Property Registration (Sale Deed) in Andaman and Nicobar Islands

Andaman and Nicobar Islands state government scheme

Quick answer

Property Registration in the Andaman and Nicobar Islands runs on the National Generic Document Registration System at onlineregistrationani.gov.in. A buyer enters the sale deed online, the portal values the property and computes the stamp duty, the fee is paid online and an appointment is booked at the Sub-Registrar office, where both parties and two witnesses appear in person.

Benefit
A registered sale deed that transfers legal title to land or a building in the Andaman and Nicobar Islands and is entered permanently in the Sub-Registrar's register
How to apply
Both — online deed entry, valuation, payment and appointment on onlineregistrationani.gov.in, followed by appearance before the Sub-Registrar

Property Registration in the Andaman and Nicobar Islands is the process by which a sale deed for land or a building is presented to a Sub-Registrar, admitted by the parties and entered in the register maintained under the Registration Act 1908. Section 17 of that Act makes registration compulsory for the sale of any immovable property worth more than Rs 100, and Section 49 states that an unregistered instrument cannot be received as evidence of the transfer. In an island territory where a large share of land is government, forest or tribal reserve, and where clean private title is scarce, the registered deed is the only thing that stands up when ownership is later questioned.

Which office registers property in the Andaman and Nicobar Islands?

Registration is carried out by the Sub-Registrar offices of the Andaman and Nicobar Administration, which sit within the district revenue administration under the Deputy Commissioners. The Union Territory runs its registration work on the National Generic Document Registration System, the Department of Land Resources' "One Nation One Registration Software" under the Digital India Land Records Modernisation Programme, at onlineregistrationani.gov.in.

The Department of Land Resources names Andaman and Nicobar in the group of eighteen states and Union Territories where NGDRS has been fully implemented, alongside Ladakh, Jammu and Kashmir, Goa, Maharashtra, Punjab, Delhi and others. NGDRS gives citizens, in the department's own words, online entry of the deed, online payment, online appointment, online admission, document search and certified copy generation. It also carries a property valuation module that computes stamp duty automatically from the property details, and it requires a prior appointment before a visit to the registration office.

Who can and cannot register a sale deed in the Islands?

Any person competent to contract under the Indian Contract Act 1872 can be a party to a sale deed for property in the Andaman and Nicobar Islands, and both the buyer and the seller; or their attorneys under a registered power of attorney; must take part in the registration.

You cannot register a sale deed where the seller has no registrable title, where an executant is a minor or of unsound mind, where the property stands attached by a court or a revenue authority, or where the stamp duty paid is deficient; the Sub-Registrar may refuse the document under Section 71 of the Registration Act and must record the reasons for the refusal.

Beyond those general bars, the Islands impose restrictions that do not exist in most of India. Substantial areas are notified tribal reserve, particularly in the Nicobar group and parts of the Andamans, and land in a tribal reserve cannot be transferred to an outsider. Forest land and land held on lease or licence from the Administration cannot be sold as freehold. Government land in the possession of an occupant is not the occupant's to sell. Anyone contemplating a purchase in the Islands should therefore establish the legal character of the land at the Deputy Commissioner's office before a deed is drafted and before any advance changes hands, this, not the registration mechanics, is where island property transactions most often fail.

Timing applies to everyone. Section 23 of the Registration Act 1908 gives four months from the date of execution to present the document. Section 25 permits a further four months if the delay is condoned and a penalty of up to ten times the registration fee is paid. After eight months the deed cannot be registered and must be executed afresh.

How to apply for property registration in the Andaman and Nicobar Islands

  1. Establish the character of the land and the seller's title — obtain the revenue record extract at the tehsil, the earlier title or allotment documents, and written confirmation from the Deputy Commissioner's office if the land is anywhere near a tribal reserve, forest or government holding.
  2. Create a citizen account on onlineregistrationani.gov.in and read the documentation published on the portal before you start the deed entry.
  3. Complete the online deed entry in NGDRS. The parties, the property description by survey number and area, the consideration, and the boundaries, and let the valuation module compute the stamp duty and registration fee payable.
  4. Pay the stamp duty and registration fee online through the payment option in NGDRS, and keep the e-stamp certificate or challan reference for the appointment.
  5. Book an appointment at the Sub-Registrar office having jurisdiction over the property, choosing a working day.
  6. Attend on the appointed day with the buyer, the seller and two witnesses, carrying original title and link documents, Aadhaar and PAN, and the payment proof.
  7. Complete admission of execution before the Sub-Registrar, who verifies identity, checks the duty against the valuation, endorses the deed and registers it.
  8. Collect the registered document, and generate a certified copy through the portal's document search and certified-copy facility for your own records and for any bank loan.

How do I check the status of my registration?

Sign in to your citizen account on onlineregistrationani.gov.in; NGDRS instances carry an appointment view for the pre-registration stage and a document search facility afterwards, so a deed that appears in the search with a registration number and date is on the public register. After registration, apply at the tehsil for mutation of the revenue record into the buyer's name. Registration and mutation are separate: a buyer who registers the deed but never applies for mutation will keep finding the seller's name in the land record and in demands for land revenue.

Why do sale deeds get delayed or rejected in the Islands?

The land itself is the leading cause. Deeds are refused or later challenged because the land turns out to be tribal reserve, forest, or government land held on lease rather than freehold, or because the seller is a long-standing occupant without registrable title. After that come the ordinary reasons: stamp duty paid on a consideration below the valuation, a survey number or area in the deed that does not match the revenue record, an undisclosed mortgage or attachment, an unregistered power of attorney used to execute the deed, absence of a party or of the two witnesses on the appointment date, and name spellings on Aadhaar or PAN that differ from those written into the deed. A deed presented more than four months after execution needs the Section 25 condonation and penalty.

