What is the Employment Incentive scheme in Puducherry?

Employment Incentive is a component of the "Motivation of Entrepreneurs to Start Industries and Fiscal Assistance to Industries" scheme of the Industries and Commerce Department, Union Territory of Puducherry. Where most components of that scheme subsidise assets, machinery, buildings, generators, effluent plants. This one subsidises jobs.

Under the component, a wage or employment subsidy of 20% of wages or salary, up to a maximum of Rs 5,00,000 per annum, is provided in the case of workers who are covered under the Provident Fund. New units that commence production on or after 2 August 2004 are eligible, and the incentive runs for five years from the date of commencement of production.

Two conditions define the character of the scheme:

  • The unit must provide direct employment to at least 10 persons.
  • The incentive is granted only if the unit has provided at least 60% of its employment to people of the Union Territory of Puducherry.

Together these make the incentive a local-employment instrument rather than a general labour subsidy. A capital-intensive plant with four technicians gets nothing; a unit of thirty workers, mostly hired from Puducherry and all on PF, gets the full benefit.

Applications are accepted offline only, in the prescribed common subsidy application form on the Department's website.

Who is eligible for the employment incentive?

Units that can claim:

  • New industrial units that commenced production on or after 2 August 2004, for five years from the date of commencement of production.
  • Units providing direct employment to at least 10 persons.
  • Units where at least 60% of employment has gone to people of the Union Territory of Puducherry.
  • In respect of workers covered under the Provident Fund, where PF is applicable.

Who is not eligible:

  • Individual employees or job-seekers. Individuals cannot apply for a personal benefit. The incentive is a subsidy on the employer's wage bill; workers receive their wages from the employer in the normal way.
  • Units employing fewer than 10 persons directly.
  • Units where the local employment share is below 60%.
  • Units that commenced production before 2 August 2004.
  • Units beyond the five-year period from commencement of production.
  • Claims built on contract or casual labour outside PF coverage, where the component is framed around PF-covered workers.

How is the amount worked out?

Element Rule
Rate 20% of wages or salary
Ceiling Rs 5,00,000 per annum
Workers counted Those covered under Provident Fund
Wage base Limited by the minimum wages prescribed by the Government from time to time
Duration 5 years from the date of commencement of production

The wage base rule deserves attention. Because wage or salary is limited by the minimum wages prescribed by the Government, a unit cannot enlarge its claim by recording high nominal salaries. The effective computation uses the prescribed minimum wage as the reference, which keeps claims across units comparable.

At the ceiling of Rs 5,00,000 a year, and 20% of the wage base, the maximum is reached at an eligible annual wage bill of Rs 25,00,000. Over five years, a unit at the ceiling throughout would draw Rs 25,00,000 in total.

How to apply for the employment incentive

  1. Download and print the prescribed form from industry.py.gov.in/common-application-subsidies, marking the employment incentive component.
  2. Fill in every mandatory field, including the date of commencement of production, the total headcount, the number of workers who are people of Puducherry with the resulting percentage, the number covered under PF, and the wage bill for the period claimed.
  3. Attach self-attested copies of all mandatory documents; registration, the production certificate, EPF returns and challans, wage registers, the employee list with residence proof, and the chartered accountant's certificate.
  4. Submit the duly filled and signed application with enclosures to the Directorate of Industries and Commerce, Industrial Estate, Thattanchavady, Puducherry 605009.
  5. Request a receipt or acknowledgement carrying the date and time of submission and a unique identification number.

What happens after submission?

Employment incentive claims follow the shorter internal route. The scheme states that these applications are processed by the Industries Department to obtain sanction, and that these cases need not be placed before the State Level Committee. Verification concentrates on the PF records and the local employment percentage, since those are the two conditions that decide the claim.

When must the claim be filed?

  • New units โ€” within one year from the date of obtaining the Entrepreneurs Memorandum Part-II, permanent registration or the commencement of production certificate.
  • Existing units, within one year of completing expansion, diversification or modernisation.

Because the entitlement covers five years from commencement of production, a unit that registers its claim in the first year and then files period-wise returns protects the whole entitlement. A unit that waits loses the earliest years rather than extending the window.

How to check the status of your claim

  1. Quote the unique identification number on the acknowledgement.
  2. Contact the Directorate of Industries and Commerce, Thattanchavady, on +91-413-2248476, 2248168 or 2248320, and ask whether the wage and PF records have been verified and whether sanction has been issued.
  3. Karaikal units can follow up on +91-4368-265438, Yanam on +91-884-2321257, and Mahe on +91-490-233235.

Why employment incentive claims are rejected

  • Headcount below 10 direct employees during the claim period.
  • Local employment below 60%, which is a condition of grant rather than a target.
  • PF records incomplete: missing ECR challans or returns for months in the claim period.
  • Wage figures above the prescribed minimum wage base used to inflate the claim.
  • Contract labour counted as direct employment.
  • Production commenced before 2 August 2004, or the five-year period already exhausted.
  • Residence of workers not evidenced, so the 60% local share cannot be verified.
  • Employee counts inconsistent between the wage register, the PF returns and the application.

The practical lesson is that this incentive is won or lost in the payroll records. A unit that runs clean monthly PF compliance and keeps residence proof on each employee's file will find the claim straightforward; one that does not will struggle regardless of how many people it actually employs.

Grievance redressal

Grievances are raised through the Industries and Commerce Department's grievance redressal mechanism at industry.py.gov.in/grievance-redressal-mechanism, and escalate to the Director of Industries and Commerce, Industrial Estate, Thattanchavady, Puducherry 605009, and then to the Secretary to Government (Industries and Commerce), Chief Secretariat, Puducherry 605001, on +91-413-2336115.

The prescribed form is free, and no payment to any intermediary is needed to file an employment incentive claim.

Frequently asked questions

How much employment incentive does a Puducherry unit get?

A wage or employment subsidy of 20% of wages or salary, up to a maximum of Rs 5,00,000 per annum, is paid for workers covered under the Provident Fund. The incentive runs for five years from the date of commencement of production.

How many workers must the unit employ?

The unit must provide direct employment to at least 10 persons. Below that headcount the incentive is not available, regardless of the wage bill.

What is the 60% local employment condition?

The employment incentive is granted only if the unit has provided at least 60% of its employment to people of the Union Territory of Puducherry. This is a condition of grant, not a preference.

Which units qualify by date?

Only new units that commenced production on or after 2 August 2004 are eligible, and they can draw the incentive for five years from the date of commencement of production.

Are workers outside Provident Fund covered?

The incentive is stated for workers who are covered under the Provident Fund where PF is applicable, so wages of workers outside PF coverage will not normally support a claim.

Is there a limit on the wage figure used?

Yes. Wage or salary is limited by the minimum wages prescribed by the Government from time to time, so a unit cannot inflate the base by paying unusually high nominal salaries.

Can an individual worker apply for this incentive?

No. Individuals cannot apply. The incentive is paid to the employing industrial unit as a subsidy on its wage bill, not to employees.

Does the State Level Committee decide these claims?

No. Employment incentive applications are processed by the Industries Department to obtain sanction, and the scheme states these cases need not be placed before the State Level Committee.
