Shop & Establishment Registration in Maharashtra (Gumasta Licence)
Maharashtra state government scheme
Shop & Establishment Registration in Maharashtra is issued by the Labour Commissionerate under the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act 2017, and the Labour Commissionerate's notified service list gives it a time limit of just 1 day with a Facilitator as the designated officer. Employers apply online at lms.mahaonline.gov.in and pay only the fee the portal calculates.
What is Shop & Establishment registration in Maharashtra?
Shop & Establishment registration in Maharashtra is the certificate the state Labour Commissionerate issues to an employer under the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act 2017. It is the document most people in Mumbai, Pune, Thane and Nagpur call the Gumasta licence, and it is the state's basic proof that a shop, office, godown, hotel, restaurant, theatre or commercial establishment exists lawfully and that its working hours, leave and wage conditions fall under a state labour law.
The 2017 Act, Maharashtra Act 61 of 2017, enacted on 7 September 2017 to replaced the Bombay Shops and Establishments Act 1948 that governed the state for nearly seventy years. Its long title covers "shops, residential hotels, restaurants, eating houses, theatres, other places of public amusement or entertainment and other establishments", which is why the same registration serves a two-table tea stall and a multi-floor IT office.
Maharashtra delivers the service entirely through the Labour Management System (LMS) at lms.mahaonline.gov.in, the Labour Commissionerate's own portal. The same portal issues contract labour licences, principal employer registrations, Building and Other Construction Workers registrations, Motor Transport Workers registrations and Beedi and Cigar licences, so an employer who needs more than one of these files them from a single login.
The single most useful published fact is the timeline. Maharashtra's notified list of public services under the Right to Public Services Act 2015 sets the time limit for "Registration under Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017" at 1 day, with the Facilitator as designated officer, the District Government Labour Officer as first appellate authority and the Assistant Commissioner of Labour as second appellate authority. One day is possible only because the service runs on self-declaration, which is exactly why Annexure A and Annexure B are mandatory uploads.
Who can and who cannot apply?
You can apply for Shop & Establishment registration in Maharashtra if you are the employer. The owner, or the person with ultimate control over the affairs: of any of the following inside Maharashtra:
- A shop where goods are sold retail or wholesale, or where services are rendered to customers, including its office, store room, godown or warehouse.
- A commercial establishment. An office, a consultancy, an advertising or commission agency, an insurance company, a bank branch, a broker's office.
- A residential hotel, restaurant or eating house.
- A theatre or other place of public amusement or entertainment.
- A society, trust or charitable body carrying on business, trade or profession, whether for gain or not.
- A proprietorship, partnership firm, LLP, private limited company, cooperative society or trust, the constitution does not change eligibility, only which constitution document you upload.
You cannot apply under this Act for a factory. Premises that are a factory within the meaning of the Factories Act 1948 are licensed by the Directorate of Industrial Safety and Health, not by the Labour Commissionerate's shops branch, and the same notified service list shows factory licensing as a separate service with its own 7-day or 30-day timelines. A shop attached to a factory whose workers already get Factories Act benefits is likewise outside the shops registration.
You are also not eligible to register a business that has no premises in Maharashtra. Registration is territorial and is granted by the Facilitator for the area where the establishment stands; a Nashik shop cannot be registered on a Nagpur address, and a branch in another state needs registration under that state's own shops law.
There is no income limit, no caste condition and no minimum turnover for Shop & Establishment registration in Maharashtra. What matters is the premises, the nature of business and the number of workers you declare.
What documents are required?
The Maharashtra Labour Commissionerate publishes an official document list for the Shops & Establishments service. It groups the papers into five buckets:
- Identity proof; any one: PAN card, passport, Aadhaar card, driving licence or election card.
- Address proof; any one: rent receipt, telephone bill, electricity bill, sale or purchase deed, property tax paid receipt, notarised leave and licence agreement, or a society maintenance receipt.
- Mandatory documents: Annexure A self-declaration, Annexure B self-declaration for self-attestation, and an actual photograph of the establishment in which the sign board bearing the establishment's name is displayed and visible.
