Legal Heir / Succession Certificate in Karnataka (Surviving Family Members Certificate)

Karnataka state government scheme

Quick answer

A legal heir certificate in Karnataka is issued by the Revenue Department as the "Surviving Family Members Certificate" through Nadakacheri at nadakacheri.karnataka.gov.in. The Tahsildar signs it, the published service charge is Rs 40, and the Sakala stipulated timeline is 14 working days. A court-issued succession certificate is separate and needed for larger financial claims.

Benefit
An official Revenue Department record of who the surviving family members of a deceased person are, accepted by Karnataka government departments, pension offices, banks and employers for claim settlement
How to apply
Both — online at nadakacheri.karnataka.gov.in, or in person at any Nadakacheri (Atalji Janasnehi Kendra) or the taluk Tahsildar office

What is a legal heir certificate in Karnataka?

A legal heir certificate in Karnataka is the Revenue Department's official record of who survived a deceased person. Karnataka does not use the phrase "legal heir certificate" on its own portal. On Nadakacheri, the state's Atalji Janasnehi Kendra portal at nadakacheri.karnataka.gov.in, the service is listed as "Surviving Family Members Certificate", one of the 44 services delivered through Nadakacheri counters and online.

The certificate names the spouse, children, parents and other surviving members of the deceased, states their relationship, and is signed by the Tahsildar of the taluk after the Village Accountant verifies the family on the ground.

Karnataka families need it for:

  • Family pension and arrears of salary where a state or central government employee has died in service or after retirement.
  • Provident fund, gratuity and group insurance claims made to the employer or to EPFO.
  • Compassionate appointment in Karnataka government service, where the department must know exactly who the dependants are.
  • Mutation of land and property records into the names of the survivors.
  • Release of small bank balances, insurance proceeds and scheme dues.

Legal heir certificate or succession certificate, which one do you need?

Karnataka runs two entirely different routes, and applying for the wrong one wastes months.

The Surviving Family Members Certificate (Tahsildar route) is an administrative certificate. It says who the survivors are. It does not decide shares, it does not settle a dispute, and it does not by itself transfer ownership. It is the right document for pension, provident fund, gratuity, compassionate appointment, scheme benefits and most routine claims. It costs Rs 40 and carries a 14 working day Sakala timeline.

A succession certificate (civil court route) is an order of the competent civil court under the Indian Succession Act, 1925. The court publishes a notice, hears objections, and then authorises the holder to receive the debts and securities of the deceased. It costs court fee calculated as a percentage of the value involved, needs a lawyer in practice, and takes months rather than weeks. Banks releasing substantial deposits, companies transferring shares and debenture registrars normally insist on this order, not on the Tahsildar's certificate.

A third Karnataka document sits alongside both: the Vamshavruksha, issued on Nadakacheri as "Attestation of Family Tree" at Rs 40 with a 14 working day Sakala timeline. Vamshavruksha maps lineage across generations and is what Karnataka revenue offices usually want in ancestral land and mutation matters.

Where there is a registered will, the executor may instead need probate from the court, and neither the Nadakacheri certificate nor a succession certificate substitutes for it.

Who can apply, and who cannot?

You can apply if:

  • You are the surviving spouse, son, daughter, mother or father of the deceased.
  • You are a grandchild or other dependant who lived in the same household and is named in the family ration card.
  • You are the legal guardian of a minor heir, applying on the minor's behalf.
  • The deceased ordinarily resided in the taluk you are applying in, which is what fixes jurisdiction.

You cannot apply if:

  • You are not related to the deceased, a friend, a neighbour, a landlord or a creditor is not eligible, whatever paperwork they hold.
  • You are trying to get the certificate to exclude another heir. The Village Accountant's job is precisely to find every surviving member, and a suppressed heir is grounds for cancellation later.
  • The estate is disputed and heirship itself is contested. A Tahsildar cannot adjudicate a heirship dispute; that goes to the civil court.
  • You need authority to collect large bank deposits or securities. Nadakacheri cannot issue that; only a succession certificate from the court can.
  • The death is not registered. Register the death first and obtain the death certificate; the Nadakacheri application cannot be filed without it.

What documents are required?

