What is the BOCW Pension Benefit Scheme in West Bengal?

BOCW Pension Benefit Scheme is the old-age pension paid by the West Bengal Building and Other Construction Workers' Welfare Board to construction workers registered with it who have crossed 60 years of age. The scheme is administered by the Labour Department, Government of West Bengal.

According to labour.wb.gov.in, the West Bengal Building and Other Construction Workers' Welfare Board was constituted in 2005 under sub-section (1) of Section 18 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, through a Labour Department memorandum. The Minister-in-Charge of the Labour Department is the Chairman of the Board, the Secretary of the Labour Department is the Vice-Chairman, and the Labour Commissioner, West Bengal is the Executive Vice-Chairman.

The Labour Department lists "Pension after sixty years of age" as one of the statutory functions of the Board under Section 22 of the Act, alongside immediate assistance in case of accident, loans for house construction, group insurance premium support, educational assistance, medical expenses for major ailments and maternity benefit.

Construction work is physically punishing and almost entirely informal. A mason, bar-bender, shuttering carpenter or headload worker has no employer-funded provident fund and no gratuity. The Board's pension is a small, predictable monthly amount that continues after the body can no longer do the work. It is sometimes referred to locally as the nirman shramik pension or construction workers' pension.

How much pension does the West Bengal BOCW Board pay?

The Labour Department publishes the following rates on its Building and Other Construction Workers' Welfare Board page:

Benefit Amount
Pension (Beneficiary) Rs 750 per month
Pension (Family) Rs 375 per month
Assistance for accident (treatment) Rs 10,000
Disablement Rs 50,000
Death (natural) Rs 50,000
Death (accidental) Rs 1,50,000

Two numbers matter for this guide. The beneficiary pension is Rs 750 a month, which works out to Rs 9,000 in a full year. The family pension is Rs 375 a month, exactly half, and it becomes payable to the surviving family after a registered beneficiary dies.

The Labour Department has not published a revision date or an indexation formula for these rates, so treat Rs 750 and Rs 375 as the figures currently shown on the official page and re-check before making financial plans around them.

Who is eligible for the BOCW pension in West Bengal?

You can claim if:

  • You are registered as a beneficiary with the West Bengal Building and Other Construction Workers' Welfare Board and hold a valid registration book or identity card.
  • You have completed 60 years of age.
  • Your membership of the Board is live, that is, your subscription or contribution entries are up to date and membership has not ceased.
  • You are engaged, or were engaged, in building or other construction work as defined by the BOCW Act, 1996. This covers masons, carpenters, bar-benders, painters, plumbers, electricians on construction sites, road and bridge workers, welders, helpers and headload workers.

You are not eligible and cannot apply if:

  • You never registered with the West Bengal BOCW Welfare Board. Working on construction sites for decades does not by itself create a claim. Registration under the Act is the gateway, and it is the single most common reason an older worker is turned away.
  • You are below 60 years of age. Registration under Section 12 of the BOCW Act, 1996 is open to workers between 18 and 60 years who have worked in building or construction for at least 90 days in the preceding 12 months, but the pension itself only begins at 60.
  • Your membership has lapsed because contributions were not paid and it has not been revived.
  • You are an employer, contractor or establishment owner rather than a worker. The Board exists for workers.
  • You are a supervisor or office employee of a construction firm who does not do building work within the meaning of the Act.

For the family pension of Rs 375 per month, the claimant must be a surviving family member or recorded nominee of a registered beneficiary who has died.

How to apply for the BOCW pension in West Bengal

The Board does not publish a self-service online pension claim. The Labour Department states that the Regional Labour Offices under the Labour Commissionerate function as the regional offices of the welfare boards, so that is where the claim is filed.

  1. Confirm your registration is active. Take your BOCW registration book to the Regional Labour Office that issued it and ask the clerk to verify that your subscription entries are current and that the recorded date of birth shows 60 years complete.
  2. Collect the pension claim form from the Regional Labour Office. Fill in your registration number, name exactly as recorded with the Board, date of birth, address, and bank account number with IFSC.
  3. Attach the documents; registration book, age proof, Aadhaar, bank passbook first page and passport size photographs. Take originals for verification and self-attested photocopies for submission.
  4. Submit the claim at the Regional Labour Office and obtain a dated acknowledgement or receipt number. Keep it; this is what you quote when you follow up.
  5. Attend verification if called. The office may cross-check the date of birth, the contribution history and the bank details before the case is put up for sanction.
  6. Wait for the sanction and the first credit into your bank account. Once sanctioned, the pension continues monthly and does not have to be applied for again each year.

How to claim the family pension of Rs 375 a month

  1. Report the death of the registered beneficiary at the Regional Labour Office holding the registration.
  2. Submit the death certificate issued by the municipality, panchayat or registrar of births and deaths.
  3. Establish the relationship โ€” through the nomination already recorded with the Board, and supporting documents such as a ration card, Aadhaar or a family relationship certificate from the local authority.
  4. Give the claimant's own bank account details, Aadhaar and photographs, and collect the acknowledgement.

Where the death is natural or accidental, the family may also be eligible for the separate death benefit of Rs 50,000 or Rs 1,50,000 respectively, listed on the Board's benefit table. Ask about that in the same visit rather than making a second trip.

How do I check my pension claim status?

  • Regional Labour Office, quoting the acknowledgement number from your claim receipt. This is the most reliable route because the case file physically sits there.
  • Shramik Sathi helpline on 1800-103-0009, the Labour Department's toll-free number, for guidance on which office holds your case.
  • Bank passbook or account statement, to confirm whether the monthly credit has started.
  • Bangla Sahayata Kendra (BSK), the state's citizen service centre network, for help reading forms and letters if you find the paperwork difficult.

Why BOCW pension claims get rejected, and how to fix them

  • No valid registration. The worker was never enrolled with the Board. Nothing can be done retrospectively; registration is only open up to age 60.
  • Lapsed membership. Subscription entries stopped years ago. Ask the Regional Labour Office whether the membership can be revived and arrears accepted.
  • Date of birth mismatch. The registration book shows one date and Aadhaar another. Get the record corrected before filing, not after.
  • Name mismatch between the registration book, Aadhaar and the bank account. Electronic payment fails on a name mismatch. Correct the weakest record first.
  • Bank account closed, dormant or not seeded with Aadhaar. Reactivate the account or give a fresh one in writing.
  • Incomplete documents, particularly missing photographs or an unsigned form. These are returned rather than rejected and are the quickest to fix.
  • For family pension, no nomination on record. Establish relationship through documentary proof from the local authority.

How does Samajik Suraksha Yojana affect construction workers?

West Bengal introduced Samajik Suraksha Yojana (SSY) through Labour Department order Labr./257/(LC-LW)/LW/5M-112/16 dated 3 April 2017, effective 1 April 2017, as a single consolidated social security scheme for unorganised workers. SSY absorbed earlier schemes including the State Assisted Scheme of Provident Fund for Unorganised Workers (SASPFUW) and the West Bengal Unorganised Sector Workers' Health Security Scheme, and introduced the Samajik Mukti Card as the beneficiary identity card.

The Building and Other Construction Workers' Welfare Board continues to be listed separately on labour.wb.gov.in with its own benefit table, so a construction worker should check with the Regional Labour Office which record, the BOCW registration, the Samajik Mukti Card, or both, governs the pension in their case. The Labour Department has not published a single consolidated statement reconciling the two, and this is the point on which workers most often get conflicting answers at the counter.
