What is Puducherry's patent and IPR assistance for industry?

Assistance for Intellectual Property Protection Support is a component of the "Motivation of Entrepreneurs to Start Industries and Fiscal Assistance to Industries; Various Incentives" scheme of the Industries and Commerce Department, Union Territory of Puducherry. The component came into force with effect from 1 April 2017 and operates in the whole of the Union Territory.

Under the component, an industrial unit that obtains a patent gets 50% of the expenditure reimbursed, subject to:

Type of patent Maximum assistance
Domestic patent Rs 2,00,000
International patent Rs 5,00,000

The gap between the two ceilings is deliberate. An Indian patent filing is within reach of a mid-sized firm's budget; an international filing, with national-phase entries and foreign attorney fees in several jurisdictions, is an order of magnitude more expensive, and a small Puducherry manufacturer with a genuinely novel process will usually simply not file abroad. Setting the international ceiling at two and a half times the domestic one is the administration's attempt to keep that door open.

Applications are accepted offline only, in the prescribed common subsidy application form on the Department's website.

Who is eligible for the IPR assistance?

Units that can claim:

  • All micro, small, medium and large industries in the Union Territory of Puducherry. Unlike several sibling components, this one is not restricted by size of enterprise.
  • Units that have made the investment on or after 1 April 2017.
  • Units that have obtained a domestic or international patent that has been published or notified.

Conditions that must be satisfied:

  • The unit must provide at least 60% of its total employment strength to people of the Union Territory of Puducherry, and maintain that share for the period specified in the affidavit.
  • The unit must not transfer or dispose of fixed assets including plant and machinery until five years from the date of submitting the application or the date of disbursement, whichever is later.
  • Only the fees paid to a patent attorney, a patent service centre and for patent registration count as eligible cost. Travel and hotel charges are expressly excluded.

Who is not eligible:

  • Individual inventors seeking a personal benefit. Individuals cannot apply; the reimbursement belongs to the registered industrial unit that incurred the cost and that satisfies the employment and asset conditions.
  • Units claiming travel, accommodation or incidental costs as part of patent expenditure.
  • Applications filed more than one year after the patent was published or notified.
  • Units that cannot meet the 60% local employment condition.
  • Claims for trademarks, designs or copyright registrations where the component's wording is framed around patents. Confirm the current scope with the Directorate before spending on the assumption that a non-patent filing is covered.

Special case. Where two or more industrial undertakings are set up by the same person as proprietor, or with common partners, directors or shareholders, each is eligible as a separate entity, provided the locations differ and licences, clearances and registrations were obtained separately.

How to apply for patent assistance in Puducherry

  1. Wait for publication or notification of the patent. The scheme times disbursement to that event, and the one-year claim window starts from it, so filing before publication is premature.
  2. Download and print the prescribed form from industry.py.gov.in/common-application-subsidies and mark the intellectual property protection support component.
  3. Fill in every mandatory field, stating whether the patent is domestic or international, its number and publication date, and an itemised statement of attorney fees, service centre fees and registration fees.
  4. Attach self-attested copies of all mandatory documents, including the chartered accountant's certificate of expenditure and the 60% local employment affidavit. Exclude travel and hotel bills from the claim.
  5. Submit the duly filled and signed application with enclosures to the Directorate of Industries and Commerce, Industrial Estate, Thattanchavady, Puducherry 605009, and obtain a dated acknowledgement with a unique identification number.

What happens after you apply?

  1. The Directorate of Industries scrutinises the application on merit and determines the quantum of assistance admissible.
  2. The case is placed before the State Level Committee, which examines the merits and recommends the amount admissible to the unit.
  3. Disbursement is made after the publication or notification of the patent, in single or multiple instalments depending on the availability of funds.

How is the assistance paid?

  • Financed units. The amount is disbursed only through the financial institution or bank, adjusted against the loan availed or applied to creating additional fixed assets or working capital. Financial institution here means PIPDIC or any other government corporation, and scheduled banks including co-operative banks.
  • Self-financed units — the amount is disbursed directly to the entrepreneur or unit.

How to check your application status

  1. Quote the unique identification number from the acknowledgement.
  2. Contact the Directorate of Industries and Commerce, Thattanchavady, on +91-413-2248476, 2248168 or 2248320, and ask whether the file is at scrutiny stage or listed before the State Level Committee.
  3. Karaikal units can follow up on +91-4368-265438, Yanam on +91-884-2321257, and Mahe on +91-490-233235.

Why IPR assistance claims are rejected

  • Filed before publication, or more than one year after publication or notification of the patent.
  • Travel and hotel charges included in the expenditure statement, which the scheme excludes.
  • Attorney invoices addressed to an individual rather than to the industrial unit claiming.
  • The 60% local employment condition not evidenced by the affidavit and employment records.
  • Patent application still pending, with no publication or notification to attach.
  • Expenditure not reconcilable with the chartered accountant's certificate and the books of the unit.
  • Investment predating 1 April 2017, which falls outside a component that starts from that date.

A worked example

A small pharmaceutical formulations unit in Puducherry files an Indian patent on a process improvement. Its costs are:

Head Amount Eligible?
Patent attorney's professional fees Rs 1,40,000 Yes
Patent service centre charges for drafting and search Rs 60,000 Yes
Patent office registration and examination fees Rs 55,000 Yes
Travel to Chennai for hearings and hotel stay Rs 35,000 No, expressly excluded
  • Eligible expenditure: Rs 1,40,000 + Rs 60,000 + Rs 55,000 = Rs 2,55,000
  • Assistance at 50%: Rs 1,27,500
  • Domestic patent ceiling: Rs 2,00,000, which is not reached
  • Assistance payable: Rs 1,27,500

Had the same unit taken the invention international, with foreign attorney fees and national-phase entries pushing total eligible expenditure past Rs 10,00,000, the 50% computation would exceed the Rs 5,00,000 international ceiling and the assistance would stop there.

The example shows why the travel exclusion matters: including the Rs 35,000 of travel in the claim does not merely add nothing, it invites the whole expenditure statement to be re-examined.

Timing: what a unit should plan for

The single most important planning point is that this is a reimbursement after the event, not funding for the filing. The sequence is fixed by the scheme itself:

  1. The unit incurs attorney, service centre and registration costs, out of its own funds or borrowings.
  2. The patent is published or notified. In India, ordinary publication of a patent application occurs some months after filing, and grant later still.
  3. The unit's one-year claim window opens from that publication or notification date.
  4. The Directorate scrutinises the claim, the State Level Committee recommends the amount, and disbursement follows in one or more instalments depending on available funds.

Between step 1 and step 4, a year or more can pass. A unit budgeting a patent programme should treat the assistance as improving the return on the filing rather than as reducing the cash it needs up front. Diarise the publication date the moment it is known, that single date controls the deadline.

Grievance redressal

Grievances are raised through the Industries and Commerce Department's grievance redressal mechanism at industry.py.gov.in/grievance-redressal-mechanism. The escalation route runs to the Director of Industries and Commerce, Industrial Estate, Thattanchavady, Puducherry 605009, and then to the Secretary to Government (Industries and Commerce), Chief Secretariat, Puducherry 605001, on +91-413-2336115.

A unit planning a patent filing should budget on the basis that reimbursement comes after publication, which can be a year or more after the money is spent. The assistance improves the economics of protecting an invention; it does not finance the filing itself.
