What is Shop & Establishment Registration in Meghalaya?

Shop & Establishment Registration in Meghalaya is the registration every employer takes under the Meghalaya Shops and Establishments Act, 2003, administered through the Meghalaya Shops and Establishment Rules, 2004. The registering authority is the Labour Commissioner or an officer authorised by him, and the service is delivered online by the Labour Department through Invest Meghalaya, the state single window portal at investmeghalaya.gov.in, where it is listed as "Registration of Shops and Establishment - FORM A".

Meghalaya keeps a formal state register. Rule 4 requires the Labour Commissioner to maintain a Register of Shops and Establishments in Form B, in three parts:

  • Part I, Shops
  • Part II: Commercial Establishments
  • Part III, Establishments for Public Entertainment or Amusement

Once the Labour Commissioner is satisfied about the correctness of the statement in Form A, Rule 5 requires him to enter the establishment in the appropriate part of the register and issue a Certificate of Registration in Form C to the employer. Rule 6 then requires the employer to display that certificate in a conspicuous place in the establishment, and to replace it with a fresh copy if it becomes defaced or illegible.

The certificate is what a Meghalaya bank asks for when a proprietor opens a current account, what a landlord or aggregator asks for during onboarding, and what brings the shop onto the Labour Department's rolls for weekly closure, weekly holidays and hours of work. It is separate from GST registration, from the Autonomous District Council or municipal trading licence, and from Udyam registration; although the trading licence is itself an enclosure Meghalaya asks for at the time of shop registration.

Who can and cannot apply in Meghalaya?

You can apply if:

  • You are the employer of a shop in Meghalaya: premises where goods are sold or services rendered to customers.
  • You are the employer of a commercial establishment. An office, a trading or broking office, a consultancy, an IT firm or a godown attached to a business.
  • You are the employer of an establishment for public entertainment or amusement, which Meghalaya registers in Part III of the Form B register and prices on its own fee schedule.
  • Your business has just commenced, in which case Rule 3 requires you to apply within thirty days from the date of commencement.
  • Your shop employs nobody at all. The fee schedule has an explicit "Shops with no employees" slab at Rs 50, so a one-person shop still registers.

You cannot apply, or are not eligible on this service, if:

  • You are an employee. Only the employer of an establishment applies; workers have no application of their own under these rules.
  • Your unit is a factory licensed under the Factories Act, which Invest Meghalaya lists as a separate service ("Licence to work as a Factory").
  • The activity is not commercial, a household employing domestic help is not an establishment.
  • You are the buyer of an existing registered shop. Rule 11 makes the certificate non-transferable, so under Rule 12 the seller surrenders the old certificate and you apply for a new Certificate of Registration rather than taking over the existing one.
  • You are looking for a trading licence, which is granted by the Autonomous District Council or the municipality, not by the Labour Commissioner.

What does Shop & Establishment Registration cost in Meghalaya?

The published fee schedule for the Meghalaya Shops and Establishments Act 2003 sets the same amount for a registration certificate and for its renewal.

Category Fee
Shops with no employees Rs 50
Shops with 1 to 3 employees Rs 150
Shops with 4 to 10 employees Rs 350
Shops with 11 to 20 employees Rs 700
Shops with 21 to 50 employees Rs 1,500
Shops with 51 employees or more Rs 2,500

Commercial establishments and establishments for public entertainment or amusement

Category Fee
No employees Rs 100
1 to 3 employees Rs 250
4 to 10 employees Rs 500
11 to 20 employees Rs 850
21 to 50 employees Rs 2,500
51 to 100 employees Rs 3,500
101 to 500 employees Rs 5,000
501 to 1,000 employees Rs 6,500
1,001 to 2,000 employees Rs 8,000
2,001 employees or more Rs 10,000

Rule 14 states where the money goes: all fees are credited to the Government Treasury under the head of account "0230-Labour & Employment-106-Fees under the Meghalaya Shops and Establishment Rules, 2004", and the original challan copy is forwarded to the Labour Commissioner with the filled and signed application form. Nothing above this schedule is a government charge. If an agent in Shillong quotes a consolidated figure well above the slab for your headcount, the difference is their fee, not the state's β€” the whole schedule is published on the state's own portal.

What documents are required?

Invest Meghalaya's list of enclosures for this service is short:

Document Mandatory Notes
Application in Form A Yes Prescribed by Rule 3; in duplicate and in print for the offline route
Identity proof of the employer Yes First item on the Meghalaya enclosure list
Trading Licence from the ADC or Municipality Yes Issued by the Autonomous District Council or local body
Original treasury challan for the fee Yes Head of account 0230-Labour & Employment-106
Others, as the Labour Inspector asks Sometimes Meghalaya's enclosure list carries an explicit "Others" line

For the auto renewal service, Meghalaya publishes a slightly different list: identity proof, the trading licence (optional), the licence copy, Form D notice of change (optional), and the latest renewal copy where the registration has been renewed at least once.

