Property Registration (Sale Deed) in Sikkim

Sikkim state government scheme

Quick answer

Property Registration in Sikkim is handled by the Land Revenue and Disaster Management Department at the District Collectorate, not by a separate Inspector General of Registration. Notification No. 70/LR&DMD/ACQ/GOS dated 1 May 2025 fixes the sale registration fee at 4% in municipal areas and 5% in rural areas for Sikkim Subject/COI holders, plus 1% stamp duty, with mutation costing Rs 500.

Benefit
A registered sale deed recorded by the Sikkim Land Revenue and Disaster Management Department, with mutation of the land record triggered from the same system once registration is complete
How to apply
Both — the Integrated Land Records Management System at ilrms.sikkim.gov.in carries the revenue calculator and land records, while registration and mutation are completed at the District Collectorate or Sub-Divisional Magistrate office

Property Registration in Sikkim runs differently from most Indian states. Sikkim has no separate Inspector General of Registration portal. The Land Revenue and Disaster Management Department (LR&DMD), Government of Sikkim, headquartered at Tashiling Secretariat, Block-B, Gangtok 737101, is responsible for revenue administration, survey and settlement, maintenance of land records and enforcement of land laws, and registration of a sale deed is one of the services delivered through the District Collectorate and Sub-Divisional Magistrate offices under it.

Which department registers a sale deed in Sikkim?

The Land Revenue and Disaster Management Department registers deeds and then mutates the record. The department states in its citizen material that it has implemented software integrating the property registration process with the mutation process after completion of sale deed registration, so that transactions in respect of both property registration and mutation are done through the system. The Integrated Land Records Management System at ilrms.sikkim.gov.in carries the land records and a Revenue Calculator that citizens can use before visiting the Collectorate. In practice, a buyer deals with the registration section of the District Collectorate; Gangtok, Namchi, Gyalshing, Mangan and the newer districts, for presentation, fee payment and mutation.

What are the exact registration fee and stamp duty rates in Sikkim?

Notification No. 70/LR&DMD/ACQ/GOS dated 1 May 2025, issued by the Secretary, Land Revenue and DM Department, supersedes the earlier 2011 and 2020 notifications and fixes these rates for property registration:

Transfer (sale or lease) of property among SSC/COI holders, and RC holders with government approval, land:

  • Municipality or Nagar Panchayat area, SSC/COI holder: 4% registration fee and 1% stamp duty
  • Rural area, SSC/COI holder; 5% registration fee and 1% stamp duty
  • Residential Certificate holder; 8% registration fee and 1% stamp duty

The same three-way split applies to immovable property other than land, that is buildings and flats. For land, the fee is computed on the consideration value or the notified block rate, whichever is higher; for buildings and flats, on the consideration or a valuation certified by a Government registered valuer, whichever is higher. A concession of 1% in the registration fee is allowed for a woman purchaser or lessee where the party is an SSC/COI holder.

Other rates in the same notification:

  • Transfer of property for industrial purposes with government approval to 9% registration fee and 1% stamp duty, for both land and buildings or flats.
  • Gift between direct blood relations of SSC/COI holders; Rs 1,000 per hectare of land (minimum Rs 1,000), and Rs 1,000 per flat.
  • Gift or donation to NGOs, religious organisations, trusts and societies — 6% registration fee and 1% stamp duty.
  • Registration of a lease deed under the Sikkim Sukumbasi (landless) Welfare Scheme, exempted.
  • Partition deed, Rs 1,000, Rs 1,500 or Rs 2,000 per parcel depending on whether the parcel is up to 2 hectares, 2 to 5 hectares, or above 5 hectares.
  • Mortgage deed, Rs 300 for a personal or housing loan of Rs 1 lakh to Rs 5 lakh, Rs 600 for Rs 5 lakh to Rs 10 lakh, and Rs 1,200 for Rs 10 lakh and above.
  • Mutation, Rs 500 for all types, exempted for a BPL applicant.
  • Survey fee: Rs 500 for the first hectare and Rs 200 for every additional hectare, minimum Rs 500.

