What is property registration in Uttarakhand?

Property registration in Uttarakhand is the recording of a sale deed by a Sub-Registrar under the Registration Act, 1908, in the register maintained by the Department of Stamps and Registration, Government of Uttarakhand. Until that entry exists, a buyer who has paid the money and taken possession is still not the owner on the public record.

Uttarakhand runs the process through registration.uk.gov.in. The department's portal carries six citizen modules: Public Data Entry (PDE) for online application for deeds, e-Stamp with an online appointment system to register deeds, e-Search for looking up registered documents, e-Valuation for calculating stamp duty and registration fees, e-Marriage for marriage registration, and e-Payment for paying registration fees online. The portal also publishes the GIS rate list, village census codes and office location maps.

Section 17 of the Registration Act makes registration compulsory for any transfer of immovable property worth more than Rs 100. An unregistered sale deed cannot be used to prove title in court, which is why registration, not the payment receipt, is the moment ownership actually moves.

Who can and cannot register a sale deed in Uttarakhand?

You can register if:

  • You are the recorded owner of the property, or hold a registered power of attorney from the owner, and are selling it.
  • You are the buyer, above 18, and legally permitted to hold that class of land in Uttarakhand.
  • The property lies within the jurisdiction of the Sub-Registrar office you approach.
  • Stamp duty and the registration fee have been paid in full on the higher of the consideration and the circle rate.

You cannot register if:

  • Stamp duty is short-paid, most often because duty was computed on a price below the circle rate. The Sub-Registrar will refuse the document or impound it.
  • You are not domiciled in Uttarakhand and are buying agricultural land without the permission the state's land law requires. Uttarakhand has tightened restrictions on land purchase by outsiders, and this is a substantive bar. A deed in breach will not be registered.
  • The seller is a minor or of unsound mind without a court-authorised guardian.
  • The land is under court injunction, attachment or a statutory freeze, or is government or forest land not transferable to a private person.
  • The document is presented more than four months after execution without paying the delay penalty allowed under section 25 of the Registration Act.

What does it cost, stamp duty and registration fee in Uttarakhand?

The Stamp and Registration Department publishes a rate table for each instrument. For a sale deed the figures are specific and worth knowing before you negotiate.

Stamp duty; Registration of Conveyance / Sale Deed (Article 23):

Case Stamp duty
Immovable property, general 5 per cent
Immovable property, female buyer 3.75 per cent up to Rs 25 lakh, 5 per cent thereafter
Movable property forming part of the deed 2 per cent of the amount
Family co-owners specifying their shares 0.25 per cent, maximum Rs 1,000

Family, for the 0.25 per cent concession, is defined by the department as father, mother, husband, wife, son, daughter, daughter-in-law, brothers, sisters and grandchildren.

Registration fee: for all non-testamentary instruments relating to Books 1 and 4, including sale certificates presented in original, where the value or consideration is expressed, the fee is 2 per cent of the value or consideration, and the maximum fee chargeable is Rs 25,000. The ceiling is the important number: on a Rs 3 crore property the registration fee still stops at Rs 25,000.

Rebates and exemptions the department lists:

  • 100 per cent rebate for each qualified disaster-affected beneficiary in five districts; Uttarkashi, Chamoli, Pithoragarh, Rudraprayag and Bageshwar.
  • Land given free by the State Government, or donated by it for public institutions, is exempt from stamp duty.

Sale certificates (Article 18) are treated differently: duty is 5 per cent on the sale consideration or auction amount only, market value is not applied, and no rebate is available.

Duty is charged on the higher of the transaction value and the circle rate notified for that locality. Use the e-Valuation module on registration.uk.gov.in and the GIS rate list rather than a broker's estimate.

Where the sale consideration is Rs 50 lakh or more, the buyer must also deposit 1 per cent TDS under section 194-IA of the Income Tax Act in Form 26QB.

How to register a sale deed in Uttarakhand online

  1. Check the revenue record and the chain of title. Take the khatauni and khasra extract showing the seller as recorded holder, and use e-Search on registration.uk.gov.in to pull the property's registered document history.
  2. Find the circle rate. Open the e-Valuation module and the GIS rate list for the district, tehsil and village, and get the notified value for the khasra number, area and construction. Duty is on this figure or the agreed price, whichever is higher.
  3. Compute duty and fee. Apply 5 per cent stamp duty, or 3.75 per cent if the buyer is a woman and the value is up to Rs 25 lakh, and add the 2 per cent registration fee subject to the Rs 25,000 ceiling. The e-Valuation module produces both.
  4. Get the deed drafted by an advocate, with the exact khasra number, area, boundaries, consideration, mode of payment and possession date.
  5. File Public Data Entry (PDE) on registration.uk.gov.in, the online application for deeds. Enter the parties, the property and the deed content yourself, and save the PDE number.
  6. Pay stamp duty and the registration fee through e-Stamp and e-Payment on the same portal, and print the challans.
  7. Deposit TDS in Form 26QB if the consideration is Rs 50 lakh or more.
  8. Book the appointment through the department's online appointment system to register the deed at the Sub-Registrar office having jurisdiction.
  9. Attend with everyone — all buyers, all sellers and two witnesses, on the appointment date with the original deed, the challans, PAN and Aadhaar. Photographs and biometrics are captured at the counter.
  10. Execute and admit the document before the Sub-Registrar, who verifies the duty, checks identity and endorses the deed.
  11. Collect the receipt and, once the document is scanned and indexed, obtain the registered copy and verify it through e-Search.