How to apply for Shop & Establishment Registration in Meghalaya

  1. Open investmeghalaya.gov.in and go to Services, then find "Registration of Shops and Establishment - FORM A" listed against the Labour Department. The same row links the Standard Operating Procedure, the Meghalaya Shops and Establishment Rules 2004, the list of enclosures, the fee details and the application form format; read the enclosure list before you start.
  2. Log in or register on the portal and open the service through the Apply Online link against that row.
  3. Fill Form A with the establishment's name, address, category (shop, commercial establishment, or public entertainment or amusement), nature of business, date of commencement and the number of employees. The category and headcount together fix your fee.
  4. Upload the enclosures; identity proof of the employer and the trading licence from the ADC or municipality, and submit the application.
  5. Wait for initial verification. Meghalaya's published process flow moves the file from application submission to initial verification, which either passes it to the Labour Inspector or opens a gateway for resubmission of enclosures if something is missing.
  6. Complete verification by the Labour Inspector (LI), who checks the application against the enclosures.
  7. Pay the fee at the payment step, which Meghalaya's process flow places after the Labour Inspector's verification rather than before it.
  8. Collect the signed certificate. The final stage of the process flow is "Issue and Sign", after which the Certificate of Registration in Form C is issued and must be displayed in the establishment.

An offline route exists in the rules themselves: Rule 3 contemplates Form A submitted in duplicate and in print to the Labour Commissioner or the officer authorised by him, together with the original treasury challan for the fee, and Rule 14 spells out the treasury head under which that challan is deposited. Invest Meghalaya's auto-renewal process flow also names PFC / kiosk as a filing channel alongside online, so a shopkeeper without a computer can file through an assisted centre.

How do I renew, amend or close a Meghalaya registration?

Renewal. The certificate is valid for twelve months only from the date of issue. Rule 7 requires the renewal application in Form A, submitted within three months after the date of expiry of the certificate, accompanied by the current certificate and the original treasury challan for the renewal fee, which is the same amount as the registration fee for your slab. Invest Meghalaya also runs a dedicated "Shops and Establishment 2003 Auto Renewal" service for this.

Change of particulars. Rule 8 requires the employer to notify any change in the particulars given under Rule 3 in Form D, with the treasury challan for the fee, within ten days after the change takes place. The Labour Commissioner then amends the current certificate or issues a fresh one.

Lost certificate. Rule 10 requires the employer to report the loss forthwith and apply in Form F with the challan, on which a duplicate is issued stamped "DUPLICATE" in red ink.

Transfer of ownership. Rule 12 requires notice of the transfer within fifteen days, surrender of the certificate, and a fresh registration by the new employer, the certificate itself is non-transferable under Rule 11.

Closure. Rule 9 requires notice in Form E within ten days of winding up, along with the certificate, after which the name is removed from the register. The rule's explanation is worth noting: an establishment closed for a continuous period of three months or more is treated as wound up.

Why do applications get rejected in Meghalaya?

The commonest reasons are procedural, not substantive: no trading licence from the ADC or municipality to attach, an identity proof that does not match the employer named in Form A, a headcount that does not match the fee slab paid, a treasury challan deposited under the wrong head of account, or a renewal filed more than three months after expiry, which no longer fits Rule 7's window. Meghalaya's process flow builds in a formal resubmission gateway at the initial verification stage, so a file with a missing enclosure normally comes back for correction rather than being refused. Rule 13 also lets the Labour Commissioner hold an enquiry to satisfy himself about the correctness of any particulars, and Rule 15 makes his decision final where there is doubt about the manner of registration, renewal, fees, or the category an establishment belongs to.

Where do I complain if the application is stuck?

The Invest Meghalaya Authority sits in the Secretariat Main Building, M.G. Road, Shillong 793001, East Khasi Hills District, and publishes the contact number +91 7085741695 and the email investmeghalayaauthority@gmail.com. The portal carries Track Application Status, a Lodge Grievance route and a state-wise pendency report, so a file that has been sitting past the process-flow stage it should have cleared can be raised with evidence. For questions on the substance of the registration, the category your establishment falls in, or the fee slab; Rule 15 sends the matter to the Labour Commissioner, whose decision is final for the purposes of the Act and rules.

Do all of this yourself on the state portal. Meghalaya's total cost for a small shop is Rs 50 to Rs 350, and the fee schedule, rules, enclosure list and process flow are published as PDFs on investmeghalaya.gov.in. A middleman charging several thousand rupees for the same Form A is charging for something the state gives away for the price of a treasury challan.

No. The trading licence comes from the Autonomous District Council or the municipality and is itself an enclosure Meghalaya asks for when you register under the 2003 Act, so most shops in Shillong, Tura and Jowai need both.
