KSUM Patent Support Scheme
Kerala state government scheme
KSUM Patent Support Scheme reimburses patent filing costs for Kerala startups, paying up to Rs 2 lakh for an Indian patent and up to Rs 10 lakh for an international patent per subject matter. Reimbursement is released in three stages, filing, prosecution and award. Startups with a KSUM Unique ID or DPIIT recognition apply through Kerala Startup Mission.
What is the KSUM Patent Support Scheme?
Kerala Startup Mission (KSUM) runs the Patent Support Scheme as an intellectual property incentive for startups and student innovators based in Kerala. Kerala Startup Mission is the nodal agency of the Government of Kerala for entrepreneurship development and incubation, functioning under the Department of Electronics and Information Technology.
The scheme addresses a specific and well-documented barrier. Filing a patent in India costs a small startup somewhere between fifty thousand rupees and two lakh rupees once patent attorney fees, drafting, official filing fees, examination requests and responses to office objections are added up. An international filing through the Patent Cooperation Treaty route, followed by national phase entry in even one or two major jurisdictions, routinely runs into several lakh rupees. Many technically strong Kerala startups simply publish or launch without protection because the cash is not there in the year when the invention is new and the priority date matters most.
According to the Kerala Startup Mission schemes listing, the Patent Reimbursement support covers up to Rs 2 lakh for an Indian patent and up to Rs 10 lakh for an international patent, calculated per subject matter. The support is a reimbursement of proven cost, including consultation fees, and not a lump-sum grant.
Key features
- Reimbursement of patent cost, including patent attorney and consultation fees.
- Two ceilings: Rs 2 lakh for India, Rs 10 lakh for international filings.
- Released in three stages; at filing, during prosecution, and on award.
- No advance disbursal; the startup pays first and claims against receipts.
- Open to KSUM-registered startups and to IEDC student innovators.
Kerala Startup Mission also lists a Technology Transfer Scheme of up to Rs 10 lakh alongside the patent reimbursement in its IPR support group, for startups acquiring or licensing technology rather than generating it in-house.
Who is eligible for KSUM patent support?
You can claim if:
- Your startup holds a KSUM Unique ID, issued by Kerala Startup Mission on registration, or a DPIIT startup recognition certificate from the Department for Promotion of Industry and Internal Trade.
- The entity is registered and operating in Kerala.
- You are a student innovator working through a recognised Innovation and Entrepreneurship Development Centre (IEDC) in a Kerala institution. IEDCs are KSUM-supported cells inside engineering and arts and science colleges across the state.
- You have actually filed a patent application and can produce the filing acknowledgement and the invoices you paid.
You are not eligible if:
- You have no KSUM Unique ID and no DPIIT recognition. This is the single gating condition and it cannot be waived after the fact.
- The entity is an established company that does not qualify as a startup under the DPIIT definition, which limits recognition by age and turnover.
- The claim is for a trademark, copyright or design registration rather than a patent. Those are separate rights and the patent scheme does not cover them.
- You are seeking money in advance to fund a filing you have not yet made.
- The invoices are in the name of an individual founder with no link to the startup entity, or are estimates rather than paid receipts.
- The startup is registered outside Kerala with no operating presence in the state.
What is covered by the reimbursement?
Kerala Startup Mission states that reimbursement covers patent cost including consultation fee. In practice this means the following heads:
| Cost head | Typically covered |
|---|---|
| Patent office statutory filing fee | Yes |
| Patent attorney or agent drafting fee | Yes |
| Examination request fee | Yes |
| Cost of responding to office objections (prosecution) | Yes |
| International search and PCT fees | Yes, under the international ceiling |
| National phase entry fees in foreign jurisdictions | Yes, under the international ceiling |
| Annual maintenance or renewal fees after grant | Not stated as covered |
| Litigation or opposition costs | Not stated as covered |
Where a cost head is not explicitly stated in the scheme documentation, ask KSUM in writing before you incur it. A claim built on an assumption is the most common way applicants lose money on this scheme.
How to apply for the KSUM Patent Support Scheme
- Register with Kerala Startup Mission first. Obtain your KSUM Unique ID through the Kerala Startup Mission portal, or secure DPIIT startup recognition. Do this before you file the patent, not after β the ID must exist for the claim to stand.
- File the patent application through a registered patent agent or attorney at the Indian Patent Office, or through the PCT route for international protection. Keep the filing acknowledgement with the application number.
- Collect every invoice and receipt as you pay them. Insist on GST invoices from your patent attorney naming the startup entity, and keep the official fee challans from the patent office.