The notification adds two timing rules that matter to a buyer: land revenue fees and other public utility charges increase by 5% annually on 1 April, while property registration fee rates are reviewed every five years and notified afresh.

Who can and cannot buy property in Sikkim?

Sikkim's land laws restrict who may hold land, and the fee schedule reflects it directly. Sikkim Subject Certificate holders and Certificate of Identification holders form the main category and pay the lowest rates. Residential Certificate holders may transact, but only with the approval of the Government, and they pay an 8% registration fee. That means an outsider without SSC, COI or an RC with government approval cannot apply to register a purchase of Sikkim land in the ordinary course; the department's own schedule contains no category for such a buyer. Transfers of property for industrial purposes likewise require government approval and attract the 9% rate.

There is no income test, no caste condition and no age bar beyond ordinary contractual capacity. Both parties must be competent to contract, and both must appear.

How to get a sale deed registered in Sikkim: step by step

  1. Check the land record and the block rate. Obtain a khatian copy for Rs 100 and a map copy at Rs 80 stationery fee plus Rs 20 copying fee per hectare from the District Collectorate, and look up the notified block rate for the location. Use the Revenue Calculator on ilrms.sikkim.gov.in to see the charges before you commit.
  2. Obtain a non-encumbrance certificate. Rs 100 under the 2025 notification. It confirms the plot is free of mortgage or charge. Where the property is a building or flat, also get the valuation certified by a Government registered valuer, since the fee is charged on the higher of consideration or that valuation.
  3. Confirm your certificate category. Establish whether the buyer is an SSC/COI holder or an RC holder, because that decides whether the fee is 4%, 5% or 8%, and whether prior government approval is needed. A woman purchaser who is an SSC/COI holder should claim the 1% concession at this stage.
  4. Execute the sale deed. Draft it with the plot number, block, area and consideration, and have both parties sign before witnesses.
  5. Present the deed at the Collectorate registration section with the khatian, map copy, non-encumbrance certificate, identity documents of both parties and witnesses, and the government approval where applicable. Pay the registration fee and 1% stamp duty computed on the higher of consideration or block rate.
  6. Apply for mutation. Pay the Rs 500 mutation fee, or claim the exemption if the applicant is BPL. Because Sikkim has integrated registration with mutation, this is the step that moves your name into the record of rights.
  7. Collect the registered deed and the mutated parcha. Keep both together with the payment receipts.

How do you check the status of a Sikkim registration?

Sikkim does not publish a public NGDRS-style tracking page for deeds. The practical checks are the land record itself on ilrms.sikkim.gov.in, which should show the new owner once mutation is completed, and a fresh non-encumbrance certificate from the Collectorate showing the registered transaction. District websites, for example the Registration Section page of the Namchi district administration, list the registration section as a Collectorate function and are the right place to confirm office timings and the officer in charge.

Common reasons a Sikkim registration stalls

  • Wrong certificate category. Presenting as an SSC/COI holder without the certificate, or as an RC holder without the required government approval, stops the file.
  • Understated consideration. The department charges on the notified block rate when it is higher than the price stated, so understating the price saves nothing.
  • No valuer's certificate for a building or flat, where the fee cannot otherwise be computed.
  • Late presentation of a lease deed. Failure to register a lease agreement or deed within four months of execution invites a penalty of 10% per annum on the registration amount.
  • Mutation not applied for. Registration alone does not change the record of rights; without the Rs 500 mutation the land record still shows the seller.
  • Stale fee assumption. Because land revenue fees rise 5% every 1 April and registration rates are revised every five years, an old figure quoted by a third party may no longer be correct.

Where do you complain in Sikkim?

Approach the registration section of the District Collectorate first, then the Additional District Collector or Sub-Divisional Magistrate, and then the Secretary, Land Revenue and Disaster Management Department at Tashiling Secretariat, Block-B, Gangtok 737101. The department publishes its Citizen's Charter at sikkimlrdm.gov.in, and the fee notification itself is a public document you can carry with you.

