Assam BOCW Welfare Board - Disability Pension
Assam state government scheme
Assam BOCW Welfare Board Disability Pension pays a registered construction worker who becomes permanently disabled Rs 2,000 a month plus Rs 100 a month for every completed year of membership, along with a one-time ex-gratia of up to Rs 3,00,000. The Labour Welfare Department sanctions it on a medical board certificate.
What is the Assam BOCW Welfare Board Disability Pension?
Assam BOCW Welfare Board Disability Pension is a monthly payment made to a registered construction worker who becomes permanently disabled and can no longer earn a living from construction work. The Assam Building and Other Construction Workers' Welfare Board, a tripartite body under the Labour Welfare Department of the Government of Assam, sanctions it out of the construction welfare cess fund.
According to the Commissionerate of Labour, Assam, the disability pension is Rs 2,000 per month plus Rs 100 per month for every completed year of service, together with a one-time ex-gratia or gratuity of up to Rs 3,00,000. That structure matters: the pension is not a flat figure, and a long-standing member draws materially more than a recent one.
The scheme operates under the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 and the companion Welfare Cess Act of the same year. Assam funds it from the one per cent cess levied on the cost of construction work in the state. Construction is among the most accident-prone occupations in India, and disability pension is the one benefit that replaces lost earnings for the rest of a worker's life rather than meeting a single expense.
How the pension is built up
| Component | Amount |
|---|---|
| Base monthly disability pension | Rs 2,000 |
| Add-on per completed year of membership | Rs 100 per month |
| Example: 5 completed years | Rs 2,500 per month |
| Example: 10 completed years | Rs 3,000 per month |
| Example: 15 completed years | Rs 3,500 per month |
| One-time ex-gratia or gratuity | Up to Rs 3,00,000 |
| Family pension to spouse after the pensioner's death | 50% of the pension drawn |
The same Rs 2,000 plus Rs 100 per year formula is used by the Board for the ordinary old-age pension paid from age 60, so a worker who is disabled before 60 is not put at a disadvantage on the monthly figure.
Who is eligible for the Assam BOCW disability pension?
A worker can claim if:
- The worker is a registered beneficiary of the Assam BOCW Welfare Board with a live registration card under the BOCW Act, 1996.
- A government medical board or civil surgeon has certified permanent disability, stating its nature and percentage.
- The disability prevents the worker from continuing in building or other construction work, which is the loss the pension is meant to replace.
- The worker's contributions have been kept up, since each completed year of membership adds Rs 100 a month to the pension.
A worker cannot apply, or is not eligible, if:
- The worker was never registered with the Assam BOCW Welfare Board. Years of actual construction work do not substitute for registration.
- The disability is temporary rather than permanent. Short-term incapacity is dealt with through the Board's medical assistance benefit, which pays Rs 1,000 a day for the first five days of hospitalisation and Rs 200 a day thereafter, subject to a ceiling of Rs 20,000.
- Only a private doctor's letter is produced. The sanctioning authority requires a certificate from a government medical board or civil surgeon.
- The applicant is an employer, contractor or supervisor rather than a registered worker.
- The worker is already drawing the Board's old-age pension on the same registration, since the Board pays one pension per member.
Under the BOCW Act, 1996, registration as a beneficiary is available to a construction worker aged 18 to 60 years who has done building or other construction work for at least 90 days in the preceding twelve months.
What documents are required for the disability pension?
| Document | Mandatory | Notes |
|---|---|---|
| BOCW registration card | Yes | Live registration; membership years decide the Rs 100 add-on |
| Disability certificate from a medical board | Yes | Government medical board or civil surgeon, with percentage of disability |
| Aadhaar card | Yes | Identification and bank seeding |
| Bank passbook | Yes | Monthly credit; account must be active |
| Age or date-of-birth proof | Yes | Voter ID, PAN, school certificate or birth certificate |
| Accident report or FIR | No | Needed to support the one-time ex-gratia in accident cases |
| Hospital treatment records | No | Discharge summary and treatment papers |
The disability certificate is the document that decides the case. It should state the percentage of disability and whether it is permanent, because a certificate that merely records an injury without those findings will be sent back.
How to apply for the Assam BOCW disability pension
- Obtain a disability certificate from the government medical board at the district civil hospital or from the civil surgeon. Ask specifically that the certificate record the nature of the disability, the percentage, and that it is permanent.
- Take the BOCW registration card to the district Labour office that issued it, and confirm that the registration is live and that the record shows the correct number of completed membership years.
- Collect and fill the welfare benefit claim form for disability pension, entering the registration number, the date and cause of the disability, and bank account details.
- Attach the supporting documents, registration card, disability certificate, Aadhaar, bank passbook copy, age proof, and where the disability arose from a worksite accident, the FIR or accident report and hospital records.
- Claim the one-time ex-gratia in the same application, referring to the accident papers, so the lump sum and the monthly pension are processed together rather than as two files.
