Trade Licence in Maharashtra (Gumasta / Shops and Establishment Registration)

Maharashtra state government scheme

Quick answer

A trade licence in Maharashtra usually means the Gumasta, the Shops and Establishment registration issued under the Labour Department's Labour Management System at lms.mahaonline.gov.in. Specified trades such as eating houses and hazardous trades additionally need a municipal trade licence from the corporation. Both are applied for online, and the fee is shown on the payment screen.

Benefit
An official registration certificate that lets you legally run a shop or commercial establishment in Maharashtra and open a current account in the business name
How to apply
Both — online on lms.mahaonline.gov.in (and the municipal corporation portal for specified trades), or through a CSC listed on the Labour Department portal

What is a trade licence in Maharashtra?

A trade licence in Maharashtra is not one document. Two different permissions travel under that name, and knowing which one you are being asked for saves a wasted application.

The Gumasta, or Shops and Establishment registration, is the Labour Department's registration of your establishment. It is applied for on the Labour Management System at lms.mahaonline.gov.in, which the Labour Department runs as its Registration / Licence Management System. The same portal handles factory registration and renewal, contract labour licensing and other labour-law compliance, so Shop and Establishment sits in a family of services rather than alone.

A municipal trade licence is separate. Municipal corporations; Brihanmumbai, Pune, Pimpri-Chinchwad, Nagpur, Nashik, Thane, Chhatrapati Sambhajinagar and the rest; license specified trades inside their limits under their own municipal Acts. Eating houses, bakeries, lodging houses, and trades classed as dangerous or offensive need the corporation's licence in addition to the Gumasta. A plain retail shop or an office usually needs only the Gumasta.

Banks, landlords and GST officers almost always mean the Gumasta when they ask a Maharashtra shopkeeper for a trade licence.

Who needs a Maharashtra Shops and Establishment registration?

You need one if:

  • You run a shop, retail outlet, showroom, godown or storeroom anywhere in Maharashtra.
  • You run a commercial establishment, an office, agency, consultancy, coaching class, travel desk, salon or IT firm.
  • You run a hotel, restaurant, eating house, tea shop or catering unit. These need the corporation's trade licence and an FSSAI licence as well.
  • You are a proprietor, partnership firm, LLP, private limited company, trust or society operating a commercial premises. The constitution does not exempt you.
  • You employ workers. Employment strength decides the category you fall into and the fee that follows.

You cannot use this route if:

  • You run a factory, which is registered under the Factories Act on the same Labour Management System but as a different service: not as a shop.
  • You are an industrial project seeking clearances in bulk. The Labour Management System itself directs industrial applicants to the MAITRI single-window portal instead.
  • You are applying for a municipal food, health or hazardous-trade licence. That application goes to the municipal corporation, not to the Labour Department.
  • You have no lawful occupancy of the premises. Without a registered leave-and-licence agreement, a rent agreement or an ownership document, there is no address to attach the registration to.

What documents are required?

Document Mandatory Notes
Employer's identity proof (Aadhaar / PAN / voter ID) Yes Name must match the application
PAN of the business or proprietor Yes The trade name is tied to a PAN

The Labour Management System publishes a user manual and an FAQ document for download on its home page. Read the manual before you start; it shows the exact upload slots and formats and saves a rejected file.

How to apply for a trade licence in Maharashtra online

  1. Open lms.mahaonline.gov.in and register with your mobile number and email, then verify the OTP and set a password. One login covers every Labour Department registration and licence on the system.
  2. Download the fee structure for your Act from the portal's home page before you begin. The Labour Management System publishes downloadable fee structures for five labour Acts, including the Contract Labour Act, 1970 and the Building and Other Construction Workers Act, 1996, so you know the amount in advance.
  3. Choose the Shop and Establishment service from the registration list. Do not pick Factory registration or Contract Labour licence, which sit in the same menu and lead somewhere else entirely.
  4. Fill the application — trade name, nature of business, full address with the municipal ward, date the business commenced, employer's details, and the number of employees on the date of application.
  5. Upload the documents into their labelled slots: identity proof, PAN, premises proof, photograph, the constitution document for a firm or company, and the employee list.
  6. Pay the government fee on the payment screen and save the receipt.
  7. Note the application number on the acknowledgement. Tracking, replying to a query and downloading the certificate all need it.
  8. Answer the inspector's query if one is raised. The Labour Department may ask for a clarification or verify the premises before approval.
  9. Download the digitally signed certificate from your account. If it opens with a signature warning, follow the portal's published instructions for validating the digital signature. The certificate itself is valid.
  10. Display the certificate at the establishment. It is meant to be visible on the premises during an inspection.