Every fee in this guide is a government fee paid at the government counter. A khatian copy is Rs 100, a non-encumbrance certificate is Rs 100, mutation is Rs 500, and sale registration is the notified percentage of the higher of consideration and block rate. Anyone quoting a "package" above these figures is charging a private commission, not a government charge.

Documents required

Sale deed drawn on the correct value
Executed between the seller and the buyer describing the plot number, block, area in hectares, and the consideration. Registration fee and stamp duty are computed on the consideration value or the notified block rate, whichever is higher.
Sikkim Subject Certificate or Certificate of Identification
The rate band you fall into depends on this. Notification No. 70/LR&DMD/ACQ/GOS of 1 May 2025 sets one set of rates for SSC/COI holders and a higher 8% registration fee for Residential Certificate holders transacting with government approval.
Parcha Khatiyan (record of rights) copy
The current land record for the plot. A khatian copy costs Rs 100 in each case under the same 2025 notification.
Copy of the cadastral map
Charged at Rs 80 stationery fee plus Rs 20 copying fee per hectare, with a minimum copying fee of Rs 20 even if the land is below one hectare.
Non-encumbrance certificateoptional
Issued at Rs 100 under the 2025 notification. Worth obtaining before paying any advance, to confirm the plot carries no mortgage or charge.
Valuation certificate from a Government registered valueroptional
Required for immovable property other than land — buildings and flats — because the fee there is computed on the consideration or the valuation certified by a Government registered valuer, whichever is higher.
Government approval for the transferoptional
Needed where a Residential Certificate holder is a party, and for transfers of property for industrial purposes, which attract a 9% registration fee and 1% stamp duty.
Identity and photographs of both parties and witnesses
Aadhaar or another photo identity for the seller, the buyer and the attesting witnesses who appear at the Collectorate registration section.

Frequently asked questions

What does it cost to register a sale deed in Sikkim?

For a Sikkim Subject or COI holder buying land, the fee is 4% registration fee plus 1% stamp duty in a Municipality or Nagar Panchayat area, and 5% registration fee plus 1% stamp duty in a rural area, under Notification No. 70/LR&DMD/ACQ/GOS dated 1 May 2025. A Residential Certificate holder pays 8% registration fee plus 1% stamp duty.

Is there any concession for women buyers in Sikkim?

Yes — the 2025 notification allows a concession of 1% in the registration fee for a woman purchaser or lessee in the case of a Sikkim Subject or COI holder, for both land and immovable property other than land.

How is the value of the property fixed?

Registration fee and stamp duty on land are calculated on the consideration value or the notified block rate, whichever is higher. For buildings and flats the comparison is between the consideration and the valuation certified by a Government registered valuer.

What does mutation cost after registration in Sikkim?

Rs 500 for all types of mutation covering land and flats, and mutation in favour of a BPL applicant is exempted. The department has integrated property registration with the mutation process so that mutation follows the registration of the sale deed in the same system.

What is the registration fee for a gift between close relatives?

Rs 1,000 per hectare of land, with a minimum of Rs 1,000 even if the land is below one hectare, and Rs 1,000 per flat — for gifts between direct blood relations of SSC/COI holders, that is grandparents, parents, children and grandchildren, and between spouses and siblings.

Do these Sikkim rates change every year?

Land revenue fees and other public utility charges rise by 5% annually on 1 April, while property registration fees are reviewed every five years and notified afresh, as stated at the end of the 2025 notification.

Is there a penalty for registering a lease deed late in Sikkim?

Yes — failure to register a lease agreement or deed within four months from execution invites a penalty of 10% per annum on the registration amount.

Do I have to pay an agent to get this done?

No. The fees are exactly those printed in the Land Revenue and Disaster Management Department's notification and paid to the government at the District Collectorate; a khatian copy is Rs 100 and a non-encumbrance certificate is Rs 100. Anyone charging more than the notified rate is a private middleman.
