Encumbrance Certificate in Chandigarh (Sub-Registrar Search and Nakal)

Chandigarh state government scheme

Quick answer

An Encumbrance Certificate in Chandigarh is obtained from the Sub-Registrar Office at Room No. 1 and 2, 30 Bays Building, Sector 17, which registers documents under the Indian Registration Act, 1908 and issues certified copies, known locally as nakal. Chandigarh does not run a Form 15 or Form 16 EC service, so a title search here is built from the register search and certified copies of registered deeds.

Benefit
A certified record from the Chandigarh Sub-Registrar of the documents registered against a property in a chosen period, used by banks, buyers and advocates to check for mortgages and charges
How to apply
Offline at the Sub-Registrar Office, Sector 17, with certified copies and property information also listed among Chandigarh District Administration online services

What is an encumbrance certificate in Chandigarh?

An encumbrance certificate in Chandigarh is a record of what has been registered against a property over a period you choose. An encumbrance is a registered claim that limits the owner's freedom to sell clean, a bank mortgage, a court attachment, a registered lease, a gift, a partition, a release or an earlier sale.

Chandigarh handles this differently from the southern states, and the difference catches out buyers who have read a generic all-India article. Chandigarh does not issue a numbered "Form 15" or "Form 16" encumbrance certificate. As a small single-district Union Territory, Chandigarh runs one registration office, and the same information is obtained here in two ways:

  • A search of the Sub-Registrar's register for the property over the period asked for.
  • Certified copies of the registered documents the search turns up. In Chandigarh and the surrounding region these are called nakal, and "Nakal" is listed by the District Administration among its citizen services alongside "Certified copies of Record".

Put together, a listing of the registered entries against one property over 13 or 30 years, with certified copies of the deeds behind them, is exactly what an encumbrance certificate is elsewhere.

Which office issues it in Chandigarh?

The Sub-Registrar Office, Chandigarh Administration, at Room No. 1 and 2, 30 Bays Building, Sector 17, Chandigarh (UT). According to the Chandigarh District Administration, this is the sub-registrar office listed for the Union Territory, and the district's citizen services include "Registration of documents / instruments under the Indian Registration Act, 1908".

On the online side, the District Administration lists property-related service categories including "Know Your Property Online", "Nakal", "Certified copies of Record" and e-District services. What Chandigarh does not publish is a self-service online encumbrance certificate of the kind Puducherry or Tamil Nadu run. The Department of Land Resources records Chandigarh as having started sharing registration data with the national portal through a user interface or API, rather than as a full National Generic Document Registration System implementation, which is consistent with the counter-led process on the ground.

Who can apply for a register search in Chandigarh?

You can apply if:

  • You are the owner of the flat, plot, booth, SCO or agricultural land.
  • You are a prospective buyer doing due diligence before paying earnest money.
  • You are a bank or housing finance company appraising a loan against the property.
  • You are an advocate or deed writer acting in the transaction.
  • You are a legal heir working out what a deceased relative owned and what charges sit on it.
  • You are any member of the public. The register of registered documents is a public record under the Registration Act, 1908, and Chandigarh does not require the owner's consent or a stated reason.

You cannot apply if. The limits are about the property, not the person:

  • You cannot search without a property identifier. For urban property that means the house or plot number with the sector; for land in the UT's peripheral villages it means the khasra or khewat number with the village.
  • You cannot see unregistered dealings. Chandigarh has a long history of transfers on general power of attorney, agreement to sell and will. The "GPA sale", and none of that appears in the register because none of it was registered as a conveyance.
  • You cannot see Estate Office matters in the register. Allotment status, ground rent arrears, misuse and building violation notices, and resumption proceedings are Estate Office records, not registration records.
  • You cannot rely on the search for leasehold conditions attached to Chandigarh allotments.

What details and documents are required?

Requirement Mandatory Notes
House / plot number and sector Yes The standard Chandigarh urban identifier
Khasra or khewat number and village For village land Behlana, Daria, Dhanas, Hallomajra, Kaimbwala, Khuda Alisher, Maloya, Manimajra, Palsora, Raipur Kalan, Sarangpur
Search period (from year, to year) Yes 13 years for lenders, 30 years for buyers
Applicant photo ID Yes Aadhaar, voter ID or equivalent
Sale or conveyance deed copy Helpful Carries the exact identifiers and earlier document number
Written application Yes Submitted at the Sector 17 counter

How to get an encumbrance search in Chandigarh

  1. Fix the property identification first. Write down the house or plot number with the sector, or the khasra and khewat number with the village name for land outside the sector grid. Take it from the conveyance deed or allotment letter, not from memory.
  2. Decide the period. Ask your bank what it needs. Thirteen years is the common lender requirement; thirty years is what a careful buyer's advocate asks for.
  3. Go to the Sub-Registrar Office at Room No. 1 and 2, 30 Bays Building, Sector 17, Chandigarh, and collect the application form for a search and certified copies at the counter.
  4. Submit the written application, describing the property and stating the exact period, with your photo ID. The counter may require the application on an affixed non-judicial stamp — confirm the current requirement before you write it out.
  5. Pay the fee at the counter and take the printed receipt. The application number on the receipt is what every later enquiry runs on.
  6. Ask for certified copies (nakal) of any registered document the search turns up, especially any mortgage that has no later cancellation or release entry.
  7. Collect the search result and the certified copies on the date given.
  8. Run the parallel checks before you pay anything to the seller, the Estate Office position on the property, and the online property information listed under the District Administration's "Know Your Property Online" service.

