What is an encumbrance certificate in Uttarakhand?

An encumbrance certificate in Uttarakhand is a record from the Department of Stamps and Registration showing every transaction registered against a particular property during a period you specify. It is commonly asked for by the Hindi name bharmukt praman patra: literally, a certificate that the property is free of charges.

An encumbrance is a registered claim that restricts an owner's freedom to sell clean: a bank mortgage, a court attachment, a registered lease, a gift deed, a partition, a release or an earlier sale. The certificate lists these in date order, with the document number and the nature of each transaction.

The Department of Stamps and Registration describes itself as a major revenue- earning branch of the state government, responsible for recording property transactions and maintaining those records. Its portal at registration.uk.gov.in carries the services citizens actually need around a property deal:

  • e-Search, search for registered documents. This is the online route to encumbrance information.
  • e-Valuation; calculate stamp duty and registration fees.
  • Public Data Entry (PDE): online applications for property deeds.
  • e-Stamp; online appointments for deed registration.
  • e-Payment; online payment of registration fees.
  • e-Marriage β€” registration under the Uttarakhand Compulsory Marriage Act,
  • GIS Rate List: property valuation information by location.

Uttarakhand does not use the numbered Form 15 and Form 16 encumbrance formats that Tamil Nadu and Andhra Pradesh use. Here the equivalent is a search of the Sub-Registrar's index, viewed online through e-Search and certified as a search report signed at the Sub-Registrar Office.

Who can apply for an encumbrance search in Uttarakhand?

You can apply if:

  • You are the owner of the land, plot, house or flat.
  • You are a prospective buyer doing due diligence before paying an advance.
  • You are a bank, housing finance company or advocate verifying title before a loan or a sale.
  • You are a legal heir working out what a deceased relative owned and what charges attach to it.
  • You are any member of the public. The register of registered documents is a public record under the Registration Act, 1908. Uttarakhand does not require the owner's consent, a power of attorney or a stated reason for a search.

You cannot apply if, the real barriers are about the property, not the person:

  • You cannot search without a property identifier. Without the khasra number, khata number, plot number or municipal property number, together with the village or mohalla, the index cannot be searched.
  • You cannot find unregistered dealings. Unregistered agreements, oral family arrangements and pending court cases do not appear.
  • You cannot cover undigitised years online. Those require a manual search at the Sub-Registrar Office.
  • You cannot use the search as proof of ownership. It records registered transactions, not title.

A separate point matters in Uttarakhand more than in most states: an encumbrance search says nothing about whether you are legally permitted to buy the land. Uttarakhand restricts the purchase of agricultural land by persons from outside the state, and hill land carries its own ceilings and permissions. A perfectly clean search on a plot you are not entitled to buy is of no help at all.

How to get an encumbrance search in Uttarakhand online

  1. Open registration.uk.gov.in and find the e-Search service in the online services list on the department's home page.
  2. Register or log in with your mobile number where the service asks for it, and verify the OTP.
  3. Select the district, then the tehsil, then the village or mohalla, and then the Sub-Registrar Office in which the property falls. The village list only loads after the tehsil is chosen.
  4. Enter the property identifier. The khasra number, khata number or property number; exactly as it appears in the khatauni or the registered deed.
  5. Set the search period, the from year and the to year. Choose the full period now rather than repeating the search later.
  6. Pay the fee shown on the payment screen through the department's e-Payment route, and save the receipt with the transaction number.
  7. Read the result list. Each row is a registered document with its number, year, the parties and the nature of the transaction. Note the document numbers of anything that concerns you, particularly a mortgage with no later cancellation entry.
  8. Download or print the result for your own use, and apply separately at the Sub-Registrar Office for a certified search report if your bank or your advocate needs a signed document.

How to apply at the Sub-Registrar Office

  1. Identify the Sub-Registrar Office with jurisdiction over the property. Dehradun, Haridwar, Udham Singh Nagar and Nainital have more than one office, and several hill tehsils are served by an office in a neighbouring town.
  2. Submit a written application describing the property by khasra or property number with village, mohalla and tehsil, and stating the exact period to be searched.
  3. Attach a copy of the khatauni or the sale deed if you have one, and carry your identity proof.
  4. Pay the notified search fee at the counter and insist on a printed receipt carrying the application number.
  5. Collect the certified search report on the date given on the acknowledgement, signed by the Sub-Registrar.

The offline route stays essential in Uttarakhand for older records. The state was formed in 2000 and its computerised registration index does not reach back far enough to cover a 30-year title search on its own. For those years the office clerk searches the physical index registers by hand, genuinely slower, and the honest reason a long search takes longer than a recent one.

How do I check the status and get support?

  • Online: open the e-Search or e-Payment transaction history on registration.uk.gov.in with the transaction number from your receipt.
  • By phone: call the Department of Stamps and Registration helpline on +91 135 297 9384.
  • In person: at the Sub-Registrar counter, quoting the application number.
  • Escalation: the Sub-Registrar, then the District Registrar in the Collectorate, then the Inspector General of Registration for the state.

