  • No Medico Legal Case was registered. Without the MLC register entry, the claim fails at the document stage.
  • No police intimation with acknowledgement is on record for the accident.
  • The injury did not arise from a road traffic accident; injuries from workplace accidents, falls at home, assault or industrial incidents fall outside this scheme even if they need the same surgery.
  • The patient or family wants a cash payment. Money is settled directly between the government and the hospital; no cash is paid to the victim.

How to apply for the Vahan Aksmat Sahay Scheme

There is no application form for the patient. The steps below are what actually happens, and knowing them helps a family make sure nothing is missed.

  1. Take the victim to the nearest empanelled hospital. In Gujarat, calling 108 brings the state emergency ambulance service, which is the fastest way to reach an appropriate facility. The hospital provides immediate care according to the severity of the injuries.
  2. Ensure a Medico Legal Case is registered. The hospital authorities register the MLC with the local police station and coordinate with the police on documentation of the accident and the injuries. This is mandatory for all road traffic accident cases, ask the duty staff to confirm it has been done.
  3. Let the treating doctor assign the package. The doctor assesses the nature and severity of the injuries and selects the appropriate package from the 27 available, then treats according to the standard protocol for that package.

What documents does the claim need?

Every claim carries a common document set collected at the time of treatment: the scanned MLC register copy showing injury details, the police intimation copy with police acknowledgement, two photographs showing the wound before and after treatment with the patient's face clearly visible alongside the treating doctor, the OPD record or case sheet showing treatment given including OT notes, the investigation report, and the hospital bill.

Some packages need additional injury-specific evidence:

  • Fractures; X-rays ruling out a fracture, and X-rays showing the fracture before and after stabilisation.
  • Chest injuries; chest X-ray before and after intercostal drainage.
  • Abdominal injuries, blood investigation, chest X-ray and erect abdomen X-ray, ultrasound, CT scan report if required, and ECG with report if required.
  • Spine injuries, X-ray spine AP and lateral views, with CT or MRI.
  • Head injuries, CT scan report and other relevant investigations.

The photograph requirement is the one families most often disrupt without meaning to. Ask before wiping or dressing a wound whether the pre-treatment photograph has been taken, because a claim can fail on a missing image even when the surgery was flawless.

  • MLC not registered or registered late. Confirm with hospital staff in the first hours that the MLC entry exists.
  • Police intimation without acknowledgement. The copy must show the police received it, not merely that it was written.
