What is the Accidental Death Benefit Scheme in Puducherry?

Accidental Death Benefit Scheme is a welfare measure of the Puducherry Building and Other Construction Workers Welfare Board (PBAOCWWB), which functions under the Labour Department, Government of Puducherry. The Board was constituted under the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, and is funded by the cess collected under the Building and Other Construction Workers' Welfare Cess Act, 1996 on the cost of construction in the Union Territory.

Construction is among the most dangerous forms of work in India. A fall from a scaffold, an electrocution, a trench collapse or a road accident on the way to a site can end a family's only income in a moment. Accidental Death Benefit Scheme exists for exactly that situation: it converts the cess collected from builders into a lump sum for the family of a worker who dies in an accident.

According to the Labour Department, Government of Puducherry, the scheme extends financial assistance of Rs 2,25,000 to the nominees or dependants of the deceased construction worker. This is in addition to Rs 2,00,000 extended through the Life Insurance Corporation cover arranged for registered beneficiaries. Where both are settled, a family receives up to Rs 4,25,000.

Key features

  • Benefit paid by the Welfare Board, not by the employer or contractor.
  • Amount credited through Direct Benefit Transfer into the nominee's bank account.
  • Stated disbursal timeline is within 15 days of the application.
  • Applications are accepted offline at the Board office.
  • Applies only where death was caused by an accident in the course of employment.

Who is eligible for the accidental death benefit?

A claim can be made if all of the following are true of the deceased worker:

  • The worker was a citizen of India.
  • The worker was registered as a building or other construction worker with the Puducherry Building and Other Construction Workers Welfare Board, and the registration was live at the time of death.
  • Death was caused by an accident arising in the course of employment. The harness of work; rather than by disease or natural causes.
  • The worker contributed regularly to the Board's fund and had not defaulted in payment of contribution for a continuous period of more than one year.
  • The claimant is the registered nominee, or a dependant able to establish entitlement through a legal heir certificate.

You are not eligible and cannot apply if:

  • The deceased was never registered with the Puducherry Welfare Board, even if he or she genuinely worked in construction. Registration is the gateway to every Board benefit, and it cannot be done after death.
  • The worker's contributions were in default for more than one continuous year at the time of death.
  • Death was from natural causes or illness. That case belongs to the Board's separate Natural Death Benefit Scheme, which carries different amounts and conditions.
  • The worker was registered with a construction workers' board in another state and not in Puducherry.
  • The claimant is not a nominee or dependant — a friend, employer, contractor or unrelated person cannot receive the money.

The single most important point for construction families in Puducherry, Karaikal, Mahe and Yanam is that registration is what creates the entitlement. A worker who has never registered leaves the family with nothing under this scheme, however long he or she worked on sites.

What documents are required to claim?

Document Mandatory Notes
Board registration/identity card of the worker Yes Proves live registration with PBAOCWWB
Death certificate Yes From the Commune Panchayat or Municipality
Post-mortem report Yes Establishes accidental cause of death
FIR or police report Yes Records the accident
Nominee or legal heir certificate Yes Establishes who is entitled
Contribution payment record Yes Shows no default beyond one continuous year
Bank passbook of the nominee Yes For DBT credit
Aadhaar card of the nominee No For identity and account seeding

Keep at least two photocopy sets. Government offices retain one set with the claim file, and a second set saves a repeat trip if a query is raised.

How to apply for the Accidental Death Benefit Scheme

  1. Collect the death documents first. Obtain the death certificate from the Commune Panchayat or Municipality, the post-mortem report from the hospital that conducted it, and a copy of the FIR or police report on the accident. Without the post-mortem report the Board cannot classify the death as accidental, and the claim will be treated under the natural death scheme instead.
  2. Verify the worker's registration and contribution record. Take the worker's Welfare Board identity card to the Board office and ask staff to confirm that registration was live and that contributions were not in default for more than one continuous year. Settle this before filing, because a contribution gap is the most common ground on which claims fail.
  3. Obtain the claim form for the Accidental Death Benefit Scheme from the Puducherry Building and Other Construction Workers Welfare Board office of the Labour Department, or from the Labour Officer in Karaikal, Mahe or Yanam.
  4. Fill the form and attach the documents, including the nominee's bank passbook copy so that the account number and IFSC code are legible for the DBT credit.
  5. Submit the completed claim in person at the Welfare Board office and obtain a dated acknowledgement with a file or reference number. Do not leave without this, it is the only proof the claim was lodged.
  6. Follow up after two weeks. The Board's stated timeline is disbursal within 15 days, so quote your acknowledgement number and ask for the status if the credit has not appeared by then.
  7. File the LIC claim separately. The Rs 2,00,000 insurance component runs through the Life Insurance Corporation and is not settled automatically by the Board claim. Ask the Board office which LIC branch and policy the registration is attached to.

