What is the Trade Mark and GI registration subsidy for Tamil Nadu MSMEs?

Subsidy for Asset Creation for Intellectual Property: Subsidy on the Cost of Trade Mark Registration or Geographical Indications (GI) in India or Abroad is a component of the intellectual property incentive of the Micro, Small and Medium Enterprises Department, Government of Tamil Nadu, delivered through the Commissionerate of Industries and Commerce and the District Industries Centres.

According to the MSME Department, the scheme was introduced to incentivise MSMEs to innovate and create intellectual property in India and abroad as a differentiator. This component gives a 50% subsidy on the cost of filing the application for Trade Mark registration, and the department's published description includes the initial maintenance fee within the covered cost. The same treatment extends to Geographical Indication registration.

The sister component of the same scheme covers patent registration at 75%.

Why the state pays for brand protection at all is worth understanding. A Tamil Nadu MSME that sells under an unregistered name has no reliable remedy when a larger firm adopts the same name, and it cannot license or franchise the brand or place it on an e-commerce marketplace with brand protection. Registration costs a few thousand rupees in official fees and considerably more in professional charges, and small firms routinely defer it until a dispute forces the issue, which is the worst possible moment. Halving the cost moves the decision forward.

A note on the ceiling. The department publishes the rate to 50%, on its incentive pages, and fixes the monetary ceiling in the Government Order and guidelines linked from msmeonline.tn.gov.in. Third-party sites quote varying figures. Confirm the ceiling for your filing year on the portal, or with the General Manager of your District Industries Centre, before treating the subsidy as part of your budget.

Who is eligible for the trade mark and GI subsidy?

You can apply if:

  • Your enterprise holds a valid Udyam Registration as a micro, small or medium enterprise in Tamil Nadu.
  • A trade mark or GI application has been filed, in India before the Trade Marks Registry or the Geographical Indications Registry, or before the corresponding office abroad.
  • The application is in the enterprise's name, or, for a GI, in the name of the producer association or body of which the enterprise is part.
  • You have paid the filing costs, official registry fees and attorney or agent charges, with invoices in the enterprise's name and matching bank payments.
  • The mark relates to the goods or services the enterprise actually deals in.

You are not eligible if:

  • The mark is filed in a promoter's personal name while the claim is made by the enterprise. Such a claim cannot be settled because the applicant and the claimant do not match.
  • Your enterprise has no Udyam Registration, or the registration has lapsed or is in a different entity's name.
  • You have only taken advice or conducted a search without filing. The subsidy attaches to the cost of filing.
  • Invoices are in a personal name or paid in cash without a bank trail.
  • The same expenditure has already been reimbursed under a central scheme and is not disclosed. The same cost cannot be reimbursed twice.

How to apply for the trade mark or GI subsidy

  1. Confirm the current rate and ceiling on msmeonline.tn.gov.in in the G.O. and guidelines section for the intellectual property incentive, before incurring the cost. The rate is 50% of the filing cost.
  2. Conduct a trade mark search through your attorney and choose a mark that is available in the relevant class. Filing a mark that is bound to be objected to wastes both your money and the subsidy.
  3. File the application in the enterprise's name before the Trade Marks Registry, or, for a Geographical Indication, through the producer association or body representing the producers.
  4. Collect the receipts and invoices: registry fee receipts, the initial maintenance fee receipt where applicable, and the attorney's invoices raised on the enterprise. Pay by bank transfer so the trail is complete.
  5. Log in to msmeonline.tn.gov.in, open the intellectual property incentive application and select the trade mark or GI component.
  6. Enter the application number, filing date, class and amounts paid, and upload the receipts, invoices, payment proofs and Udyam registration.
  7. Support the verification by the General Manager, District Industries Centre, or the Regional Joint Director, Chennai, who checks the filing against the registry record.
  8. Track the claim on the portal and answer queries promptly.

Geographical Indications in Tamil Nadu

Geographical Indications matter unusually much in Tamil Nadu, which holds one of the largest state tallies of registered GIs in India, covering handloom, handicraft and agricultural products. Well-known examples include Kancheepuram silk, Madurai Malli jasmine, Srivilliputtur palkova, Thanjavur art plate, Salem silk and Nilgiri tea.

