Free Legal Aid under the Legal Services Authority Act 1987
Uttarakhand state government scheme
Free Legal Aid under the Legal Services Authority Act 1987 gives Uttarakhand residents a free lawyer, free court fees and free case papers. All women, children, SC/ST citizens, senior citizens, transgender persons and anyone with annual income under Rs 3,00,000 qualify. Apply at any District Legal Services Authority front office or on the NALSA portal, or call 15100.
What is free legal aid under the Legal Services Authorities Act, 1987?
Free Legal Aid under the Legal Services Authority Act 1987 is a statutory entitlement implemented in the state by the Uttarakhand State Legal Services Authority (UKSLSA), Nainital, which functions under the Department of Law, Government of Uttarakhand. The scheme provides a free lawyer and free case-related costs to every eligible person in Uttarakhand who intends to file a case, has already filed one, or has to defend one.
The legal basis is Section 12 of the Legal Services Authorities Act, 1987, read with Section 16 of the Uttaranchal State Legal Services Authority Rules, 2006. Because it is a statutory right and not a discretionary grant, an eligible applicant does not have to persuade anyone of merit at the entry stage, falling into a listed category is enough to be entitled to services.
According to the UKSLSA portal, free legal services are delivered through a four-tier structure:
- Uttarakhand State Legal Services Authority (UKSLSA) at the ADR Centre, High Court Compound, Nainital.
- High Court Legal Services Committee at the Uttarakhand High Court, Nainital, with an E-Seva Kendra at Gate No. 7.
- District Legal Services Authorities (DLSA) in all 13 districts: Almora, Bageshwar, Chamoli, Champawat, Dehradun, Haridwar, Nainital, Pauri Garhwal, Pithoragarh, Rudraprayag, Tehri Garhwal, Udham Singh Nagar and Uttarkashi.
- Tehsil (Taluk) Legal Services Committees at tehsil level.
Who is eligible for free legal aid in Uttarakhand?
You can get free legal aid if you are a resident of Uttarakhand and fall in any of these categories, with no income test at all:
- A member of a Scheduled Caste or Scheduled Tribe.
- A victim of trafficking in human beings or begar, as referred to in Article 23 of the Constitution.
- A woman or a child.
- A mentally ill or otherwise disabled person.
- A person in circumstances of undeserved want. A victim of mass disaster, ethnic violence, caste atrocity, flood, drought, earthquake or industrial disaster.
- An industrial workman.
- A person in custody; including a protective home under the Immoral Traffic (Prevention) Act, 1956, a juvenile home under the Juvenile Justice Act, or a psychiatric hospital or nursing home under the Mental Health Act.
- An ex-serviceman.
- A person from the transgender community.
- A senior citizen.
- A person infected with HIV/AIDS.
Everyone else can apply on the income route: annual income from all sources less than Rs 3,00,000, or such higher amount as the State Government may prescribe, where the case is before a court other than the Supreme Court.
Who is not eligible: a person outside all eleven categories whose annual income from all sources exceeds Rs 3,00,000 cannot apply on income grounds alone. A person who conceals income or files a false certificate is liable to have the aid withdrawn under the Act, and legal aid can also be withdrawn where the beneficiary obtained it by misrepresentation or does not cooperate with the assigned advocate.
What does free legal aid include?
According to the UKSLSA portal, free legal services in civil and criminal matters include:
- Representation by an advocate in legal proceedings before any court, tribunal or authority.
- Payment of process fees, witness expenses and all other charges payable in connection with the proceeding.
- Preparation of pleadings, memo of appeal and paper book, including printing and translation of documents.
- Drafting of legal documents, including special leave petitions.
- Supply of certified copies of judgments, orders and notes of evidence.
- Aid and advice to access benefits under central and state welfare statutes and schemes.
Section 2(c) of the Act defines legal services broadly β any service in the conduct of a case or legal proceeding before any court, authority or tribunal, and the giving of advice on any legal matter. Legal aid is not confined to subordinate courts: legal aid counsel appear before district courts, the Uttarakhand High Court and the Supreme Court of India.
What documents are required for free legal aid?
| Document | Mandatory | Notes |
|---|---|---|
| Aadhaar card | Yes | Identity proof |
| Mobile number | Yes | For acknowledgement and updates |
| Caste certificate | Only for SC/ST claim | Establishes category eligibility |
| Disability certificate | Only for disability claim | Issued by State Government or District Administration |
| Income or BPL certificate | Only for the income route | Annual income Rs 3,00,000 or less |
| Case papers | If a case exists | FIR, summons, notice, or earlier orders |
An applicant in a listed category does not need an income certificate at all. This is the single most misunderstood point at DLSA counters.
How to apply for free legal aid in Uttarakhand
- Decide which office covers your case. Use the District Legal Services Authority for district court matters, the Tehsil Legal Services Committee for tehsil-level matters, and the High Court Legal Services Committee, Nainital for High Court matters.
- Apply online on the NALSA Legal Services Management System at nalsa.gov.in/lsams/nologin/applicationFiling.action, which accepts applications for Uttarakhand without any login.
- Or apply offline at the front office of your District Legal Services Authority, or at the E-Seva Kendra inside the Uttarakhand High Court premises at Gate No. 7, Nainital. The offline form can be downloaded from the UKSLSA website.
- Attach your category proof; caste certificate, disability certificate, or income/BPL certificate: along with Aadhaar and any existing case papers.
- Call the helpline if you cannot travel. Dial 15100 or the toll-free number 1800-180-4000 operated at the State Authority front office, or the High Court Legal Services Committee on +91-9412979696.
- Ask a Para Legal Volunteer for help. Volunteers are deployed across urban and rural Uttarakhand; their names and mobile numbers are listed on the UKSLSA website, and they assist senior citizens, women and children who cannot fill the form themselves.
- Collect the acknowledgement and note the application number, then wait for the panel advocate to be assigned by the Secretary of the authority.
How to check the status of a legal aid application
- Contact the front office of the District Legal Services Authority where the application was filed, quoting the application number.
- For applications filed online, follow up through the same NALSA LSAMS route, which records the application against your mobile number.
- Ask specifically which panel advocate has been assigned and get the advocate's contact, this is the practical outcome you are waiting for.
- If nothing moves, escalate in writing to the Secretary, District Legal Services Authority, and then to the Member Secretary, UKSLSA, ADR Centre, High Court Compound, Nainital.
Why legal aid applications get refused or withdrawn
- Income above Rs 3,00,000 with no listed category to fall back on.
- Missing category proof, for example an SC/ST claim without a caste certificate.
- Misrepresentation of facts when obtaining aid, which allows the authority to withdraw the services.
- Non-cooperation with the assigned advocate, including repeated failure to appear or to supply documents.
- Wrong forum. A High Court matter filed at a tehsil committee, which simply delays assignment until it is transferred.
Refusal is not the end of the road: the applicant may make a fresh application with the missing proof, or approach the Secretary of the authority in writing.
Related services you can ask for at the same counter
The same authorities that run legal aid also operate Lok Adalats and Permanent Lok Adalats for amicable settlement of pending and pre-litigation disputes, mediation services, victim compensation schemes, and legal aid clinics and legal literacy clubs across the districts. UKSLSA also runs an Internal Complaints Committee and publishes notifications, forms and statistical information on its portal. If your problem can be settled rather than litigated, ask the front office about the next National Lok Adalat date before filing.

