What is Shop & Establishment registration in Goa?

Shop & Establishment registration in Goa is the certificate the Department of Labour & Employment, Government of Goa issues to an employer running a shop, commercial establishment, restaurant, residential hotel, theatre or other place of public amusement in the state. Goa delivers it entirely through the Goa Online portal, where it appears under EoDB–Business Services with the department code LEM and the service code LEM37.

The governing law has just changed. The Goa Shops and Establishments Act 1973: Goa Act 13 of 1973, enforced from 24 October 1974, with the stated purpose of regulating conditions of work and employment in shops, commercial establishments, restaurants, theatres and other establishments; was the state's law for half a century. India Code now also records the Goa Shops and Establishments (Regulation of Employment and Conditions of Service) Act 2025, Goa Act 23 of 2025, enacted on 7 August 2025 with an enforcement date of 19 September 2025, owned by the same Department of Labour & Employment. Its long title extends to workers employed in shops, commercial establishments, residential hotels, restaurants, eating houses, theatres, other places of public amusement or entertainment and other establishments. Employers registering in Goa now should therefore ask the Labour Inspector which Act their file is being processed under, and expect forms and rules to be reissued under the 2025 Act.

What has not changed is the delivery route and the timeline. The Goa Online service page states a processing time of seven days under the Goa Right of Citizens to Time-bound Delivery of Public Services Act, names the Labour Inspector as the designated officer and the Labour Commissioner as the appellate authority. Goa is one of the few states that publishes both the officer and the appeal route on the service page itself, which makes an overdue file straightforward to escalate.

Who can and who cannot apply?

You can apply for Shop & Establishment registration in Goa if you are the employer of premises inside Goa falling in the categories the Act covers:

  • A shop; any premises where goods are sold retail or wholesale, or where services are rendered to customers, including its office, store room, godown or warehouse.
  • A commercial establishment, an office, agency, consultancy, bank branch, insurance office or brokerage.
  • A restaurant, eating house or residential hotel. A large category in Goa, and one that brings extra conditional documents with it.
  • A theatre or other place of public amusement or entertainment.
  • Any of the above run as a proprietorship, partnership firm, LLP, private limited company, society or trust. The constitution changes only which conditional document you upload.

You cannot apply through this route for a factory. Factory premises are licensed under the Factories Act 1948 by the state's factories and boilers authority, not by the Labour Inspector on the LEM37 service. Nor can you register premises that are not in Goa, registration is territorial and is decided by the Labour Inspector with jurisdiction over the address on the file.

You are also not eligible to submit an application on a provisional trade licence. The Goa Online service page states the requirement as "Trade Licence/NOC from Panchayat (Not provisional)". A provisional document is rejected outright. In a Panchayat area that means the Panchayat's final trade licence or NOC; in a municipal area, the corresponding municipal licence. This single condition causes more returned Goa applications than any other.

There is no income limit, no domicile requirement and no minimum turnover for Goa Shop & Establishment registration. What decides the file is the premises, the trade licence, and whether the conditional documents match the nature of the business.

What documents are required?

Goa publishes its checklist on the service page itself, split into mandatory and conditional documents.

Mandatory:

  • Authority letter for signature, authorising the person signing on behalf of the establishment.
  • Forms XXVIII, XXIV and XXV, the three statutory forms the service page names.
  • Identity proof, PAN card, Voter ID or Aadhaar card.
  • Premises document: house tax copy, lease deed, sale deed, or a notarised NOC from the landowner where you do not own the premises.
  • Trade Licence or NOC from the Panchayat, final and not provisional.

Conditional, required according to how the business is constituted and what it does:

  • Memorandum and Articles of Association, or the partnership deed, or the society or trust registration papers.
  • Food or drugs licence, for a restaurant, eating house, bakery, food outlet or pharmacy.
  • Excise licence — for a bar, liquor shop or any establishment serving or selling alcohol.
  • Tourism or mining licence, for establishments in the tourism trade or in mining-related business, both distinctively Goan categories.
  • RBI authority letter, where the business needs Reserve Bank of India authorisation.

The application itself is framed on the service page as "FORM I [See rule 3, Statement under section 3(1)]".

