Legal Heirs Certificate in Himachal Pradesh (HimSeva) and the Succession Certificate route
Himachal Pradesh state government scheme
Legal Heirs Certificate in Himachal Pradesh is a Revenue Department service applied for on the HimSeva portal at himseva.hp.gov.in, which replaced the old eDistrict Himachal Pradesh portal, or through a Lok Mitra Kendra. The Tehsildar signs it after a revenue enquiry, and the citizen helpline for the portal is 0177-3525111 or toll-free 1800 180 8076.
What is a legal heirs certificate in Himachal Pradesh?
A Legal Heirs Certificate in Himachal Pradesh is the Revenue Department's official statement of who the surviving heirs of a deceased person are. It is listed by name among the services on HimSeva, the state's citizen services portal at himseva.hp.gov.in.
Himachal Pradesh changed the front door to this service recently, and readers often land on the wrong one. The old eDistrict Himachal Pradesh portal at edistrict.hp.gov.in now carries only a notice: the portal "has now been renamed as HimSeva Portal", and citizens are directed to himseva.hp.gov.in for all citizen services and applications. If you have an old bookmark or an old printed instruction sheet naming eDistrict HP, use HimSeva instead.
The certificate is signed by the Tehsildar of the tehsil where the deceased ordinarily resided, after the Patwari and the Kanungo verify the family composition on the ground. In Himachal Pradesh that verification leans heavily on the Parivar Register. The family register each gram panchayat maintains, which is the state's working record of who belongs to which household.
The certificate is used for pension and family pension claims, arrear salary, gratuity and provident fund of a deceased government employee, compassionate appointment claims, and as a supporting document in inheritance mutation of land.
Legal heir certificate or succession certificate, which do you need?
These are separate documents from separate branches of the state, and the distinction decides where you spend the next few months.
A legal heirs certificate is administrative. The Tehsildar issues it after a revenue enquiry. It names the survivors, and Himachal Pradesh departments accept it for pension, service dues and welfare claims.
A succession certificate is judicial. A District Judge grants it under sections 370 to 390 of the Indian Succession Act, 1925, on a petition filed in the court having jurisdiction over the place where the deceased ordinarily resided or where the property is situated. The court publishes a notice inviting objections, waits out the period, and grants the certificate only if the claim stands unchallenged or survives the challenge. A succession certificate authorises the holder to collect debts and securities, bank balances, fixed deposits, shares, debentures, bonds and mutual fund units, and carries an ad valorem court fee on the value of the estate.
The practical rule in Himachal Pradesh:
- Pension, family pension, gratuity, provident fund and service dues, the Tehsildar's legal heirs certificate is normally the document the paying office wants.
- Bank deposits, shares and securities, particularly large balances with no registered nominee: expect the bank or depository to insist on a court succession certificate.
- Land and houses in Himachal Pradesh, neither document transfers title. Inheritance is recorded through mutation (intkaal) in the jamabandi, a separate revenue proceeding before the Tehsildar. Where there is a will, the executor may need probate.
A succession certificate does not decide ownership of immovable property. Families in Himachal frequently file for one expecting it to end a land dispute, and it cannot.
Who can apply, and who cannot?
You can apply if:
- You are the spouse, son, daughter, mother or father of the deceased, the Class I heirs under the Hindu Succession Act, 1956, who take equal shares. Since the 2005 amendment, daughters are coparceners on the same footing as sons, married or not.
- You are a grandchild through a predeceased son or daughter, taking that parent's share by representation.
- You are a family member recorded in the deceased's service book where the deceased was a Himachal Pradesh government employee or pensioner.
- You are an heir under Muslim personal law, or under the Indian Succession Act 1925 where the deceased was Christian or Parsi.
You cannot apply if:
- You are not an heir. A creditor, an employer, a neighbour or a friend cannot obtain another family's legal heir certificate.
- The deceased did not ordinarily reside in Himachal Pradesh. Jurisdiction follows the deceased's last ordinary residence, so apply in the state where the deceased actually lived.
