Legal Heir / Succession Certificate in Punjab (Warasat Mutation and Court Succession)

Punjab state government scheme

Quick answer

Punjab does not publish a standalone "legal heir certificate" among its notified Sewa Kendra services. Punjab handles inheritance through two real routes instead: inheritance mutation, intkal warasat, recorded by the Patwari and sanctioned by the Revenue Officer, and a succession certificate granted by a civil court under the Indian Succession Act, 1925. Sewa Kendras and connect.punjab.gov.in deliver the revenue side.

Benefit
Legal recognition of the heirs of a deceased Punjab resident, either as an inheritance mutation entered in the revenue record or as a civil court succession certificate authorising collection of debts and securities
How to apply
Both — revenue records and Fard through Sewa Kendras and connect.punjab.gov.in, and succession certificates through the competent civil court

Does Punjab issue a legal heir certificate?

Punjab does not publish a standalone "legal heir certificate" among its notified citizen services. This is a genuine difference from states such as Karnataka, Tamil Nadu, Kerala and Jammu and Kashmir, where a Tahsildar issues a named heirship or surviving-member certificate through a state portal. Searching Punjab district sites and the state's service portals for a legal heir certificate returns nothing, and applicants routinely waste weeks looking for a service that Punjab does not run.

What Punjab does have are two real routes, and the whole task in Punjab is working out which of the two the office in front of you actually needs.

Route one, inheritance mutation (intkal warasat). Land and immovable property standing in the name of a deceased person is transferred to the heirs by a mutation entered in the revenue record. The Patwari of the village records the mutation; the Revenue Officer (the Naib Tehsildar or Tehsildar exercising revenue-officer powers) sanctions it after the entry is read out in the village and objections are heard. The result appears in the Jamabandi, and the Fard, the copy of the record of rights, is what you then produce as proof. "Copy of Fard" is one of the prominent services listed on Connect Punjab at connect.punjab.gov.in.

Route two, succession certificate from a civil court. For movable property, bank deposits, fixed deposits, shares, debentures, mutual fund units and other debts and securities — the authority to collect comes from a succession certificate granted by the competent civil court under the Indian Succession Act, 1925. No revenue office in Punjab can issue this, and no affidavit substitutes for it.

Which route do you need?

Read the letter the bank, employer or department has actually given you, then match it:

  • Land, house, agricultural holding → inheritance mutation, then a fresh Fard showing the heirs' names.
  • Bank deposits above the bank's own threshold, shares, securities, mutual funds → succession certificate from the civil court.
  • Family pension, gratuity, provident fund, compassionate appointment → the employing department's own prescribed forms, normally supported by the death certificate, an affidavit of the heirs, and corroboration from the Sarpanch or Municipal Councillor. Government departments generally do not require a court order for these.
  • Small bank balances → most banks operate a nomination route or a simplified settlement procedure below a stated threshold, requiring only the death certificate, indemnity and an affidavit. Ask the branch for its threshold before you go anywhere near a court.
  • Deceased left a registered will → the executor may need probate or letters of administration from the court, not a succession certificate.

Who can apply, and who cannot?

You can apply if:

  • You are the surviving spouse, son, daughter, mother or father of the deceased, or another heir under the personal law applicable.
  • You are the legal guardian of a minor heir, applying on the minor's behalf.
  • The deceased ordinarily resided in Punjab, or the land in question lies in Punjab, which is what gives the Punjab revenue authority and the local civil court jurisdiction.

You cannot apply if:

  • You are not an heir. A creditor, employer, neighbour or landlord cannot obtain a mutation or a succession certificate in your family's place.
  • The land lies outside Punjab, or the deceased resided outside Punjab. Apply to that jurisdiction instead; your own Punjab address does not create jurisdiction over property elsewhere.
  • You are trying to exclude another heir. A mutation is read out publicly in the village precisely so that objections surface, and a suppressed heir can have the entry set aside afterwards.
  • The death has not been registered and no death certificate exists yet.
  • You expect a revenue office to settle a disputed inheritance. A Revenue Officer sanctioning a mutation is not adjudicating title; a contested claim goes to the civil court.

