What is the Financial Assistance for Widow or Widower of Registered Construction Worker?

Financial Assistance for Widow or Widower of Registered Construction Worker is a welfare scheme of the Maharashtra Building and Other Construction Workers Welfare Board, an allied office of the Labour Department, Government of Maharashtra. The Board pays the surviving spouse of a registered construction worker Rs 24,000 a year for up to 5 years, a maximum of Rs 1,20,000, so that the household has a predictable income for the years immediately after the earning member's death.

The Board itself is a statutory body constituted under the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, and it is funded by a cess collected on construction cost. That is worth understanding, because it explains who the scheme is for. The money is not a general state grant. It is the accumulated cess of the construction industry returned to the families of the workers who built on those sites, which is why the worker's registration with the Board is the single condition everything else hangs on.

Maharashtra's Board runs a large family of schemes, commonly searched under the name Bandhkam Kamgar Yojana. This particular one is often confused with the Board's lump-sum death benefits, and the confusion costs families money because they claim one and never claim the other. The two are separate heads and both can be claimed for the same worker.

How much is paid, and how does it relate to the Board's other death benefits?

The assistance under this scheme is Rs 24,000 per year for a maximum of 5 years, credited to the surviving spouse's own bank account.

Separately, according to the Board's published welfare schemes list, the family of a registered construction worker may also claim:

Head Amount
Accidental death during work Rs 5,00,000 to legal heirs
Natural death Rs 2,00,000
Funeral assistance Rs 10,000
Disability, 75 per cent or permanent Rs 2,00,000
Assistance for a daughter's marriage Rs 51,000
Marriage expense reimbursement Rs 30,000
Education support for children Up to Rs 1,00,000 for a medical degree

A widow whose husband was a registered worker and died a natural death is therefore looking at Rs 2,00,000 plus Rs 10,000 funeral assistance plus Rs 24,000 a year for five years, and possibly education support for the children, all from the same Board. File the claims together at the same office, on the strength of the same death certificate, rather than one at a time.

The Rs 24,000 is paid annually rather than monthly, which works out to Rs 2,000 a month in effect. Families should plan around an annual credit and not expect a monthly pension-style payment.

Who is eligible for this assistance?

You can apply if:

  • You are the widow or widower of a construction worker.
  • The worker was registered with the Maharashtra Building and Other Construction Workers Welfare Board and the registration was live at the time of death.
  • You can produce a death certificate issued by a competent medical or municipal authority.
  • You are resident in Maharashtra and hold a bank account in your own name.

You cannot apply or are not eligible if:

  • The deceased was never registered with the Board. Working on a construction site is not by itself enough. An unregistered worker's family cannot claim any Board benefit, and this is by far the most common and most painful rejection.
  • The worker's registration had lapsed and was not renewed. Board registration requires periodic renewal, and a lapsed card is treated as no registration in many district offices.
  • You are a parent, child, sibling or other relative rather than the spouse. Other relatives may still be legal heirs for the lump-sum death benefit, but this particular scheme is for the widow or widower.
  • You have remarried, which is treated as taking the claim outside the scheme.
  • The worker was in an occupation not covered by the BOCW Act, for example factory or shop employment, since the Board covers building and other construction work only.

How does a worker get registered in the first place?

Because eligibility for this scheme is decided by the worker's registration, it is worth stating the registration rule plainly. According to the Board, a worker can register if:

  • Age is between 18 and 60 years, and
  • The worker has been working for more than 90 days in the last 12 months as a building or other construction worker.

Registration is done by submitting Form-V with age proof, a 90-day work certificate from the employer or contractor, residence proof, identity proof and three passport-size photographs to the local labour office, or online through mahabocw.in.

Any construction worker's family reading this page while the worker is still alive should treat that as the action item. Registering costs almost nothing and takes an afternoon; it is what makes Rs 1,20,000 plus a Rs 2,00,000 death benefit claimable later.

What documents are required for the widow or widower claim?

Document Mandatory Notes
Death certificate Yes From a competent medical or municipal authority
Worker's Board registration or smart card Yes Proves live registration at the time of death
Marriage certificate or relationship proof Yes Establishes that you are the spouse
Aadhaar card of the applicant Yes Identity and payment seeding
Bank passbook of the applicant Yes Account in the surviving spouse's own name
Residence proof Yes Ration card, electricity bill or domicile certificate
Photographs No Usually asked for the claim file
Non-remarriage declaration No Sometimes asked at annual renewal

The death certificate is issued by the municipal corporation, nagar parishad or gram panchayat where the death was registered. If it has not been registered, that is the first task — no Board claim can move without it.