- You have no registered death certificate from the panchayat, nagar panchayat, municipal council or corporation.
- The heirship is disputed and another claimant has objected. The Tehsildar will not adjudicate a contested succession — that is for the civil court.
A legal heirs certificate is not a Parivar Register extract, though the two get confused in Himachal Pradesh. The Parivar Nakal records who currently lives in the household; the legal heirs certificate is a formal Revenue finding of who inherits from a specific deceased person. You will usually need the first in order to get the second.
What documents are required?
| Document | Mandatory | Notes |
|---|---|---|
| Death certificate of the deceased | Yes | From the panchayat, nagar panchayat or municipal registrar |
| Applicant's identity proof (Aadhaar / voter ID / PAN) | Yes | Name must match the application exactly |
| Residence proof of the deceased in Himachal Pradesh | Yes | Fixes the tehsil with jurisdiction |
| Parivar Register extract (Parivar Nakal) | Yes | Panchayat family register, checked against the heir list |
| Affidavit listing every surviving heir | Yes | Name, age, relationship and address of each heir |
| Service book or pension papers | If applicable | Where the deceased was a government employee or pensioner |
| No-objection from the other heirs | If applicable | Where one heir applies for the family |
How to apply for a legal heirs certificate in Himachal Pradesh
- Register the death with the gram panchayat, nagar panchayat, municipal council or municipal corporation, and collect the death certificate.
- Get the Parivar Register extract updated at the gram panchayat so the household record matches the heir list you are about to declare.
- Prepare the affidavit naming every surviving heir with age, relationship and current address, including heirs living outside the state.
- Open HimSeva at himseva.hp.gov.in, create a citizen account, and select Legal Heirs Certificate from the service list. Read the checklist shown on the service page before starting the form.
- Fill the application, entering the deceased's name exactly as it appears on the death certificate, the date of death, the last address, and the tehsil and district.
- Upload the documents, death certificate, identity proof, residence proof, Parivar Nakal, the affidavit, and the service book extract if it applies.
- Submit and note the reference number, which is what you will use for status tracking and for every escalation afterwards.
- Attend the Patwari's field enquiry. The Patwari and Kanungo verify the family composition locally and report to the Tehsildar. This step accounts for most of the elapsed time.
- Download or collect the certificate once the Tehsildar signs it.
How to apply through a Lok Mitra Kendra or the Tehsil office
- Visit an authorised Lok Mitra Kendra (LMK), Himachal Pradesh's network of citizen service centres, with the originals and photocopies of every document. The HimSeva portal directs citizens to an LMK for assisted filing.
- Have the operator file the HimSeva application on your behalf. Himachal Pradesh runs one online workflow, so the LMK route is an assisted online filing rather than a separate paper channel.
- Check the acknowledgement slip and confirm that the heir list typed into the form matches the list in your affidavit.
- Approach the Tehsil office directly if the file needs following up, and ask the Patwari of your halqa about the status of the enquiry report.
How do I check the status of my application?
HimSeva provides a Track Application Status page. Enter the reference number issued when you filed, and the portal shows which stage the file is at; pending with the Patwari, with the Kanungo, with the Tehsildar, or approved. HimSeva also provides a Verify Certificate option, which anyone receiving your certificate can use to confirm it is genuine.
For a stalled application, call the citizen helpline 0177-3525111 or the toll-free number 1800 180 8076. Departmental officers have a separate digital helpline on 0177-3525101/02, which is useful to quote when a Tehsil office says the portal is at fault.
How long is it valid?
A Himachal Pradesh legal heirs certificate does not expire. A finding of who the heirs are does not change with time, so there is no renewal cycle. In practice a bank, insurer or pension office may still ask for a recently issued copy, and some will insist on a fresh certificate if the family has changed since. A further death, a marriage, a birth. Keep the digitally signed copy, which can be verified online through HimSeva at any time.
Why do applications get rejected?
