Legal Heir / Succession Certificate in Sikkim
Sikkim state government scheme
Legal Heir Certificate in Sikkim is a paper application to the District Administrative Centre of your district, decided by the Additional District Collector or Sub-Divisional Magistrate. Sikkim SSO at sso.sikkim.gov.in runs 45 online services for more than 83,000 users, including income, SC, ST, OBC, marriage and unmarried certificates, but does not list a separate legal heir service, so this one is filed at the counter.
What is a legal heir certificate in Sikkim?
A legal heir certificate in Sikkim is the district administration's official statement of who survived a person who has died, and how each survivor was related. Sikkim issues it through the District Administrative Centre of the district, the office of the District Collector, with the Additional District Collector and the Sub-Divisional Magistrate as the working authorities; after an enquiry into the family at the local level.
Sikkim's certificate architecture is worth understanding before you start, because it is unusual. The state runs its citizen services through Sikkim SSO, the single sign-on portal at sso.sikkim.gov.in, described on the portal itself as a single window to access online government services, with 45 services and more than 83,000 registered users. The District Administrative Centre services listed there include the Income Certificate, Marriage Certificate, Unmarried Certificate, Scheduled Caste Certificate, Scheduled Tribe Certificate, Primitive Tribe Certificate, OBC Certificate and Employment Card.
What that list does not contain is a legal heir or succession certificate. Sikkim has not put this service online. The application is therefore a paper file at the District Administrative Centre counter, even though several of the supporting documents can be obtained online first.
Legal heir certificate or succession certificate, which one do you need?
Two different documents solve two different problems, and Sikkim families lose weeks by asking the wrong office.
The legal heir certificate (district administration route). An administrative certificate from the District Administrative Centre, based on an enquiry into the family. It is what government offices in Sikkim want for family pension and pension arrears, gratuity and provident fund claims from a government employer, compassionate appointment of a dependant, transfer of a ration card or a service connection, and uncontested transfer entries in land and house records.
The succession certificate (civil court route). An order under Part X of the Indian Succession Act 1925, granted by the district judge with jurisdiction over the place where the deceased ordinarily resided. The court certificate helps the holder to collect the debts and securities of the deceased; fixed deposits, shares, debentures, company deposits and money owed to the estate, and it legally protects the bank or company that pays the holder against a later rival claim. That protection is precisely why a bank asks for it when the amount is large or the account carried no nomination.
Neither replaces the other. A widow in Gangtok claiming her husband's family pension needs the district certificate; the same widow trying to release his share portfolio will be sent to court. Many families in Sikkim end up needing both, and the sensible order is to file the district application first, since the death certificate and heir list assembled for it also serve the court petition.
Who can and who cannot apply?
You can apply for a legal heir certificate in Sikkim if you are a surviving heir of a person who died while resident in the state:
- The surviving husband or wife.
- Sons and daughters, including married daughters.
- The mother of the deceased.
- Grandchildren through a son or daughter who died before the deceased.
- A guardian applying for a minor heir, with proof of guardianship.
You cannot apply to a Sikkim District Administrative Centre where the deceased was not a resident of that district, jurisdiction follows the district of last residence, and each of Sikkim's District Administrative Centres decides only its own cases. You are not eligible if you cannot document a relationship with the deceased: a creditor, employer, tenant or family friend has no standing at the counter and must approach the civil court. The district administration will also stop a file where another person has objected and claims to be an heir, because an administrative enquiry cannot adjudicate a contest.
Sikkim applies no income limit, no caste condition and no age bar to a legal heir certificate. Community documents such as the Certificate of Identification matter here only as proof that the deceased belonged to the district.
What documents are required?
- Death certificate of the deceased, from the registrar of the Gram Panchayat Unit, Nagar Panchayat or Municipal Corporation where the death was registered.
- Application to the District Collector naming every surviving heir with age and relationship, and stating why the certificate is needed.
- Certificate of Identification or residence proof of the deceased, establishing the district.
- Identity proof of the applicant and of every heir named; Aadhaar, voter ID or equivalent.
- Affidavit of heirship, sworn before a notary or magistrate.
- Marriage certificate of the surviving spouse, where a widow or widower is claiming — obtainable online as a District Administrative Centre service on
sso.sikkim.gov.in. - Service record or pension papers of the deceased, for a family pension, gratuity or compassionate appointment claim.
- Panchayat or ward recommendation confirming the family composition, commonly asked for during the enquiry.
How to get a legal heir certificate in Sikkim
- Register the death and collect the death certificate from the Gram Panchayat Unit, Nagar Panchayat or Municipal Corporation registrar of the place where the death occurred. Everything else waits on this document, and the spelling of the name on it becomes the spelling the whole file carries.
- Collect the supporting certificates online first. Log in at
sso.sikkim.gov.inand obtain the marriage certificate, income certificate or community certificate you will need. Doing this before the counter visit is what shortens a Sikkim certificate file most. - Write out the full list of heirs. Include married daughters, the mother of the deceased and the children of any son or daughter who died earlier. An heir left off the application is left off the certificate, and putting the name back means a fresh enquiry.
- Swear the affidavit of heirship before a notary or magistrate, stating that the persons listed are the only surviving heirs.
- Submit the application at the District Administrative Centre of your district, with the death certificate, residence proof of the deceased, identity proof of each heir and the affidavit. Ask the counter for a written acknowledgement and for the date on which the decision is expected.
- Cooperate with the local enquiry. The Panchayat President, ward member or the office's own enquiry official verifies the household and the relationships. Keep an adult family member reachable at the address during this period.
- Collect the signed certificate from the same District Administrative Centre once the Additional District Collector or Sub-Divisional Magistrate approves it, and ask for more than one attested copy in the same visit.
