Legal Heir / Succession Certificate in Arunachal Pradesh

Arunachal Pradesh state government scheme

Quick answer

Legal Heir Certificate in Arunachal Pradesh is issued offline by the Deputy Commissioner's office or the Circle Officer of the circle where the deceased lived, not through the Arunachal eServices portal at eservice.arunachal.gov.in, which currently lists a Dependent Certificate but no legal heir service. A succession certificate for bank deposits, shares and debts comes only from the District Judge under the Indian Succession Act 1925.

What is a legal heir certificate in Arunachal Pradesh?

A legal heir certificate in Arunachal Pradesh is a written finding by the district administration that names every surviving heir of a person who has died, along with each heir's age and relationship to the deceased. Arunachal Pradesh issues it through the office of the Deputy Commissioner, normally after a field enquiry conducted by the Circle Officer or the Extra Assistant Commissioner of the circle in which the deceased last resided.

Arunachal Pradesh differs from most Indian states here in two concrete ways, and both matter before you start.

First, the state has no Tehsildar cadre. Where a family in Uttar Pradesh or Telangana would walk into a tehsil office, an Arunachal family goes to the circle office, and the circle administration; Circle Officer, Extra Assistant Commissioner, Additional Deputy Commissioner: performs the same revenue and magisterial function under the Deputy Commissioner.

Second, the legal heir certificate is not an online service. The Arunachal eServices portal at eservice.arunachal.gov.in, run by the Department of Information Technology with National Informatics Centre support, lists nine District Administration services: Inner Line Permit, Government Identity Card, Marriage Certificate, Scheduled Tribe Certificate, Permanent Residence Certificate, Temporary Residence Certificate, Income Certificate, Dependent Certificate and Character Certificate. A legal heir certificate and a succession certificate appear on neither that list nor the Police, Vigilance or Finance department lists on the same portal. Anyone who tells you otherwise is either confusing it with the Dependent Certificate or selling you a service that does not exist.

The second route. The succession certificate; is a court document, not an administrative one, and it exists everywhere in India under the same central statute. Sections 370 to 390 of the Indian Succession Act 1925 empower a District Judge to grant a certificate authorising the holder to receive debts due to the deceased and to transfer or receive dividends on securities. In Arunachal Pradesh that jurisdiction sits with the District and Sessions Judge.

Which one do you actually need?

Use the legal heir certificate from the Deputy Commissioner or Circle Officer when the claim is against a government or quasi-government office and is modest in size:

  • Family pension and commuted pension of a deceased state or central employee.
  • Gratuity, General Provident Fund and group insurance dues.
  • Compassionate appointment of a dependent in a state department.
  • Arrears of salary and leave encashment.
  • Transfer of a gas connection, electricity meter or ration card entry.
  • Release of small bank balances where the bank's internal limit permits an heirship declaration.

Use the succession certificate from the District and Sessions Judge when a third party is holding money or securities and wants court protection before releasing them:

  • Bank fixed deposits and savings balances above the bank's internal threshold.
  • Shares, debentures, mutual fund units and other securities.
  • Insurance proceeds where no nomination was registered.
  • Debts owed to the deceased by any person.

A legal heir certificate does not decide ownership of immovable property. If two branches of a family dispute who owns a plot or a house, no Circle Officer can settle it, that is a civil suit for partition or declaration, and in Arunachal Pradesh it may also engage the customary law of the community and the land transfer restrictions that apply in the state.

Who can and who cannot apply?

You can apply for a legal heir certificate in Arunachal Pradesh if you are a Class I heir or another surviving next of kin of a person who died while ordinarily resident in the state:

  • The surviving spouse, widow or widower.
  • Sons and daughters, including adopted children where the adoption is lawful.
  • The mother and, depending on the personal law applying, the father.
  • Grandchildren of a predeceased son or daughter, who step into their parent's share.
  • A guardian applying on behalf of a minor heir.

You cannot apply where the death took place and the deceased ordinarily resided outside Arunachal Pradesh, the enquiry is territorial, and a circle office cannot certify heirs of a family that never lived in its circle. You are also not eligible where you are a creditor, tenant, employer or family friend with a financial interest but no heirship: a creditor's remedy is a civil suit, not a heirship certificate. A Circle Officer will further refuse to proceed where the deceased left a registered will that has been produced, because a will displaces intestate succession and the executor's route is probate or letters of administration from the District Judge, not a heirship enquiry.

There is no income limit, no caste condition and no minimum property value for a legal heir certificate in Arunachal Pradesh. Being a Scheduled Tribe or a Permanent Resident of the state is not a precondition, though both certificates are commonly attached because they are already in the family's file.

What documents are required?

