What is a legal heir certificate in Maharashtra?

A legal heir certificate in Maharashtra. The Warasan certificate, also called the Surviving Member certificate: is a Revenue Department document that lists every surviving member of the family of a person who has died. The Tahsildar of the taluka signs it after the Talathi and the Circle Officer verify the family in the village or ward. Maharashtra delivers the service through Aaple Sarkar, the state's right-to-services portal at aaplesarkar.mahaonline.gov.in, run by MahaOnline, and through Aaple Sarkar Seva Kendras and Setu centres in every taluka.

The certificate matters because most institutions will not release a dead person's dues to a family member on the strength of a death certificate alone. Maharashtra families use the Warasan certificate for family pension, gratuity, provident fund, arrears of salary, compassionate appointment, insurance settlements, transfer of electricity and water connections, and mutation of the deceased's name in the 7/12 land records.

What is the difference between a Warasan certificate and a succession certificate?

Maharashtra recognises two distinct instruments, and confusing them is the commonest and most expensive mistake families make.

  • The Warasan / legal heir certificate is administrative. It is issued by a revenue officer, not a judge. It answers only one question, who survived the deceased. It is enough for pension, gratuity, provident fund, salary arrears, compassionate appointment, utility transfers and small bank balances.
  • A succession certificate is judicial. The competent civil court issues it under Part X of the Indian Succession Act, 1925, and it authorises the person named in it to receive the debts and securities of the deceased; fixed deposits, shares, debentures, bonds and mutual fund holdings. The court charges an ad valorem court fee on the value of the assets and publishes a public notice inviting objections, which is why it takes months rather than weeks.

Ask the bank, employer or insurer in writing which document they will accept before you start. Where immovable property is involved and the family is not in agreement, neither certificate resolves the question, that is a partition suit, or letters of administration where a will exists.

Who can apply for a legal heir certificate in Maharashtra?

The following can apply:

  • The surviving spouse of the deceased.
  • Sons and daughters, including married daughters and legally adopted children.
  • The mother and father of the deceased.
  • Grandchildren claiming through a predeceased son or daughter.
  • A natural guardian applying on behalf of a minor heir.

Maharashtra sets no income limit, no caste condition and no minimum residence period for this certificate, because it records a fact rather than granting a benefit.

The following cannot apply and are not eligible:

  • Relatives outside the class of heirs recognised by the personal law of the deceased. A nephew, cousin, in-law, tenant or friend cannot apply.
  • Anyone applying where the deceased left a registered will; the executor named in the will must apply to the court for probate.
  • Applicants where the deceased last lived outside Maharashtra and held no property in the state.
  • Applicants where a rival claim over heirship is already pending before a civil court. The Tahsildar will not decide a contested question of title.

How to apply for a legal heir certificate in Maharashtra online

  1. Open aaplesarkar.mahaonline.gov.in and register as a new user, choosing either the Aadhaar-based option or the full profile option with a photograph and address proof. Verify the mobile number with the OTP.
  2. Log in and select the Revenue Department, then the certificates group, then the legal heir / surviving member certificate service. Each service page on Aaple Sarkar lists the documents it needs and the time limit notified for it under the Maharashtra Right to Public Services Act, 2015 — read that page before you begin.
  3. Fill in the deceased's full name exactly as it appears on the death certificate, the date of death, the last residential address, and the district and taluka. A wrong taluka sends the file to a Tahsildar without jurisdiction.
  4. Add every surviving family member with the precise relationship. Married daughters and children from an earlier marriage must be included: omitting them is the leading cause of rejection and of the certificate being challenged later.
  5. Upload the death certificate, the applicant's identity proof, the deceased's address proof, and a relationship proof for each person named.
  6. Generate and upload the self-declaration in the format the portal provides, or the affidavit on stamp paper where the taluka insists on one.
  7. Pay the fee shown on the service page through the portal's gateway and save the receipt.
  8. Submit and record the application number from the acknowledgement.
  9. Attend the Talathi and Circle Officer enquiry. An officer visits the address, checks the ration card and may record neighbours' statements. Keep all originals ready for this visit.
  10. Once the Tahsildar approves, log back in and download the digitally signed certificate from your Aaple Sarkar dashboard.

How to apply offline at a Setu centre or the Tahsildar office

  1. Visit an Aaple Sarkar Seva Kendra, a Setu centre, or the Tahsildar's office for the taluka where the deceased last lived.
  2. Ask for the legal heir / surviving member certificate application and fill in the deceased's details and the full list of surviving members.
  3. Attach the death certificate, identity and address proofs, relationship proofs for every heir, and the affidavit on stamp paper.
  4. Pay the counter fee and collect the dated acknowledgement with the application number. Do not leave without it.
  5. Attend the Talathi's enquiry when called, then collect the certificate from the Setu centre or download it from Aaple Sarkar.

How do you check the status of your application?

