Shops & Establishment Registration in Jammu and Kashmir is issued by the Department of Labour and Employment, Government of J&K, and the entire process runs through the J&K Single Window System at singlewindow.jk.gov.in. The department publishes a Standard Operating Procedure for the service: titled "Registration under The Shops and Establishment Act (including 365 days licence)", which is unusually detailed for a state Shops Act service and sets out the fee slabs, the document checklist, the process flow and the statutory timeline.

What is Shops & Establishment Registration in J&K?

Registration under the Shops and Establishments law brings a shop, commercial establishment, hotel, clinic, school or showroom onto the Labour Department's register. The certificate is the standard proof in Jammu and Kashmir that a business is legally operating at a given address, and it is what banks, licensing authorities and inspectors ask for.

The J&K service is bundled with the 365-day licence, which is why the SOP title names both. The fee is charged per annum, so the registration is annual rather than a once-and-forever certificate.

Who has to register and who does not?

The J&K fee schedule itself is the clearest guide to who is covered, because it lists categories by name:

  • ₹2,000 a year: hotels (A&E), nursing homes, cinema halls, privately managed educational institutions of two levels and above, privately managed professional colleges and institutions, petrol pumps, insurance companies other than the Life Insurance Corporation, financial institutions, banks other than the Reserve Bank of India and the State Bank of India, chartered accountant chambers, wine shops, vehicle showrooms and gas agencies: where these are not covered under the Factories Act.
  • ₹1,000 a year: computer training centres, jewellers, STD/ISD/PCO centres, health fitness centres, health clinics, X-ray, ultrasound and ECG centres, hostels in C&D categories, banquet halls (janjgahars), cable operators, medical agencies, agencies other than medical agencies, privately managed high schools and ice factories, again where not covered under the Factories Act.
  • ₹800 a year: privately managed middle schools.
  • ₹500 a year: clinical laboratories, privately managed primary schools, beauty parlours, tent and light houses, and ice candy units not covered under the Factories Act.

Ordinary shops and commercial establishments are then charged by headcount, from ₹50 to ₹2,000 a year.

Who cannot apply here: establishments covered under the Factories Act are expressly excluded from several of these categories and register with the Factories wing instead. The Reserve Bank of India and the State Bank of India are carved out of the banks category, and the Life Insurance Corporation is carved out of the insurance companies category. A business located outside Jammu and Kashmir is not eligible and must register under its own state's law.

How to apply for shop and establishment registration in Jammu and Kashmir

The SOP lays out the applicant's process flow step by step:

  1. Register on the Single Window System at singlewindow.jk.gov.in. If you are already registered, log in with your existing user ID and password. Sign-up is OTP-verified, and the registration details come to your registered email and mobile number.
  2. Create a Project. On the Single Window System a Project is your new or existing business or industry. Everything else hangs off it.
  3. Fill the Common Application Form (CAF) for the project, capturing the common details every department needs. Once the CAF ID is created, you can pick the specific service form you want.
  4. Upload your documents in the Document Manager before filling the service form. The mandatory set is the rent deed or affidavit (PDF), a photograph of the employer (JPEG/JPG), the Aadhaar card, election card or driving licence of the principal employer (PDF), and a photograph of the business premises or unit (JPEG/JPG). A partnership deed and a GST certificate are uploaded where applicable.
  5. Select "Registration under The Shops and Establishments Act" from Service Clearance and fill the form. It asks for the name and location of the establishment, two address lines, city, district, PIN code, email, phone, nature of work carried on, and the total number of workers to be employed. If you have an office, storeroom, godown or warehouse attached to the establishment but in different premises, its full postal address is captured separately. Partner, member, director or shareholder details are optional; the name, designation and permanent address of the employer, manager or agent in immediate charge of general management is mandatory.
  6. Make the payment online using debit card, credit card or net banking, at the annual rate for your category.
  7. Submit to the Inspector Labour. The Inspector scrutinises the application with its uploaded documents, reports any deficiency to you within fifteen working days, and, if there is no deficiency; issues or rejects the registration within fifteen working days.
  8. Download the certificate from your login once it is approved. The SOP confirms the certificate can be downloaded from the applicant login.

