branch. Until the online module is fully operational for a given component, offices accept hard-copy submissions at the Industries Commissionerate or the District Industries Centre.
How to apply offline and where to submit papers
- Prepare the claim set in the prescribed format and get every certificate signed by the authorised signatory named in the board resolution.
- Submit the papers at the Office of the Industries Commissioner, Block No. 1, 2nd Floor, Udyog Bhavan, Gandhinagar 382 010, addressed to the Joint Commissioner of Industries, Large-INC Branch.
- Keep the acknowledgement, since the statutory processing clocks run from the date a complete application is received, not from the date of a partial filing.
How long does approval take?

Delay on the applicant's side is penalised rather than forgiven. If a PEC application is filed six months late, that six months is deducted from the eligible incentive period, and the deduction carries through to the Final Eligibility Certificate even if the FEC application is on time.
Why stamp duty claims get rejected, and how to fix them
- Land is still agricultural. Reimbursement applies only to land converted for non-agricultural use. Complete the NA process before filing.
- No eligibility certificate. A claim filed before the PEC is issued has no basis. Register first, obtain the PEC, then claim.
- Deed and receipt mismatch. The amount claimed must match the stamp duty certificate and the registration receipt exactly; rounded or estimated figures are queried.
- Index-2 not attached, so the registered transaction cannot be verified in the revenue record.
- Layout not certified by an approved civil engineer or architect, leaving the department unable to confirm that the land is the project land.
- Signatory not authorised. Without a board resolution or authority letter naming the signatory, the file is returned.
- Thresholds not met. If verified investment falls below Rs 2,500 crore or employment below 2,500 persons, the unit loses mega status and must be assessed under the Large Industries scheme instead.
Units should also note the general recovery clause of the Aatmanirbhar Gujarat schemes: if conditions are breached, disbursed incentives are recovered, and recovery is made as arrears of land revenue with interest.
Which other incentives come with the same registration?
Once registered under the Mega Industries scheme, the same unit can claim, on the strength of its PEC and later its FEC, reimbursement of net SGST for up to 20 years subject to an annual ceiling expressed as a percentage of eligible FCI, reimbursement of input SGST paid on admissible capital goods, interest subsidy on term loans against an annual ceiling of eligible FCI, and EPF reimbursement claimed quarterly, half-yearly or annually after the date of commencement of production. Each is a separate claim with its own annexure and checklist, but all of them depend on the same registration and eligibility certificates, which is why getting the registration date right matters more than any single claim.