How do you apply for a succession certificate in court?
- File a petition before the district judge with jurisdiction over the deceased's ordinary residence, under Section 372 of the Indian Succession Act 1925, listing the heirs and each debt and security you want covered.
- Pay the statutory court fee, calculated as a percentage of the value of the debts and securities in the petition rather than as a flat charge, the court office computes the exact amount from your valuation.
- Wait through the public notice inviting objections from anyone claiming a competing right. This step, not the paperwork, is what makes the court route take months.
- Attend the hearing with the death certificate, the heirship evidence and the bank or company statements.
- Produce the certificate to the bank or company, which is then protected in law when it pays the holder.
How do you check the status of your application?
Enquire at the District Administrative Centre counter that received the file, quoting your name, the date of submission and the acknowledgement given to you. Because a Sikkim district file moves through named desks and ends with the Additional District Collector, the counter can usually say which desk it is sitting on. Sikkim district administrations publish their own contact directories on their district websites, and the Department of Information Technology lists dit-sik[at]nic[dot]in as the contact for portal problems on sso.sikkim.gov.in, a failed login, a payment that did not go through, or a service that will not open.
Why are legal heir applications rejected in Sikkim?
- No death certificate attached, or the name on it does not match the identity documents.
- The application went to the wrong District Administrative Centre, jurisdiction is the district of last residence.
- An heir was omitted and the enquiry produced a name the application did not carry.
- Another claimant objected, converting the matter into a dispute the district administration cannot decide.
- Identity proof was missing for one of the named heirs, or ages and relationships were inconsistent across documents.
- Nobody was available at the address when the enquiry official visited.
- A supporting certificate had lapsed, the unmarried certificate, for instance, is valid for only three months in Sikkim.
What does it cost, and what about agents?
Sikkim processes the legal heir certificate at the government fee quoted at the District Administrative Centre counter, and any online supporting certificate at the charge shown on the sso.sikkim.gov.in payment screen. Ask for the fee to be written on your acknowledgement and keep it. Nobody at the counter, in the Panchayat or in the enquiry chain is entitled to anything beyond that listed amount, and a demand for more should be raised with the Additional District Collector and then the District Collector.
Agents who offer to "arrange" an heir certificate for a lump sum are selling a paper application any family member can file themselves, and the file still joins the same queue before the same Additional District Collector. The court route is genuinely different: a succession certificate carries a real statutory court fee based on the value of the estate, and an advocate's fee on top of it, both of which are unavoidable and neither of which passes through a middleman.
Where do you complain if the file is stuck?
Escalate inside the district administration. Raise the delay first at the receiving counter, then with the Additional District Collector, who is the dealing officer for district certificates in Sikkim, and then with the District Collector. Each district publishes its District Administrative Centre address and email on its own nic.in website, South Sikkim's centre at Namchi, for example, is reachable at dmnamchi-skm@nic.in. For anything wrong with the online portal rather than the file, use the help and contact links on sso.sikkim.gov.in or write to dit-sik[at]nic[dot]in.
Where an heir was wrongly left out, put the objection in writing to the Additional District Collector and ask for a fresh enquiry. Where two groups each claim to be the rightful heirs, no district officer can settle it, that belongs in the civil court, alongside the succession certificate petition.

Frequently asked questions
Who issues a legal heir certificate in Sikkim?
The District Administrative Centre of the district issues the legal heir certificate in Sikkim, through the District Collector, the Additional District Collector or the Sub-Divisional Magistrate, after a local enquiry into the family. Sikkim's district administrations, not a separate revenue board, run the certificate desks for heirship, residence and identity documents alike.
Can I apply for a Sikkim legal heir certificate online?
No, Sikkim SSO at sso.sikkim.gov.in does not list a legal heir or succession certificate among its 45 online services, so the application is filed on paper at the District Administrative Centre. The portal does carry several documents you will need alongside it — income, SC, ST, OBC, marriage and unmarried certificates are all District Administrative Centre services available online.
What is the difference between a legal heir certificate and a succession certificate in Sikkim?
A legal heir certificate is an administrative record from the district administration naming the surviving heirs, while a succession certificate is an order of the civil court authorising a named person to collect the debts and securities of the deceased. Government offices in Sikkim accept the district certificate for pension and service claims; banks and companies holding substantial deposits or shares generally require the court certificate.
What documents do I need for a legal heir certificate in Sikkim?
You need the death certificate of the deceased, an application to the District Collector naming every heir, residence proof or the Certificate of Identification of the deceased, identity proof for each heir, and an affidavit of heirship. Pension or service papers are added where the claim is against a government employer.
How long does a Sikkim legal heir certificate take?
The file moves at the pace of the local enquiry, and the District Administrative Centre counter tells you the expected date when it accepts the application. Ask for it in writing on your acknowledgement and measure your follow-up against that date rather than an assumed number of days.
Does a legal heir certificate in Sikkim expire?
A legal heir certificate does not expire, because it records who survived a person who has died — a fact that cannot change afterwards. Note that Sikkim's unmarried certificate, which some families collect alongside it, does lapse in three months, so time that one to the claim you are filing.
What if an heir is left out of the certificate?
An omitted heir should object in writing to the Additional District Collector, who can order a fresh enquiry and a corrected certificate. Because the district certificate is administrative and not judicial, a real dispute between rival claimants has to go to the civil court, which is the only forum that can decide who inherits.
Do I need a lawyer for a succession certificate in Sikkim?
A succession certificate is a petition under the Indian Succession Act 1925 filed in the district civil court, and most families engage an advocate because the petition must value each debt and security and survive a public notice inviting objections. The advocate's fee is a private professional charge, separate from the statutory court fee calculated on the value of the estate.
