Property Registration (Sale Deed) in Goa
Goa state government scheme
Property registration in Goa is done by the Department of Registration under the Revenue Department, through the Sub-Registrar office of the taluka where the property lies, with online services on goaonline.gov.in. Goa charges stamp duty and registration fee on a slab basis that rises with property value, and registration is normally completed on the appointment date.
What is property registration in Goa?
Property registration in Goa is the recording of a sale deed by the Sub-Registrar of the taluka in which the property lies, under the Registration Act, 1908, in the register maintained by the Department of Registration, Revenue Department, Government of Goa. Registration is what turns a signed agreement into a public record of ownership.
Goa's land record system is unlike any other Indian state's, and that is the fact a buyer here most needs to understand. Alongside the modern survey record; Form I and XIV; Goa retains the descriptive and inscription records inherited from the Portuguese-era registration system, the Property Register and the Index of Land Registration. A clean title in Goa means the survey record, the descriptive record and the deed chain all agree. They often do not.
The state's online services run through goaonline.gov.in, which carries the Revenue Department's property services: Property / Land Information (Record of Rights, Registration, Property Tax), Form I and XIV, the Property Register, application for a digitally signed survey plan, and the divergence certificate used where records conflict.
Who can and cannot register a sale deed in Goa?
You can register if:
- You are the lawful owner of the property, or hold a registered power of attorney from the owner, and are selling it.
- You are the buyer, above 18, an Indian citizen or an NRI or person of Indian origin buying property permitted under FEMA.
- The property lies within the jurisdiction of the taluka Sub-Registrar office you approach.
- The stamp duty and registration fee have been paid in full on the notified value.
You cannot register if:
- The stamp duty is short-paid, typically where duty was computed on a price below the government-notified market value. The Sub-Registrar will refuse or impound the document.
- The land is comunidade land or otherwise not freely alienable. Comunidade holdings are village-community property under Goa's own land system, and a private sale of such land is not a routine registration.
- The property is subject to mundkar or tenancy rights under Goa's tenancy laws, which give a resident occupant statutory protection that survives a sale.
- The seller is a minor or of unsound mind without a court-appointed guardian's authority.
- The property is under court injunction, attachment or a statutory freeze, or is government or comunidade land occupied without title.
- The document is presented more than four months after execution without paying the delay penalty allowed under section 25 of the Registration Act.
Foreign nationals who are not of Indian origin cannot acquire immovable property in Goa without Reserve Bank of India approval. A live issue in a state with heavy overseas interest in villas and second homes.
What does it cost; stamp duty and registration fee in Goa?
Goa's cost structure is genuinely different from most states. Instead of a single flat percentage for a sale deed, Goa charges both the stamp duty and the registration fee on slabs that rise with the value of the property. A modest house and a high-value villa are not charged at the same rate, and the registration fee — which many states cap, also climbs with value here.
Duty is computed on the higher of the consideration written into the deed and the government-notified market value for that survey number, locality and construction type.
Take the exact rate from the department, not from a broker or a blog. Slab boundaries and rates are revised by government notification, and a rate that was correct a year ago may not be correct for your transaction. Ask the taluka Sub-Registrar office for the current slab table, or check the Department of Registration's own published schedule, before you commit to a price.
Goa has also moved decisively to e-stamping. Physical stamp paper is no longer accepted for higher-value instruments, so budget for the e-stamp certificate route rather than assuming you can buy paper from a vendor on the day.
Where the sale consideration is Rs 50 lakh or more, the buyer must separately deposit 1 per cent TDS under section 194-IA of the Income Tax Act in Form 26QB.
How to register a sale deed in Goa
- Pull the survey record. Apply for Form I and XIV for the survey number and sub-division through the Revenue Department services on goaonline.gov.in, and confirm the seller is the recorded occupant and the area matches what you are being sold.
- Check the descriptive record. Take the Property Register entry and the Index of Land Registration description and inscription for the property. Goa's Portuguese-era records are where most title defects surface, and a mismatch between them and Form I and XIV is a warning, not a formality.
- Get a divergence certificate or a digitally signed survey plan if the records disagree on boundaries or extent. Both are services on goaonline.gov.in and both exist precisely because Goa's records diverge.
- Check for tenancy, mundkar and comunidade interests. Ask specifically whether any occupant lives on the land, and whether the land is or was comunidade property. These are the two claims that most often defeat a Goa purchase after money has changed hands.
- Get the deed drafted by an advocate practising in Goa, describing the survey number, sub-division, area, boundaries, consideration, mode of payment and possession date, and reciting the chain of title from the Property Register.
- Obtain the current duty and fee slab from the taluka Sub-Registrar office or the Department of Registration's published schedule, and compute the amounts on the notified value.
- Pay stamp duty by e-stamping and pay the registration fee separately, and keep both certificates or challans.
- Deposit TDS in Form 26QB if the consideration is Rs 50 lakh or more.
- Book the appointment with the Sub-Registrar office having jurisdiction, selecting the date, the office shift and the hour.
- Attend on the appointment date with all buyers, all sellers and two witnesses, carrying the original deed, the e-stamp certificate, the fee receipt, PAN and Aadhaar. Photographs and biometrics are captured at the office.
- Execute and admit the document before the Sub-Registrar, who verifies the duty and the identities and endorses the deed.
