Maternity Assistance for Construction Workers — Sikkim
Sikkim state government scheme
Maternity Assistance for Construction Workers in Sikkim pays Rs 10,000 to a woman registered with the Sikkim Building and Other Construction Workers Welfare Board for up to two children. Registration needs 90 days of construction work, an age between 18 and 60, and a Rs 20 monthly contribution. Claims go to the District Labour Officer in Form XLI.
What is maternity assistance for construction workers in Sikkim?
Maternity Assistance for Construction Workers is a cash benefit paid by the Sikkim Building and Other Construction Workers Welfare Board to women registered with it, at the time of childbirth. The Board sits under the Labour Department, Government of Sikkim, at Shram Bhawan, Sokaythang, Gangtok – 737102, and is funded largely by the welfare cess collected from construction works under the Building and Other Construction Workers' Welfare Cess Act, 1996.
The legal basis is rule 277 of the Sikkim Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2010, which reads: women employees who are registered beneficiaries for a period of one year shall be given a sum as determined by the Board from time to time as maternity benefit during the period of maternity, on an application in Form XLI, and such benefit shall not be allowed more than twice.
The rule leaves the amount to the Board, and the Board fixed it. Labour Department Notification No. 22/DL dated 14 June 2018, published in Sikkim Government Gazette Extraordinary No. 347 on 9 July 2018, lists Maternity at serial number 1 of an eight-row schedule of financial assistance with an amount of Rs 10,000. That notification was issued after the 31st meeting of the Sikkim BOCW Welfare Board and supersedes the earlier Notification No. 19/DL dated 18 May 2013.
The Labour Department's own Building and Other Construction Workers Welfare Schemes information sheet, published on its BOCW page, states the benefit in the plainest terms available: "Maternity Benefit (upto two children) : Rs. 10,000/-".
The BOCW Act and the Welfare Cess Act were implemented in Sikkim with effect from 6 September 2010, and apply to every establishment that employed ten or more building workers on any day of the preceding twelve months.
How much is paid, and what else does the Board pay?
The complete schedule notified in 2018 is as follows.
| Case for which assistance is granted | Amount | Applicable to |
|---|---|---|
| Maternity | Rs 10,000 | Registered worker and immediate dependants |
| Marriage | Rs 10,000 | Registered worker and immediate dependants |
| Minor injury sustained in the course of employment | Rs 10,000 | Registered worker |
| Funeral | Rs 10,000 | Registered worker and immediate dependants |
| Medical | Rs 10,000 | Registered worker and immediate dependants |
| Pension (one time) | Rs 10,000 | Registered worker |
| Partial disability in the course of employment | Rs 10,000 to Rs 1,00,000 by percentage of disability | Registered worker |
| Permanent disability or death in the course of employment (one time) | Rs 1,50,000 | Registered worker |
The Labour Department's later welfare schemes sheet revises the one-time pension figure upward to Rs 2,00,000 and adds three non-cash entitlements: free education for the children of registered workers with hostel accommodation in Gangtok, coverage under the Pradhan Mantri Shram Yogi Maandhan Yojana (PMSYM), and coverage under the Pradhan Mantri Ayushman Bharat Jan Arogya Yojana (PM-JAY). A pregnant registered worker in Sikkim is therefore usually covered for delivery costs under PM-JAY as well as receiving the Rs 10,000 cash benefit. These are separate entitlements and claiming one does not cancel the other.
Rule 270 adds a further, separate assistance for beneficiaries hospitalised for five or more days due to an accident: Rs 200 for the first five days and Rs 20 a day thereafter, up to a maximum of Rs 1,000.
Who is eligible for the Sikkim BOCW maternity benefit?
You can claim if all of these are true.
- You are a woman registered as a beneficiary of the Sikkim BOCW Welfare Board and hold the identity card issued in Form XXVIII under rule 266.
- You have been a registered beneficiary for at least one year. This is the single condition most often missed; rule 277 sets a one-year qualifying period, so registering after you become pregnant will not usually work.
- You were, at registration, between 18 and 60 years of age, and had completed 90 days of service as a building worker during the preceding 12 months. Rule 264 sets both tests, and the Department's welfare schemes sheet repeats them under "Coverage".
- Your Rs 20 per month contribution to the Welfare Fund is current.
- This is your first or second child. Rule 277 caps the benefit at two claims, and the Department's sheet describes it as "upto two children".
- You are a resident of Sikkim working as a building or construction worker.
You cannot apply, or are not eligible, in these situations.
- You are an unregistered construction worker. No length of service on Sikkim sites substitutes for registration with the Beneficiary Registering Officer.
- You registered less than a year ago. The one-year qualifying period in rule 277 is a hard condition, not a formality.
- This would be your third or later claim. Rule 277 states the benefit shall not be allowed more than twice.
- You defaulted on the Rs 20 contribution for a continuous year. Rule 267(2) says such a beneficiary ceases to be a beneficiary of the Fund. Membership can be resumed on payment of arrears with the Secretary's permission, but resumption is not allowed more than twice.