How do I check the status of my application?

  • In person: at the Sub-Registrar counter, 30 Bays Building, Sector 17, with your receipt.
  • Online: through the Chandigarh District Administration services pages at chandigarhdistrict.nic.in, which list the e-District and property service categories.
  • Escalation: the Sub-Registrar first, then the Deputy Commissioner's Office, Chandigarh, which runs the citizen charter covering registration of documents and certified copies of record.

How long is the search valid?

An encumbrance search in Chandigarh has no expiry date, but it is only true up to the last date it covers. A mortgage registered the day after your search period ends will not be in it.

Chandigarh lenders and buyers' advocates therefore ask for a freshly run search, usually dated within days of the transaction, and many run a second short search immediately before the sale deed is registered to catch anything filed in the gap. There is no renewal, you simply run the search again for the new period, which costs far less than repeating the full thirty years.

Why do property searches go wrong in Chandigarh?

  • Wrong sector or plot number. Chandigarh sector numbering is dense and a single wrong digit returns another property. A clean result on the wrong plot is the most dangerous outcome there is.
  • Searching the urban register for village land, or the reverse, when the property sits in one of the UT's peripheral villages.
  • Search period too short to catch a live older mortgage.
  • Assuming the register covers GPA transactions. Unregistered power-of-attorney transfers are common in the region and leave no register entry at all.
  • Ignoring the Estate Office. Ground rent arrears, misuse notices, need-based change violations and resumption proceedings sit outside the register entirely and can be far more expensive than an old mortgage.
  • Ignoring an uncancelled mortgage. A loan repaid in real life but never released in the register still stands as a live charge and must be cleared before sale.
  • Skipping the share and society checks for a flat in a co-operative house building society, where the society's own records matter alongside the deed.

What should you pay, and what should you refuse?

Apply directly at the Sub-Registrar counter in Sector 17, or through the Chandigarh District Administration's own online services, and pay only the amount the counter receipts or a government payment screen displays. Chandigarh Administration does not publish a single flat encumbrance certificate fee, the district citizen charter prices certified copies of record by the number of pages, which makes the rule simpler, not looser: if it is not on a printed government receipt, do not pay it.

Deed writers and agents outside 30 Bays Building offer to "get the search done fast" for a few thousand rupees. They are filing the same application at the same counter. There is no paid priority queue at the Sub-Registrar Office, and no officer can add or remove an entry in the register on request. Never hand over your original conveyance deed or allotment letter to an agent, and never share your Aadhaar OTP.

Frequently asked questions

Does Chandigarh issue an encumbrance certificate in Form 15 or Form 16?

No, Chandigarh does not run the Form 15 and Form 16 encumbrance certificate formats used in Tamil Nadu and Andhra Pradesh. The equivalent information in Chandigarh comes from a search of the Sub-Registrar's register and from certified copies, called nakal, of the registered documents found.

Where is the Sub-Registrar Office in Chandigarh?

The Sub-Registrar Office is at Room No. 1 and 2, 30 Bays Building, Sector 17, Chandigarh (UT), under the Chandigarh Administration. All registration of documents under the Indian Registration Act, 1908 for the Union Territory is done there.

Is there an online encumbrance search for Chandigarh?

Chandigarh District Administration lists property-related online services including "Know Your Property Online", "Nakal" for certified copies, and "Certified copies of Record", but the UT does not publish a standalone online encumbrance certificate service. The Department of Land Resources records Chandigarh as sharing registration data with the national portal through a user interface or API rather than as a full NGDRS implementation.

What does a search and certified copy cost in Chandigarh?

Chandigarh Administration does not publish a single EC fee on its public service pages, so pay only the amount receipted at the Sub-Registrar counter or shown on a government online payment screen. Certified copies at village level are charged by the number of pages under the district citizen charter.

Do I need the owner's permission to search the register?

No, registered documents are a public record under the Registration Act, 1908, and Chandigarh does not require the owner's consent, a power of attorney or a stated reason for a register search. You need the property identification and the period.

Does a clean search mean the Chandigarh property is safe to buy?

No, a nil search only says nothing was registered against the property in the period checked. Most Chandigarh residential property originates in an Estate Office allotment or a Housing Board allotment, so a buyer also needs the allotment and conveyance position, the no-dues status and any building violation notices, none of which appear in a register search.

How far back should the search go?

Banks lending against Chandigarh property commonly ask for 13 years and buyers' advocates for 30 years. A short 5-year search will not reveal a mortgage created eight years ago that was never released.

Whom do I approach if the certified copy is refused or delayed?

Approach the Sub-Registrar at 30 Bays Building, Sector 17 first, then the Deputy Commissioner's Office, Chandigarh, which runs the citizen charter covering registration of documents and certified copies of record. Carry the receipt with your application number.
