Legal Heir Certificate in Uttarakhand (Uttaradhikar Praman Patra)
Uttarakhand state government scheme
A legal heir certificate in Uttarakhand, the Uttaradhikar Praman Patra, is a Revenue Department record of the surviving heirs of a deceased person. District administration pages list it as a tehsil service delivered through the state eServices portal at eservices.uk.gov.in, and the Tehsildar or Sub-Divisional Magistrate sanctions it after the Patwari and Kanungo verify the family.
What is a legal heir certificate in Uttarakhand?
A legal heir certificate in Uttarakhand, the Uttaradhikar Praman Patra, is a Revenue Department record naming every surviving heir of a person who has died. The Tehsildar or the Sub-Divisional Magistrate sanctions it, acting on the report of the Patwari and Kanungo for the village or ward.
Uttarakhand delivers citizen services through the state eServices / e-District platform at eservices.uk.gov.in and edistrict.uk.gov.in, and through CSC-Jan Seva Kendras. District administration websites list the legal heir certificate as a tehsil-level revenue service and direct applicants to that portal: Haridwar district, for example, lists it against Tehsil Haridwar, Roorkee, Bhagwanpur and Laksar.
Uttarakhand families need the certificate whenever an institution has to decide whom to pay after a death. The common uses are family pension, gratuity, provident fund, arrears of salary, compassionate appointment, insurance settlement, transfer of electricity and water connections, and mutation of the deceased's land in the khatauni.
What is the difference between a legal heir certificate and a succession certificate?
Uttarakhand, like every state, keeps two separate instruments, and picking the wrong one costs months.
- The legal heir certificate (Uttaradhikar Praman Patra) is administrative. A revenue officer records who survived the deceased. It is accepted for pension, gratuity, provident fund, salary arrears, compassionate appointment, utility transfers, and mutation of land records.
- A succession certificate is judicial. The competent civil court issues it under Part X of the Indian Succession Act, 1925, and it authorises the person named to receive the debts and securities of the deceased, fixed deposits, shares, debentures, bonds and mutual fund units. The court charges an ad valorem court fee on the value of those assets and issues a public notice inviting objections, which is why it takes months and needs an advocate.
Where the deceased left a registered will, neither route applies. The executor named in the will must apply for probate. Where the estate is immovable property and the heirs disagree, the answer is a partition suit, not a certificate. Always ask the bank, insurer or employer in writing which document they will accept before spending money.
Who can apply in Uttarakhand, and who cannot?
The following can apply:
- The surviving spouse of the deceased.
- Sons and daughters, including married daughters and legally adopted children.
- The mother and father of the deceased.
- Grandchildren claiming through a predeceased son or daughter.
- A natural guardian applying on behalf of a minor heir.
Uttarakhand attaches no income limit, no caste condition and no minimum residence period to this certificate, because it records a fact rather than granting a benefit. What it does require is jurisdiction. The deceased's last residence, or the property, must fall within the tehsil.
The following cannot apply and are not eligible:
- Relatives outside the class of heirs recognised by the personal law of the deceased. A nephew, cousin, in-law, tenant or friend cannot apply.
- Anyone applying where the deceased left a registered will, since probate is the correct route.
- Applicants where the deceased last lived outside Uttarakhand and held no property in the state.
- Applicants where another claimant has already objected or a civil suit is pending. A contested heirship is decided by the Tehsildar as a revenue court after a full hearing, or by a civil court, not by a routine certificate.
How to apply for a legal heir certificate in Uttarakhand
- Obtain the death certificate from the nagar nigam, nagar palika or gram panchayat that registered the death, and check that the name and address match the deceased's Aadhaar.
- Obtain the family register extract (Parivar Register nakal) from the gram panchayat secretary or the nagar palika ward office. This is the record the Patwari checks first.
- Prepare a notarised affidavit on stamp paper listing every surviving heir by name, age and relationship.
- Register on the Uttarakhand eServices portal at eservices.uk.gov.in with your mobile number, or go to a CSC-Jan Seva Kendra or the tehsil counter: district administration pages direct applicants for this service to the eServices portal.
- Fill in the deceased's full name, date of death, last residential address, and the district and tehsil, then list every heir with the exact relationship.
- Upload or attach the death certificate, family register extract, identity and residence proofs, relationship proofs for each heir, and the affidavit.
- Pay the fee charged at the counter or on the portal and keep the dated receipt with the application number — without it you cannot track or escalate.
- Attend the Patwari and Kanungo enquiry. An officer visits the address, checks the family register and may record neighbours' statements. Keep all originals available.
- Collect the sanctioned certificate from the tehsil office, the Jan Seva Kendra or the eServices download section once the Tehsildar or SDM has signed it.
How to apply offline at the tehsil office
- Visit the tehsil office for the area where the deceased last lived, in Haridwar district that means Tehsil Haridwar, Roorkee, Bhagwanpur or Laksar, and every district lists its own tehsils.
- Collect the heirship application form from the revenue clerk and fill it in naming all heirs.
- Attach the death certificate, family register extract, identity and residence proofs, relationship proofs and the notarised affidavit.
- Submit at the counter, pay the fee and take the dated acknowledgement.
