What is the Assam BOCW Welfare Board Death Benefit?

The Assam BOCW Welfare Board Death Benefit is a lump-sum payment made to the nominee or dependants of a registered construction worker who dies. The Assam Building and Other Construction Workers' Welfare Board, a tripartite body under the Labour Welfare Department of the Government of Assam, administers the benefit out of the welfare cess collected from construction projects in the state.

According to the Commissionerate of Labour, Assam, the Board sanctions Rs 50,000 to the nominee or dependants of a member in case of a normal death, and Rs 3,00,000 where the death is caused by an accident during the course of employment. The distinction between the two rates is the single most important thing a claiming family needs to understand, because it changes the payout six-fold and depends entirely on the documents filed.

The legal basis is the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, together with the Building and Other Construction Workers' Welfare Cess Act, 1996. Assam constituted its own Welfare Board under this framework, with representatives of employers, trade unions and government officials, and funds the benefits from the one per cent cess levied on the cost of construction work.

What the death benefit is not

  • It is not an insurance policy the family buys. No premium is paid by the worker for this particular benefit.
  • It is not automatic. The Board does not know a worker has died until a claim is filed, so a family that never approaches the labour office never gets paid.
  • It is not the only payment due on death. Funeral assistance of Rs 5,000 and, where applicable, family pension at 50 per cent of the deceased pensioner's pension are separate entitlements.

Who is eligible for the Assam BOCW death benefit?

A family can claim if:

  • The deceased was a registered beneficiary of the Assam Building and Other Construction Workers' Welfare Board, holding a valid registration or identity card.
  • The registration was live and not lapsed on the date of death. Registration under the BOCW Act is maintained by periodic contribution, and a membership that has lapsed for non-payment weakens the claim.
  • The person claiming is the nominee recorded in the registration file, or a dependant able to produce a legal heir or succession certificate.
  • A death certificate from the Registrar of Births and Deaths, the municipal body or the gaon panchayat is available.

A family cannot apply, or is not eligible, if:

  • The worker was never registered with the Assam BOCW Welfare Board. Employment on a construction site alone does not create entitlement; only registration does.
  • The claimant is not a nominee or dependant. A neighbour, employer, contractor or labour union office-bearer cannot claim the money for themselves, though they may help the family file.
  • The worker was engaged in work that is outside the definition of building or other construction work under the 1996 Act, so the registration itself was not valid.
  • The family is claiming the accidental rate without accident documents. In that situation the claim is not rejected, but it is settled at the normal death rate of Rs 50,000.

Under the BOCW Act, 1996, registration as a beneficiary is open to a construction worker aged 18 to 60 years who has worked in building or other construction work for at least 90 days in the preceding twelve months. A family should check the registration card first, because eligibility for the death benefit is decided by that card, not by how long the person actually worked.

How much money does the family receive?

Circumstance of death Amount sanctioned
Normal or natural death of a registered member Rs 50,000
Accidental death during the course of employment Rs 3,00,000
Funeral assistance (separate, in every case) Rs 5,000
Family pension to surviving spouse of a pensioner 50% of the deceased pensioner's pension

The death benefit is a one-time lump sum, released to the nominee's bank account. Assam does not pay it in instalments and does not vary it by the number of dependants. A family in which the worker was also drawing disability pension or old-age pension from the Board should ask about family pension in the same application, because it is a recurring monthly payment and is easy to miss.

What documents are required for the death benefit claim?

Document Mandatory Notes
BOCW registration card of the deceased Yes Establishes live beneficiary status on the date of death
Death certificate Yes From Registrar of Births and Deaths, municipality or gaon panchayat
Nomination record or legal heir certificate Yes Nominee claims directly; heirs need a succession or legal heir certificate
Identity proof of nominee Yes Aadhaar, voter ID or PAN
Bank passbook of nominee Yes Payment is by bank transfer
Post-mortem report or FIR No Needed only to claim the Rs 3,00,000 accidental rate
Employer or contractor certificate No Supports the claim that the accident occurred during employment

Keep the originals and take at least two sets of self-attested photocopies. The labour office retains one set, and a second set is useful if the file has to be resubmitted.

How to apply for the Assam BOCW death benefit

  1. Locate the worker's registration card and confirm the registration number and the district labour office that issued it. Everything else in the claim depends on this number.
  2. Obtain the death certificate from the Registrar of Births and Deaths, the municipal board or the gaon panchayat covering the place of death. For an accidental death, also collect the FIR copy and the post-mortem report from the police station and hospital concerned.
  3. Collect the claim form from the district Labour office or the office of the Inspector holding the worker's file, and fill in the worker's registration number, date and cause of death, and the nominee's details.
  4. Attach the supporting documents, registration card, death certificate, nomination or legal heir certificate, nominee's identity proof and bank passbook copy, plus accident papers where the higher rate is being claimed.
  5. Submit the file at the district Labour office and insist on a dated acknowledgement or receipt carrying a diary number. This receipt is the only way to follow up later.
  6. Claim funeral assistance of Rs 5,000 in the same visit using the same supporting documents, so the family does not have to return with a second file.
  7. Follow up after four to six weeks with the diary number, and escalate to the Commissionerate of Labour at Shram Bhawan, Guwahati-07 if the file has not moved.