Two points that MSMEs frequently get wrong about GIs:

  • A GI is not owned by one enterprise. It is registered by an association of producers, a cooperative society or a body representing the producers of the region, and individual producers then register as authorised users of the GI.
  • Being located in the region is not enough. To use a registered GI on your goods you must be entered as an authorised user, and the subsidy is best used by the registering body for the GI application itself and by member enterprises for their own trade marks.

How to check the status of your claim

  1. Log in to msmeonline.tn.gov.in and open the incentive status screen.
  2. Contact the General Manager, District Industries Centre of your district. In Chennai, contact the Regional Joint Director.
  3. Escalate to the Commissionerate of Industries and Commerce where a verified claim remains unsettled.

Why claims get rejected or reduced

  • Mark filed in a personal name while the enterprise claims the subsidy.
  • Udyam Registration lapsed or in a different entity name from the applicant.
  • Cash payment to the attorney, with no bank trail against the invoice.
  • Claim made without a filing receipt, on the strength of a search report or an engagement letter.
  • Ceiling exceeded, in which case the claim is settled at the ceiling rather than rejected.
  • Same cost claimed under a central IPR scheme and not disclosed.
  • Class mismatch, a mark filed in a class unrelated to the enterprise's goods or services, which raises a question during verification.

Related intellectual property and MSME incentives

  • Subsidy for Asset Creation for Intellectual Property: Patent Registration — the sister component, at 75% of the cost of filing, including the first-time maintenance fee.
  • Grant of Quality Certification Reimbursement of Charges; up to Rs 2 lakh for national and Rs 10 lakh for international certification.

  • General Manager, District Industries Centre of your district.
  • Regional Joint Director (Industries and Commerce), Chennai.
  • Commissionerate of Industries and Commerce, Government of Tamil Nadu.

No fee is payable to any individual to file or expedite the subsidy claim. Trade mark attorney charges are a legitimate professional cost and are themselves part of what the subsidy reimburses.

Frequently asked questions

How much subsidy does Tamil Nadu give for trade mark or GI registration?

A 50% subsidy on the cost of filing the application for Trade Mark or Geographical Indication registration, including the initial maintenance fee, according to the Micro, Small and Medium Enterprises Department. The monetary ceiling is fixed in the Government Order published on msmeonline.tn.gov.in, so confirm the current figure there before incurring the cost.

Does the subsidy cover registrations abroad?

Yes. The component is expressly framed as a subsidy on the cost of trade mark registration or Geographical Indications registration "in India or abroad", so foreign filings are within its scope.

What is a Geographical Indication, and who registers one?

A Geographical Indication identifies goods as originating from a particular place, where a given quality or reputation is attributable to that origin. Tamil Nadu holds a large number of GIs, including Kancheepuram silk, Madurai Malli, Srivilliputtur palkova, Thanjavur art plate and Salem silk. A GI is registered by an association of producers, a cooperative or a body representing the producers, not by a single enterprise.

Why is the trade mark rate lower than the patent rate?

The Tamil Nadu MSME Department sets 75% for patent registration and 50% for trade mark and GI registration, reflecting the much higher drafting and prosecution cost of a patent. Both are components of the same Subsidy for Asset Creation for Intellectual Property scheme.

Can I claim before the trade mark is registered?

The subsidy is described as being on the cost of filing the application, so it attaches to the filing rather than to the eventual registration. This matters because trade mark registration in India routinely takes well over a year and may face opposition.

Who can claim the subsidy?

A micro, small or medium enterprise in Tamil Nadu with a valid Udyam Registration, claiming for a mark filed in the enterprise's name. A promoter who filed the mark in a personal name cannot claim it through the enterprise.

Where do I apply?

Online at msmeonline.tn.gov.in under the intellectual property incentive, and the claim is verified by the General Manager of the District Industries Centre, or the Regional Joint Director in Chennai.