- Submit at the district Labour office and take a dated acknowledgement carrying a diary number.
- Follow up after four to six weeks, and escalate in writing to the Commissionerate of Labour, Shram Bhawan, Guwahati-07, if the Inspector has not completed verification.
How to check the status of a disability pension claim
- Carry the diary number from the acknowledgement back to the district Labour office.
- Ask whether the Inspector's field verification of the registration and the disability has been completed.
- Confirm the file has gone to the Welfare Board for sanction, and whether the medical board certificate has been accepted or queried.
- Once the pension is sanctioned, check the first monthly credit in the passbook. If the credit does not appear in the following month, take the passbook and sanction reference back to the office immediately.
Why disability pension claims get rejected in Assam
- Disability certificate does not say "permanent" or omits the percentage. The commonest single defect, and it requires a fresh medical board sitting.
- Registration lapsed because contributions stopped after the injury, which is a cruel trap: the worker stops earning, stops contributing, and then finds the membership dead.
- Private hospital certificate submitted instead of a government medical board certificate.
- Bank account dormant or wrongly recorded, so the monthly credit fails.
- Name or age mismatch between the registration card, Aadhaar and the medical certificate. A notarised affidavit cures this.
- Ex-gratia claimed without accident documents, which does not defeat the monthly pension but does hold up the lump sum.
A worker whose registration lapsed after an injury should still file, with a written request that the lapse be condoned in view of the disability, and should attach the hospital records showing the period of incapacity.
Which other Board benefits should a disabled worker claim?
The Assam BOCW Welfare Board runs a package of benefits on the same registration, and a disabled worker's household is often eligible for several at once:
- Medical assistance: Rs 1,000 a day for the first five days of hospitalisation and Rs 200 a day thereafter, capped at Rs 20,000.
- Educational assistance for children; from Rs 1,500 a year for Classes 1 to 4 up to Rs 20,000 for postgraduate study, with full cost covered for engineering, medical and IIT courses at government institutions.
- Marriage assistance, Rs 25,000 for up to two children, subject to five years of membership.
- Annual health check-up; Rs 5,000.
- Interest-free tools loan — up to Rs 20,000, relevant where a partially disabled worker can shift to lighter self-employment.
- PMJJBY and PMSBY. The Board also facilitates coverage under the two central insurance schemes.
Each is claimed on the same registration number at the same district Labour office, and it is worth asking about all of them in one visit.
Key dates and timelines
The Assam BOCW Welfare Board has not published a hard last date for disability pension applications; the benefit is open all year and an application can be made once the medical board certificate is in hand. Workers should apply as soon as the disability is certified, because the pension runs from sanction and delay simply loses months of payment. Where the disability arose from a worksite accident, file the FIR promptly, since an accident report obtained months later is much harder to have accepted for the ex-gratia.

Frequently asked questions
How much disability pension does the Assam BOCW Welfare Board pay?
The Assam BOCW Welfare Board pays a disability pension of Rs 2,000 per month plus Rs 100 per month for each completed year of the worker's membership, and a one-time ex-gratia of up to Rs 3,00,000. A worker with ten completed years therefore draws Rs 3,000 a month.
Is there a lump-sum payment as well as the monthly pension?
Yes. The Assam BOCW Welfare Board sanctions a one-time ex-gratia or gratuity of up to Rs 3,00,000 in permanent disability cases, in addition to the monthly disability pension. The exact amount within that ceiling depends on the severity certified by the medical board.
Who certifies the disability for this pension?
A government medical board or civil surgeon certifies the disability, stating its nature and percentage. The Assam BOCW Welfare Board sanctions the pension on that certificate; a private doctor's letter alone is not accepted.
Can a construction worker who was never registered claim disability pension?
No. Unregistered construction workers are not eligible. Only a worker registered as a beneficiary of the Assam BOCW Welfare Board under the BOCW Act, 1996, with a live registration, can claim disability pension.
Does the disability have to be caused by a worksite accident?
The one-time ex-gratia is tied to accident cases and needs an FIR or accident report, but permanent disability certified by a medical board is the core requirement for the monthly pension. Workers should file the accident papers wherever the disability arose at work.
What happens to the pension if the worker dies?
The Assam BOCW Welfare Board pays family pension at 50 per cent of the deceased pensioner's pension to the surviving spouse. The nominee should also claim the death benefit of Rs 50,000, or Rs 3,00,000 for accidental death, and Rs 5,000 funeral assistance.
How is the Rs 100 per year component calculated?
Rs 100 is added to the monthly pension for every completed year of the worker's membership of the Assam BOCW Welfare Board. Keeping the registration live and contributions paid up therefore raises the pension directly, which is why lapsed memberships cost money.
Where does a disabled worker apply for this pension?
Applications go to the district Labour office or the Inspector of the Assam BOCW Welfare Board holding the worker's registration record. The Commissionerate of Labour, Assam is at Shram Bhawan, Guwahati-07.