Document Mandatory Notes
Death certificate of the deceased Yes Registered with the local body
Applicant's Aadhaar / identity proof Yes Aadhaar e-KYC is the usual route
Identity details of every surviving member Yes Each person to be named must be identified
Family ration card Yes Establishes the household
Proof of relationship Sometimes Marriage certificate, birth certificate, school record
Address proof of the deceased Sometimes Fixes the correct taluk
Service or pension record For pension claims Quoted by the employing department
Self-declaration that no heir is omitted Sometimes Asked for in many taluks

Scan each document as a clear file within the size limit the upload box shows. Blurred and cropped scans are rejected routinely, and a rejection restarts the 14-day clock.

How to apply for a legal heir certificate in Karnataka online

  1. Open nadakacheri.karnataka.gov.in and choose "Online Application". Register with your mobile number and verify the OTP; one registration covers all Nadakacheri services.
  2. Select "New Request" and pick "Surviving Family Member" from the service list. Do not pick "Attestation of Family Tree" unless the office asking you for a document has specifically named Vamshavruksha.
  3. Enter the deceased person's details: full name as printed on the death certificate, date of death, and the district and taluk of ordinary residence.
  4. Add every surviving family member with name, age, relationship to the deceased and Aadhaar details. Add them all. An omitted heir is the single most common reason a Karnataka certificate is later challenged.
  5. Upload the documents; death certificate, ration card, identity proofs and any relationship proof; into their labelled slots.
  6. Pay the Rs 40 service charge shown on the payment screen, by net banking, card or UPI, and save the receipt.
  7. Submit and note the acknowledgement number. Sakala sends an SMS with a GSC number; keep both.
  8. Cooperate with field verification. The Village Accountant will visit or call to confirm the household and the list of survivors. Answer the phone.
  9. Download the digitally signed certificate from the portal once the status shows it as issued, or collect the print from the Nadakacheri counter.

How to apply offline at a Nadakacheri or the Tahsildar office

  1. Visit the Nadakacheri (Atalji Janasnehi Kendra) for your hobli, or the taluk Tahsildar office.
  2. Ask for the Surviving Family Members Certificate application and fill in the deceased's details and the full list of survivors.
  3. Attach self-attested photocopies of the death certificate, ration card and identity proofs, and carry the originals for counter verification.
  4. Pay the Rs 40 service charge and insist on a printed receipt carrying the Sakala GSC number.
  5. Track the file with that acknowledgement, and collect the certificate from the same counter or download it online.

The offline route feeds into the same Nadakacheri workflow — the operator is simply typing your application into the portal for you.

How do I check the status of my application?

  • Online: at nadakacheri.karnataka.gov.in, using the acknowledgement number.
  • By SMS: Sakala pushes status updates against the GSC number automatically.
  • In person: at the Nadakacheri counter or the Tahsildar's office, which can see whether the file is stuck at Village Accountant verification or awaiting the Tahsildar's signature.

Under the Karnataka Sakala Services Act, 2011, the Surviving Family Members Certificate carries a stipulated timeline of 14 working days. If the designated officer misses it, you can escalate to the competent officer named under Sakala and claim the compensation the Act provides. Very few applicants use this right, and it is the fastest way to move a stalled file.

How long is it valid, and does it need renewal?

A Karnataka Surviving Family Members Certificate records a fact, who survived a person on a date of death, and that fact does not change. The certificate therefore carries no expiry date and no renewal process.

In practice, some banks, insurers and employers ask for a copy issued within the last six months to one year as a freshness check. That is the receiving institution's rule, not a Revenue Department rule; if you are asked for a recent copy, simply apply again for Rs 40 rather than argue at the counter.

Why do applications get rejected in Karnataka?

  • An omitted heir. The Village Accountant finds a son, daughter or spouse who was not listed, and the file goes back.
  • Name mismatch between the death certificate, the ration card and Aadhaar.
  • Wrong taluk selected, where the deceased did not ordinarily reside.
  • Unregistered death, or a death certificate that has not yet been issued.
  • Blurred or unreadable uploads.
  • A contested heirship, the Tahsildar will decline and point you to the civil court.
  • The wrong service chosen; applying for Attestation of Family Tree when the bank asked for surviving family members, or the reverse.

What does it cost, and what should you refuse to pay?

The Karnataka Surviving Family Members Certificate costs Rs 40, the service charge published on the Nadakacheri list of online services. The Attestation of Family Tree costs the same Rs 40. Both are paid on the portal or at the Nadakacheri counter, and both come with a receipt.

Anyone offering a "fast legal heir certificate in two days" for a few thousand rupees is selling something the Revenue Department does not sell. There is no paid priority queue under Sakala. The 14-working-day timeline is the same for everyone. Apply yourself on the portal, or use the Nadakacheri counter and take the printed receipt. Never hand your Aadhaar OTP to an agent; no revenue official needs it to issue your certificate.