- You were 60 years or older at registration, or had not completed 90 days of construction work in the preceding twelve months, so the registration was never valid under rule 264.
- You are a contractor or an employer rather than a building worker. The Board's benefits run to registered workers and beneficiaries, not to establishments.
- You cannot produce a medical certificate from a Medical Officer of at least Assistant Surgeon rank, which Form XLI requires in original.
What documents are needed for the maternity claim?
| Document | Mandatory | Notes |
|---|---|---|
| Application in Form XLI | Yes | The prescribed maternity application under rule 277 |
| Letter from the concerned organisation or establishment | Yes | First document listed in the 2018 notification for every claim |
| Identity card | Yes | The Form XXVIII beneficiary card |
| Birth Certificate of the child | Yes | Scheme-specific proof named in the 2018 notification |
| Family photo | Yes | Named in the 2018 notification against the maternity row |
| Medical certificate in original | Yes | From a Medical Officer not below the rank of Assistant Surgeon |
| Challan copies or bank passbook | No | Form XLI asks for the first and last subscription dates and amounts |
Form XLI itself asks for the applicant's name and address, registration number, age and date of birth, husband's name, date of confinement, whether the benefit has been claimed before and how many times, the date of registration, and the date, amount, bank and branch of the first and last subscription. Fill these in from your passbook rather than from memory, a mismatch here is a common reason for a claim being sent back.
How to apply for maternity assistance in Sikkim
- Register as a beneficiary first, well before you need the benefit. Apply in Form XXVII to the Beneficiary Registering Officer authorised by the Sikkim BOCW Welfare Board. Rule 265 requires three small-size photographs; one pasted on the form and two enclosed; attested proof of date of birth from a school certificate, the Registrar of Births and Deaths, a local authority, a panchayat body, an MLA, an MP or a municipal councillor, an employer's certificate of engagement as a building worker, and documents showing payment of the Rs 20 registration fee. Because of the one-year qualifying period, this step is the one that decides whether you can claim at all.
- Collect the identity card issued in Form XXVIII under rule 266, and file a nomination in Form XXXI. If registration is refused, rule 266(2) allows an appeal to the Board within 30 days, and the Board's decision is final.
- Keep the Rs 20 monthly contribution current. Rule 267 requires it to be remitted once every three months at a bank specified by the Board in the district where you live. Keep the challans, Form XLI asks for them.
- Obtain the medical certificate and the child's birth certificate after delivery, and get a letter from your organisation or establishment confirming your engagement.
- Fill in Form XLI, printed at page 167 of the Sikkim BOCW Rules, 2010 and downloadable from the Labour Department's BOCW page.
- Submit the form and documents to the Secretary of the Board or an officer authorised by him at the District Labour Office, and send a copy of the information to Head Quarter, Labour Department, Shram Bhawan, Sokaythang, Gangtok. Ask for an acknowledgement.
- Follow up with the District Labour Officer or the BOCW Nodal Officer until the sanction is issued and the amount is paid.
Who do I contact in each district?
The Labour Department's BOCW welfare schemes sheet publishes these numbers for workers:
- BOCW Nodal Officer to 70769-26998
- East — 90643-89842
- Pakyong to 90028-33969
- South to 96098-63959
- West to 95477-16798
- North to 96359-98441
- Toll free helpline for labourers to 1800-345-1474
The Labour Department headquarters is at Shram Bhawan, Sokaythang, Gangtok – 737102.
Why do maternity claims get rejected, and how do you fix it?
- Less than one year of registration. Rule 277's qualifying period is the most frequent cause. The fix is structural rather than procedural; register as a beneficiary as soon as you start construction work, not when you need money.
- Registration lapsed because the Rs 20 contribution went unpaid for a continuous year. Apply to the Secretary of the Board to resume membership on payment of arrears, remembering that resumption is allowed no more than twice.
- Third claim. Rule 277 permits only two. There is no relaxation clause.
- No medical certificate in the prescribed form, or one signed by a doctor below the rank of Assistant Surgeon. Form XLI prints the exact certificate text the Medical Officer should complete, take that page with you.
- Missing letter from the establishment. The 2018 notification lists it as the first required document for every category, including maternity.
- Subscription details left blank in items 9 and 10 of Form XLI. Attach a passbook copy or challan copies rather than leaving them empty.
- Claim filed only at headquarters instead of being routed through the District Labour Office. The notification is explicit that claims go to the concerned District Labour Officer, with a copy to headquarters.
How do I appeal or raise a grievance?
Where a claim decision goes against you, the Sikkim BOCW Rules, 2010 provide a written appeal route. Rule 271(6), which governs benefit sanctioning decisions, allows an aggrieved person to appeal to the Board within 60 days of receiving the order, and the Board's decision on that appeal is final. Against a refusal to register you as a beneficiary in the first place, rule 266(2) allows a shorter 30-day appeal to the Board.
