What is Nirman Shramik Pension Yojana?

Nirman Shramik Pension Yojana, abbreviated NSPY, is the old-age pension for registered building and other construction workers in Odisha. Its legal basis is rule 272 of the Odisha Building and Other Construction Workers' (Regulation of Employment and Conditions of Service) Rules, 2002, as substituted by the Amendment Rules of 2019 notified as S.R.O. No. 187/2019 on 30 May 2019.

Rule 272 says it in one sentence. A registered building or other construction worker who has remained registered for a minimum period of ten years, with up-to-date annual contribution, and has completed sixty years of age, shall be eligible for pension. The terms, conditions, quantum and sanction of that pension follow the NSPY scheme as formulated by the Government of Odisha and revised from time to time, without any further amendment to the Rules being needed.

Two features of the design are worth noticing. First, the ten-year qualifying period is not applied to every claimant, the rule states that it does not apply to other categories such as widow pension and physically challenged construction workers. Second, although eligibility comes from the Labour & ESI Department through the Odisha Building and Other Construction Workers' Welfare Board, the scheme is implemented through the Social Security & Empowerment of Persons with Disabilities Department, which runs Odisha's social security pension machinery. That split is why a construction worker's pension file travels between two departments.

How much pension does NSPY pay?

The rule deliberately does not fix an amount. It delegates the quantum to the NSPY scheme document as revised by the Government of Odisha from time to time, so that rates can be raised without amending the Rules. The Board's own portal at nirmanshramik.odisha.gov.in publishes benefit amounts for maternity benefit, marriage assistance, funeral expenses and education assistance, but it does not publish a pension figure.

Because of that, this guide does not state a rupee amount for NSPY. Secondary websites quote several different figures, including older figures from before revisions, and repeating them would mislead. Ask your District Labour Office or the Registering Officer who holds your registration for the rate currently in force, and get it in writing on the sanction order rather than relying on a number seen online. Payment, like the state's other social security pensions, reaches the beneficiary through the Social Security & Empowerment of Persons with Disabilities Department's disbursal system.

Who is eligible for the construction workers' pension?

You can be sanctioned pension if:

  • You are a registered building or other construction worker with the Odisha BOCW Welfare Board.
  • Your registration has run for a minimum of ten years.
  • Your annual contribution of Rs 50 is up to date across that period.
  • You have completed sixty years of age.

The ten-year condition is relaxed if:

  • You are a widow claiming widow pension.
  • You are a physically challenged construction worker.

Rule 272 names both categories expressly as ones to which the minimum qualifying period does not apply.

You are not eligible if:

  • You are not registered with the Board. Years spent working on construction sites without registration do not count towards the ten years. The count runs from the registration date on your identity card.
  • Your membership has ceased. Under rule 267, default in payment of the annual contribution for three continuous years ends membership of the fund. That breaks the qualifying record.
  • You registered afresh after cessation. A worker who re-registers as a new beneficiary starts a new registration record and cannot re-draw benefits already availed under the previous registration.
  • You are under sixty, unless you fall in the widow or disability category.
  • Your registration was found to be fraudulent. The 2019 Rules allow cancellation of the registration certificate and identity card, recovery of assistance already sanctioned, and blacklisting of the agents or facilitators involved.

How to apply for Nirman Shramik Pension Yojana

The Board's portal currently offers online forms for maternity benefit, marriage assistance, funeral expenses, death benefit and education assistance. Pension is not among the online forms, so the route is offline through the officer who holds your registration.

  1. Confirm your registration record. Take your identity card to the Registering Officer who registered you, or to the District Labour Office, and ask them to print your registration date and the years for which the annual contribution has been received.
  2. Clear any arrears of contribution. If there is a gap, pay it immediately. Under rule 267 the Secretary of the Board, or an officer authorised by him, may permit resumption of membership on payment of arrears β€” but only twice in a worker's lifetime, so treat the second resumption as the last chance.
  3. Submit the pension application with the identity card, contribution record, age proof, Aadhaar and bank passbook copy to the Registering Officer or District Labour Office. Widows attach the husband's death certificate; physically challenged workers attach the disability certificate, and neither needs the ten-year record.
  4. Follow the file to the sanctioning side. Because rule 272 routes implementation through the Social Security & Empowerment of Persons with Disabilities Department, the sanction and the monthly disbursal sit with that department's district machinery. Ask the District Labour Office for the reference under which your case was forwarded.
  5. Collect the sanction order and check the amount and the effective date on it, then verify the first credit in your bank account.

How do I keep the pension running?

