What is property registration in Gujarat?

Property registration in Gujarat is the recording of a sale deed by a Sub-Registrar under the Registration Act, 1908, in the register maintained by the Inspector General of Registration (IGR), Revenue Department, Government of Gujarat. Registration is what converts a signed agreement between two people into a public record of ownership that a court, a bank and the revenue authorities will accept.

Gujarat runs the process on Garvi: garvi.gujarat.gov.in, the department's web application for the automation of registration, valuation and indexing. Garvi carries e-Registration with online application and appointment scheduling, e-Stamping, property valuation against the Jantri rates, encumbrance certificates, certified Index-2 and document copies through the IORA service, and e-Mortgage.

Registration matters for a practical reason. Section 17 of the Registration Act makes registration compulsory for any transfer of immovable property worth more than Rs 100. An unregistered sale deed is inadmissible as evidence of title, so a buyer holding one has possession but no defensible ownership.

Who can and cannot register a sale deed in Gujarat?

You can register if:

  • You are the lawful owner, or a person holding a registered power of attorney from the owner, selling the property.
  • You are the buyer, above 18, an Indian citizen or an NRI or person of Indian origin buying property permitted under FEMA.
  • The property lies within the jurisdiction of the Sub-Registrar office you approach.
  • Stamp duty of 4.9 per cent on the market value has been paid in full before presentation.

You cannot register if:

  • The stamp duty is short-paid, typically because duty was computed on a price below the Jantri value. The Sub-Registrar will refuse or impound the document.
  • The seller is a minor or of unsound mind, without a guardian authorised by a court.
  • The land is agricultural and the buyer is not an agriculturist. Gujarat's tenancy law restricts the purchase of agricultural land, and this is a real bar rather than a formality; plan for non-agricultural conversion or a competent authority's permission.
  • The property is new tenure land whose transfer needs the Collector's prior permission, and that permission has not been obtained.
  • The property is under court injunction, attachment or a statutory freeze.
  • The document is presented more than four months after execution, without paying the delay penalty allowed under section 25 of the Registration Act.

Foreign nationals who are not of Indian origin cannot acquire immovable property in Gujarat without Reserve Bank of India approval.

What does it cost: stamp duty and registration fee?

Stamp duty on a conveyance of immovable property in Gujarat is 4.9 per cent of the market value, listed as Article 20(a) in the stamp duty schedule published on the Garvi portal. The same 4.9 per cent rate runs through Gujarat's related articles, long leases, conveyance on amalgamation and similar instruments are all computed at 4.9 per cent of the relevant value.

Market value means the higher of the consideration written in the deed and the Jantri value: Gujarat's Annual Statement of Rates β€” for that survey number, locality and construction type. Writing a lower price in the deed does not lower the duty; it only creates a shortfall the Sub-Registrar will catch.

The registration fee is a separate charge, calculated on the same value through the "Find Registration Fee" calculator on Garvi. Gujarat's long-standing concession is that where the property is registered in the sole name of a woman, the registration fee is waived, though the 4.9 per cent stamp duty is unchanged. Check both figures on the portal's own calculators before you buy the e-stamp, those are the numbers the Sub-Registrar will apply.

Where the sale consideration is Rs 50 lakh or more, 1 per cent TDS under section 194-IA of the Income Tax Act must be deposited in Form 26QB by the buyer. That is a central obligation, not a Gujarat one, but it is checked in practice.

How to register a sale deed in Gujarat online through Garvi

  1. Check the title and the encumbrance. Take the 7/12 and 8-A extracts for agricultural land or the property card for urban property, and pull the encumbrance certificate and the certified Index-2 of the seller's own purchase deed through the IORA service on Garvi.
  2. Value the property on Garvi. Use the property valuation / Jantri module to get the notified market value for the survey number, area and construction type, then compare it with the agreed price. Duty is on the higher figure.
  3. Calculate duty and fee. Run the "Calculate Stamp Duty" and "Find Registration Fee" tools on Garvi. For a normal sale deed the duty figure should come out at 4.9 per cent of the market value.
  4. Get the deed drafted by an advocate, with the exact survey or city survey number, area, boundaries, consideration, mode of payment and possession date.
  5. Register on Garvi as a citizen user with your mobile number and email, and log in to the citizen application section.
  6. Enter the document details online; parties, property, consideration and article of the schedule: through the e-Registration module. The data entry is what makes the counter visit short.
  7. Buy the e-stamp for the computed duty through Garvi's e-Stamping service, and pay the registration fee online. Print both.
  8. Deposit TDS in Form 26QB if the consideration is Rs 50 lakh or more.
  9. Book the Sub-Registrar appointment on Garvi, choosing the office having jurisdiction over the property and an available date and slot.
  10. Attend with all parties and two witnesses on the appointment date, carrying the original deed, the e-stamp certificate, the fee receipt, PAN and Aadhaar. The office captures photographs and biometrics.
  11. Execute and admit the document before the Sub-Registrar, who verifies the duty and the identities and endorses the deed.
  12. Collect the receipt, then download the registered document and the certified Index-2 from Garvi / IORA once indexing is complete.

