What is the stamp duty reimbursement for MSEs in Tamil Nadu?

Reimbursement of Stamp Duty and Registration Charges is an incentive of the Micro, Small and Medium Enterprises Department, Government of Tamil Nadu. It returns 50 per cent of the stamp duty and registration charges an enterprise has paid on the purchase of land meant for industrial use.

According to the Tamil Nadu MSME portal, "all new Micro and Small enterprises set up in declared 254 industrially backward blocks are eligible to avail 50 per cent reimbursement of stamp duty and Registration charges paid to the Registration department on purchase of land meant for industrial use". The MSME Policy 2021 guidelines approved under G.O. (Ms) No. 37 dated 6 July 2021 repeat the same rule and add that the stamp duty and transfer duty benefit applies to all eligible new manufacturing enterprises.

The purpose is locational. Land registration costs are a real barrier when a first-time entrepreneur is buying a plot, and Tamil Nadu uses the rebate to push new manufacturing into blocks that industry would otherwise skip. That is why the incentive is not available everywhere in the state, it is tied to the declared industrially backward blocks, counted at 254 under the current policy.

Who is eligible for the stamp duty rebate?

Your enterprise can apply if:

  • It is a new micro or small enterprise, not an existing unit shifting papers.
  • It is set up in one of the 254 declared industrially backward blocks.
  • It is a manufacturing enterprise. The guidelines apply the stamp duty and transfer duty benefit to eligible new manufacturing enterprises.
  • The land was purchased for industrial use, and stamp duty and registration charges were actually paid to the Registration Department.
  • The claim is filed within six months of commencement of commercial production.
  • The unit holds Udyam registration.

Your enterprise is not eligible if:

  • It is set up outside the declared backward blocks. Location is the core test of this incentive, and no other document can substitute for it.
  • It is a medium enterprise. The rebate is confined to micro and small enterprises.
  • The unit's line of activity falls in the ineligible annexure (Annexure IV) of the MSME Policy 2021 guidelines, which the guidelines apply expressly to this incentive.
  • The six-month window from commencement of commercial production has closed.
  • The land is not meant for industrial use, for example a residential or commercial plot held by the promoter.

How much land does the rebate cover?

Element Rule
Rebate 50 per cent of the actual value of stamp duty and registration charges paid
Admissible area Land area up to five times the plinth area of the factory building constructed
Larger open area The sanctioning authority may allow land over five times the plinth area on a case-to-case basis where the nature of the industry requires it
Who pays first The enterprise pays the full duty at registration and claims 50 per cent afterwards

The five-times-plinth-area rule is the part most applicants miss. An enterprise that buys two acres but constructs a small shed will not get the rebate on the whole two acres. The eligible area is pegged to what has actually been built. Industries that genuinely need large open land, such as those with outdoor storage or effluent handling requirements, should make that case in writing to the sanctioning authority, because the guidelines expressly permit a relaxation on a case-to-case basis.

How to apply for stamp duty and registration charge reimbursement

  1. Confirm the block is a declared industrially backward block before you buy the land. Use the Backward Blocks list under the miscellaneous menu on msmeonline.tn.gov.in, or ask the General Manager of the District Industries Centre in writing.
  2. Register the sale deed with the Registration Department, pay the stamp duty and registration charges in full, and keep the receipts and the registered deed.
  3. Construct the factory building and note the plinth area, since the admissible land area is five times that figure.
  4. Commence commercial production and record the date. This date starts the six-month clock.
  5. Obtain or update your Udyam Registration Certificate as a micro or small enterprise.
  6. Log in to msmeonline.tn.gov.in, open the Incentives section and select the Stamp Duty incentive.
  7. Fill the online application and upload the registered sale deed, the duty and registration charge receipts, proof of commencement of commercial production, plinth area details and bank account details, as PDFs of not more than 200 KB each.
  8. Submit within six months of commencement of commercial production, to the General Manager, District Industries Centre concerned, or the Office of the Regional Joint Director of Industries and Commerce for Chennai district, and keep the reference number.

How to check the status of your claim

  1. Use Track Your Status in the incentives section of msmeonline.tn.gov.in with your application reference number.
  2. Follow up with the General Manager, District Industries Centre, who sanctions the reimbursement.
  3. Attend the inspection, at which the department verifies the unit, the building and the original documents. Originals are returned after verification.
  4. After sanction, check the bank account given in the application for the credit.

Why stamp duty claims get rejected

  • The unit is not in a declared backward block. This is the most common rejection and cannot be cured after the land is bought.
  • Applying late, more than six months after commercial production began.
  • Claiming on the full land area when only five times the plinth area is admissible, and no case has been made for a relaxation.
  • A medium enterprise applying, when the incentive is for micro and small enterprises.
  • Land not shown as meant for industrial use in the deed or in the local body records.
  • Ineligible line of activity under Annexure IV of the 2021 guidelines.
  • Duty receipts missing, so the 50 per cent base cannot be established.

Key dates

  • Date of registration of the sale deed, the transaction on which duty was paid.
  • Date of commencement of commercial production, the date that starts the application window.
  • Six months from commencement of commercial production. The last date to file online.

Notice that the deadline is not tied to the registration date. An enterprise that bought land two years before starting production still has a full six months from the date production actually begins, provided every other condition is met.

Related incentives to check at the same time

An enterprise that qualifies for the stamp duty rebate is usually eligible for other items in the same package, and all of them are filed on the same portal:

  • Capital subsidy for eligible new micro, small and medium manufacturing enterprises.
  • Low Tension Power Tariff (LTPT) subsidy to 20 per cent of power charges paid to TANGEDCO for the first 36 months, for micro manufacturing enterprises using LT supply.
  • Payroll subsidy — reimbursement of employer's EPF contribution up to Rs 24,000 per employee per annum for the first three years.
  • Generator subsidy to 25 per cent up to 320 KVA, capped at Rs 5,00,000.
  • Subsidy for asset creation for intellectual property to 75 per cent of patent filing cost up to Rs 3,00,000, and 50 per cent of trademark or GI filing cost up to Rs 25,000.

Each has its own deadline, and most run from the date of commencement of commercial production, so it is worth filing them together.