Log in to Aaple Sarkar and open the track-application section on your dashboard, where each application shows its current stage against the application number. The file moves from submitted, to pending with the Talathi or Circle Officer, to pending with the Tahsildar, to approved or rejected with a reason. If it has not moved after the field visit, take the printed acknowledgement to the Tahsildar's office. For login, payment or download problems, call the Aaple Sarkar support number 1800 120 8040.

How long is the certificate valid, and does it need renewal?

A Maharashtra legal heir certificate has no expiry date and needs no renewal, because the death and the identity of the survivors do not change. Institutions that ask for a "recent" copy are asking for a fresh printout, not a fresh application: download the digitally signed PDF again from Aaple Sarkar. A new application is only genuinely needed when the family composition recorded on the certificate must change, for example when a child born after the death has to be added, or when an heir omitted by mistake must be brought in.

Why do legal heir applications get rejected in Maharashtra?

  • An heir was left out, most often a married daughter or a child from an earlier marriage.
  • Name mismatch between the death certificate, the ration card and Aadhaar. Correct the record before applying.
  • Wrong taluka, the application filed where the deceased did not last reside.
  • Weak address proof for the deceased, so the Talathi cannot place the family in the village or ward.
  • Missing or incomplete self-declaration, which is the document the Tahsildar relies on.
  • Nobody available for the field enquiry across repeated visits.
  • A pending dispute between claimants, which forces the file to be closed with a direction to approach a civil court.

What does it cost, and should you use an agent?

Apply directly on aaplesarkar.mahaonline.gov.in or at an authorised Aaple Sarkar Seva Kendra and pay only the fee displayed on the service page, taking the receipt every time. The other costs are outside the government's control, stamp paper and notarisation for the affidavit, and, if you later need a court succession certificate, the ad valorem court fee and your advocate's fee. Private agents who promise a Warasan certificate "in a week" cannot shorten the Talathi's enquiry, which is the only step that governs the timeline. Never hand original documents to a middleman, and never pay cash without a receipt.

Where do you complain if the certificate is delayed?

Maharashtra's Right to Public Services Act, 2015 gives you a statutory appeal when a notified service is not delivered within the time limit shown on its Aaple Sarkar service page. File the first appeal with the designated first appellate authority: usually the Sub-Divisional Officer; quoting the application number and the date of submission, and a second appeal thereafter, with the Maharashtra State Commission for Right to Service as the final forum. Separately, the Tahsildar and the District Collector hold grievance days, and the Aaple Sarkar helpline 1800 120 8040 handles portal faults such as a deducted payment with no acknowledgement.

Frequently asked questions

What is a legal heir certificate called in Maharashtra?

A legal heir certificate in Maharashtra is usually called the Warasan certificate or the Surviving Member certificate, and it is issued by the Revenue Department through the Aaple Sarkar portal. The Tahsildar signs it after the Talathi and Circle Officer verify the family.

Where do I apply for a Maharashtra legal heir certificate?

Apply on the Aaple Sarkar portal at aaplesarkar.mahaonline.gov.in under the Revenue Department, or at any Aaple Sarkar Seva Kendra, Setu centre or the Tahsildar's office. The portal issues a digitally signed certificate you can download once approved.

What is the difference between a Warasan certificate and a succession certificate?

A Warasan certificate is a Revenue Department record of who the surviving family members are, while a succession certificate is a civil court order under the Indian Succession Act, 1925 that authorises an heir to collect debts and securities. Banks holding large deposits and companies holding shares generally require the court's succession certificate, not the Tahsildar's Warasan certificate.

Who can apply for a legal heir certificate in Maharashtra?

The spouse, sons, daughters including married daughters, parents and other surviving members of the deceased's family can apply in Maharashtra. A guardian may apply on behalf of a minor heir.

Does a Maharashtra legal heir certificate expire?

A legal heir certificate in Maharashtra does not expire, because it records permanent facts about a death and the surviving family. Some banks and insurers still ask for a recently issued copy, so download a fresh signed PDF from Aaple Sarkar instead of applying again.

Is the Aaple Sarkar process covered by the Right to Public Services Act?

Maharashtra notifies time limits for Aaple Sarkar services under the Maharashtra Right to Public Services Act, 2015, and the notified limit for each service is displayed on that service's page on the portal. Check the time limit shown on the service page before escalating a delay, because the Act gives you an appeal only after the notified period lapses.

What helpline can I call about an Aaple Sarkar application?

Aaple Sarkar publishes the toll-free support number 1800 120 8040 for portal and application problems. Use it for login, payment and download issues, and go to the Tahsildar's office for anything about the field enquiry.

Do I need a legal heir certificate to transfer land in Maharashtra?

Land held by a deceased owner in Maharashtra is transferred by a mutation entry in the village record, and the Talathi normally makes that entry on the strength of the death certificate and the list of heirs recorded in the Warasan certificate. Where the heirs disagree, the mutation becomes a disputed case and moves to the Tahsildar's revenue court.