How to apply for the widow or widower assistance

  1. Register the death and obtain the death certificate from the municipal corporation, nagar parishad or gram panchayat, and take several attested copies since multiple Board claims need one each.
  2. Locate the deceased worker's Board registration certificate or smart card and check whether the registration was live. If a renewal was pending, take the renewal receipts with you and raise it at the office rather than abandoning the claim.
  3. Collect the supporting documents, marriage or relationship proof, your Aadhaar, your bank passbook in your own name, and residence proof.
  4. Visit the district or taluka labour office, or the Board office, and ask for the claim form for financial assistance to the widow or widower of a registered construction worker.
  5. Check the online route at mahabocw.in, since the Board operates online intake for its schemes; where an online claim is available for your district, log in and file there with scanned documents.
  6. Ask at the same visit about the other claims you are entitled to, the natural or accidental death benefit, the Rs 10,000 funeral assistance and education support for the children, and file them together.
  7. Submit the claim and take a dated acknowledgement with a claim or registration number.
  8. Follow the annual renewal for each of the five instalments, as required by your district office, so that no year is missed.

How to check the status of your claim

Status is tracked through the district or taluka labour office where the claim was filed, quoting the acknowledgement number, and through the Board's own portal at mahabocw.in where the claim was filed online. The Board also runs a helpdesk on 1800-8892-816 between 10:00 am and 6:00 pm, with direct lines on 022-2657-2631 and 022-2657-2632, and email at support@mahabocw.in and bocwwboardmaha@gmail.com.

When you call, have three things ready: the deceased worker's Board registration number, the acknowledgement number of your claim, and the date of death. Without the registration number the Board cannot trace the file at all.

Why claims get rejected, and how to fix each one

  • The worker was never registered. There is no fix after death; this is why registration during the worker's lifetime matters so much.
  • Registration lapsed before death. Take the renewal receipts and any proof of continued construction work to the district labour office and ask for the case to be considered rather than assuming it is closed.
  • Death certificate not from a competent authority. A hospital slip or a cremation receipt is not a death certificate. Register the death formally.
  • Relationship not established. Where there is no marriage certificate, a ration card naming both spouses, a joint bank account or the Board record's own nominee entry usually helps.
  • Bank account not in the applicant's name or not Aadhaar-seeded, so the credit fails even after sanction.
  • Annual renewal missed, which stops the instalments part-way through the five years. Diarise the renewal month.
  • Claim filed at the wrong office, for example a labour office in a district where the worker was not registered.

Frequently asked questions

How much does the widow or widower of a registered construction worker get?

The Maharashtra Building and Other Construction Workers Welfare Board pays Rs 24,000 per year for up to 5 years, which comes to a maximum of Rs 1,20,000. The amount is paid to the surviving spouse's own bank account, not as a single lump sum.

Who is eligible for this assistance?

The widow or widower of a construction worker who was registered with the Maharashtra BOCW Welfare Board at the time of death is eligible. The worker's registration is the decisive condition, and the applicant must produce the death certificate from a competent authority.

Who cannot apply for this scheme?

The spouse of a construction worker who was never registered with the Board, or whose registration had lapsed and was not renewed, cannot claim. Parents, children and other relatives cannot claim under this particular head, and a remarried spouse is treated as outside the scheme.

Is this the same as the death benefit of Rs 2,00,000 or Rs 5,00,000?

No, they are separate heads. The Board pays Rs 5,00,000 to legal heirs on accidental death during work and Rs 2,00,000 on natural death, plus Rs 10,000 as funeral assistance. This Rs 24,000-a-year scheme is an ongoing support for the surviving spouse and is claimed in addition.

How does a construction worker get registered with the Board?

A worker aged 18 to 60 who has worked as a building or other construction worker for more than 90 days in the last 12 months can register by submitting Form-V with age proof, a 90-day work certificate, residence proof, identity proof and three photographs to the local labour office or online at mahabocw.in.

Do I have to apply every year for the five instalments?

The assistance runs for up to 5 years, and district offices normally require an annual renewal or live-certificate step before releasing each year's instalment. Confirm the renewal requirement with your district labour office when the first instalment is sanctioned.

What is the helpline for the Maharashtra construction workers board?

The Board's toll-free helpdesk is 1800-8892-816, available from 10:00 am to 6:00 pm, with direct lines on 022-2657-2631 and 022-2657-2632. The Board office is at the 5th Floor, MMTC House, Plot C-22, E-Block, Bandra Kurla Complex, Mumbai 400051.
