What is the Aatmanirbhar Gujarat patent registration assistance?

Assistance for Patent Registration is a component of the Aatmanirbhar Gujarat Scheme for Assistance to Micro, Small and Medium Enterprises, notified by the Industries and Mines Department, Government of Gujarat, through Government Resolution No. MIS-102022-1271(1)-I(CH) dated 5 October 2022. The component is administered by the MSME Commissionerate and the Office of the Industries Commissioner in Gandhinagar.

The purpose is straightforward. Patent filing is expensive, and the cost falls hardest on small manufacturers who have developed a genuine product or process improvement but cannot justify attorney fees, filing fees and international prosecution costs against a small turnover. This component reimburses most of that spending after the fact, so that a small firm's innovation reaches the patent register rather than staying undocumented.

According to the Directorate's guideline for the component, assistance is available at 75% of the cost or expenditure incurred, for any number of patents, subject to a maximum of Rs 25 lakh per applicant or enterprise during the policy period. Within that overall ceiling, attorney fees are separately capped at Rs 50,000 for a national patent and Rs 2,00,000 per country for an international patent. The assistance is a reimbursement. The enterprise spends first and claims afterwards.

The component's operative period runs from 5 October 2022 to 4 October 2027. An earlier version of the same scheme ran under Gujarat Industrial Policy 2015 through Government Resolution No. SSI-102014-924840-CH dated 19 January 2015, also at 75% and Rs 25 lakh; enterprises whose patent was published and whose commercial production started before 5 October 2022 fall under that earlier scheme.

Who is eligible for patent registration assistance?

You can apply if:

  • You are an individual or any legal entity holding MSME status, classified as micro, small or medium under Para 1 of the Government Resolution dated 5 October 2022.
  • The enterprise holds an acknowledgement or registration from the Ministry of MSME (Udyam) or from DPIIT, as applicable.
  • The patent was filed for an industrial or commercial purpose.
  • You apply within one year of the date of publication or notification of the patent.

Who cannot apply:

  • Enterprises without MSME status. Large and mega industrial undertakings are not eligible under this component; they are covered by the separate Aatmanirbhar Gujarat schemes for Large Industries and Thrust Sector and for Mega Industries, which do not include a patent reimbursement of this kind.
  • Applicants who file more than one year after patent publication or notification. Those applications are expressly not eligible for assistance.
  • Patents not filed for industrial or commercial purposes.
  • Enterprises whose patent publication and commercial production both predate 5 October 2022 and which applied before that date, since they fall under the earlier 2015 scheme instead.

What expenditure is covered, and what is not?

Eligible expenditure:

  • Fees paid to the patent attorney, within the Rs 50,000 national and Rs 2,00,000 per-country international caps.
  • Patent service centre charges.
  • Patent registration fees and other statutory expenditure, incurred up to the date the application under the scheme is submitted.
  • Equipment and parts purchased to develop the prototype of the patented product or process.
  • Fees paid to the attorney, to government and to other statutory bodies before final patent grant approval.
  • Cash payment of stamp fees, government fees and other charges up to Rs 10,000.

Not eligible:

  • Raw material, travel and hotel charges, and any other expenses apart from prototype development.
  • Cash payments above Rs 10,000.

The guideline requires a separate expenditure statement for each patent, and for international patents the statement must be country-wise.

How to apply for patent registration assistance

  1. Secure MSME status first. Obtain the Udyam registration or DPIIT acknowledgement in the name of the applying enterprise.
  2. Wait for patent publication or notification. The one-year application window starts on that date, not on the filing date.
  3. Assemble the expenditure record, attorney invoices, statutory fee receipts, patent service centre bills and prototype equipment invoices, and get a Chartered Accountant to certify a separate expenditure statement for each patent.
  4. Apply online on the Investor Facilitation Portal at https://ifp.gujarat.gov.in, filling the prescribed application form for assistance for patent registration.
  5. Submit the self-certified hard copy with the checklist documents at the MSME Commissioner's office, within one year from the date of patent publication or notification. Until the online module is live for a component, the guideline allows the application to be made offline in hard copy at the same office.
  6. Collect the first tranche. The MSME Commissioner's office disburses 50% of the sanctioned assistance after the publication or notification of the patent, subject to availability of grant.
  7. Submit the patent registration grant certificate within six months of its issue by the competent authority, and the remaining 50% is released.

An applicant or enterprise may claim twice in a year, with a gap of six months between the claims.

How the two-tranche disbursement works

The split payment is the feature applicants most often misread. Patent publication and patent grant are different events, often years apart:

  • After publication or notification to 50% of the sanctioned amount is paid, subject to availability of grant with the MSME Commissioner's office.
  • After the patent certificate is issued. The remaining 50% is paid.
  • The six-month rule. The grant certificate must reach the MSME Commissioner's office within six months of its date of issue. Enterprises that file the certificate late risk losing the second half.

Because the first half is released against publication, an MSME whose application is otherwise clean still receives half the money long before the patent is granted, which is the point of structuring it this way.

Why patent assistance claims get rejected

  • Filed more than one year after publication or notification. This is a hard bar in the guideline.
  • No MSME status on the date of application, or an expired Udyam registration.
  • Cash payments above Rs 10,000 included in the expenditure statement.
  • Travel, hotel and raw material costs claimed, which the guideline excludes.
  • A single combined expenditure statement for several patents instead of one per patent, country-wise for international filings.
  • Attorney fees claimed above the Rs 50,000 or Rs 2,00,000 caps, which are trimmed rather than refused entirely.
  • Grant certificate submitted after six months, which holds up the second tranche.
  • Patent not for industrial or commercial purpose.