How much is paid and how does the money arrive?

Accidental Death Benefit Scheme pays a single lump sum of Rs 2,25,000. There is no instalment structure and no monthly component. Payment is made by Direct Benefit Transfer into the nominee's or dependant's bank account, which is why an active account in the claimant's own name is essential. A joint account or an account belonging to a relative slows the claim down and can cause rejection at the payment stage.

The Rs 2,00,000 payable through the Life Insurance Corporation is a distinct settlement. It follows insurance procedure, has its own claim form and timelines, and is not credited alongside the Board amount.

Why accidental death claims get rejected

  • Worker was never registered, or registration had lapsed before the death.
  • Contributions in default for a continuous period of more than one year.
  • No post-mortem report, so accidental cause cannot be established.
  • Dispute over the nominee where no nomination was recorded and several relatives claim entitlement. A legal heir certificate resolves this.
  • Mismatch of names between the Board record, the death certificate and the bank account.
  • Bank details wrong or account dormant, which causes the DBT credit to fail even after sanction.

Most of these are preventable while the worker is alive. Two habits protect a family more than anything else: pay the contribution on time every year, and record a nomination with the Board so that entitlement is never in doubt.

How to check the status of a claim

There is no online claim tracking for this benefit. Status is checked in person or by telephone at the Puducherry Building and Other Construction Workers Welfare Board office of the Labour Department, quoting the acknowledgement or file number issued at submission. Nominees in Karaikal, Mahe and Yanam can route the enquiry through the Labour Officer of the region rather than travelling to Puducherry.

Where to raise a grievance

Grievances about a delayed, reduced or rejected claim go first to the Secretary of the Puducherry Building and Other Construction Workers Welfare Board, and then to the Labour Commissioner, Labour Department, Government of Puducherry. Take the acknowledgement, the rejection communication if one was issued, and the full document set. Where a claim is refused on a contribution default, ask for the default period to be shown in writing from the Board's own records, because credited payments are sometimes not posted against the correct registration number.

No fee is payable to any agent, contractor or middleman for filing this claim. The Board processes applications directly from nominees, and registration and claim forms are issued free at the Labour Department office.

Frequently asked questions

How much does the Accidental Death Benefit Scheme pay in Puducherry?

The scheme pays Rs 2,25,000 to the nominee or dependants of a registered construction worker who dies in an accident, and this is separate from the Rs 2,00,000 payable through the Life Insurance Corporation cover arranged by the Board. A family can therefore receive up to Rs 4,25,000 in total where both claims succeed.

Who can claim the accidental death benefit?

Only the registered nominee or the dependants of the deceased worker can claim. The worker must have been registered as a building or other construction worker with the Puducherry Building and Other Construction Workers Welfare Board and must not have defaulted on contributions for a continuous period of more than one year.

How long does the Welfare Board take to pay the accidental death benefit?

The Board's stated timeline is disbursal within 15 days of the application, with the money credited by Direct Benefit Transfer into the nominee's bank account. Delays in practice are usually caused by a missing post-mortem report or an unclear nomination rather than by the Board.

Is the accidental death benefit paid if the worker died of illness?

No. Death from illness or natural causes is covered by the separate Natural Death Benefit Scheme of the same Board, not by the Accidental Death Benefit Scheme. The post-mortem report and police record are what decide which of the two schemes applies.

Can the claim be filed online?

No. Applications under the Accidental Death Benefit Scheme are accepted offline at the Welfare Board office of the Labour Department. There is no self-service online claim form for this benefit.

Does the worker's family lose the benefit if contributions lapsed?

A lapse of more than one continuous year in contribution payment disqualifies the claim. A shorter gap that has been cleared does not, so families should check the contribution record and pay arrears while the worker is alive rather than after a death.

Is the Rs 2,00,000 LIC amount claimed separately?

Yes, the LIC component is a separate insurance settlement processed through the insurer, while the Rs 2,25,000 is paid directly by the Welfare Board. Filing the Board claim does not automatically settle the LIC claim, so both routes must be pursued.