Start with the District Labour Officer who handled the claim, then the Secretary of the Sikkim BOCW Welfare Board at Shram Bhawan, Sokaythang, Gangtok. The toll free labour helpline 1800-345-1474 and the BOCW Nodal Officer on 70769-26998 are the quickest way to find out which stage your file is at before you put an appeal in writing.
How to check your application status
Sikkim's BOCW maternity claim is an offline paper process, filed in Form XLI at the District Labour Office, so there is no online tracking portal or reference number system to log into. Status checking works through direct follow-up instead.
- Keep your acknowledgement. When you submit Form XLI at the District Labour Office, ask the receiving clerk for a dated acknowledgement or a receipt number for your application. This is the only proof of filing you will have, and you will need to quote it whenever you follow up.
- Call the District Labour Officer who received your form. The claim is processed at district level, not at headquarters, so the District Labour Office is where the file actually sits and where an official can tell you whether it has been forwarded, is awaiting sanction, or has already been passed for payment.
- Call the BOCW Nodal Officer on 70769-26998 if the District Labour Office cannot give you a clear answer, or if you filed the copy sent to headquarters and want to confirm it reached Shram Bhawan, Sokaythang, Gangtok.
- Use the toll free labour helpline, 1800-345-1474, for a general check on where a maternity claim typically stands and to be directed to the right district contact if you are unsure who is handling your file.
- Visit the office in person with your identity card and acknowledgement if phone follow-up does not produce an answer within a few weeks. Since the Board processes a limited volume of claims per district, an in-person visit to the Secretary of the Board or the authorised officer at Shram Bhawan usually resolves ambiguity faster than repeated calls.
- Watch for the payment itself rather than a status message. Because there is no SMS or portal notification system for this benefit, the sanctioned amount arriving in your registered bank account (the same account whose passbook details you entered in Form XLI) is usually the first confirmation that the claim has been approved.
If it has been more than a few weeks since filing with no update at the district level, escalate to the Secretary of the Sikkim BOCW Welfare Board at Shram Bhawan, Sokaythang, Gangtok, quoting your acknowledgement and registration number, before considering a formal appeal under rule 271(6).

Frequently asked questions
How much maternity assistance does the Sikkim BOCW Board pay?
The Sikkim BOCW Welfare Board pays Rs 10,000 as maternity benefit. The rate is fixed at serial number 1 of Labour Department Notification No. 22/DL dated 14 June 2018, published in Sikkim Government Gazette Extraordinary No. 347 on 9 July 2018, and is repeated in the Department's welfare schemes sheet as "Maternity Benefit (upto two children) : Rs. 10,000/-".
How many times can a woman claim maternity benefit in Sikkim?
Twice. Rule 277 of the Sikkim BOCW Rules, 2010 states that the benefit "shall not be allowed more than twice", and the Labour Department's welfare schemes sheet describes the benefit as applying up to two children.
Do I have to be registered for a year before claiming maternity benefit?
Yes. Rule 277 gives the benefit to women employees "who are registered beneficiary for a period of one year". A woman who registers with the Board during her pregnancy will not have completed the one-year qualifying period by the time of delivery.
How do I register as a BOCW beneficiary in Sikkim?
Apply in Form XXVII to the Beneficiary Registering Officer authorised by the Sikkim BOCW Welfare Board, with three small photographs, attested proof of date of birth, an employer's certificate of engagement and a registration fee of Rs 20. Rule 264 requires you to be between 18 and 60 years old and to have completed 90 days of construction work in the preceding 12 months.
Where do I submit the maternity claim?
Submit Form XLI to the Secretary of the Board or an officer authorised by him at the District Labour Office, and send a copy of the information to the Labour Department headquarters at Shram Bhawan, Sokaythang, Gangtok. The 2018 notification prescribes this routing for all its financial assistance categories.
Do I have to keep paying a contribution to stay eligible?
Yes. Rule 267 sets the beneficiary contribution at Rs 20 per month, remitted once every three months at a bank specified by the Board in your district. A beneficiary who defaults continuously for one year ceases to be a beneficiary of the Fund, though membership can be resumed on payment of arrears with the Secretary's permission, not more than twice.
What other benefits does a registered Sikkim construction worker get?
The Labour Department's welfare schemes sheet lists marriage benefit of Rs 10,000, minor injury assistance of Rs 10,000, funeral expenses of Rs 10,000, medical assistance of Rs 10,000, a one-time pension of Rs 2,00,000, partial disability assistance from Rs 10,000 to Rs 1,00,000, permanent disability assistance of Rs 1,50,000, free education for workers' children with hostel accommodation in Gangtok, and coverage under PMSYM and PM-JAY.
Can a male worker claim the maternity benefit for his wife?
Rule 277 gives the benefit to "women employees who are registered beneficiary", so the registered beneficiary must herself be the woman. The 2018 notification's "applicable to" column for the maternity row reads "Registered worker & their immediate dependants", which is broader — so check the current practice with your District Labour Officer before assuming either reading.