The one place you will legitimately pay more is the court route. A succession certificate carries a court fee assessed on the value of the estate, plus advocate's fees. That is a genuinely different, and genuinely more expensive, process.

Grievance and helpline route

  • Portal: nadakacheri.karnataka.gov.in, for application, tracking and downloads.
  • Taluk level: the Tahsildar, who is the designated officer for the service.
  • Sub-division level: the Assistant Commissioner, as the first escalation.
  • District level: the Deputy Commissioner's office.
  • Sakala: the Karnataka Sakala Mission, for delay complaints and compensation claims against the GSC number issued with your application.

Carry your Nadakacheri acknowledgement number and the Sakala GSC number to any of these. Without them, no office can trace the file.

Documents required

Death certificate of the deceased
Issued by the municipal corporation, town panchayat or gram panchayat where the death was registered. Nothing moves without this, and the name on it must match the name typed into the Nadakacheri form.
Identity proof of the applicant
Aadhaar card is the standard. Nadakacheri applications are commonly submitted with Aadhaar e-KYC, so keep the mobile number linked to Aadhaar with you for the OTP.
Aadhaar or identity details of every surviving family member
The certificate names each surviving member, so every person to be listed must be identified. Leaving one out is the commonest cause of a certificate being sent back for correction.
Ration card of the family
Used by the Village Accountant to establish that the persons named actually lived as one household with the deceased.
Proof of relationship to the deceasedoptional
Marriage certificate for a spouse, birth certificate or school record for a child, and the parents' names on it must tally with the deceased.
Address proof of the deceased in Karnatakaoptional
Voter ID, electricity bill or property tax receipt, to establish that the taluk applied in is the correct jurisdiction.
Service or pension record of the deceasedoptional
Where the certificate is being taken for a government pension, family pension, gratuity or compassionate appointment, the employing department often asks for the service book reference to be quoted.
Self-declaration or affidavit of the surviving membersoptional
Many taluks ask for a signed declaration that the list of heirs is complete and that no heir has been omitted.

Frequently asked questions

What is a legal heir certificate called in Karnataka?

Karnataka issues it as the "Surviving Family Members Certificate" on the Nadakacheri portal, under the Revenue Department. There is no separate service listed as "legal heir certificate" — when a Karnataka bank, pension office or employer asks for one, the Surviving Family Members Certificate is the document they mean.

How much does a Karnataka surviving family members certificate cost?

Rs 40 is the service charge published on the Nadakacheri list of online services. The same Rs 40 applies to almost every Nadakacheri certificate, including the Attestation of Family Tree, and it is the only amount you should be asked to pay.

How long does it take?

Fourteen working days is the stipulated Sakala timeline published against the Surviving Family Members Certificate. Karnataka's Sakala Act gives you a right to the service inside that period and a compensation route if the office misses it.

What is the difference between this and a succession certificate?

A Surviving Family Members Certificate is an administrative record signed by the Tahsildar that names the survivors; a succession certificate is a court order under the Indian Succession Act, 1925 that authorises you to collect the deceased's debts and securities. Banks releasing large deposits, and companies transferring shares, usually insist on the court order, while pension and provident fund offices accept the Tahsildar's certificate.

What is a Vamshavruksha certificate and do I need it instead?

Vamshavruksha is the family tree, issued on Nadakacheri as "Attestation of Family Tree" for Rs 40 with a 14-working-day Sakala timeline. It maps the family lineage rather than certifying survivorship at a date of death, and Karnataka revenue offices commonly ask for it in land mutation and ancestral property matters.

Who signs the certificate?

The Tahsildar of the taluk signs it, after the Village Accountant and the Revenue Inspector verify the family details on the ground. Nadakacheri is the delivery channel; the Revenue Department is the issuing authority.

Can I apply from outside Karnataka?

Yes, the Nadakacheri application is online and can be filed from anywhere, but the taluk you select must be the one where the deceased ordinarily resided. Field verification happens at that taluk, so choosing a convenient taluk instead of the correct one gets the application rejected.

How do I check my Nadakacheri application status?

Open nadakacheri.karnataka.gov.in, go to the "Online Application" area and use the acknowledgement number printed on your receipt. Sakala also issues an SMS with a Sakala GSC number, which you can quote at any Nadakacheri counter.