Is the process free, and where do I complain?

Registration is not free; stamp duty and the registration fee are statutory charges assessed on the property, but nothing beyond the amount NGDRS computes for your transaction is payable, and it should be paid through the portal's own online payment route, never in cash to a facilitator standing outside the office. NGDRS was built so that a citizen can do the deed entry, the payment and the appointment booking directly, and anyone offering to "arrange the registry" for a bundled fee is charging you for steps you can do yourself. If the portal fails, use the help, feedback and contact links published on onlineregistrationani.gov.in; NGDRS instances are supported by the National Informatics Centre service desk. For a refusal to register, an unexplained delay, or a demand for money outside the assessed duty and fee, put the complaint in writing to the Sub-Registrar and then to the Deputy Commissioner of the district.

Who is eligible

You can register a sale deed on onlineregistrationani.gov.in if:

  • You are the buyer, the seller, or a duly appointed attorney under a registered power of attorney, and you are competent to contract under the Indian Contract Act, 1872 (of sound mind and not a minor).
  • The property is situated within the Andaman and Nicobar Islands and the seller holds registrable title to it, meaning freehold land, a regular allotment, or property already carrying a clear chain of earlier registered deeds.
  • You can produce two witnesses who are willing to appear in person at the Sub-Registrar office on the appointment date.
  • You are presenting the document within four months of its execution date, as required under Section 23 of the Registration Act, 1908.
  • The consideration stated in the deed matches, or exceeds, the value the NGDRS valuation module computes for the property, so the stamp duty paid is not deficient.

You cannot register the deed, or the Sub-Registrar can lawfully refuse it under Section 71, if:

  • The land falls inside a notified tribal reserve, chiefly in the Nicobar group and parts of the Andamans, and the seller is not entitled to transfer it to an outsider.
  • The land is forest land, or is held on lease or licence from the Andaman and Nicobar Administration rather than as freehold, since such holdings cannot be sold as private property.
  • The seller is a long-standing occupant of government land without a registrable title of their own, however long the occupation.
  • The property stands attached by a court order or by a revenue authority at the time of presentation.
  • More than eight months have passed since execution, counting the initial four months under Section 23 plus the four-month condonation window under Section 25, after which the deed must be executed afresh rather than registered.
  • Any executant is a minor, is of unsound mind, or is acting under a power of attorney that is itself unregistered.

Because the largest share of registration failures in the Islands traces back to the character of the land rather than to paperwork, confirm the land's status (freehold, tribal reserve, forest, or government lease) at the Deputy Commissioner's office before a deed is drafted or any advance is paid, not after.

Documents required

Draft sale deed
Entered as an online deed entry in NGDRS before the appointment, so the recitals, the parties and the property description are checked in advance rather than at the counter.
Proof of stamp duty payment
NGDRS supports online payment of stamp duty and registration fee. Carry the e-stamp certificate or challan to the appointment.
Title and link documents of the seller
The earlier sale deed, allotment or lease document from the Administration, or the inheritance record showing how the seller came to hold the property.
Land records extract and possession record
Survey number, khasra and area from the revenue record of the tehsil, which must match the description in the deed.
Aadhaar and PAN of buyer and seller
NGDRS provides for online admission and identity verification of the parties, so photo identity of both sides is required.
Two witnesses with photo identity
Witnesses attest execution before the Sub-Registrar and must attend on the appointment date.
Clearance where the land is tribal, forest or reservedoptional
Transfer of land in tribal reserve areas of the Andaman and Nicobar Islands is restricted, and the Deputy Commissioner's office must be consulted before any such deed is drafted.
No-dues and encumbrance proofoptional
Proof that no mortgage, bank charge or attachment stands against the property. NGDRS carries a document search facility that helps establish this.

Frequently asked questions

Which portal is used for property registration in the Andaman and Nicobar Islands?

The Islands use the National Generic Document Registration System at onlineregistrationani.gov.in. The Department of Land Resources lists Andaman and Nicobar among the eighteen states and Union Territories where NGDRS has been fully implemented, not merely among those that share data.

Can property registration in the Andaman and Nicobar Islands be done fully online?

No. NGDRS covers the deed entry, valuation, payment and appointment booking online, but the buyer, the seller and two witnesses must appear before the Sub-Registrar for admission of execution.

What is the stamp duty on a sale deed in the Andaman and Nicobar Islands?

Stamp duty is charged under the Indian Stamp Act 1899 as it applies to the Union Territory, and the amount for a specific transaction is computed by the NGDRS valuation module from the property details entered. The Administration has not published a consolidated public rate card online, so take the figure from the portal or from the Sub-Registrar office rather than from a private property website.

Can an outsider buy land in the Andaman and Nicobar Islands?

Not freely. Large parts of the Islands are tribal reserve, forest or government land where transfer is restricted or barred, and a transaction in such an area cannot be registered. Check with the Deputy Commissioner's office before paying any advance.

How long do I have to register a sale deed after signing it?

Four months from execution under Section 23 of the Registration Act 1908, with a further four months possible under Section 25 on payment of a penalty of up to ten times the registration fee. After eight months the deed cannot be registered at all.

What happens at the Sub-Registrar office on the appointment day?

The Sub-Registrar verifies the identity of the parties, records their admission of execution, checks the stamp duty paid against the valuation, and then endorses and registers the document. Witnesses attest the execution at the same sitting.

Do I need to do anything after the deed is registered?

Yes — apply for mutation of the revenue record at the tehsil so that the land record shows the buyer's name. Registration proves the transfer; mutation updates the record of rights, and the two are separate steps.
