What is the Payroll Subsidy in Tamil Nadu?

Payroll Subsidy is an incentive of the Micro, Small and Medium Enterprises Department, Government of Tamil Nadu designed to cut the cost of employing people in a new manufacturing unit. The Government reimburses the provident fund contribution for the enterprise's workforce for the first three years from the date of commencement of commercial production, subject to a ceiling of Rs 24,000 per employee per annum, if the unit employs more than 20 persons.

According to the MSME Policy 2021 guidelines approved in G.O. (Ms) No. 37, MSME Department, dated 6 July 2021, the subsidy is a "Reimbursement of Employer's contribution to the EPF for the first three years from the date of commencement of commercial production, if the unit has employed more than 20 persons, subject to a maximum of Rs.24000/- per employee per annum".

A note of caution on the wording. An older guidance page on the Tamil Nadu MSME portal describes the same incentive as "reimbursement of employee's contribution to the EPF for their employees for the first three years". The 2021 Government Order, which supersedes earlier orders on subsidies, says employer's contribution. Since the two readings produce the same ceiling but different computations for some wage bands, confirm the position in writing with your District Industries Centre before you file, and compute from the EPF challans either way.

Twenty employees is not an arbitrary number. It is the threshold at which the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 generally applies to an establishment, so the incentive is aimed at units that have crossed into formal, statutory employment.

Who is eligible for Payroll Subsidy?

Your enterprise can apply if it is:

  • A new micro manufacturing enterprise set up anywhere in Tamil Nadu.
  • A new small or medium manufacturing enterprise set up in backward areas and industrial estates, excluding the industrial estates located within a radius of 50 km from Chennai city centre.
  • A small or medium agro-based or food processing enterprise set up in any of the 388 blocks of the state.

The Tamil Nadu MSME portal states the same eligibility in slightly different words: all micro enterprises anywhere in the state; small and medium enterprises set up in the 254 industrially backward blocks and in all industrial estates promoted by the Government and government agencies such as SIPCOT and TANSIDCO; and agro-based small and medium enterprises set up in all 388 blocks of the state.

Your enterprise is not eligible if:

  • It employs 20 persons or fewer. The requirement is more than 20.
  • It is beyond three years from the date of commencement of commercial production. The benefit period is fixed and does not extend.
  • It is a small or medium enterprise in a non-backward area, or in an industrial estate within 50 km of Chennai city centre, unless it is an agro-based or food processing unit.
  • Its line of activity is listed in Annexure IV of the MSME Policy 2021 guidelines, which the payroll subsidy chapter expressly applies.
  • It counts casual, temporary or contract workers to cross the threshold. Only regular workers are taken into account.

How much is the subsidy and how is it computed?

Element Rule
Benefit Reimbursement of EPF contribution
Ceiling Rs 24,000 per employee per annum
Duration First 3 years from the date of commencement of commercial production
Employment condition More than 20 regular workers
Workers counted Regular workers only; casual, temporary and contract workers excluded
Partial year If employee strength falls below the stipulated number in any month, the claim is restricted to the months in which the condition was satisfied
Evidence Statutory returns filed under the Employees Provident Fund Act, 1952

A worked example makes the ceiling clear. A unit with 30 regular workers, all of whom attract an employer PF contribution of about Rs 1,800 a month, incurs about Rs 21,600 per employee for the year. That is inside the Rs 24,000 ceiling, so the whole amount is claimable, giving roughly Rs 6.48 lakh for the year. A unit paying higher wages, where the contribution exceeds Rs 2,000 a month per employee, hits the Rs 24,000 per employee cap.

The three-year window is measured from the date of commencement of commercial production, not from the date of Udyam registration or of incorporation.

How to apply for the Payroll Subsidy

  1. Record the date of commencement of commercial production. Every deadline in this scheme runs from it.
  2. Register the establishment under the EPF Act and remit the contributions month by month. The statutory returns are the department's evidence of employment.
  3. Maintain a regular-worker register with joining dates, so that casual, temporary and contract workers are not mixed into the count.
  4. Wait for the financial year to close. The claim is annual and retrospective, made for the previous year.
  5. Log in to msmeonline.tn.gov.in, open the Incentives section and select Payroll subsidy.
  6. Fill the online application with the Udyam number, date of commencement of commercial production, the month-wise employee strength and the contribution claimed per employee.
  7. Upload the documents as PDFs of not more than 200 KB each: Udyam certificate, EPF returns and challans, proof of commencement of commercial production, employee list with joining dates, and bank account details.
  8. Submit within three months after the completion of the financial year, to the General Manager, District Industries Centre, or the Regional Joint Director of Industries and Commerce, Chennai, and note the reference number.
  9. Repeat the claim in each of the three eligible years.

How to check the status of a payroll subsidy claim

  1. Use Track Your Status in the incentives section of msmeonline.tn.gov.in with the application reference number.
  2. Follow up with the General Manager, District Industries Centre, the sanctioning authority.
  3. Keep the EPF portal records accessible, the department verifies employment against the statutory returns, and a mismatch between the claim and the returns is the fastest way to a query.
  4. After sanction, check the bank account given in the application.

Why payroll subsidy claims fail

  • Headcount of exactly 20 or fewer. The rule requires more than 20 regular workers at the time of application.
  • Contract and casual workers counted to reach the threshold.
  • Claim filed later than three months after the financial year ended.
  • Claim for a fourth year or beyond, when the benefit is limited to the first three years from commencement of commercial production.
  • Location outside the eligible area for a small or medium enterprise: particularly an industrial estate within 50 km of Chennai city centre.
  • Ineligible line of activity under Annexure IV of the 2021 guidelines.
  • EPF returns not filed or not matching the claimed employee list.

Key dates

  • Date of commencement of commercial production; starts the three-year eligibility period.
  • End of the financial year. The claim is made for the year just closed.
  • Three months after the financial year ends. The last date to file, which in practice means filing by the end of June for a year ending 31 March.

The guidelines add a useful clarification: the unit must have employed more than 20 persons at the time of application, irrespective of the year within the first three years in which the application is made. A unit that crossed 20 workers only in its second year can therefore still claim for that year.

Other incentives to file alongside

Payroll subsidy is one of a package, and most of the others also run from the date of commencement of commercial production:

  • Reimbursement of Stamp Duty and Registration Charges — 50 per cent for new micro and small enterprises in declared backward blocks, claimable within 6 months of commencement of commercial production.
  • Low Tension Power Tariff (LTPT) subsidy to 20 per cent of TANGEDCO power charges for the first 36 months, for micro manufacturing enterprises on LT supply.
  • Generator subsidy to 25 per cent up to 320 KVA capacity, capped at Rs 5,00,000, claimable within 6 months of purchase or installation.
  • Back Ended Interest Subsidy to 5 per cent for up to 5 years on eligible term loans, claimed quarterly.

Help and grievance route

  • General Manager, District Industries Centre of your district. The sanctioning authority.
  • Regional Joint Director of Industries and Commerce, Chennai, for Chennai district enterprises.
  • msmeonline.tn.gov.in, Know Your Eligibility, Backward Blocks, Track Your Status and the entrepreneur Grievance login.
  • Industries Commissioner and Director of Industries and Commerce, Government of Tamil Nadu, for scheme interpretation, including the employer-versus-employee contribution question.

There is no fee to file the claim, and the department's published dos and don'ts warn enterprises not to enter false data in an online incentive application and not to be deceived by intermediaries.