- Raise the first-stage claim with Kerala Startup Mission, attaching the KSUM Unique ID or DPIIT certificate, the filing receipt, the specification, the invoices and your entity bank details.
- Raise the second-stage claim during prosecution, when you have paid for the examination request and for responses to the examiner's objections. Attach the First Examination Report and your filed response.
- Raise the final claim on award, attaching the patent grant certificate issued by the patent office.
- Track the claim with the Kerala Startup Mission office and respond quickly to any query on invoices, since incomplete documentation is the usual cause of delay.
How to apply offline or in person
- Visit the Kerala Startup Mission office at G3B, Thejaswini, Technopark, Thiruvananthapuram, or the KSUM facility nearest you at Kochi or Kozhikode.
- Carry the full document set in original with one photocopy each.
- Ask for the IPR or patent support desk and submit the claim with a covering letter describing the invention and the stage claimed.
- Collect an acknowledgement with a reference number and use it in all follow-up.
Student innovators should route the claim through their college IEDC, which forwards it to Kerala Startup Mission with an institutional endorsement.
Why patent support claims get rejected
- No KSUM Unique ID or DPIIT recognition at the time of filing. This is the most common reason and it is not curable retrospectively.
- Invoices in a personal name. Reimbursement goes to the startup entity, so the paper trail must sit with the entity.
- Estimates instead of paid receipts. A patent attorney's quotation is not proof of expenditure.
- Claiming for a trademark or design. These are frequently confused with patents by first-time founders and are outside the scheme.
- Duplicate claim for the same subject matter already reimbursed to the ceiling.
- Filing done before startup registration, leaving the expense outside the eligible period.
The practical fix in almost every case is sequencing: register with KSUM, then file, then claim. Founders who invert that order lose the benefit entirely.
Current status and key dates
The Kerala Startup Mission schemes page, following its portal restructure, lists Patent Reimbursement under IPR support with the India ceiling of Rs 2 lakh and the international ceiling of Rs 10 lakh, and marks it as Coming Soon alongside the Technology Transfer Scheme. No fixed annual application window or last date is published for the patent support, and claims have historically been accepted on a rolling basis as patents progress through their stages.
Before committing to significant patent spending on the strength of expected reimbursement, confirm in writing with Kerala Startup Mission that the scheme is accepting claims and that your intended cost heads qualify.

Kerala Startup Mission charges nothing for a patent support claim. No official will ask for a facilitation payment, and no consultant can guarantee approval. Patent agent fees are a legitimate professional cost you pay directly to a registered patent agent, that is a separate commercial arrangement and not a fee to the government.

Frequently asked questions
How much does the KSUM Patent Support Scheme reimburse?
Kerala Startup Mission reimburses up to Rs 2 lakh for an Indian patent and up to Rs 10 lakh for an international patent, per subject matter. The amount covers official patent office fees and patent attorney consultation fees, and is paid against actual invoices rather than as a flat grant.
Is the money paid before or after filing the patent?
After. KSUM Patent Support Scheme reimburses cost already incurred, in three stages linked to filing, prosecution and award of the patent. No advance payment is made, so the startup must fund the patent attorney and patent office fees first and claim afterwards with receipts.
Who can claim under the KSUM Patent Support Scheme?
Startups holding a Kerala Startup Mission Unique ID or DPIIT startup recognition can claim, and student innovators working through an Innovation and Entrepreneurship Development Centre are also covered. Established companies without startup status cannot apply.
Does the scheme cover international patent filings?
Yes. International filings attract the higher ceiling of up to Rs 10 lakh per subject matter, which reflects the much higher cost of PCT national phase entry and prosecution in jurisdictions such as the United States and the European Patent Office.
What happens if my patent application is rejected?
Reimbursement already released for the filing and prosecution stages is normally not clawed back, but the final award-stage instalment is not paid because there is no grant certificate to produce. Confirm your specific case in writing with Kerala Startup Mission before you file.
Is the KSUM Patent Support Scheme currently open?
The revamped Kerala Startup Mission schemes page lists Patent Reimbursement under IPR support with the India and international ceilings, marked as "Coming Soon" following the portal restructure. Confirm current status with KSUM on 08047180470 before committing to patent spending.
Can I claim for more than one patent?
The ceilings are stated per subject matter, so a startup filing patents on genuinely distinct inventions can raise separate claims. Multiple filings on the same underlying invention across jurisdictions are treated as one subject matter.
Is there any fee to apply for patent support from KSUM?
No. Kerala Startup Mission charges no fee for a patent support claim. Any person demanding money to secure or speed up your reimbursement is not acting for KSUM and should be reported to the Mission.
