Trade Licence in Bihar
Bihar state government scheme
Trade Licence in Bihar is granted by the Nagar Nigam, Nagar Parishad or Nagar Panchayat in whose limits your shop stands, under the Bihar Municipal Act, 2007, and the Urban Development and Housing Department administers those bodies. The licence is an annual permission renewed each year, and the fee comes from your own municipality's schedule rather than from a single statewide rate.
What is a trade licence in Bihar?
A trade licence in Bihar is the written permission of an urban local body to carry on a stated trade at a stated premises inside its limits. Bihar's Nagar Nigams, Patna, Gaya, Bhagalpur, Muzaffarpur, Darbhanga, Munger, Purnia and others: along with its Nagar Parishads and Nagar Panchayats, grant the licence each for its own area. The Urban Development and Housing Department, Government of Bihar, is the state department that administers the entire urban local body tier.
The governing statute is the Bihar Municipal Act, 2007, the single law that covers municipal corporations, municipal councils and nagar panchayats in Bihar. The Act helps a municipality to require a licence before specified trades are carried on in its area, to impose conditions on how the trade is run, and to charge a licence fee that the municipality itself fixes. It also gives the municipality inspection and penalty powers against a business running without the licence it should hold.
A trade licence is not a business registration and does not replace one. It sits alongside GST registration, registration under the Bihar Shops and Establishments Act, 1953 with the labour department, FSSAI registration for any food business, and Udyam registration for MSME identity. The trade licence is the document that certifies your premises may lawfully host that trade inside that municipal area.
Who can and cannot apply for a Bihar trade licence?
Any person aged 18 or above who runs, or intends to run, a trade or business from a fixed premises inside a Bihar urban local body may apply. Sole proprietors, partnership firms, LLPs, private limited companies, societies and trusts are all valid applicants, provided they lawfully occupy the premises named in the form.
You cannot apply, or will not be granted a licence, where:
- You hold no lawful right over the premises, no deed or holding record, no valid rent or lease agreement, and no owner's consent.
- The holding is in arrear of municipal holding tax. Bihar licence branches routinely check the property's tax position first.
- The premises fall outside every Nagar Nigam, Nagar Parishad and Nagar Panchayat limit, in which case the gram panchayat and not the municipality is the local authority and a municipal trade licence is not the right document.
- The building's permitted use does not allow that trade at that address.
- The trade is regulated and you lack the prior statutory approval: FSSAI registration or licence for a food business, a drug licence for a chemist, a fire NOC for a larger or hazardous premises, or Bihar State Pollution Control Board consent for a polluting process.
- The activity is mobile street vending, which is dealt with under separate street-vendor provisions rather than as a fixed-premises trade licence.
How to apply for a trade licence in Bihar
- Identify the urban local body covering the shop address. Find the Nagar Nigam, Nagar Parishad or Nagar Panchayat for your locality from the Urban Development and Housing Department's listing of Bihar urban local bodies. A file lodged with a body that has no jurisdiction over the address cannot be decided and has to be filed again.
- Check whether that body takes the application online. Bihar has not put a single statewide trade licence form on one portal. Larger Nagar Nigams run their own citizen-service modules for municipal services; smaller Parishads and Panchayats still take the form at the licence or tax branch counter. Confirm on your municipality's own website or by asking at the branch.
- Clear the holding tax first. Pay any outstanding municipal holding tax on the premises and keep the receipt. An unpaid holding is the commonest reason a Bihar licence file stalls before it is even examined.
- Fill the application form completely. Enter the trade name, the exact nature of the trade, the constitution of the business, the full premises address with the holding number, the floor area used for the trade, the number of workers, and the proprietor's or partners' details exactly as they appear on the identity proof.
- Attach or upload the documents. Identity proof, premises proof, the latest holding tax receipt, the owner's NOC where the shop is rented, constitution documents for a firm or company, photographs, and any sector approval the trade needs.
- Pay the fee your municipality demands and keep the receipt. The amount comes from that body's own schedule, usually by trade category and area. Pay at the official cash counter or through the official online payment screen, never as cash to an individual, and always against a receipt.
- Note the acknowledgement number and follow the file. Use it to chase progress, answer any objection from the licence branch, and finally collect or download the licence. Check the trade description, the address and the validity period printed on it before you accept it.
How do I apply offline at the municipal office in Bihar?
The counter route is fully alive and remains the normal one outside the big corporations.
- Go to the licence branch — often the tax branch, of the Nagar Nigam, Nagar Parishad or Nagar Panchayat in whose area the shop stands.
- Collect the trade licence application form and fill it in full.
- Attach self-attested copies of identity proof, premises proof, the latest holding tax receipt, the owner's NOC where the shop is rented, and any trade-specific approval.
- Submit at the counter and insist on a dated, stamped acknowledgement with a diary or application number on it.
- Pay the fee at the cash counter and keep the printed receipt.