Arunachal circle offices work from a written application plus the following:

  • Death certificate of the deceased, in original for verification and a photocopy for the file.
  • Affidavit of heirship on stamp paper, sworn before a notary or Executive Magistrate, listing every surviving heir with age and relationship and stating that none has been omitted.
  • Identity and address proof of the applicant — Aadhaar, voter ID, or the Government Identity Card issued by District Administration.
  • Proof of relationship for each heir: birth certificates, school leaving certificates, the family ration card, or a marriage certificate for a spouse.
  • Statement or certificate from the Gaon Burah or village authority, which in Arunachal Pradesh carries real evidentiary weight where older heirs have no birth record.
  • Permanent Residence Certificate or Scheduled Tribe Certificate, where the estate involves land or a customary-law question.
  • Service and pension papers of the deceased, where the certificate is for family pension, GPF, gratuity or compassionate appointment.
  • Passport-size photographs of the applicant, as the counter requires.

How to get a legal heir certificate in Arunachal Pradesh

  1. Register the death and collect the death certificate. The Registrar of Births and Deaths of the town committee, local body or hospital issues it. Order at least four or five certified copies at once. The bank, the pension office, the insurer and the circle office each keep one.
  2. Prepare the affidavit of heirship. Draft it on stamp paper listing every surviving heir with full name, age, relationship and present address, and swear it before a notary or an Executive Magistrate. Leaving an heir out is the mistake that most often unravels a certificate later.
  3. Go to the circle office of the deceased's last residence. Ask the Circle Officer or Extra Assistant Commissioner's counter for the heirship application proforma if the circle uses one, and submit the written application with the death certificate, the affidavit, the relationship proofs and your own identity proof.
  4. Pay the counter fee and keep the receipt. Arunachal Pradesh does not publish a consolidated fee for this service on eservice.arunachal.gov.in, so pay only what the counter quotes and insist on a written receipt.
  5. Cooperate with the field enquiry. The Circle Officer verifies the family composition locally, often recording the Gaon Burah's or village authority's statement, and in many circles issues a public notice inviting objections from anyone claiming to be an omitted heir.
  6. Collect the certificate from the Deputy Commissioner's office once the enquiry closes and the objection period passes without a competing claim. Ask for extra attested copies in the same visit.

How to get a succession certificate from the court

  1. File a petition under Section 372 of the Indian Succession Act 1925 before the District and Sessions Judge having jurisdiction over the place where the deceased ordinarily resided, or where any part of the property is situated.
  2. Attach the schedule of debts and securities you are claiming; bank account numbers with balances, fixed deposit receipts, share certificates, mutual fund folios, together with the death certificate and proof of your relationship.
  3. Pay the ad valorem court fee calculated on the value of the debts and securities claimed, under the court fee law applicable in Arunachal Pradesh. The court's copying and process charges are separate.
  4. Wait out the public notice. The court publishes a notice in a newspaper and calls for objections, typically allowing 45 days. Objections convert the petition into a contested matter and lengthen it considerably.
  5. Collect the certificate and, where the court directs, furnish security before the certificate is released. Banks and depositories act on the certified copy.

How do you check the status of the application?

Arunachal Pradesh has no online tracker for the legal heir certificate, because the service is not on the eServices portal. Track it by the diary or receipt number issued at the circle office counter, and follow up with the dealing assistant at the Deputy Commissioner's office. The Arunachal eServices platform itself is supported by the Digital Cell of the Department of Information Technology on 155250, and the National Informatics Centre state unit on 0360 2212919; both listed on eservice.arunachal.gov.in. Use these for portal problems; for the heirship file itself, the Deputy Commissioner's grievance counter is the right door. A court succession certificate is tracked by the case number in the District and Sessions Judge's registry.

Why are legal heir applications rejected in Arunachal Pradesh?

  • An heir was omitted from the affidavit, and a rival claimant objected during the enquiry or the public notice period.
  • The deceased left a registered will, which makes probate or letters of administration the correct remedy instead.
  • The application went to a circle office that had no territorial connection to the deceased's last residence.
  • The relationship of one claimed heir could not be proved and no village authority statement was produced to fill the gap.
  • The death certificate was missing, or the name spelling on it did not match the identity documents of the deceased.
  • The dispute is really about ownership of immovable property, which no administrative certificate can settle.
  • A pending police case or civil suit over the same estate froze the enquiry.

What does it cost, and what about agents?

Arunachal Pradesh charges only what the Deputy Commissioner's or Circle Officer's counter quotes for the legal heir certificate, plus the real cost of stamp paper and notarisation for the affidavit. The state does not publish a fee schedule for this service online. Because there is no published figure, the risk of overcharging is higher here than for the certificates that do appear on eservice.arunachal.gov.in with fixed workflows, so take a receipt for every payment and never hand cash to an intermediary standing outside the office.

Agents around district headquarters in Itanagar, Naharlagun and the circle towns offer "guaranteed" heirship certificates for several thousand rupees. They cannot shorten the field enquiry, they cannot waive the objection period, and a certificate obtained on a defective affidavit is worse than none. It collapses the first time another heir challenges it. Prepare the affidavit honestly, file it yourself, and report any demand for money beyond the counter fee to the Deputy Commissioner's grievance cell.

