Patta Transfer (Property Mutation) in Puducherry

Puducherry state government scheme

Quick answer

Patta transfer is Puducherry's name for property mutation, and the Department of Revenue and Disaster Management runs it through the Tahsildar of the taluk or sub-taluk. The citizen files Patta Transfer Application Form-10 with the registered deed and link documents. The department's citizen charter fixes 15 days for a transfer without sub-division and 2 months where the field must be sub-divided.

Benefit
A patta standing in your own name in the Puducherry settlement and chitta register, so the land record, the Nilamagal search and any future sale start from you as the recorded pattadar
How to apply
Offline in Form-10 at the Taluk / Sub-Taluk Office of the Tahsildar in Puducherry, Karaikal, Mahe or Yanam; the resulting record is viewable online at nilamagal.py.gov.in

What is patta transfer in Puducherry?

Patta transfer is the Union Territory of Puducherry's name for what most Indian states call property mutation or dakhil-kharij, the revenue proceeding that takes a patta out of the seller's or deceased holder's name and puts it in the buyer's or heir's name. The Department of Revenue and Disaster Management, Government of Puducherry owns the process, and the Tahsildar or Deputy Tahsildar of the taluk or sub-taluk is both the officer you apply to and the officer who sanctions it.

Registration and mutation are two separate acts in Puducherry, and confusing them is the single most expensive mistake a buyer makes here. When you register a sale deed at the Sub-Registrar Office, the Registration Department records that a transaction happened, its citizen charter allows seven working days for registration of documents and five working days for an encumbrance certificate. Nothing in that step changes the patta. Until you file Form-10 with the Tahsildar and the transfer is sanctioned, the settlement and chitta register still shows the previous holder, and the land you paid for is still recorded against someone else's name.

Puducherry is administered as four geographically separate regions, Puducherry, Karaikal, Mahe and Yanam, and Form-10 asks you to name which one at the top. Puducherry region alone is divided into Pondicherry Taluk and the Villianur, Bahour and other sub-taluks, each with firkas and numbered revenue villages; Karaikal, Mahe and Yanam have their own taluk or sub-taluk offices. Your application goes to the taluk office of the region where the land lies, not to a central office.

The record that results is visible to the public. Nilamagal, at nilamagal.py.gov.in, is the online land-records application of the Directorate of Survey and Land Records and lets anyone search the settlement and chitta register by patta number or R.S. number, for any of the four regions, without a login. After the transfer is sanctioned, that search is how you confirm it actually reached the record.

Who can and cannot apply for patta transfer in Puducherry?

You can apply if you are:

  • A purchaser of land or a house site under a registered sale deed
  • A legal heir or successor of a deceased pattadar, applying on the strength of a succession certificate or a legal heir certificate issued by the civil court
  • A donee under a registered gift deed, or a beneficiary under a registered settlement deed
  • A legatee under a will, which Form-10 lists as one of the four modes of acquisition
  • A co-owner seeking a separate patta by measuring and sub-dividing the field

You cannot apply; or the application will fail — in these situations:

  • The land is government poramboke, temple property or a water body, or there is an encroachment involved. Declaration 4 of Form-10 requires you to state on your signature that none of these apply.
  • There are pending litigations or court cases on the land. Declaration 2 requires you to certify there are none.
  • You are not in peaceful possession. Declaration 3 requires you to certify that you are.
  • The transfer rests on an unregistered paper, an agreement to sell or a power of attorney rather than a registered instrument. Form-10 only offers four boxes: sale, settlement, will and gift: each tied to a registered document number and Sub-Registrar Office.
  • You cannot produce the chain of title. Column III of Form-10 asks for the recent transactions from the original pattadar down to you, and the charter requires "link documents depicting devolution of the property".
  • The existing entry is merely wrong rather than out of date. That is rectification of an erroneous entry, a different service before the Settlement Officer.

Declaration 7 of Form-10 is worth reading before you sign: false or misleading information may lead to the rejection, cancellation or reversal of the patta, and may attract legal action.