- Identity verification of the entity, any one: ROC record, MOA with registration certificate, list of trustees of a trust, registered address proof, society resolution on starting the business, list of the chairman and members of the cooperative society, list of directors with the nomination resolution, Charity Commissioner's registration certificate, certificate of incorporation or commencement certificate under the Companies Act, or the pages of the partnership deed showing partners' names, signatures, business name and percentage of partnership.
- Nature of business verification — any one, where it applies: RBI permission, RTO transport permit, collector permission, Agriculture Department licence, food licence, Food and Drugs Administration licence, police NOC for a cyber cafe, IEC certificate for import-export, SEBI certificate for a share broker, police licence for security services, municipal NOC for a flour or masala mill, excise licence for a wine shop, beer bar or bar and restaurant, or NOC from the Municipal Commissioner, Fire Brigade, Collector and Police Department.
The list also names one catch-all: a copy of any licence or registration that was mandatory under any other law from any authority before the business could start.
How to apply for Shop & Establishment registration in Maharashtra online
- Open lms.mahaonline.gov.in and create a new user account. Register with the employer's mobile number and email, verify the OTP, and set a password. Existing certificate holders must instead fill the Old User form first, because the portal routes renewals through that form.
- Select the Shops and Establishments service from the dashboard of acts the Labour Commissionerate administers, and choose the new registration application rather than renewal or amendment.
- Fill the establishment details, name of the establishment exactly as it appears on the sign board, full postal address with ward or taluka, category (shop, commercial establishment, residential hotel, restaurant, eating house, theatre), date of commencement, employer's name and residential address, manager's name, and the number of workers employed directly and through contractors.
- Upload the documents; one identity proof, one address proof, the entity constitution document, any nature-of-business licence, and the mandatory photograph showing the name board. Keep every scan inside the file size the upload screen states.
- Sign Annexure A and Annexure B and upload both. These self-declarations are what let Maharashtra clear the file in one day without a prior inspection, and a false declaration is what later gets a registration cancelled.
- Pay the fee shown on the payment screen by net banking, card or UPI. The amount is calculated from the number of workers you declared; the portal generates a receipt against your application number.
- Download the registration certificate from your LMS dashboard once the Facilitator approves it, and display it prominently at the establishment. Inspectors ask to see it on the wall, not on a phone.
How do you apply offline or through a Seva Kendra?
Maharashtra has no separate paper counter for this service. The Labour Commissionerate accepts it through the LMS portal only. Employers without a computer file the same application through an Aaple Sarkar Seva Kendra or a Common Service Centre, where the operator keys in the form and uploads the scans against the notified operator charge. Insist on the printed acknowledgement carrying your application number: that number, not the operator's word, is what proves a file was actually submitted.
For anything the portal cannot resolve, a stuck payment, a rejected upload, a certificate not generating, the office to approach is the District Government Labour Officer of your district, who is also the first appellate authority for this service.
How do you check the application status?
Log in to lms.mahaonline.gov.in with the same credentials and open the application against its number. The status moves from submitted, to payment received, to approved, at which point the Download Certificate option appears. If it reads returned, the Facilitator has raised a defect, correct it and resubmit rather than filing a fresh application, because a duplicate application for the same premises is rejected.
If the notified 1-day limit passes without a decision, the Maharashtra Right to Public Services Act 2015 gives you a first appeal to the District Government Labour Officer and a second appeal to the Assistant Commissioner of Labour, both named against this service in the Labour Commissionerate's own list. A final appeal lies to the Maharashtra State Commission for Right to Service.
Why are Maharashtra Shop Act applications rejected?
- The photograph does not show the name board, or the board is unreadable in the scan. This is the commonest single defect.
- The address proof is in a different name from the employer with no leave and licence agreement or landlord NOC connecting the two.
- A partnership deed is uploaded without the pages showing partner names, signatures and profit shares. The document list asks for exactly those pages.
- A business needing a prior licence, a restaurant without FSSAI, a bar without an excise licence, a cyber cafe without a police NOC, files without it.
- The number of workers declared does not match the fee paid, or contract workers are left out of the count.