Two things protect the pension once sanctioned. The first is your bank account staying Aadhaar-seeded and active, a dormant account is the commonest reason a social security pension credit fails. The second is that the Board's records continue to match your identity documents; a name spelt differently on the identity card and on the bank account is worth correcting before it stops a payment.

The Registering Officer is entitled to verify employment details at the time of each annual contribution deposit, using the employment diary entered in the identity card and authenticated by the employer. Keeping that diary updated through your working years is what makes a ten-year claim easy to prove at sixty.

Why pension claims fail

  • Registration shorter than ten years on the Board's record, even where the worker has been on sites far longer.
  • Contribution gaps, especially a three-year continuous default that ended membership.
  • Re-registration after cessation, which restarts the clock.
  • Age proof inconsistent across Aadhaar, EPIC and Board records.
  • Bank account dormant or not Aadhaar-seeded, which stops the credit after sanction.
  • No documentary support for a relaxed-category claim, a widow without the death certificate, or a disabled worker without a disability certificate.

Other Board benefits and grievance route

Nirman Shramik Pension Yojana sits alongside the Board's other benefits for registered workers, several of which have published amounts: maternity benefit of Rs 10,000 per child for up to two children, marriage assistance of Rs 50,000, funeral assistance of Rs 5,000 to the nominee, death benefit payable within sixty days of the application, education assistance under Nirman Shramik Kalyan Yojana, financial assistance up to Rs 3,00,000 for treatment of major ailments, up to Rs 4,000 for working tools and Rs 1,000 for safety equipment, and up to Rs 4,000 for a bicycle. Rural housing runs separately as Nirman Shramik Pucca Ghar Yojana under rule 273-A, implemented through the Panchayati Raj and Drinking Water Department, with a Rental Housing Complex scheme for migrant construction workers in urban areas.

The OB&OCWW Board office is at Unit-3, Kharavel Nagar, Bhubaneswar, reachable on 0674-3120552 or at obocwwboard@yahoo.com. The Labour Commissioner, Odisha is the Board's Member Secretary and Chief Executive Officer. Written grievances can be filed at janasunani.odisha.gov.in.

Registration costs Rs 20 once and Rs 50 a year, both paid to the Board through the Registering Officer against a receipt. Nothing else is payable, and the 2019 Rules allow blacklisting of any agent or facilitator involved in fake registrations.

Frequently asked questions

Who is eligible for Nirman Shramik Pension Yojana?

A registered building or other construction worker who has remained registered for a minimum of 10 years with up-to-date annual contribution and has completed 60 years of age is eligible. Rule 272 of the Odisha BOCW Rules, as substituted in 2019, is the governing provision.

Is the 10-year registration condition absolute?

No. The rule states that the minimum qualifying period of 10 years does not apply to other categories such as widow pension and physically challenged construction workers. Those claimants are assessed on their category rather than on length of registration.

How much pension does NSPY pay?

The rule does not fix a rupee figure. It says the terms, conditions, quantum and sanction of pension follow the Nirman Shramik Pension Yojana as formulated by the Government of Odisha and revised from time to time, without needing an amendment to the Rules. The Board's own portal does not publish a current amount, so ask your District Labour Office for the rate in force.

Which department actually pays the pension?

The Social Security & Empowerment of Persons with Disabilities Department. Rule 272 states expressly that the scheme is implemented through that department, which also runs Odisha's other social security pensions, even though eligibility flows from the Labour & ESI Department's welfare board.

What ends eligibility for the pension?

Cessation of membership of the fund. Default in the annual contribution for three continuous years ends membership, and with it the qualifying record for pension. Membership can be resumed on payment of arrears with the Board Secretary's permission, but not more than twice.

Can I apply for NSPY online?

The Board's portal at nirmanshramik.odisha.gov.in currently lists only maternity benefit, marriage assistance, funeral expenses, death benefit and education assistance for online application. Pension is not among the online forms, so approach your Registering Officer or District Labour Office.

How much does registration with the Board cost?

Rs 20 as a one-time registration fee and Rs 50 per year as the annual contribution to the fund. The annual contribution may be remitted in advance at any point in the financial year through the Registering Officer against a receipt.

Is NSPY the same as the Board's death benefit or the pucca ghar scheme?

No. Nirman Shramik Pension Yojana is old-age pension under rule 272. Death benefit is a separate lump sum to the nominee under rule 271, and Nirman Shramik Pucca Ghar Yojana is a rural housing scheme under rule 273-A, implemented through the Panchayati Raj and Drinking Water Department.