- Collect the receipt, then obtain the registered document and apply for mutation.
How to register at the taluka Sub-Registrar office
- Identify the correct taluka Sub-Registrar office. Goa's registration jurisdiction follows the taluka in which the land lies: Bardez, Salcete, Tiswadi, Mormugao, Ponda, Bicholim, Pernem, Sattari, Quepem, Canacona, Sanguem and Dharbandora, and presenting at the wrong office wastes the day.
- Confirm the current duty and fee slabs at the counter before you buy the e-stamp, and ask for the printed schedule.
- Present the deed in person with every party and two witnesses during the office shift you have been given, and take a token.
- Complete photo and biometric capture, pay the registration fee and the printed copying charges, and insist on receipts.
- Collect the endorsed document on the date written on your receipt.
How do I check the status and confirm registration?
- The Property / Land Information service on goaonline.gov.in, covering Record of Rights, registration and property tax, is the route to confirm the property's current recorded position.
- The Property Register extract taken a few weeks after registration should show your deed inscribed against the property. That is the practical proof registration is complete.
- The taluka Sub-Registrar office can trace the file against the presentation receipt number.
- goaonline helpline +91-8882988000, 9:30 AM to 1:15 PM and 2:15 PM to 5:45 PM, Monday to Friday excluding holidays, for online service problems.
Is a registered sale deed valid forever, and what comes next?
A registered sale deed in Goa carries no expiry and needs no renewal. The register entry is permanent.
Three steps remain after registration, and Goa buyers commonly stop at the first:
- Mutation so that Form I and XIV records you as the occupant of the survey number.
- Inscription in the Property Register, so the descriptive record and the survey record agree. In Goa this matters more than elsewhere, because the next buyer's advocate will check both.
- Property tax name change at the municipal council, corporation or village panchayat, and the association transfer for a flat.
Why do property registrations fail in Goa?
- Duty computed below the notified market value, or on the wrong slab.
- A divergence between Form I and XIV and the Property Register on area, boundaries or ownership, unresolved at the time of presentation.
- Comunidade land presented as freehold.
- A mundkar or tenant in occupation whose statutory rights were never disclosed.
- Physical stamp paper used where e-stamping is now required.
- A co-owner absent on the appointment date, with no registered power of attorney. Goa's inheritance law produces large numbers of co-owners, and a single missing heir stops the registration.
- An unregistered power of attorney offered in place of the owner.
- Name mismatch across the deed, PAN and Aadhaar, or between the deed and the Portuguese-era spelling in the Property Register.
- Presentation beyond four months of execution without the delay penalty.
What should you pay, and what should you refuse?
Three payments are legitimate: the stamp duty on the applicable slab, the registration fee on its slab, and any printed copying or service charge at the counter. Each produces a receipt or an e-stamp certificate you can verify.
Nobody can reduce the duty. It is computed on the government's own notified value, and anyone offering a "cheaper registration" is proposing to under-declare the price, a liability that falls on the buyer when the document is impounded. Goa's property market attracts a large number of unregulated intermediaries; insist on seeing the department's own slab schedule before you accept any figure, and never pay an advance before you have read Form I and XIV and the Property Register yourself. Never share your Aadhaar OTP with a middleman, and never sign a deed with a blank consideration column.

Frequently asked questions
Which department registers property in Goa?
The Department of Registration under the Revenue Department, Government of Goa, registers property through the Sub-Registrar office of the taluka in which the property lies. Supporting property records — Form I and XIV, the Property Register, survey plans and land information — are delivered online through goaonline.gov.in.
How are stamp duty and registration fee charged in Goa?
Goa charges both stamp duty and the registration fee on a slab basis that rises with the value of the property, which is unusual — most states apply a single percentage for a sale deed. Because the slab boundaries and rates are revised by notification, take the exact figure from the Department of Registration or the Sub-Registrar office before you pay.
On what value is duty calculated in Goa?
Duty is calculated on the higher of the consideration written in the deed and the government-notified market value for that survey number and locality. Writing a lower price in the deed does not lower the duty; it only creates a shortfall the Sub-Registrar will pick up.
What are Form I and XIV, and why does every Goa buyer need them?
Form I and XIV is Goa's survey record for a plot, showing the survey number, sub-division, area and the recorded occupant, and it is the first document to check before paying any advance. You can apply for it through the Revenue Department services on goaonline.gov.in.
What is comunidade land and can I buy it?
Comunidade land is village community land held under Goa's distinctive pre-Portuguese and Portuguese-era communal ownership system, and it is not freely saleable to a private buyer in the way freehold land is. If the records show comunidade ownership or a comunidade lease, get legal advice before signing anything.
Do all parties have to attend the Sub-Registrar office?
Yes, every buyer, every seller and two witnesses must appear on the appointment date for identity verification, photographs and biometric capture. A registered power of attorney is the only substitute for an absent party.
Does registration change the land record into my name?
No, registration and mutation are separate. After the sale deed is registered, apply for mutation so that Form I and XIV and the Property Register carry your name, and separately get the municipal or panchayat property tax record changed.
What should I refuse to pay a middleman?
Refuse anything beyond the stamp duty, the registration fee and the printed copying or service charge, each of which produces a receipt. No agent can reduce the duty, because it is computed on the government-notified value of the property.