How to apply through a CSC or the municipal counter

  1. Find an authorised centre using the CSC Centre List the Labour Management System publishes on its home page.
  2. Carry the originals of your identity proof, PAN, premises document and photographs, plus self-attested copies.
  3. Have the operator file the same online application on lms.mahaonline.gov.in on your behalf.
  4. Pay the government fee plus the notified centre charge and take a printed receipt. Nothing beyond the printed rate card is legitimate.
  5. For a specified trade, separately approach your municipal corporation's licence department or ward office for the trade licence, for example the licence department of the corporation for an eating house, and follow the corporation's own document list and fee schedule.

How do I check my application status?

Log in to lms.mahaonline.gov.in and open your application list, where the status shows whether the file is under scrutiny, awaiting a clarification, or approved for download. Keep the application number to hand; without it no office can trace the file.

If the file is stuck, take it up in this order: the Labour Inspector for your area, then the Assistant Labour Commissioner, then the Deputy Labour Commissioner of the division. For the municipal trade licence, escalate through the ward officer, then the corporation's licence department, then the Municipal Commissioner's grievance cell. Maharashtra also runs the Aaple Sarkar grievance portal for complaints against a government office that has not acted.

How long is it valid, and how do I renew it?

The Labour Management System is built as a Registration / Licence Management System with renewal built in; factory registration and renewal are named explicitly among its services, and Shops and Establishment certificates carry their own validity term. Read the validity date printed on your own certificate and renew before it, because the term granted differs by category and by the Act you registered under.

Three practical rules follow from that:

  • Renew early. A lapsed certificate counts as no certificate during an inspection.
  • Update, do not re-apply, when the trade name, address, ownership or employee strength changes. A certificate showing the wrong address is the commonest inspection objection.
  • Close it properly when you shut the business, rather than letting it lapse silently.

Why do applications get rejected in Maharashtra?

  • Name mismatch between Aadhaar, PAN and the trade name entered on the portal.
  • An unregistered or expired rent agreement for the premises. Maharashtra inspectors look closely at leave-and-licence registration.
  • Residential premises used commercially without the change of use the building rules require.
  • Wrong service selected, a factory or contract-labour application filed where a Shop and Establishment registration was needed.
  • Employee numbers that contradict the documents, for example a payroll list longer than the number declared on the form.
  • Blurred or oversized uploads, especially long rent agreements scanned as a single unreadable image.
  • Missing constitution document where a partnership firm or a company applies in the firm's name.
  • Assuming the Gumasta covers a specified trade. An eating house without the corporation's trade licence is still unlicensed however good its Gumasta is.

What should it cost, and what should you refuse to pay?

A Maharashtra Shops and Establishment registration costs only the government fee published in the Labour Department's own downloadable fee structure and shown on the portal's payment screen, plus the notified CSC charge if you file through a centre. Both are printed, and both come with a receipt. A municipal trade licence costs the fee in the corporation's published schedule for that trade category.

Agents advertising a "Gumasta in one day" for a few thousand rupees are selling a priority queue the Labour Department does not operate. Download the fee sheet, read the user manual, and file it yourself, or use a CSC from the portal's own list. Never hand over your portal password or an Aadhaar OTP to an agent; no Labour Department officer needs either to issue your certificate.

Frequently asked questions

What is a trade licence called in Maharashtra?

Maharashtra's everyday name for it is the Gumasta, formally the Shops and Establishment registration issued under the Labour Department. Applications are filed on the Labour Management System at lms.mahaonline.gov.in, which the Labour Department describes as its Registration / Licence Management System.

Is the Gumasta the same as a municipal trade licence?

No — they are two different permissions and many businesses need both. The Gumasta is a Labour Department registration of the establishment, while a municipal trade licence is the corporation's permission for a specified trade such as an eating house, bakery, lodging house or hazardous trade.

Which website do I use to apply?

Use lms.mahaonline.gov.in, the Labour Department's Labour Management System, which handles Shop and Establishment registration alongside factory registration and contract labour licensing. The portal also publishes downloadable fee structures for five labour Acts, a user manual, an FAQ document and a list of CSC centres.

Can I apply through a Common Service Centre?

Yes, the Labour Management System publishes a CSC centre list on its own home page for applicants who would rather not file themselves. Pay only the notified centre charge on top of the government fee, and take a receipt.

Do I need a digital signature?

The Labour Management System publishes separate instructions for validating digital signatures, because certificates issued through it are digitally signed. Read that instruction sheet if your downloaded certificate opens with a signature-validation warning — the certificate is still valid.

Is there a different portal for industrial units?

Yes, the Labour Management System points industrial applicants to the MAITRI portal, Maharashtra's single-window clearance system, for faster act-specific service. A regular shop or office should stay on lms.mahaonline.gov.in.

How much does the registration cost?

Only the government fee shown on the portal's payment screen, which varies with the number of employees and the Act you are registering under. The Labour Management System publishes downloadable fee structures for five labour Acts, so check the sheet for your category before you pay anyone.

What happens if I trade without registering?

Running an unregistered establishment exposes you to prosecution by the Labour Department inspector and to municipal action for the trades that also need a corporation licence. In practice the bigger day-to-day cost is commercial — banks will not open a current account in the trade name without the certificate.