How does a construction worker register in the first place?

Registration is the precondition for every BOCW benefit, so a working family member should complete it now rather than after a tragedy. The Commissionerate of Labour, Assam lists Registration of Workers under the BOCW Act among the services delivered through the state Ease of Doing Business portal at eodb.assam.gov.in, and registration is also handled at district labour offices and at worksite registration camps.

To register, a worker needs proof of age, proof of residence in Assam, a photograph, a bank account, and a certificate of at least 90 days of construction work in the preceding twelve months, usually issued by the employer, contractor or a registered trade union. The nomination column must be filled in at the time of registration. A blank nomination is the single most common reason a family later has to spend months obtaining a succession certificate.

How to check the status of a death benefit claim

  1. Take the dated acknowledgement or diary number issued when the claim was filed back to the same district Labour office.
  2. Ask the dealing assistant whether the file has been verified by the Inspector and forwarded to the Welfare Board for sanction.
  3. Once sanction is issued, confirm that the bank account details on the file match the nominee's passbook, since a mismatch stops the transfer at the last step.
  4. If the account has changed since the claim was filed, submit a fresh cancelled cheque or passbook copy immediately, in writing.

Why BOCW death benefit claims get rejected in Assam

  • Registration had lapsed before the date of death because contributions were not kept up.
  • No nominee recorded, and the family has not produced a legal heir or succession certificate.
  • Name mismatch between the death certificate, the registration card and the nominee's identity document: very common where a name is spelt differently in Assamese and English records.
  • Accidental rate claimed without accident documents, which downgrades the claim to Rs 50,000 rather than rejecting it.
  • Bank details wrong or the account dormant, so the transfer fails after sanction.
  • Duplicate claim filed by two different relatives of the same worker, which freezes both files until the dispute is settled.

Most of these are curable. A name mismatch is fixed with an affidavit before a notary or executive magistrate. A lapsed registration should still be filed, with a written request for condonation, rather than abandoned.

Key dates and timelines

The Assam BOCW Welfare Board does not publish a hard last date for death benefit claims, the benefit is open all year and a claim can be filed once the death certificate is available. Families should still file as early as possible, because delay makes it harder to obtain the employer certificate, the FIR copy and the post-mortem report, and because a long gap between the date of death and the date of claim invites additional verification.

Grievance redressal and contact

  • Commissionerate of Labour, Assam — Shram Bhawan, Guwahati-07
  • Email; labour.commissioner@assam.gov.in and labourcommissionerassam@yahoo.com
  • District Labour office, the first point of contact for the claim itself and for any complaint about delay
  • Online services: eodb.assam.gov.in for registration of workers and establishments under the BOCW Act

Claiming the death benefit is free. No contractor, agent or intermediary is authorised to take a share of the Rs 50,000 or Rs 3,00,000 sanctioned to a nominee, and any demand for such a payment should be reported in writing to the Commissionerate of Labour.

Frequently asked questions

How much does the Assam BOCW Welfare Board pay as death benefit?

The Assam BOCW Welfare Board sanctions Rs 50,000 to the nominee or dependants of a registered member in case of normal death, and Rs 3,00,000 if the death is caused by an accident during the course of employment. Both amounts are paid as a lump sum to the nominee on record.

Is the funeral assistance separate from the death benefit?

Yes, funeral assistance of Rs 5,000 is a separate payment. The Assam BOCW Welfare Board sanctions Rs 5,000 towards funeral expenses in addition to the Rs 50,000 or Rs 3,00,000 death benefit, so a nominee should claim both in the same visit rather than treating them as alternatives.

Who can claim the death benefit of a registered construction worker?

The nominee recorded in the worker's BOCW registration record claims the benefit. Where no nomination was made, the dependants claim on the strength of a legal heir or succession certificate issued by the competent revenue authority.

Can the family of an unregistered construction worker claim this benefit?

No. Families of unregistered workers are not eligible. The Assam BOCW Welfare Board pays only on the death of a worker who was registered as a beneficiary under the Building and Other Construction Workers Act, 1996 and whose registration was live on the date of death.

What proof is needed for the higher Rs 3,00,000 accidental death rate?

A post-mortem report, FIR or police inquest report is normally required to establish accidental death in the course of employment. Without documentary proof of an accident the claim is settled at the normal death rate of Rs 50,000.

Does the widow also get a pension after the worker dies?

Yes, if the deceased was already drawing pension from the Board. The Assam BOCW Welfare Board pays family pension at 50 per cent of the deceased pensioner's pension to the surviving spouse, which is separate from the one-time death benefit.

Where does the family submit the death benefit claim?

Claims are submitted to the district Labour office or the office of the Inspector of the Assam BOCW Welfare Board that holds the worker's registration record. The Commissionerate of Labour, Assam operates from Shram Bhawan, Guwahati-07.

Is there any fee to claim the BOCW death benefit in Assam?

No, there is no fee. Claiming the death benefit is free, and no agent, contractor or middleman is authorised to charge the family for filing the claim or for having the payment released.