How to get inheritance recorded in Punjab; step by step

  1. Register the death with the municipal corporation, municipal council or gram panchayat, and obtain the death certificate. Nothing in either route starts without it.
  2. Obtain the Fard or Jamabandi showing the land standing in the deceased's name. Apply through Connect Punjab at connect.punjab.gov.in, where "Copy of Fard" is a listed service, or at a Sewa Kendra. Connect Punjab also lets you book a Sewa Kendra token or a doorstep service appointment online, which saves a wasted trip.
  3. Prepare an affidavit of the heirs, sworn on the appropriate stamp paper, listing every legal heir with name, age and relationship, and stating that no heir has been omitted. Punjab offices and banks both ask for this, and a Sarpanch's or Municipal Councillor's corroboration alongside it is common.
  4. Report the death to the Patwari of the village where the land lies, and ask for the inheritance mutation (intkal warasat) to be entered. Hand over the death certificate, the Fard, the affidavit and identity proof for each heir.
  5. Attend the mutation proceeding. The entry is read out and the Revenue Officer hears objections before sanctioning it. Attend, and make sure every heir is named correctly and no share is misdescribed; correcting a sanctioned mutation later is far harder than getting it right now.
  6. Take a fresh Fard after sanction, showing the heirs' names in the record. That fresh Fard is your proof of the transfer.
  7. For movable assets, file for a succession certificate in the competent civil court having jurisdiction, with the death certificate, the list of heirs, and a schedule of the debts and securities you seek authority over. The court issues public notice, allows time for objections, and then grants the certificate.
  8. Track and download what you can at esewa.punjab.gov.in, Punjab's e-Sewa portal, which carries certificate download, certificate verification and application tracking, along with Sewa Kendra details for every district.

How do I check the status of my application?

  • Online: connect.punjab.gov.in carries "Track Service" and "Track Grievance" options for services filed through it, and esewa.punjab.gov.in carries application tracking, certificate download and certificate verification.
  • At the Sewa Kendra: the counter can look up your application against the receipt number. Book a token on Connect Punjab first.
  • With the Patwari: for a mutation, the Patwari of the halqa is the person who knows whether the entry has been made and when the Revenue Officer will take it up.
  • At the Tehsil: the Tehsildar or Naib Tehsildar's office, for a mutation waiting on sanction.
  • At the court: for a succession certificate, through your advocate against the case number.

Punjab operates a Right to Service regime and Connect Punjab carries an RTS section, so ask which notified timeline applies to your particular service when you file, and get it recorded on your receipt. That receipt is what an appeal rests on.

How long is it valid, and does it need renewal?

Neither route produces a document that expires.

An inheritance mutation, once sanctioned, permanently changes the revenue record; there is nothing to renew. What you may need again is a fresh Fard, because banks and buyers routinely ask for a recently issued copy of the record of rights, that is a fresh extract of a permanent record, not a renewal.

A succession certificate granted by the court is likewise not time-limited, though it is limited in a different way: it covers only the debts and securities listed in the schedule the court granted it over. If assets surface later that were not in the schedule, you must go back for an extension.

Why do applications fail in Punjab?

  • Applying for a service Punjab does not run. Hunting for a "legal heir certificate" at a Sewa Kendra wastes weeks. Ask instead for a mutation, or go to the court.
  • An omitted heir, which surfaces when the mutation is read out in the village and stalls the sanction.
  • Name or spelling mismatch between the death certificate, the Jamabandi entry and Aadhaar: very common where Punjabi names are transliterated differently across records.
  • Land outside the tehsil applied in, or in another state.
  • Unregistered death, or no death certificate yet issued.
  • An affidavit that does not list all heirs, or is not properly sworn.
  • Going to court unnecessarily. Many families spend on a succession certificate when the bank's own small-balance settlement procedure or the nomination on the account would have released the money. Ask the branch first.
  • Contested inheritance taken to a Revenue Officer, who cannot decide title.

What does it cost, and what should you refuse to pay?

Revenue services in Punjab are delivered through Sewa Kendras and connect.punjab.gov.in at the government's own notified charge, printed on the Sewa Kendra rate card. Pay only that, and insist on a printed receipt for everything. Mutation of inheritance in the revenue record and a copy of the Fard are both ordinary notified services, not favours.

Agents and middlemen who offer a "Punjab legal heir certificate" for a few thousand rupees are selling a document Punjab does not issue. Anyone who produces one has produced a forgery, and it will be rejected the moment a bank or department checks. There is no paid priority queue at a Sewa Kendra, and no fee speeds up a Revenue Officer's sanction of a mutation. Never hand your Aadhaar OTP to an agent; no revenue official needs it.

The one route that genuinely costs real money is the court. A succession certificate carries court fee calculated as a proportion of the value of the estate covered, plus advocate's fees. That expense is real and unavoidable when a bank or registrar has asked for the certificate in writing, but confirm they have actually asked before you incur it.