How to apply for patta transfer in Puducherry: step by step

  1. Register the deed first. Get the sale, settlement, gift or will-based transfer registered at the Sub-Registrar Office. The Registration Department's charter allows seven working days for registration and three days for a copy of a document. Note the document number, date and the SRO: Form-10 asks for all three.
  2. Take an Encumbrance Certificate. An official EC is a listed enclosure to Form-10. The Registration Department allows five working days for it.
  3. Collect the existing patta copy, settlement copy and FMB sketch. A patta, chitta or adangal copy is a five-day service from the Tahsildar or Deputy Tahsildar on a plain-paper application; an FMB copy is a seven-day service from the Directorate of Survey and Land Records. You can check the current entry yourself first on Nilamagal.
  4. Fill Form-10 completely. Give your name, father's or husband's name, residential address and mobile number; the taluk, revenue village, existing patta number, survey number (R.S. No./T.S. No.), cadastre number (O.S. No.) and extent in HAC or square feet; the four boundaries of the property in the North/South/East/West table; and the transaction history in Column III. Attach a separate signed sheet if there are more than five transactions.
  5. Sign the seven declarations. They cover rightful ownership, absence of litigation, peaceful possession, the land not being poramboke or temple property, truth of the documents, cooperation with verification, and the consequence of false information.
  6. Submit Form-10 with all enclosures at the taluk office. The listed enclosures are all relevant documents from Column III, the patta copy, the settlement copy, the FMB sketch or layout copy if available, and the official Encumbrance Certificate. Incomplete applications are not processed.
  7. Pay the sub-division fee if the field is being split. The charter lists a sub-division fee among the documents to be produced where a separate patta has to be issued by measuring and sub-dividing the field.
  8. Follow up with the Tahsildar within the charter timeline. 15 days for a transfer without sub-division; two months where sub-division is involved.
  9. Verify the result on Nilamagal. Search by your patta number or R.S. number under the correct region, taluk, village and land type. If the new patta shows, the transfer is done.

How long does patta transfer take in Puducherry?

The citizen charter of the Department of Revenue and Disaster Management sets the timelines directly. Patta transfer without sub-division: 15 days. Patta transfer involving sub-divisions: two months. The sanctioning authority in both cases is the Tahsildar or Deputy Tahsildar.

Related timelines from the same charter are useful to plan around. Issue of a chitta, patta or adangal copy takes five days. Issue of extracts of land records from the Directorate of Survey and Land Records takes five days. Issue of a separate patta by measuring and sub-dividing the field takes two months. Demarcation of boundaries takes one month. Transfer of a kudiyiruppu patta to the legal heirs of the kudiyiruppu pattadar takes one month, and is sanctioned by the Authorised Officer (Kudiyiruppu) rather than the Tahsildar. Transfer of the patta of a free house-site to the legal heirs of the original assignee takes two months and is a Director of Survey matter. Rectification of an erroneous entry takes three months in undisputed cases.

Why do patta transfer applications get rejected in Puducherry?

  • The chain of title in Column III is broken, or the link documents do not match the registered deeds.
  • The Encumbrance Certificate, patta copy or settlement copy is missing, Form-10 says such applications will not be processed.
  • The survey number, cadastre number or extent in the application does not tally with the settlement register.
  • The four boundaries stated do not agree with the FMB sketch or with the neighbours' pattas.
  • The land turns out to be classified as poramboke, temple property or a water body, contradicting Declaration 4.
  • Litigation is pending on the property, contradicting Declaration 2.
  • The applicant is not in possession, or a co-heir disputes the claim in an inheritance case.
  • The applicant applied for patta transfer when what was actually needed was rectification of an erroneous entry.

Does a Puducherry patta expire, and does it need renewal?

No. A patta once transferred into your name has no validity period and needs no renewal. It stands until the next change of ownership, at which point the next buyer or heir files their own Form-10. What does need attention is keeping the record consistent, if you later sub-divide the plot, sell part of it, or the boundaries are disturbed, use the sub-division and demarcation services of the Directorate of Survey and Land Records rather than letting the record drift out of line with the ground.

Fees, middlemen and where to complain

File Form-10 yourself at the taluk office. The application is a departmental form, the only charge the citizen charter attaches to patta transfer is the sub-division fee where the field actually has to be measured and split, and services such as a patta, chitta or adangal copy are plain-paper applications to the Tahsildar. Any other amount someone asks for is not a government fee.

Do not pay an agent to "get the patta changed." The Tahsildar decides these applications on the documents and the field position, the charter publishes exactly how long each step may take, and every enclosure the department wants is printed on Form-10 itself. If the timeline lapses, the charter names the remedy: the Additional District Magistrate for patta transfer, the Director of Survey for sub-division, demarcation, FMB and village map services, and the District Collector for rectification of erroneous entries and for the issue of a separate patta by sub-division. Take the delay up that ladder in writing, quoting the charter time limit and your application date, rather than paying someone to move a file that is already time-bound.