Documents required

Death certificate of the deceased
Issued by the Registrar of Births and Deaths of the local body, town committee or the hospital-linked registrar. Every legal heir enquiry in Arunachal Pradesh starts from this document, and no Circle Officer will open a file without it.
Written application to the Deputy Commissioner or Circle Officer
A plain application naming the deceased, the date of death, the last residence and every surviving heir with age and relationship, signed by the applicant. Some circles issue their own printed proforma at the counter.
Affidavit of heirship on stamp paper
Sworn before a notary or an Executive Magistrate, listing all surviving heirs and stating that no heir has been left out. A false statement here is the single commonest ground on which a certificate is later cancelled.
Identity and address proof of the applicant
Aadhaar, voter ID or an Arunachal Pradesh Government identity card. The Government Identity Card is itself an Arunachal eServices item issued by District Administration.
Proof of relationship of each heir
Birth certificates, school certificates, the family ration card, or the marriage certificate for a widow or widower. Arunachal circles frequently accept a certificate from the Gaon Burah or the village authority as corroboration in tribal areas.
Permanent Residence Certificate or Scheduled Tribe Certificateoptional
Both are issued by District Administration through Arunachal eServices. They matter where the estate includes land held under the Bengal Eastern Frontier Regulation 1873 restrictions or where a tribal customary law question arises.
Certificate or statement from the Gaon Burah or village authorityoptional
In Arunachal Pradesh the Gaon Burah's confirmation of the family composition carries real weight in the Circle Officer's enquiry, particularly where formal birth records do not exist for older heirs.
Service or pension papers of the deceasedoptional
Needed where the certificate is being sought for family pension, gratuity, GPF or compassionate appointment in a state government department.
Petition under Section 372 of the Indian Succession Act 1925optional
Required only for the court route. Filed before the District and Sessions Judge with the schedule of debts and securities, and carrying ad valorem court fee on the value claimed.

Frequently asked questions

Can I apply for a legal heir certificate online in Arunachal Pradesh?

No, Arunachal Pradesh does not currently offer a legal heir certificate online. The Arunachal eServices portal at eservice.arunachal.gov.in lists Inner Line Permit, Government Identity Card, Marriage Certificate, Scheduled Tribe Certificate, Permanent Residence Certificate, Temporary Residence Certificate, Income Certificate, Dependent Certificate and Character Certificate under District Administration — but no legal heir or succession certificate. The application is made in person at the Circle Officer, Extra Assistant Commissioner or Deputy Commissioner's office.

Who issues a legal heir certificate in Arunachal Pradesh?

The Deputy Commissioner of the district issues the legal heir certificate in Arunachal Pradesh, usually after an enquiry by the Circle Officer or Extra Assistant Commissioner of the circle where the deceased last lived. Arunachal Pradesh has no Tehsildar cadre of the kind found in mainland states; the circle administration performs the same revenue and magisterial role.

What is the difference between a legal heir certificate and a succession certificate?

A legal heir certificate names the surviving heirs and is used for family pension, provident fund, gratuity, compassionate appointment and small claims, while a succession certificate is a court order under Sections 370 to 390 of the Indian Succession Act 1925 that authorises the holder to collect debts and securities of the deceased. Banks, insurers and depositories in Arunachal Pradesh ask for the succession certificate once the amount crosses their internal threshold.

What does a legal heir certificate cost in Arunachal Pradesh?

Arunachal Pradesh does not publish a consolidated fee for the legal heir certificate on eservice.arunachal.gov.in, so the amount payable is whatever the Deputy Commissioner's or Circle Officer's counter quotes, plus the cost of the stamp paper for the affidavit and the notary charge. Ask for a receipt for every rupee paid, and refuse any demand beyond the counter figure.

Is a Dependent Certificate the same as a legal heir certificate in Arunachal Pradesh?

No, a Dependent Certificate and a legal heir certificate answer different questions. The Dependent Certificate, which Arunachal eServices does issue online under District Administration, certifies that a named person was financially dependent on the deceased or on a serving employee. A legal heir certificate lists everyone who inherits. Some offices in Arunachal Pradesh accept the Dependent Certificate for compassionate appointment purposes, so confirm with the department asking for the paper before you apply for the wrong one.

Where do I get a succession certificate in Arunachal Pradesh?

File a petition under Section 372 of the Indian Succession Act 1925 before the District and Sessions Judge having jurisdiction over the place where the deceased ordinarily resided. The petition must list the debts and securities claimed, the court issues a public notice inviting objections, and the certificate is granted after the objection period on payment of ad valorem court fee on the value of the estate claimed.

Does customary tribal law affect inheritance in Arunachal Pradesh?

Yes, customary law of the community frequently governs succession to tribal land and clan property in Arunachal Pradesh, and Circle Officers routinely record the Gaon Burah's or village authority's statement on the family and the customary position during the heirship enquiry. Movable assets such as bank deposits, provident fund and insurance are still handled through the ordinary legal heir certificate and succession certificate route.

How long is an Arunachal Pradesh legal heir certificate valid?

A legal heir certificate in Arunachal Pradesh does not carry an expiry date, because it records a fixed set of facts about who survived the deceased. In practice banks and departments often ask for a copy issued within the last six months or a fresh certified copy, which the issuing office will supply from the same file.