What does registration cost in Jammu and Kashmir?

Fees are per annum and set by category. For ordinary shops and commercial establishments the slabs are:

Establishment Fee per annum
Shops and commercial establishments run by owners without any employees ₹50
Shops and establishments employing less than 3 workers ₹150
Employing 3 to 4 workers ₹300
Employing 5 to 9 workers ₹500
Employing 10 to 19 workers ₹1,000
Employing 20 or more workers ₹2,000

Named categories — hotels, nursing homes, cinema halls, banks, petrol pumps and so on; pay ₹2,000, ₹1,000, ₹800 or ₹500 a year as listed above.

Pay only these amounts, and pay them inside the Single Window application using your own card or net banking. There is no cash counter in this process and no agent needs to touch your payment. J&K's fee for a small shop is among the lowest in India, an owner-run shop pays ₹50 a year, so any four-figure "fee" quoted by a middleman for a small shop is almost entirely their own charge.

What happens if I register late?

The application gets compounded. The SOP is specific: if the applicant delays the registration, the application is compounded by the Assistant Labour Commissioner and returned to the applicant. The applicant then has to submit the necessary compound fee and resubmit the application to the Inspector Labour. Registering on time is therefore materially cheaper than registering late.

How do I check status and what is the timeline?

Everything happens inside your Single Window login. The published departmental timeline is 15 days, split as follows:

  • Level 1 to Inspector (concerned), 15 days: verifies the documents, raises a query with the applicant if needed, and takes the decision to approve and issue the certificate or to reject.
  • Level 1 to Assistant Labour Commissioner, 15 days: where the applicant has delayed registration, the application is compounded and returned.

If a query is raised you submit the clarification through the same application; the SOP shows the clarification loop returning to the Inspector for verification rather than requiring a fresh application.

Why do J&K applications get rejected or delayed?

  • A missing rent deed or affidavit. This is the first mandatory document on the checklist, and possession of the premises is the thing the Inspector checks hardest.
  • Wrong file formats. The SOP is precise: the rent deed, identity proof, partnership deed and GST certificate go up as PDFs, while the employer photograph and the premises photograph must be JPEG or JPG. Uploads in the wrong format are rejected by the Document Manager.
  • No photograph of the business premises. Applicants often upload only their own photograph.
  • Incomplete mandatory fields, the employer or manager block (full name, father's or husband's name, address, city, district, PIN, email and contact number) is entirely mandatory, unlike the partner and director block.
  • A partnership firm applying without the partnership deed.
  • Applying long after the establishment started work, which triggers the compounding route through the Assistant Labour Commissioner.

Where do I get help?

The J&K Single Window System at singlewindow.jk.gov.in is the department's own facilitation channel and publishes the SOP, the fee schedule and the service list for the Department of Labour and Employment. The Labour Commissioner's office site at jklabourcomm.jk.gov.in publishes the Labour Acts, including the Shops and Establishments Act text, and the departmental portal jklabouremp.nic.in carries the Citizen Charter for the Department of Labour and Employment with the department's service commitments. Escalation on a registration held past the fifteen-day timeline goes to the Assistant Labour Commissioner for the district.

Note that J&K has moved to a newer Shops and Establishment (Regulation of Employment and Conditions of Service) Act replacing the 1966 Act cited in the published SOP. The Single Window service, its fee slabs and its process flow are the ones the portal currently applies; check jklabourcomm.jk.gov.in for the current statutory text before relying on a specific section number.

What is a CAF on the J&K Single Window portal?

A Common Application Form. Once the CAF ID is created you can pick individual service forms, including shop and establishment registration, from the available list.

How do I get my certificate once it is approved?

Download it from your Single Window login. The SOP states that after approval the applicant receives the status and can view or download the certificate through the login — no visit to a labour office is needed.

Which law governs shops and establishments in Jammu and Kashmir?

The Single Window SOP for this service cites the Shops and Establishments Act 1966 as the governing policy, and the fee slabs and process described on that SOP are the ones the portal applies.