How to check your patta transfer application status

Puducherry's Department of Revenue and Disaster Management does not run an online tracking portal where you can enter an acknowledgement number and see a live status for a Form-10 application, so status checking here is a mix of direct follow-up with the taluk office and a final verification on the public land-records site once the transfer is sanctioned.

  1. Keep your submission receipt. When you hand in Form-10 with its enclosures at the taluk or sub-taluk office, note the date of submission and, if the office issues one, the acknowledgement or diary number. This is what you quote in every follow-up.
  2. Track against the charter timeline, not a portal. The citizen charter gives the Tahsildar or Deputy Tahsildar 15 days to sanction a transfer with no sub-division, and two months where the field has to be measured and sub-divided. Count from your submission date; there is nothing to check online before that window closes.
  3. Call or visit the taluk office directly. Because there is no tracking number system, the working way to check progress mid-process is to contact the Tahsildar's office of the taluk or sub-taluk where you filed, quoting your application date and the survey/patta number, and ask whether the field verification or Column III document check is complete.
  4. Search Nilamagal once the timeline has passed. Nilamagal (nilamagal.py.gov.in), run by the Directorate of Survey and Land Records, lets anyone search the settlement and chitta register by patta number or R.S. number for Puducherry, Karaikal, Mahe or Yanam without logging in. If your name now appears as the pattadar against that survey number, the transfer has gone through and been recorded.
  5. If Nilamagal still shows the old name after the charter deadline has passed, that is your signal to escalate rather than keep waiting. The charter names the Additional District Magistrate as the authority for delays in patta transfer specifically. Write to the ADM, quoting the charter's 15-day or two-month limit, your submission date and the taluk office where you filed.
  6. For sub-division-linked transfers, remember two separate offices can be involved: the Tahsildar sanctions the patta transfer itself, while the Director of Survey's office handles the actual measurement and sub-division of the field. If the delay is on the survey side, the charter routes escalation to the Director of Survey rather than the ADM.

There is no SMS or app-based status alert for this service; a sanctioned transfer is confirmed only by the updated entry appearing on Nilamagal or by written confirmation from the taluk office.

Frequently asked questions

What is patta transfer in Puducherry?

Patta transfer is Puducherry's term for property mutation — moving the patta from the seller or deceased holder into the buyer's or heir's name in the settlement and chitta register. The Department of Revenue and Disaster Management handles it through the Tahsildar or Deputy Tahsildar of the taluk or sub-taluk.

How long does patta transfer take in Puducherry?

The citizen charter of the Department of Revenue and Disaster Management fixes 15 days for a transfer without sub-division and two months where the land has to be sub-divided. Where a separate patta is issued by measuring and sub-dividing the field, the Directorate of Survey and Land Records also lists two months.

Which form do I use for patta transfer in Puducherry?

Form-10, the "Patta Transfer Application" of the Department of Revenue and Disaster Management, addressed to the Tahsildar of your taluk office. It is the same form for a name transfer and for a sub-division — you tick which one you need in the subject line.

Who do I apply to for patta transfer in Puducherry?

The Tahsildar of the taluk or sub-taluk where the land lies. Form-10 is addressed to "The Tahsildar, ______ Taluk Office, ______ District, Puducherry / Karaikal / Mahe / Yanam", and the charter names the Tahsildar or Deputy Tahsildar as both the receiving and the sanctioning authority.

What if the Tahsildar does not act on my patta transfer?

The citizen charter names the Additional District Magistrate as the remedy for non-service on patta transfer. For the Directorate of Survey and Land Records services — sub-division, demarcation, FMB copies — the named remedy is the Director of Survey, and for rectification of an erroneous entry, the District Collector.

Can I check my Puducherry patta online after the transfer?

Yes. Nilamagal, the online land-records application of the Directorate of Survey and Land Records at nilamagal.py.gov.in, lets anyone search the settlement and chitta register by patta number or R.S. number for all four regions. Use it to confirm the transfer actually landed in the record.

My patta entry is simply wrong — is that also patta transfer?

No. A wrong name, extent or survey entry with no change of ownership is "rectification of erroneous entry of land records", a separate service sanctioned by the Settlement Officer with a charter time limit of three months for undisputed petitions. Patta transfer is only for a change of owner.

What happens if my Form-10 is incomplete?

It is not processed. Form-10 states in terms that incomplete applications without the requisite documents will not be processed, and the declarations you sign confirm there is no pending litigation, no encroachment and that the land is not government poramboke or temple property.