Who gets free legal aid in Uttarakhand?
Every woman, every child, every Scheduled Caste and Scheduled Tribe citizen, every person with a disability or mental illness, senior citizens, transgender persons, industrial workmen, ex-servicemen, persons in custody, disaster and caste-atrocity victims, HIV/AIDS-infected persons and trafficking victims get free legal aid in Uttarakhand with no income limit at all. Is there an income limit for free legal aid in Uttarakhand?
The income limit is Rs 3,00,000 a year from all sources, and it applies only to applicants who do not fall into any of the eleven listed categories. The Uttarakhand State Legal Services Authority states plainly that there is no income limit for the persons listed at serial numbers 1 to 11 of the entitlement list.
What is the free legal aid helpline number for Uttarakhand?
Call 15100, the NALSA legal aid helpline, or the toll-free number 1800-180-4000 operated at the front office of the Uttarakhand State Legal Services Authority. The State Authority office in Nainital can also be reached on 05942-236762, and the High Court Legal Services Committee on +91-9412979696.

The beneficiary pays nothing for any of it.
Is free legal aid only for lower courts?

Para Legal Volunteers deployed across urban and rural Uttarakhand will help senior citizens, women and children who cannot reach an office or fill the online form. The list of volunteers with names and mobile numbers is published on the Uttarakhand State Legal Services Authority website.
Does free legal aid cost anything?
Nothing. The Legal Services Authority pays the advocate and all case-related charges. No advocate on the legal aid panel may take a fee from a legal aid beneficiary, and any demand for money should be reported to the District Legal Services Authority secretary.
