What is the Allotment of Commercial Shops facility?

Allotment of Commercial Shops is a facility of the Uttarakhand Agricultural Produce Marketing Board, known everywhere in the state as the Mandi Parishad, under which licensed traders are given commercial shops inside mandi premises on rent or lease. The purpose is ease of doing business: a trader who buys and sells in the regulated market needs a fixed business address inside it, with footfall, storage nearby and access to the auction platform, and the board's shops supply exactly that. The board works under the Department of Agriculture, Government of Uttarakhand, and its headquarters is at Mandi Bhawan, Rudrapur, in Udham Singh Nagar district.

The legal basis is the Uttarakhand Agricultural Produce Marketing (Development and Regulation) Act, 2011, under which the board and the market committees, the mandi samitis, are constituted. Under that Act each samiti builds and owns the market infrastructure in its area: auction platforms, godowns, shops, Kisan Bazaar complexes, weighing and grading facilities, and allotting that infrastructure to users on rent is both how the infrastructure is put to productive use and how the samiti funds its own maintenance and development work. This is why the terms of a shop allotment are set locally by each samiti in its own notice, and why there is no single statewide rent table, application form or calendar.

Main features

  • Commercial shop premises inside a regulated mandi, allotted to traders.
  • Intended for licensed traders of that market area.
  • Allotted on rent, licence fee or lease against a security deposit.
  • Allotment usually by auction, bid or scrutiny of applications, as stated in the samiti's notice.
  • Governed by the Uttarakhand Agricultural Produce Marketing (Development and Regulation) Act, 2011.
  • A business facility, not a subsidy; no grant, loan or cash benefit is attached.

Who is eligible for a commercial shop in a mandi?

You can apply if:

  • You are a licensed trader in the market area, holding a valid and current licence issued by the mandi samiti.
  • Your firm is registered, as a proprietorship, partnership or company, and you can produce the identity, registration and tax documents the notice asks for.
  • You can pay the rent, licence fee and security deposit the samiti has fixed for that shop, and the earnest money at the time of applying.
  • An allotment notice for vacant shops is currently open in that market area.
  • You intend to use the shop for a permitted trade as described in the conditions of allotment.

You are not eligible and cannot claim an allotment if:

  • You do not hold a mandi licence. Licensing comes first and allotment second; an unlicensed applicant is rejected at the first scrutiny.
  • You have dues outstanding to the samiti, market fee, rent or penalty: or a previous allotment cancelled for breach of conditions.
  • You want the premises for residential, storage-only or non-trade use, or to sub-let it. Sub-letting is normally barred outright.
  • You are an individual or farmer wanting a retail outlet rather than a trader in the regulated market. Farmer-facing retail space is dealt with through the board's Kisan Bazaar shop allotments, which are advertised separately.
  • You apply outside the notice period, when no vacancy has been advertised.

How to apply for allotment of a commercial shop

  1. Obtain a mandi licence first. Apply to the mandi samiti of the market area for a trader's licence if you do not already hold one, since the shop facility is defined for licensed traders and no application will be entertained without it.
  2. Watch for the samiti's allotment notice. Shops are allotted only when a vacancy is advertised. Notices are put up at the mandi office and, where the samiti uses a bidding or auction route, published on the Uttarakhand e-procurement portal, uktenders.gov.in.
  3. Collect the application form and the conditions of allotment from the samiti office. Read the rent, licence fee, security deposit, permitted trade, lease period and transfer restrictions before you apply — these differ between samitis and between rounds in the same samiti.
  4. Submit the application with documents and deposit. Attach the mandi licence, identity proof, firm registration and the prescribed earnest money or security deposit, and file it at the samiti office before the closing date in the notice. Take a dated acknowledgement.
  5. Take part in the allotment process. Attend on the notified date if the route is auction or bid opening. Where the route is scrutiny of applications, the samiti evaluates against the published conditions.
  6. Execute the agreement and take possession. On selection, pay the balance amount, sign the allotment or lease agreement with the mandi samiti, and take possession of the shop against a written handover recording its condition.
  7. Keep the conditions. Pay rent on time, trade only in the permitted line, do not sub-let or transfer, and renew the licence and the lease when due.

How do I follow up on an application?

The mandi samiti office that issued the notice is the point of contact throughout. The secretary of the samiti announces the result, executes the agreement and orders refund of earnest money to unsuccessful applicants. Where the samiti cannot settle a dispute, the Uttarakhand Agricultural Produce Marketing Board at Mandi Bhawan, Rudrapur supervises the samitis under the 2011 Act and is the next level of escalation; above that lies the Department of Agriculture, Government of Uttarakhand.