How to register at a Sub-Registrar office without doing the online entry yourself

  1. Identify the correct Sub-Registrar office for the taluka or ward in which the property lies, and confirm jurisdiction at the enquiry counter.
  2. Buy the stamp for the correct duty from an authorised stamp vendor, franking bank or the e-stamping counter, and have the deed engrossed on it.
  3. Present the deed in person with all buyers, all sellers and two witnesses during office hours, and take a token.
  4. Complete photo and biometric capture, pay the registration fee and the printed service charges, and insist on a receipt.
  5. Collect the endorsed document on the date written on the receipt, and apply for the certified Index-2 afterwards.

Both routes end in the same Garvi database. A document typed at the counter is entered into the same system you would have used from home.

How do I check the status of my document?

  • Log in to Garvi and open the citizen application section to see the status of a submitted e-registration application and its appointment.
  • IORA on Garvi issues the certified Index-2 and certified copies once the document is indexed. The appearance of Index-2 is the practical confirmation that registration is complete.
  • Encumbrance certificate on Garvi will show the newly registered deed against the property.
  • The Sub-Registrar office can trace the document by the receipt number and the date of presentation.

Is a registered sale deed valid forever, and what comes next?

A registered sale deed in Gujarat carries no expiry and needs no renewal. The register entry is permanent.

Two further steps are yours to complete, and both are commonly forgotten:

  • Mutation. Registration does not change the revenue record. Apply for mutation so that the 7/12 and 8-A extracts for rural land, or the municipal property register for urban property, are updated into your name.
  • Society or association transfer for a flat, so the share certificate and the maintenance record reflect the new owner.

Why do property registrations fail in Gujarat?

  • Duty computed below the Jantri value. The single commonest problem, the deed price is under the Annual Statement of Rates and the 4.9 per cent has been paid on the lower figure.
  • Wrong article selected when buying the e-stamp, so the amount is right but the instrument description is not.
  • A co-owner missing at the appointment, with no registered power of attorney in place.
  • An unregistered power of attorney offered in place of the owner.
  • Agricultural land sold to a non-agriculturist, or new tenure land transferred without the Collector's permission.
  • Name mismatch across the deed, PAN and Aadhaar.
  • Survey number or boundary description that does not match the 7/12 extract.
  • Presentation beyond four months of execution without the delay penalty.

What should you pay, and what should you refuse?

You should pay exactly three things: the e-stamp value at 4.9 per cent of the market value, the registration fee shown by the Garvi calculator, and any printed service or copying charge at the counter. Every one of them generates a receipt or a certificate you can verify online.

Nobody can reduce the 4.9 per cent. The rate is in the schedule published on the department's own portal, and the value it applies to is generated by the government's Jantri. An agent offering a "lower registration" is proposing to under-declare the price, and the liability for the shortfall and penalty falls on you, the buyer, not on him. There is no paid priority appointment on Garvi; slots are free. Never share your Aadhaar OTP with a middleman, and never sign a deed with the consideration column left blank.

Frequently asked questions

What is the stamp duty on a sale deed in Gujarat?

Stamp duty on a conveyance of immovable property in Gujarat is 4.9 per cent of the market value, shown against Article 20(a) in the stamp duty schedule published on the Garvi portal. Market value means the higher of the consideration stated in the deed and the Jantri (Annual Statement of Rates) value for that location.

What is the Garvi portal?

Garvi is the Gujarat government's registration system run by the Inspector General of Registration, at garvi.gujarat.gov.in, covering e-registration, e-stamping, appointment booking, property valuation, encumbrance certificates, certified Index-2 copies and e-mortgage. It is the only official online route for registering a document in Gujarat.

What is Jantri and why does it decide my stamp duty?

Jantri is Gujarat's Annual Statement of Rates, the government-notified minimum value for land and built-up property in each area. Stamp duty is charged on the Jantri value or the agreed price, whichever is higher, so a deed written below Jantri does not reduce the duty.

Is a woman buyer charged less in Gujarat?

Gujarat exempts the registration fee where the property is registered in the sole name of a woman, a concession widely applied at Sub-Registrar offices; the 4.9 per cent stamp duty itself is unchanged. Confirm the exemption on the Garvi registration fee calculator before you pay, since it applies only to sole female ownership.

Do I have to visit the Sub-Registrar office in person?

Yes, for a sale deed the buyer, the seller and two witnesses must appear before the Sub-Registrar for identity and biometric capture. Garvi lets you do the data entry, the stamp duty payment and the appointment booking online, so the visit itself is short.

What is Index-2 and where do I get it?

Index-2 is the Sub-Registrar's official abstract of your registered document, and Gujarat issues a certified Index-2 through the IORA service linked from Garvi. Banks, municipal offices and the revenue authority ask for Index-2 rather than the full deed.

Does registration transfer the revenue record into my name?

No, registration and mutation are two different steps. After the sale deed is registered you must apply separately for mutation so the 7/12 and 8-A extracts, or the municipal property register, carry your name.

How much should an agent charge me?

Nothing beyond the e-stamp value, the registration fee and any printed service charge, all of which generate a receipt. No agent can reduce the 4.9 per cent duty, because it is computed on the Jantri value by the department's own calculator.