How long is the certificate valid?

An encumbrance search in Uttarakhand carries no expiry date, but it is only true up to the last date it covers. A mortgage registered the day after your period ends will not appear in it.

For that reason lenders and buyers' advocates ask for a freshly run search, usually within days of the transaction, and many run a second short search immediately before the sale deed is registered to catch anything filed in the gap. There is no renewal process. You run the search again for the new period, and a short top-up search costs far less than repeating the whole 30 years.

Why do encumbrance searches go wrong in Uttarakhand?

  • Wrong khasra number. The number on an old family document may not match the current record.
  • Consolidation and renumbering. Where chakbandi has been carried out or a rural khasra has been converted into urban plots, the old and new numbers are different identifiers and a search on only one misses part of the history.
  • Wrong Sub-Registrar Office selected, producing an empty result that proves nothing.
  • Village or mohalla spelt differently in the register from the spelling on your deed.
  • A period that is too short, missing the very charge you were looking for.
  • Assuming online coverage is complete. Pre-2000 records and, in many offices, a good part of the early 2000s exist only on paper.
  • Treating a nil result as a clean title. Unregistered claims, pending litigation, revenue dues and purchase restrictions do not show up in it.
  • Skipping the revenue-side checks. The khatauni, the mutation register and, for converted farmland, the land-use permission.

What does it cost, and what should you refuse to pay?

An encumbrance search in Uttarakhand costs only the notified search fee, charged either on the department's e-Payment screen or at the Sub-Registrar counter, in both cases against a receipt. The stamp duty and registration fee calculators on the portal relate to registering a document and are a separate charge altogether.

Agents and deed writers sitting outside Sub-Registrar Offices in Dehradun, Haridwar, Haldwani and Rudrapur offer to "arrange" a bharmukt praman patra quickly for several thousand rupees. They are filling in the same forms on the same portal, and there is no paid priority queue. No officer can add an entry to the register or remove one that is genuinely there. Do the e-Search yourself first, then pay only the counter rate for the certified report. Never share your portal password or your Aadhaar OTP with an agent, and never accept a search report that did not come from registration.uk.gov.in or from the Sub-Registrar's counter.

Grievance and helpline route

  • Department of Stamps and Registration helpline: +91 135 297 9384
  • Portal: registration.uk.gov.in, for e-Search, e-Valuation, e-Payment and department information
  • Local level: the Sub-Registrar of the tehsil holding the records
  • District level: the District Registrar in the Collectorate

Keep the application or transaction number from your receipt. Without it, no office can trace your request.

Frequently asked questions

Which portal gives property registration records in Uttarakhand?

registration.uk.gov.in, the website of the Department of Stamps and Registration, Uttarakhand, is the official route. The portal offers e-Search for registered documents, e-Valuation for stamp duty and registration fees, Public Data Entry for deed applications, e-Stamp appointments, e-Payment, e-Marriage and the GIS rate list.

Does Uttarakhand issue the encumbrance certificate in Form 15 or Form 16?

No, the numbered Form 15 and Form 16 encumbrance formats belong to Tamil Nadu and Andhra Pradesh, not to Uttarakhand. In Uttarakhand the equivalent is a search of the Sub-Registrar's index, obtained online through e-Search and as a certified search report signed at the Sub-Registrar Office.

Who issues the encumbrance certificate in Uttarakhand?

The Sub-Registrar of the tehsil where the property is situated issues it, under the Department of Stamps and Registration, which the state describes as a major revenue-earning branch responsible for recording property transactions and maintaining those records.

How far back does Uttarakhand e-Search cover?

Uttarakhand's computerised registration records begin well after the state was formed in 2000, so a 30-year search will reach into years that exist only as physical index registers at the Sub-Registrar Office. Plan on a manual search at the counter for the older part of the period.

Does an encumbrance search prove ownership of land in Uttarakhand?

No, it records registered transactions, not title. An Uttarakhand land check also needs the khatauni and khasra records from the Revenue Department, the mutation entries, and, for hill districts, a check on the land ceiling and purchase restrictions that apply to buyers from outside the state.

What does an encumbrance certificate cost in Uttarakhand?

Only the notified search fee, charged on the portal payment screen or at the Sub-Registrar counter against a receipt. The department publishes stamp duty and registration fee calculators separately through e-Valuation; those are the charges on registering a document, not on getting a search.

Why does my Uttarakhand search show nothing for a property I know was sold?

The usual causes are a wrong khasra number, the wrong Sub-Registrar Office, or a period that ends before the sale was registered. Land consolidation and the renumbering of khasras in developed areas also break the link between an old number and the current one.

Whom do I call if the Uttarakhand registration portal fails?

Call the Department of Stamps and Registration helpline on +91 135 297 9384. For a records problem rather than a portal problem, the Sub-Registrar of the tehsil and then the District Registrar in the Collectorate are the right escalation.