Keep two papers safe: the dated application acknowledgement and the deposit receipt. Both are needed to claim a refund or to press a query about the result, and a trader who has mislaid the deposit receipt often waits months for the refund.

Why applications fail

  • No valid mandi licence, which disqualifies the application at the first check and is the most common single reason.
  • Applying outside a notice period, when no shop vacancy has been advertised. A speculative application filed at the samiti office is simply not processed.
  • Earnest money not paid in the prescribed form or by the date. A demand draft when the notice asked for a bank challan, or a payment made a day late, is enough to put the bid out.
  • Dues pending with the samiti against the trader or the firm.
  • Intended trade not permitted under the conditions of allotment.
  • Incomplete firm documents, such as an unsigned partnership deed or an expired GST registration.
  • Being outbid, where the route is open auction, in which case the earnest money is refunded and the trader waits for the next round.

Rent, renewal and cancellation

Rent, licence fee and deposit are fixed by the samiti in its notice, not by a statewide schedule, and are revised from time to time. The lease or allotment runs for the period written into the agreement and is renewable on the terms in that agreement. Allotment can be cancelled for non-payment of rent, breach of the permitted-use condition, sub-letting or transfer without permission, or misuse of the premises, and cancellation normally carries forfeiture of the security deposit. A trader planning any change. A new line of business, taking in a partner, shifting to a bigger shop; should get the samiti's written permission first rather than act and seek regularisation later.

Help and information

  • Mandi samiti of your market area, licensing, the allotment notice, the application, the agreement and the refund.
  • Uttarakhand Agricultural Produce Marketing Board, Mandi Bhawan, Rudrapur, Udham Singh Nagar; portal ukapmb.org.
  • Uttarakhand e-procurement portal: uktenders.gov.in, for board and samiti notices issued as tenders or auctions.

The Uttarakhand Agricultural Produce Marketing Board does not publish a statewide rent schedule, a fixed allotment calendar or a dedicated helpline number for commercial shops, and each mandi samiti sets its own terms in its own notice. A trader should therefore work directly from the samiti's notice and its office, and should not act on rates, dates or eligibility conditions quoted by an intermediary.

Frequently asked questions

What is the Allotment of Commercial Shops facility?

Allotment of Commercial Shops is a facility of the Uttarakhand Agricultural Produce Marketing Board under which licensed traders are allotted commercial shops inside mandi premises on rent or lease, so that trade in the regulated market can be carried on from a fixed, well-located business address.

Who can get a commercial shop?

Licensed traders of the market area are the intended allottees. A valid mandi licence from the samiti is the basic qualification, along with the firm registration, identity and financial documents named in the samiti's allotment notice.

Which department runs it?

The Uttarakhand Agricultural Produce Marketing Board, commonly called Mandi Parishad, which works under the Department of Agriculture, Government of Uttarakhand, with its headquarters at Mandi Bhawan, Rudrapur, Udham Singh Nagar. The day-to-day allotment is done by the mandi samiti of each market area.

Is the shop given free or at a subsidised rate?

No. The shop is allotted against the rent, licence fee and security deposit fixed by the mandi samiti. Allotment of Commercial Shops is a business facility for traders, not a subsidy scheme, and no grant or cash benefit is attached to it.

How is the allotment decided?

The mandi samiti decides through the route stated in its own notice, which may be open auction, sealed bid or evaluation of applications against fixed conditions. Where a bidding route is used the notice is often published on the Uttarakhand e-procurement portal as well as at the mandi office.

Can I sub-let the shop or use it for something else?

No. An allotment carries written conditions on permitted use and normally bars sub-letting or transfer. Breach of those conditions is a standard ground for cancellation of the allotment and forfeiture of the deposit.

How is this different from a shop in a Kisan Bazaar?

A commercial shop is allotted inside the regulated mandi premises for trade in the market area, while Kisan Bazaar shops are allotted in the board's Kisan Bazaar complexes, which are aimed at direct farmer-to-consumer selling. The two are advertised separately by the samiti and carry different conditions.

Where do I apply?

Apply at the mandi samiti office of the market area where the shop is located, within the dates given in the allotment notice. Applications are offline; the Uttarakhand Agricultural Produce Marketing Board at Mandi Bhawan, Rudrapur supervises the samitis.
