What is property registration in Tamil Nadu?

Property registration in Tamil Nadu is the recording of a sale deed by a Sub-Registrar under the Registration Act, 1908, in the register maintained by the Registration Department, Government of Tamil Nadu, headed by the Inspector General of Registration. Registration is what turns a private agreement into a public record of ownership that a court, a bank and the revenue department will act on.

Tamil Nadu runs the process through TNREGINET, tnreginet.gov.in, the department's single portal for every registration service. Alongside property and document registration, TNREGINET covers marriage registration including special and civil marriages, apartment association registration, society registration, firm and partnership registration, chit fund registration, encumbrance certificates with free viewing and download, certified copies, guideline value search, stamp vendor search, and document status tracking.

Section 17 of the Registration Act makes registration compulsory for a transfer of immovable property worth more than Rs 100. An unregistered sale deed is not admissible as proof of title, so an unregistered purchase leaves you with possession and no defensible ownership.

Who can and cannot register a sale deed in Tamil Nadu?

You can register if:

  • You are the lawful owner of the property, or hold a registered power of attorney from the owner, and are selling it.
  • You are the buyer, above 18, an Indian citizen or an NRI or person of Indian origin buying property permitted under FEMA.
  • The property lies within the jurisdiction of the Sub-Registrar office you approach.
  • The stamp duty and registration fee have been paid on the market value or the guideline value, whichever is higher.

You cannot register if:

  • The stamp duty is short-paid, usually because duty was computed on a price below the guideline value. The Sub-Registrar refuses the document or impounds it for determination of the correct duty.
  • The plot is in an unapproved layout. Tamil Nadu restricts the registration of plots in layouts without DTCP or the local planning authority's approval, and this is one of the state's most distinctive registration bars.
  • The seller is a minor or of unsound mind without a court-appointed guardian's authority.
  • The property is under court injunction, attachment or a statutory freeze, or is government poromboke land.
  • The document is presented more than four months after execution without paying the delay penalty allowed under section 25 of the Registration Act.

What does it cost, stamp duty and registration fee?

Two payments are due, both computed on the market value or the guideline value, whichever is higher.

According to the Registration Department's published rate schedule, a sale deed attracts 7 per cent stamp duty and a 4 per cent registration fee, which makes the statutory cost of a straightforward purchase 11 per cent of the value. That is one of the higher combined rates among Indian states, and it is the single biggest number a Tamil Nadu buyer has to budget for beyond the price itself.

Confirm the current figure yourself. Open the rate of stamp duty page on tnreginet.gov.in and run the portal's own calculator for your document type, because rates, ceilings and concessions are revised by government notification and apply differently to gift deeds, settlement deeds within a family, partition deeds and releases.

Payment routes accepted, per TNREGINET:

  • Online banking through the portal, no upper limit, and the only practical route for a property purchase.
  • Demand draft, accepted up to Rs 5,000.
  • Point of Sale (PoS) card machines at registration offices β€” accepted up to Rs 1,000.

Where the sale consideration is Rs 50 lakh or more, the buyer must also deposit 1 per cent TDS under section 194-IA of the Income Tax Act in Form 26QB before registration.

How to register a sale deed in Tamil Nadu

  1. Take the encumbrance certificate first. Download the EC free on TNREGINET for the survey number or door number, covering at least the last fifteen to thirty years, and confirm there is no subsisting mortgage, attachment or prior sale.
  2. Verify the revenue record. Take the patta, chitta and adangal for land, and confirm the seller's name is the recorded one against the survey number.
  3. Search the guideline value on TNREGINET by zone, village and survey number or street name. Duty is charged on this value or the agreed price, whichever is higher.
  4. Check the layout approval if you are buying a plot. Registration of plots in unapproved layouts is restricted in Tamil Nadu, so get the DTCP, CMDA or local planning authority approval number before you pay an advance.
  5. Get the deed drafted by an advocate, with the exact survey number, sub-division, extent, boundaries, consideration, mode of payment and possession date.
  6. Compute duty and fee on the portal's calculator, and pay online through TNREGINET using net banking. Print both receipts.
  7. Deposit TDS in Form 26QB if the consideration is Rs 50 lakh or more.
  8. Present the document at the Sub-Registrar office having jurisdiction, with all buyers, all sellers and two witnesses attending in person with PAN and Aadhaar. The office captures photographs and biometrics of every party.
  9. Execute and admit the deed before the Sub-Registrar, who verifies the duty and the identities and endorses the document.
  10. Collect the receipt and note the document number, then use document status tracking on TNREGINET to follow the scanning and indexing.
  11. Take a fresh encumbrance certificate a few weeks later. Your deed appearing on the EC is the practical proof registration is complete.