- An heir omitted from the affidavit, usually a married daughter or a son settled outside Himachal Pradesh. The Patwari's enquiry finds it.
- A Parivar Register that does not match the claim. A birth, death or marriage never entered in the panchayat's family register.
- Name mismatch between the death certificate, the Parivar Nakal and the Aadhaar or voter ID.
- No registered death certificate, or a hospital death summary offered instead of the registrar's certificate.
- Wrong tehsil, where the family filed from where they now live rather than from the deceased's last ordinary residence.
- An objection by another claimant, which stops the administrative route.
What does it cost, and what should you refuse to pay?
Apply directly on himseva.hp.gov.in and you pay only what the portal itself charges at the payment step, or nothing at all where the service carries no fee. A Lok Mitra Kendra may charge its own notified service charge for assisted filing, and that is the only other legitimate payment.
Refuse to pay an agent, a tout outside the Tehsil office, or anyone claiming influence with the Patwari, a fee to "get the file cleared". No payment shortens the field enquiry, and paying one is a bribe. If a government official demands money, that is a matter for the State Vigilance and Anti-Corruption Bureau.
Court fees on a succession certificate are a separate matter and are genuinely payable, an ad valorem court fee on the value of the estate, plus an advocate's fee. Ask your advocate for the exact figure applicable to your estate value before filing.
Grievance and helpline route
Start with the HimSeva citizen helpline 0177-3525111 or the toll-free 1800 180 8076, quoting your application reference number. The portal also carries a Feedback / Grievance channel for complaints about a service or a service centre.
If the Tehsil office has held the file for an unreasonable time, escalate in order: the Tehsildar, then the Sub-Divisional Magistrate (SDM), then the Deputy Commissioner of the district. Himachal Pradesh also runs a state public grievance system, and an RTI application to the Tehsil office asking for the file's current status and the reason for delay frequently produces movement on its own.

Frequently asked questions
Which portal do I use for a legal heir certificate in Himachal Pradesh?
Use HimSeva at himseva.hp.gov.in, which lists "Legal Heirs Certificate" among its services. The older eDistrict Himachal Pradesh portal at edistrict.hp.gov.in now carries a notice saying it has been renamed as the HimSeva Portal and redirects citizens there for all applications.
Who issues the legal heir certificate in Himachal Pradesh?
The Revenue Department issues it through the Tehsildar of the area where the deceased ordinarily resided. The Patwari and the Kanungo carry out the field enquiry into the family composition before the Tehsildar signs.
What is the difference between a legal heir certificate and a succession certificate?
A legal heir certificate is an administrative Revenue Department document naming the survivors, used for pension, service dues and provident fund claims. A succession certificate is granted by a District Judge under sections 370 to 390 of the Indian Succession Act 1925 and is what banks and depositories require for bank deposits, shares and securities.
Can I apply for a Himachal Pradesh legal heir certificate at a Lok Mitra Kendra?
Yes — Lok Mitra Kendras are Himachal Pradesh's authorised citizen service centres and file HimSeva applications on a citizen's behalf. The HimSeva portal directs citizens to an authorised LMK where they prefer assisted filing over applying themselves.
Is a Parivar Register extract needed for the Himachal Pradesh legal heir certificate?
Yes, in practice. The Parivar Register maintained by the gram panchayat is Himachal Pradesh's standard record of who lives in a household, and Revenue offices check the claimed heir list against it before the enquiry. Get the extract updated if a birth, death or marriage has not been entered.
Does a Himachal Pradesh legal heir certificate transfer land?
No. Inheritance mutation of land in Himachal Pradesh is a separate revenue proceeding before the Tehsildar, entered in the jamabandi and the mutation register. The legal heir certificate is one of the papers filed in it, not a substitute for it.
How do I check the status of a HimSeva application?
Use the track application status option on himseva.hp.gov.in with the reference number issued when you filed. For a stalled file, call the citizen helpline 0177-3525111 or the toll-free number 1800 180 8076.