How to register at a Sub-Registrar office without doing PDE yourself

  1. Locate the correct Sub-Registrar office using the office location map on registration.uk.gov.in, and confirm jurisdiction at the enquiry counter.
  2. Buy stamp paper of the correct value, or obtain the e-stamp certificate, and have the deed engrossed on it by a deed writer or advocate.
  3. Present the deed in person with all parties and two witnesses during working hours and take a token.
  4. Pay the registration fee at the counter, complete the photo and biometric capture, and insist on the printed receipt.
  5. Collect the endorsed document on the date written on your receipt.

Both routes end in the same departmental database. A deed typed at the counter is entered into the same system PDE feeds.

How do I check the status of my document?

  • e-Search on registration.uk.gov.in looks up registered documents and confirms your deed has been indexed.
  • Your PDE number traces the application through the department's system before registration.
  • The Sub-Registrar office can locate the file against the presentation receipt number.
  • Helpline +91 135 297 9384 for portal and process queries.

Is a registered sale deed valid forever, and what comes next?

A registered sale deed in Uttarakhand carries no expiry and needs no renewal. The register entry is permanent.

Two steps remain after registration, and buyers skip them constantly:

  • Mutation (dakhil kharij). Apply at the Tehsil so the khatauni records you as the holder of the khasra number. Until mutation happens, the revenue record still names the seller, and that is the record most government offices consult.
  • Municipal or society transfer, so the property tax record or the share certificate reflects the new owner.

Why do property registrations fail in Uttarakhand?

  • Duty computed below the circle rate, the commonest cause of impounding.
  • Female-buyer concession claimed above Rs 25 lakh, where the rate reverts to 5 per cent on the excess.
  • The 2 per cent registration fee miscalculated by ignoring the Rs 25,000 ceiling, or by applying the ceiling where it does not apply.
  • Land purchase restrictions. An outsider buying agricultural land without the required permission.
  • A co-owner absent on the appointment date, with no registered power of attorney.
  • An unregistered power of attorney offered in place of the owner.
  • Khasra number or area mismatch between the deed and the khatauni.
  • Name or date-of-birth mismatch across the deed, PAN and Aadhaar.
  • Presentation beyond four months of execution without paying the delay penalty.

What should you pay, and what should you refuse?

Three payments are legitimate: the stamp duty at the published rate, the 2 per cent registration fee capped at Rs 25,000, and any printed copying or service charge at the counter. Each generates a receipt or a challan you can verify online.

No deed writer, agent or middleman can reduce the 5 per cent duty. The rate is published by the department, and the value it applies to comes from the government's own circle rate and GIS rate list. Anyone offering a "cheaper registration" is proposing to under-declare the price, and the penalty for that falls on the buyer when the document is impounded. Registration.uk.gov.in slots are free, there is no paid priority queue. Never hand your Aadhaar OTP to an agent, and never sign a deed with the consideration column blank.

Frequently asked questions

What is the stamp duty on a sale deed in Uttarakhand?

Stamp duty on registration of a conveyance or sale deed of immovable property in Uttarakhand is 5 per cent in general, and 3.75 per cent for a female buyer up to Rs 25 lakh with 5 per cent applying beyond that, as published by the Stamp and Registration Department. For movable property covered by such a deed the rate is 2 per cent of the amount.

What is the registration fee in Uttarakhand?

The registration fee for a sale deed in Uttarakhand is 2 per cent of the value or consideration, subject to a maximum of Rs 25,000, as set out in the department's fee schedule. The cap applies regardless of the buyer's gender, so high-value transactions are protected from an open-ended fee.

Is there a concession for transfers within a family?

Yes, where members of a family who are co-owners specify their respective shares, stamp duty is payable at 0.25 per cent subject to a maximum of Rs 1,000, as published by the department. Family for this purpose means father, mother, husband, wife, son, daughter, daughter-in-law, brothers, sisters and grandchildren.

Is there any stamp duty rebate for disaster-affected people?

Yes, the Uttarakhand Stamp and Registration Department lists a 100 per cent rebate for each qualified disaster-affected beneficiary in five districts — Uttarkashi, Chamoli, Pithoragarh, Rudraprayag and Bageshwar. Land provided free by the State Government or donated by it for public institutions is also exempt from stamp duty.

What is Public Data Entry (PDE) in Uttarakhand?

Public Data Entry is the online application for deeds on registration.uk.gov.in, where you enter the parties, the property and the deed content yourself before visiting the Sub-Registrar. PDE feeds the department's registration software directly, so the counter visit becomes a verification step rather than a data-entry session.

Can outsiders buy land in Uttarakhand?

Uttarakhand restricts the purchase of agricultural land by people not domiciled in the state, and such purchases require permission from the competent authority rather than being freely registrable. Check the current land law position for your category and land type before signing an agreement, because a deed that breaches the restriction will not be registered.

Does registration change the khatauni record into my name?

No, registration and mutation are separate. After the sale deed is registered, apply to the Tehsil for mutation so that the khatauni and khasra records carry your name as the recorded holder.

What should I refuse to pay a middleman?

Refuse anything beyond the stamp duty, the 2 per cent registration fee and any printed copying or service charge that comes with a receipt. Nobody can lower the 5 per cent duty, because it is computed on the circle rate by the department's own e-Valuation system.