- Be present at the premises when the sanitary inspector or licence inspector comes to verify the trade and the area you declared.
- Collect the licence from the same branch once it is granted.
A Common Service Centre or Vasudha Kendra operator can help you fill and file the form. Any charge the centre makes for that help is its own service charge, and is separate from and additional to the municipal fee, ask what it is beforehand and insist on a receipt.
How do I check my trade licence application status in Bihar?
Take the acknowledgement number back to the licence branch that received the file, or use the tracking screen on your municipality's own portal where one exists. Ask specifically whether an objection has been raised, because an unanswered objection is the single commonest reason a file sits still. If the branch gives no answer, put the query in writing to the Municipal Commissioner or Executive Officer, quoting the acknowledgement number and date.
Renewal, validity and changes
A Bihar trade licence is an annual permission tied to the financial year. Renew it before it expires rather than after: municipalities levy late fees on delayed renewals, and running a licensable trade on an expired licence exposes you to penalty and closure proceedings under the Bihar Municipal Act, 2007.
Apply to amend the licence, rather than waiting for the next renewal, whenever a material detail changes, the trade actually carried on, the floor area used, the constitution of the firm, or the ownership of the business. Moving the shop to a new address needs a fresh application, because the licence attaches to one premises.
Why Bihar trade licence applications get rejected
- Holding tax arrear on the premises.
- Wrong urban local body, or an address that in fact falls under a gram panchayat.
- Address mismatch between the deed or rent agreement and the address typed into the form.
- Expired rent agreement, or no owner's NOC for commercial use.
- Missing sector approval: no FSSAI registration for a food business, no drug licence for a chemist, no pollution board consent for a polluting process.
- Trade not permitted by the building's sanctioned use.
- Illegible documents, especially holding tax receipts where the holding number cannot be read.
- Objection left unanswered, after which the licence branch closes the file.
Grievance route, and a warning about agents
Raise a stalled or wrongly rejected file first with the Municipal Commissioner of the Nagar Nigam, or the Executive Officer of the Nagar Parishad or Nagar Panchayat, in writing and quoting the acknowledgement number. If that produces nothing, escalate to the Urban Development and Housing Department, Government of Bihar, which is the administrative department for every urban local body in the state, and keep a copy of the escalation letter.
Pay only the fee your municipality officially demands, at the official counter or through its official payment screen, and take a receipt every single time. No agent or "licence consultant" can make a municipal file move faster than it moves, and nobody in the licence branch is entitled to cash on the side for granting a licence. File the application yourself, keep copies of everything you submit, and complain immediately if somebody asks you for money that no receipt will cover.

Frequently asked questions
Who issues a trade licence in Bihar?
The urban local body covering the premises issues it — a Nagar Nigam such as Patna, Gaya, Bhagalpur, Muzaffarpur or Darbhanga, or the Nagar Parishad or Nagar Panchayat of a smaller town. The Urban Development and Housing Department, Government of Bihar, is the state department that administers all of them.
Which law requires a trade licence in Bihar?
The Bihar Municipal Act, 2007 is the governing statute, and it empowers every Bihar municipality to require a licence before specified trades are carried on in its area, to attach conditions to that licence, and to charge a fee fixed by the municipality itself.
Can I apply for a Bihar trade licence online?
It depends on your municipality, because Bihar has not placed one statewide trade licence form on a single portal. The larger Nagar Nigams run their own online modules for municipal services, while many Nagar Parishads and Nagar Panchayats still take the application at the counter, so check your own body's website or licence branch first.
How much does a trade licence cost in Bihar?
The fee is fixed by each Nagar Nigam, Parishad or Panchayat from its own schedule, usually by trade category and the floor area used, so there is no single statewide figure. Pay only the amount on the official demand or portal payment screen, and take a receipt each time.
How long is a Bihar trade licence valid?
A Bihar trade licence is an annual permission tied to the financial year and must be renewed rather than left to lapse. Renew before expiry, because municipalities charge late fees on delayed renewals and an expired licence offers no protection during an inspection.
Is a trade licence the same as a shop and establishment registration?
No — a trade licence is municipal permission to carry on a trade at a premises, while shop and establishment registration under the Bihar Shops and Establishments Act, 1953 is a labour department registration about working hours and employment conditions. Most Bihar shops need both, plus GST registration once turnover crosses the GST threshold.
Do I need a separate trade licence for each shop in Bihar?
Yes — a Bihar trade licence attaches to one premises and one trade, so a second branch at a different address needs its own application even when the owner and the trade are the same. Shifting the shop to a new address also needs a fresh application rather than a change on the old licence.
What should I do if my Bihar trade licence file does not move?
Write to the Municipal Commissioner of the Nagar Nigam, or the Executive Officer of the Nagar Parishad or Nagar Panchayat, quoting the acknowledgement number and the date of filing. If the file still does not move, escalate to the Urban Development and Housing Department, which is the administrative department for all Bihar urban local bodies.
