Property Registration (Sale Deed) in Puducherry
Puducherry state government scheme
Property Registration in Puducherry is done by the Registration Department through the e-Pathirapathivu portal at epathirapathivu.py.gov.in. A sale deed attracts 10% stamp duty on the sale value or the G.L.R. value, whichever is higher, reduced to 5% when the purchaser is a woman, plus a 1.5% registration fee and a Rs 100 computer fee. The Citizen Charter allows 3 working days.
Property Registration in Puducherry is the act of presenting a sale deed before a Sub-Registrar of the Registration Department so that the transfer of immovable property becomes a public, permanent and legally enforceable record. Section 17 of the Registration Act 1908 makes registration compulsory for every sale of immovable property worth more than Rs 100, and Section 49 of the same Act makes an unregistered sale deed useless as evidence of title. In practice this means that until the Sub-Registrar has endorsed and registered the deed, the buyer has paid the money but has not acquired the property.
Which department registers property in Puducherry?
The Registration Department of the Government of Puducherry, which functions under the Department of Revenue and Disaster Management, is the registering authority. The department operates Sub-Registrar offices across the four regions of the Union Territory, Puducherry, Karaikal, Mahe and Yanam, and its head office is at Kamaraj Salai, Sakthi Nagar, Saram, Puducherry. Besides document registration, the same department issues encumbrance certificates and certified copies, registers Hindu and special marriages, registers chit funds, and authenticates powers of attorney.
Puducherry has moved most of the pre-registration work online. The department runs e-Pathirapathivu at epathirapathivu.py.gov.in for document registration and appointment booking, e-Thirumanam for marriage registration, the Government Receipt Accounting System at gras.py.gov.in for online payment, and links to the Stock Holding Corporation of India for e-stamping.
What does a sale deed cost in Puducherry?
The Registration Department publishes a full fee schedule on its website, and the sale deed entries are unambiguous. Conveyance (sale) attracts stamp duty of 10% on the sale value of the property or the G.L.R. value, whichever is higher. Where the purchaser is a woman, the rate for the same transaction is 5%. The registration fee is 1.5% in both cases. A computer fee of Rs 100 applies to every transaction.
For comparison, a gift deed attracts the same 10% stamp duty and 1.5% registration fee. A simple mortgage attracts 1% stamp duty capped at Rs 20,000, with a 1.5% registration fee capped at Rs 5,101. A will attracts no stamp duty and a flat Rs 30 registration fee. A power of attorney costs Rs 5,000 where it is executed in favour of a blood relation and Rs 20,000 where it is not.
Because duty is charged on the higher of the sale price and the G.L.R. value, the single most useful thing a buyer can do before agreeing a price is to check the guideline value. e-Pathirapathivu carries a "Know Your Property Value" tool and a G.L.R. value search, and the department also hosts a stamp duty and registration fee calculator at regn.py.gov.in that lists both "Sale Deed" and "Sale Deed (Women Purchase)" as separate transaction types.
Who can and cannot register a sale deed in Puducherry?
Any person competent to contract under the Indian Contract Act 1872 can buy and sell immovable property in Puducherry and get the deed registered. There is no residence requirement, a buyer from Tamil Nadu, Kerala or anywhere else in India can register a purchase in Puducherry.
You cannot register a sale deed where the executant is a minor, where the seller does not hold registrable title to the property, where the property is under attachment by a court or a revenue authority, or where the stamp duty paid is deficient. A Sub-Registrar can and will refuse a document under Section 71 of the Registration Act if it is not properly stamped or if the executant refuses to admit execution. Agricultural land and property in notified areas may also carry separate restrictions under the applicable land laws, and a planning authority approval may be needed before a plot in an approved layout can be transferred.
Registration must be sought within four months of the date of execution under Section 23 of the Registration Act 1908. Section 25 allows a delay of up to a further four months on payment of a penalty of up to ten times the registration fee. Beyond eight months the document cannot be registered at all, and the transaction has to be re-executed.
How to apply for property registration in Puducherry online
- Check the G.L.R. value of the survey number using the "Know Your Property Value" tool on e-Pathirapathivu, and take an encumbrance certificate for the property to confirm there is no existing mortgage, attachment or prior sale.
- Get the sale deed drafted using the deed formats published on regn.py.gov.in, or through a document writer from the department's published licensed list, and collect the Rule 59 link documents, patta copy and planning authority approval where applicable.
- Register on e-Pathirapathivu at epathirapathivu.py.gov.in, enter the deed details online and submit the application.
- Pay the registration fee online through the Government Receipt Accounting System at gras.py.gov.in, and book your appointment slot at the Sub-Registrar office of the sub-district where the property lies.
- Buy the e-stamp for the stamp duty amount through a Stock Holding Corporation of India counter or at shcilestamp.com, in the name of one of the parties to the deed.
- Attend the Sub-Registrar office on the booked date and time with the buyer, the seller and two witnesses, carrying original identity documents and all the papers listed in the checklist.
- Complete the biometric step. The office captures photographs and fingerprints of the claimant, the executant and the witnesses — after which the Sub-Registrar regularises the document, generates the endorsement page, affixes registration seals and signs it.
- Collect the registered document after scanning. The department's Citizen Charter allows 3 working days for a document to be registered and returned.
How do I check the status of a Puducherry registration?
e-Pathirapathivu shows the status of a submitted application in the citizen's own login, and the portal home page publishes the average registration time taken in the previous week for each sub-registration office, which in recent weeks has ranged from roughly 27 to 76 hours across offices. After registration, the surest confirmation is an encumbrance certificate taken for the period covering the date of registration; once the sale appears in the EC, the transfer is on the public record.
Why are sale deeds rejected or delayed in Puducherry?
Deficient stamp duty is the commonest reason. If the deed is stamped on the sale price when the G.L.R. value is higher, the Sub-Registrar will call for the difference before registering. Other frequent causes are a mismatch between the survey number in the deed and the survey number in the patta, missing Rule 59 link documents, an encumbrance disclosed in the EC that has not been cleared, absence of one of the parties or of the two witnesses on the appointment date, and identity documents that do not match the names spelt in the deed. A document presented more than four months after execution needs the Section 25 condonation and penalty, and one presented after eight months cannot be registered at all.
Is the property registration process free, and how do I complain?
Property registration in Puducherry is not free, stamp duty, registration fee and the Rs 100 computer fee are real statutory charges, but you should pay nothing beyond the amounts in the department's published fee schedule, and every rupee of it is paid to the government through gras.py.gov.in or through an authorised SHCIL e-stamp counter, never in cash to an individual. Middlemen who offer to "get the registry done" for a lump sum are charging you for steps you can complete yourself on e-Pathirapathivu. If you are asked for money outside the schedule, or your document is held up beyond the 3 working days in the Citizen Charter, contact the Registration Department at 0413-2247194 or 0413-2231275, or write to regn@py.gov.in. The e-Pathirapathivu portal additionally lists regn-it.py@gov.in and a Telegram support channel for technical problems with the online application.