How to apply for Shop & Establishment registration in Goa online

  1. Get the final trade licence first. The Panchayat or Municipality must issue the trade licence or NOC before you start, and it must not be provisional. Everything else in the Goa file can be arranged in an afternoon; this cannot.
  2. Register on goaonline.gov.in. Create the citizen or business account, verify the mobile number and email, and log in.
  3. Create the business profile with PAN validation. Goa Online validates the PAN of the establishment or proprietor at this stage, so the PAN name and the business name on the application must agree.
  4. Open the Shop and Establishment Registration service, department code LEM, service code LEM37, listed under EoDB–Business Services, and complete the registration form with the establishment's name and address, category, employer details, and worker count.
  5. Upload the documents; authority letter, Forms XXVIII, XXIV and XXV, identity proof, premises document, and the final trade licence or Panchayat NOC, plus every conditional document that applies to your trade.
  6. Wait for departmental verification. The Department of Labour & Employment verifies the file before payment is called for; Goa does not take money on submission.
  7. Pay the fee when the portal asks, after verification, and download the registration certificate once the Labour Inspector issues it. The seven-day clock under the Goa Right of Citizens to Time-bound Delivery of Public Services Act runs against this file.

How do you renew a Goa shop registration?

Goa Online runs renewal as a separate service, LEM45 to Shop and Establishment Renewal, under the same Labour and Employment module. Use it rather than filing a fresh LEM37 registration: a duplicate new registration for premises that already carry one is rejected, and the renewal service is designed to carry your existing registration number forward. Start the renewal before the validity on your current certificate lapses, because an establishment operating on a lapsed registration is treated as unregistered during an inspection.

How do you check the status and escalate?

Track the application from your Goa Online account against the application number the portal generates on submission. The status shows submission, verification by the department, payment due, and issue of certificate.

If the seven-day processing time passes without a decision, the escalation route is published on the service page itself: the Labour Commissioner is the appellate authority for this service, and the time limit is set under the Goa Right of Citizens to Time-bound Delivery of Public Services Act. For portal problems rather than departmental ones, a payment that did not register, an upload that will not attach: Goa Online's support line is +91-8882988000, working 9:30 AM to 1:15 PM and 2:15 PM to 5:45 PM, Monday to Friday, and services[dot]goa[at]gov[dot]in is the published email.

Why are Goa shop registration applications rejected?

  • A provisional trade licence or NOC is uploaded. The service page rejects provisional documents by name, and this is the single commonest cause.
  • The authority letter is missing, or is signed by someone whose authority the entity documents do not establish.
  • One of Forms XXVIII, XXIV or XXV is left out: all three are mandatory, not alternatives.
  • A restaurant or bar files without the food, drugs or excise licence its trade requires. In Goa, where hospitality dominates, this is a frequent defect.
  • The premises document does not connect the applicant to the address, no lease deed, no sale deed, and no notarised NOC from the landowner.
  • The PAN validation fails because the PAN name and the business name on the application do not agree.
  • A factory applies on LEM37 instead of to the factories authority.

What does it cost, and what about agents?

Goa charges only the government fee the Goa Online portal calls for after departmental verification, and nothing on submission. That sequencing is itself a protection: if anyone asks you for money before the Department of Labour & Employment has verified your file, they are not collecting a government fee.

Agents around Panjim, Margao and the coastal belt sell "shop licence in 24 hours" packages to new restaurants and beach-side businesses. They cannot compress the seven-day statutory period, they cannot make a Panchayat issue a final trade licence any faster, and they file the identical LEM37 form on the same portal. Where they do real damage is by submitting on a provisional trade licence to look fast, which gets the file rejected and the fee wasted.

File it yourself, keep the Goa Online acknowledgement and the payment receipt, and report any demand beyond the portal fee to the Labour Commissioner or on the Goa Online support line +91-8882988000.

What do you need the certificate for afterwards?

A Goa Shop & Establishment registration certificate is what a bank asks for before opening a current account in the business name, what a landlord or mall management asks for before signing a commercial lease, what payment gateways and online marketplaces accept as entity proof, and what tourism, excise and food-safety offices ask to see alongside their own licences. For Goa's large hospitality sector it is also the document an inspecting Labour Inspector asks for first, which is why keeping it current, and renewing through LEM45 rather than letting it lapse, matters more here than the one-time cost of getting it.