- Attend the Patwari's enquiry when called, then collect the signed certificate from the tehsil office.
How do you check the status of your application?
Track the application on eservices.uk.gov.in using the application number on your acknowledgement, where each file shows its current stage. If the file has not moved after the Patwari's visit, take the printed acknowledgement to the Tehsildar's reader and ask for the position in writing. Uttarakhand districts publish contact details for each tehsil on their nic.in websites, and those pages are the reliable route to the right officer.
How long is the certificate valid, and does it need renewal?
An Uttarakhand legal heir certificate has no expiry date and needs no renewal, because it records permanent facts. Banks and insurers who ask for a "recent" copy want a fresh certified copy or a fresh portal download, not a fresh enquiry. A new application becomes necessary only when the recorded family composition must change, a child born after the death who has to be added, or an heir omitted by mistake who must be brought in.
Why do heirship applications get rejected in Uttarakhand?
- An heir was omitted, most often a married daughter or a child from an earlier marriage.
- The name is missing from the family register, so the Patwari cannot confirm the relationship.
- Name spelt differently across the death certificate, Aadhaar and the khatauni. Correct the mismatch before applying.
- Wrong tehsil. The file lodged where the deceased did not last reside and holds no land.
- No notarised affidavit, or one that does not name every heir.
- An objection from another claimant, which converts the file into a contested revenue case.
- Nobody available for the Patwari's field visit across repeated attempts, which is a real problem in hill districts where families have moved to the plains.
What does it cost, and should you use an agent?
Apply directly on the eServices portal or at the tehsil counter and pay only the fee the portal or counter charges, taking the printed receipt every time. The only unavoidable outside costs are the stamp paper and notarisation for the affidavit, and; if a bank insists on the court route, the ad valorem court fee and an advocate's fee for a succession certificate. Agents advertising a guaranteed fast Uttaradhikar Praman Patra cannot shorten the Patwari's enquiry, which is the step that governs the timeline. Never hand original documents to a middleman, and never pay cash without a receipt.
Where do you complain if the certificate is delayed?
Escalate in order: the Tehsildar, then the Sub-Divisional Magistrate, then the District Magistrate, whose office holds a regular public grievance hearing in every Uttarakhand district. Put the complaint in writing with the application number and the date of the Patwari's visit attached. Portal problems, a payment deducted with no acknowledgement, or a certificate that will not download; should go to the support contact published on eservices.uk.gov.in, and the district's nic.in website lists the tehsil and collectorate contacts.
A note on what could not be verified
The exact fee and the notified time limit for the Uttarakhand heirship certificate are not published uniformly across district websites, and the state service list is revised from time to time. Confirm both on the service page at eservices.uk.gov.in or at the tehsil counter before you pay, and insist on the printed receipt.

Frequently asked questions
Who issues a legal heir certificate in Uttarakhand?
The Tehsildar or the Sub-Divisional Magistrate sanctions the legal heir certificate in Uttarakhand, on the report of the Patwari and Kanungo for the village or ward. District administration pages list the service under the tehsils — Haridwar district, for example, lists it for Tehsil Haridwar, Roorkee, Bhagwanpur and Laksar.
Where do I apply for a legal heir certificate in Uttarakhand?
District administration pages point applicants to the Uttarakhand eServices portal at eservices.uk.gov.in, and the tehsil counter and CSC-Jan Seva Kendras also accept the application. The e-District system at edistrict.uk.gov.in is the same state service platform.
What is the family register and why does Uttarakhand ask for it?
The Parivar Register maintained by the gram panchayat or nagar palika is Uttarakhand's basic household record, and the Patwari uses the register extract as the first cross-check on the list of heirs. Obtain the nakal before applying, because a name missing from it will stall the file.
What is the difference between a legal heir certificate and a succession certificate?
A legal heir certificate is an administrative record made by a revenue officer of who survived the deceased, while a succession certificate is a civil court order under the Indian Succession Act, 1925 authorising the named heir to collect debts and securities. Banks holding large deposits and companies holding shares usually insist on the court's succession certificate.
Does an Uttarakhand legal heir certificate expire?
A legal heir certificate does not expire, because a death and the identity of the survivors are permanent facts. Institutions asking for a recent copy want a fresh certified copy or download, not a fresh application.
Do I need a legal heir certificate to mutate land in Uttarakhand?
Land standing in a deceased owner's name is transferred by a mutation entry in the khatauni, and the revenue staff make that entry using the death certificate together with the recorded list of heirs. Where the heirs disagree, the mutation becomes a contested revenue case decided by the Tehsildar after a hearing.
Can a married daughter be a legal heir in Uttarakhand?
Yes — a married daughter is a class-one heir under the Hindu Succession Act and must be named in the application. Omitting a married daughter is the most frequent reason an Uttarakhand heirship file is rejected or challenged afterwards.
Can I apply for a legal heir certificate for a relative who died outside Uttarakhand?
Apply in the tehsil where the deceased last resided or where the property lies, which for most families means the state of last residence rather than the state of death. If the deceased lived and held property outside Uttarakhand, the Uttarakhand tehsil has no jurisdiction.