Grievance and helpline route

  • Connect Punjab: connect.punjab.gov.in, for applying, tracking services, lodging a grievance, tracking a grievance, filing RTI, verifying certificates and booking a Sewa Kendra token or a doorstep service.
  • Punjab e-Sewa: esewa.punjab.gov.in, for certificate download, certificate verification, application tracking and district-wise Sewa Kendra details.
  • Revenue Department: revenue.punjab.gov.in, the Department of Revenue, Rehabilitation and Disaster Management, which carries the acts, rules, circulars and notifications governing mutation and land records.
  • Village and tehsil level: the Patwari, then the Naib Tehsildar and Tehsildar as Revenue Officers.
  • District level: the Deputy Commissioner's office, and the district website's services page.
  • Grievance: Connect Punjab's grievance module, and the central public grievance portal at pgportal.gov.in.

Quote your Sewa Kendra receipt number, your mutation number, or your court case number in every follow-up. Without one of those, no office can trace your matter.

Documents required

Death certificate of the deceased
Issued by the municipal corporation, municipal council or gram panchayat where the death was registered. Neither route — mutation or court — moves without it.
Identity proof of the applicant
Aadhaar card, voter ID or passport. Connect Punjab and the Sewa Kendra counters run on a registered citizen login, and Connect Punjab also supports DigiLocker login.
Jamabandi and Fard (copy of the record of rights)
Needed for an inheritance mutation, because the land recorded against the deceased is what is being transferred. "Copy of Fard" is one of the prominent services listed on Connect Punjab.
Details and identity proof of every heir
Every heir must be identified with name, age and relationship. The Patwari's mutation entry names each heir and the share attributed, so an omission is corrected only by a fresh proceeding.
Affidavit of the heirs
A sworn affidavit listing every legal heir and confirming that none has been omitted, executed on the appropriate stamp paper. Punjab revenue offices and banks both ask for this.
Proof of relationship to the deceasedoptional
Marriage certificate for a spouse, birth certificate or school record for a child, where the family record does not make the relationship clear.
Certificate from the Sarpanch or Municipal Councilloroptional
Commonly asked for in Punjab as local corroboration of the family composition, particularly in rural areas.
Registered will, if anyoptional
Where the deceased left a will, the executor may need probate or letters of administration from the court rather than a succession certificate.
Service or pension record of the deceasedoptional
Required where the heirs are claiming family pension, gratuity, provident fund or a compassionate appointment from a government employer.

Frequently asked questions

Does Punjab issue a legal heir certificate?

Punjab does not publish a standalone "legal heir certificate" among its notified citizen services, unlike Karnataka, Tamil Nadu or Jammu and Kashmir. Punjab handles inheritance through two other routes — inheritance mutation (intkal warasat) in the revenue record, and a succession certificate from a civil court — so the right question in Punjab is which of those two the office asking you actually needs.

What is intkal warasat?

Intkal warasat is the inheritance mutation entered in Punjab's revenue records, under which land standing in the name of a deceased person is transferred into the names of the heirs. The Patwari records the mutation and the Revenue Officer sanctions it after hearing the parties, and the result shows in the Jamabandi.

What is a succession certificate and when do I need one?

A succession certificate is an order of the competent civil court under the Indian Succession Act, 1925 that authorises the holder to collect the debts and securities of a deceased person. Punjab banks releasing substantial deposits, companies transferring shares and mutual fund registrars normally require it, because no revenue certificate confers that authority.

How do I get land transferred to the heirs in Punjab?

Apply for an inheritance mutation through the Patwari of the village or the Sewa Kendra, with the death certificate, the Fard or Jamabandi extract, an affidavit of the heirs and identity proof of each heir. The Revenue Officer sanctions the mutation after the entry is read out and objections are heard.

Where do I get a copy of the Fard or Jamabandi?

Copy of Fard is one of the prominent services listed on Connect Punjab at connect.punjab.gov.in, and Sewa Kendras across the state issue it. Punjab's Revenue Department site also carries the land records and registration services.

What are Sewa Kendras and how do I use one?

Sewa Kendras are Punjab's citizen service centres, and Connect Punjab lets you book a Sewa Kendra token or a doorstep service appointment online before you go. Punjab's e-Sewa portal at esewa.punjab.gov.in additionally lets you download and verify certificates and track applications.

Does an affidavit alone work as proof of heirship in Punjab?

An affidavit alone is not a certificate and does not bind anyone, though many Punjab banks, employers and departments accept a sworn affidavit of heirs together with the death certificate and a Sarpanch or Councillor's corroboration for small claims. For land it must be followed by a mutation, and for large deposits by a court succession certificate.

How long does a succession certificate take in Punjab?

Court timelines are not published as service standards, and a succession certificate realistically takes months rather than weeks, because the court must issue public notice and allow time for objections before it grants the certificate. Budget for court fee assessed on the value of the estate plus advocate's fees.