How to register through a document writer or at the office counter

  1. Locate the correct Sub-Registrar office for the area in which the property lies, using the office list on TNREGINET, and confirm jurisdiction before you pay anything.
  2. Use a licensed document writer or an advocate to draft and engross the deed on stamp paper of the correct value, or buy stamps from a licensed stamp vendor; TNREGINET publishes a stamp vendor search so you can verify the vendor is genuine.
  3. Present the deed in person with every party and two witnesses during office hours and take a token.
  4. Pay the registration fee and the printed copying or scanning charges at the counter, and insist on receipts.
  5. Collect the endorsed document on the date written on the receipt.

Both routes end in the same TNREGINET database.

How do I check the status of my document?

  • Document status tracking on tnreginet.gov.in, using the document number from your receipt.
  • Encumbrance certificate; free on the portal, and the most reliable confirmation that your deed has been indexed against the property.
  • Certified copy through the portal once the document is scanned.
  • The Sub-Registrar office, which can trace the file by the presentation receipt number.

Is a registered sale deed valid forever, and what comes next?

A registered sale deed in Tamil Nadu carries no expiry and needs no renewal. The register entry is permanent, and the encumbrance certificate carries it forward indefinitely.

Two follow-on steps are yours to complete:

  • Patta transfer. Registration does not change the revenue record. Apply through the Taluk office or the state's e-Services so the patta names you as the holder of the survey number. A buyer with a registered deed but no patta will hit problems at the first loan application or resale.
  • Property tax name change at the municipality, corporation or panchayat, and the apartment association transfer for a flat.

Why do property registrations fail in Tamil Nadu?

  • Duty computed below the guideline value. The commonest reason a document is impounded.
  • An unapproved layout. Buyers discover at the counter that the plot cannot be registered because the layout has no planning approval.
  • A subsisting encumbrance. An unreleased mortgage or an attachment visible on the EC that the seller never disclosed.
  • A co-owner absent on the day, with no registered power of attorney.
  • An unregistered power of attorney offered in place of the owner.
  • Survey number, sub-division or extent mismatch between the deed, the patta and the EC.
  • Name mismatch across the deed, PAN and Aadhaar.
  • Presentation beyond four months of execution without the delay penalty.

What should you pay, and what should you refuse?

Three payments are legitimate: the stamp duty, the registration fee, and the printed copying, scanning and computer charges at the counter. All three come with receipts, and the first two can be paid online through TNREGINET without any intermediary touching your money.

No document writer or agent can reduce the duty. It is computed on the government's own guideline value, published free on the portal, and anyone promising a lower figure is proposing to under-declare the price. A liability the buyer carries when the deed is later impounded. Verify a stamp vendor through the stamp vendor search on TNREGINET before buying stamps from anyone. Never share your Aadhaar OTP with a middleman, and never sign a deed with a blank consideration column.

Frequently asked questions

Which portal registers property in Tamil Nadu?

TNREGINET at tnreginet.gov.in is the Tamil Nadu Registration Department's official portal for property and document registration. The same portal covers marriage, society, firm, chit fund and apartment association registration, encumbrance certificates, certified copies, guideline value searches, stamp vendor searches and document status tracking.

What is the stamp duty and registration fee on a sale deed in Tamil Nadu?

The Registration Department's notified rate for a sale deed is 7 per cent stamp duty and 4 per cent registration fee, both computed on the market value or the guideline value, whichever is higher. Always confirm the current figure on the rate-of-stamp-duty page and the calculator on tnreginet.gov.in before you pay, because rates and concessions are revised by notification.

What is guideline value and where do I check it?

Guideline value is the Tamil Nadu government's notified minimum value per unit for land and buildings in each street or survey number, and stamp duty is charged on the guideline value or the agreed price, whichever is higher. Search it free on TNREGINET by zone, village and survey number or street name.

Is the encumbrance certificate free in Tamil Nadu?

Yes, TNREGINET offers free viewing and download of encumbrance certificates, which is unusual among state registration portals. Take the EC before you pay any advance, and take it again after registration to confirm your deed has been indexed.

How can I pay the stamp duty and fee?

TNREGINET accepts online banking payment with no upper limit, demand drafts up to Rs 5,000, and Point of Sale card payments up to Rs 1,000 at registration offices. For any substantial property purchase, online banking through the portal is the only practical route.

Do all parties have to appear at the Sub-Registrar office?

Yes, every buyer, every seller and two witnesses must appear before the Sub-Registrar for identity verification, photographs and biometric capture. A registered power of attorney is the only substitute for an absent party.

Does registration transfer the patta into my name?

No, registration and patta transfer are separate steps. After the sale deed is registered, apply for patta transfer through the Taluk office or the e-Services portal so the revenue record names you as the holder of the survey number.

What should I refuse to pay a middleman?

Refuse anything beyond the stamp duty, the registration fee and the printed copying or scanning charges, all of which produce receipts. Nobody can lower the duty, because it is computed on the government's own guideline value.