- Annexure A or Annexure B is missing, unsigned, or signed by someone other than the employer.
- A factory applies here instead of to the Directorate of Industrial Safety and Health.
What does it cost, and what about agents?
Maharashtra issues this registration at the government fee the LMS payment screen calculates, plus the notified operator charge if you file through a Seva Kendra or Common Service Centre. Nothing else is payable. The fee scales with the number of workers you declare, which is why the portal computes it after you enter the worker count rather than publishing one flat number.
Agents around municipal offices in Mumbai and Pune sell a "same-day Gumasta" for several thousand rupees. They file the identical form on the same portal, and the file still goes to the same Facilitator under the same one-day limit. Filing it yourself costs the government fee and about twenty minutes. If anyone demands money beyond the portal receipt, take it to the District Government Labour Officer or the Labour Commissionerate's grievance cell, the payment record in your LMS account is your evidence.
What do you need the certificate for afterwards?
A Maharashtra Shop & Establishment registration certificate is what a bank asks for to open a current account in the business name, what payment gateways and marketplaces ask for as entity proof, what landlords and mall managements ask for before signing a commercial lease, and what municipal, FSSAI, excise and professional tax offices ask to see alongside their own registrations. It is also the document an inspecting officer asks for first, which is why the Act requires it to be displayed prominently at the establishment rather than filed away.

Frequently asked questions
How long does Shop and Establishment registration take in Maharashtra?
Maharashtra notifies a time limit of 1 day for "Registration under Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017" in the Labour Commissionerate's list of notified public services. The designated officer is the Facilitator, the first appellate authority is the District Government Labour Officer and the second appellate authority is the Assistant Commissioner of Labour.
Which law governs shop registration in Maharashtra now?
The Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act 2017 — Maharashtra Act 61 of 2017, enacted on 7 September 2017 — replaced the old Bombay Shops and Establishments Act 1948. Every reference to a "Bombay Shop Act licence" in older paperwork now means registration under the 2017 Act.
What is a Gumasta licence and is it the same thing?
Gumasta licence is the everyday Marathi and Hindi name for exactly this registration certificate under the Maharashtra Shops and Establishments Act — there is no separate document. Banks in Mumbai, Pune and Nagpur ask for the "Gumasta" when opening a current account, and the certificate downloaded from lms.mahaonline.gov.in is what they mean.
Where do I apply for Shop Act registration in Maharashtra?
Applications go to the Labour Management System at lms.mahaonline.gov.in, the Maharashtra Labour Commissionerate's own portal, which also handles contract labour licences, BOCW registration, Motor Transport Workers registration and Beedi and Cigar licences. The same portal carries the renewal route — the site instructs existing holders to "fill the Old User form first to apply Renewal Application form for Shop and Establishment Registration".
What documents does Maharashtra actually demand?
The Labour Commissionerate's published document list requires one identity proof, one address proof, Annexure A and Annexure B self-declarations, and a photo of the establishment with the name board visible. Everything else — partnership deed, incorporation certificate, FSSAI or excise licence — is demanded only where it matches the constitution or the nature of the business.
What does Shop Act registration cost in Maharashtra?
Maharashtra charges only the government fee that lms.mahaonline.gov.in calculates on the payment screen from the number of workers you declare, plus the notified operator charge if you file through a Seva Kendra or Common Service Centre. No Facilitator, inspector or clerk may take a rupee beyond that, and every payment leaves a receipt in your portal account.
What happens if the one-day time limit passes with no certificate?
The Maharashtra Right to Public Services Act 2015 gives you a first appeal to the District Government Labour Officer and a second appeal to the Assistant Commissioner of Labour, both named against this service in the Labour Commissionerate's notified list. A further appeal lies to the Maharashtra State Commission for Right to Service.
Do I need to renew the Maharashtra Shop Act certificate?
Yes — the Labour Management System runs a separate renewal application for Shop and Establishment registration, and the portal directs returning employers to the Old User form before filing it. Renew before the validity printed on your certificate lapses, because a lapsed registration is treated as an unregistered establishment during inspection.
