What is property registration in Jammu and Kashmir?

Property registration in Jammu and Kashmir is the recording of a sale deed, gift deed or other instrument in the register of a Sub-Registrar under the Registration Act, 1908, handled by the Department of Registration, Government of Jammu and Kashmir, headed by the Inspector General of Registration.

Registration is what makes the transfer legally effective. A buyer who has paid the price and taken possession of a plot in Jammu or a house in Srinagar has no title a court will recognise until the deed is registered and endorsed.

The Department of Registration lists exactly three services, which is a useful map of what the office actually does:

  1. Registration of documents relating to immovable property, meaning land, and of miscellaneous documents.
  2. Delivery of registered documents.
  3. Issuance of duplicate documents, the route to take when an original deed is lost.

Which system does Jammu and Kashmir use?

Jammu and Kashmir runs on the National Generic Document Registration System (NGDRS) at ngdrs.jk.gov.in, built by the National Informatics Centre for the Department of Land Resources, Government of India, and operated here in coordination with the J&K Department of Registration.

The department records three facts about the rollout that matter to a buyer:

  • NGDRS has been available across the entire Union Territory since 9 November 2020.
  • The registration system is fully computerised, with electronic payment of stamp duty and registration fee.
  • There are 86 Sub-Registrar offices, including 9 Additional Sub-Registrar offices, across the Jammu and Kashmir divisions.

Alongside NGDRS the department points to two payment routes: e-stamping through SHCIL at shcilestamp.com, and free e-registration through JKGRAS, the J&K Government Receipt Accounting System at jkgras.jktreasury.gov.in.

Who can and cannot register a property in Jammu and Kashmir?

You can register if:

  • You are the buyer and seller of land, a house, a flat, a shop or commercial property anywhere in the Union Territory.
  • You are a resident of another Indian state or union territory buying non-agricultural immovable property. Following the reorganisation of the erstwhile State, the earlier bar on outsiders acquiring immovable property no longer applies to non-agricultural land.
  • You are a donor and donee on a gift deed, or family members recording a partition or exchange.
  • You are an NRI or OCI buying residential or commercial property, which FEMA permits.
  • You are a company, trust or society acting through an authorised signatory.
  • You hold a registered power of attorney for a party who cannot attend.

You cannot register if:

  • You are a non-agriculturist buying agricultural land. Agricultural land in Jammu and Kashmir remains restricted and cannot be freely transferred to someone who is not an agriculturist.
  • You are a foreign national of non-Indian origin resident outside India buying immovable property without RBI approval, which FEMA does not permit.
  • The land is state land, kahcharai, forest or common land, or otherwise not the seller's to sell.
  • The property is under court injunction, attachment or acquisition.
  • The seller is not the recorded owner in the revenue record, or the chain of earlier deeds is broken.
  • Stamp duty is short-paid against the notified market value for the district, tehsil, village or ward.

What are the stamp duty and registration charges?

Jammu and Kashmir charges stamp duty on a sale deed at a rate that varies with the gender of the buyer, with a materially lower rate for a woman purchaser and an intermediate rate for a husband-and-wife joint purchase. The registration fee is levied as a percentage of the value of the immovable property, and is paid electronically along with the duty.

The Department of Registration publishes its Stamp Duty Rates section on igr.jk.gov.in, where the rates are issued as district-wise PDF documents; Jammu, Srinagar and every other district of both divisions, each with its own schedule. That district-by-district structure is deliberate: the notified market value differs sharply between a Srinagar ward and a rural tehsil, and the duty follows the value.

Because the rate schedules are revised and are published per district rather than as one state-wide table, the honest instruction is: open the PDF for your own district on igr.jk.gov.in, and run the NGDRS valuation and stamp duty calculator for your own deed, before you budget. Duty is charged on the higher of the consideration and the government-notified market value: commonly searched as the circle rate or ready reckoner rate, for the district, tehsil, village, ward or locality in question.

How to register a property in Jammu and Kashmir

The Department of Registration sets out the NGDRS workflow as a sequence of 13 steps. In practice it runs like this:

  1. Verify title and revenue record first. Get the fard intikhab or record of rights extract for the khasra, confirm the seller is the recorded owner, and check the class of land, agricultural land is restricted.
  2. Check the notified market value for your district in the stamp duty rate PDF on igr.jk.gov.in.
  3. Create a citizen login on NGDRS J&K at ngdrs.jk.gov.in and sign in as a Citizen user, or as an Organization user if you are registering on behalf of a company.
  4. Enter the general information for the deed — the type of document, the place and the date of execution.
  5. Enter the property details and let the system value the property. NGDRS J&K carries online valuation and stamp duty calculation, so the duty is computed by the system rather than guessed.
  6. Enter the party details, designating who is the executant and who is the claimant, and then the witness information. Witnesses are required.
  7. Pay the stamp duty and registration fee electronically, through e-stamping via SHCIL or through JKGRAS, and save the challan or e-stamp certificate.
  8. Review the pre-registration summary, correct any error in the schedule, names or extent, and upload the scanned documents.
  9. Submit the data for the Sub-Registrar's check.
  10. Schedule the appointment at the Sub-Registrar office having jurisdiction over the property. There are 86 offices, so confirm which one covers your tehsil.
  11. Attend in person on the appointment date. Buyer, seller and both witnesses appear with originals; photographs and identity are captured and the parties admit execution before the Sub-Registrar.
  12. Collect the registered deed under the department's document delivery service, with its registration number and endorsement.
  13. Apply for mutation in the revenue record afterwards, so that the record of rights shows your name. Registration alone does not update the revenue record.

How do I check the status of a J&K registration?

  • On NGDRS J&K, log in to your citizen account and open the application or appointment view to see the stage of the file.
  • Through the NGDRS grievance portal, which the department has launched for complaints about the registration process.
  • At the Sub-Registrar office, quoting the token or receipt number.
  • By email to the Department of Registration at igrjnk@gmail.com or igr-govt@jk.gov, the addresses the department publishes.
  • Under the RTI Act, the department names its Central Public Information Officer, Mr Mubashir Mohd Bhat, JKAS, on 7889989238.

Why do registrations get rejected or delayed in J&K?

  • Value below the notified market rate for the district or tehsil, the commonest reason a deed is refused or duty is demanded again.
  • Agricultural land sold to a non-agriculturist, which the restriction does not permit.
  • Seller not the recorded owner in the fard, or an earlier mutation never sanctioned.
  • Witness absent. The department states witnesses are required, and the appointment cannot be completed without them.
  • Wrong Sub-Registrar office chosen out of the 86 in the Union Territory.
  • Name and spelling mismatches between Aadhaar, PAN and the earlier deed: common where names are transliterated differently across documents.
  • Missing NOC for Housing Board, development authority or leasehold property.
  • TDS not deducted where consideration is Rs 50 lakh or more.
  • Payment made but not mapped to the NGDRS token, which is why the challan number must be entered exactly.

How long is the deed valid, and what should it cost?

A registered sale deed in Jammu and Kashmir has no expiry and needs no renewal. It is a permanent entry in the Sub-Registrar's register, and if the original is lost the department's duplicate document service is the way to get a fresh copy, you do not re-register the transaction.

What does carry a time limit is presentation: a deed must ordinarily be presented for registration within four months of execution, and later presentation needs the Registrar's condonation with a penalty.

Jammu and Kashmir charges only the stamp duty and the registration fee computed by the NGDRS system, paid electronically against a challan or e-stamp certificate. The NGDRS citizen account, the online data entry, the valuation calculator, the document upload and the appointment scheduling are free, and the department explicitly describes e-registration through JKGRAS as free.

Agents outside tehsil complexes in Jammu, Srinagar, Anantnag and Udhampur offer to "complete the registry" for a lump sum. They are filling the same 13 screens on the same NGDRS portal. There is no paid priority appointment, and no officer can register a deed stamped below the notified value. A licensed deed writer or an advocate charging a fair, receipted fee for drafting and title scrutiny is doing genuine work; cash for speed is not. Never hand your NGDRS password or Aadhaar OTP to an agent, and never accept an e-stamp certificate you have not verified yourself on the SHCIL verification page.

Grievance and helpline route

  • NGDRS grievance portal, launched by the department for complaints about registration.
  • Sub-Registrar of the office where the document was presented, for anything about the deed itself.
  • Department of Registration, J&K; email igrjnk@gmail.com or igr-govt@jk.gov.
  • Central Public Information Officer, Mr Mubashir Mohd Bhat, JKAS: 7889989238, for RTI applications about a registration file.
  • Inspector General of Registration, Jammu and Kashmir, for escalation.
  • Deputy Commissioner of the district, where the problem is with the revenue record or mutation rather than the registration itself.

Carry the NGDRS token number or the registration number and year to any of these. Without it, no office can trace the file.

Where do I find the circle rate for my property in J&K?

The Department of Registration publishes stamp duty rate documents district by district on igr.jk.gov.in, covering the districts of both the Jammu and the Kashmir divisions. Yes, since the reorganisation of the erstwhile State and the repeal of the restrictions that flowed from Article 370, non-residents can buy non-agricultural immovable property in Jammu and Kashmir. Agricultural land remains subject to restriction and cannot be freely bought by a non-agriculturist.
