What is the HPBOCWWB death benefit scheme?

Payment of Death Benefit is a welfare scheme of the Himachal Pradesh Building and Other Construction Workers Welfare Board (HPBOCWWB), the statutory board set up under the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 and the associated Cess Act of the same year. The board functions under the Labour and Employment Department of the Government of Himachal Pradesh and is funded by the 1 per cent cess levied on the cost of construction works in the state, not by ordinary tax revenue.

According to the board's portal at bocw.hp.gov.in, the scheme pays Rs 4,00,000 to the nominees or dependants of a registered worker who dies in an accident during work, and Rs 2,00,000 where the death is natural. The scheme exists because construction is among the most hazardous occupations in India and most site workers carry no employer-provided life cover. Locally the benefit is spoken of as mrityu labh, and a search under that name leads to the same scheme.

Payment of Death Benefit is a one-time lump-sum payment. It is not a pension, it is not linked to how much cess the worker's employer paid, and it does not depend on how many days the worker had worked in the year of death. What it does depend on, absolutely, is whether the worker was a registered beneficiary of the board with a live registration on the date of death.

Who is eligible for the HPBOCWWB death benefit?

The following can claim:

  • The nominee recorded in the deceased worker's HPBOCWWB registration record.
  • Where no nominee is recorded, the dependants or legal heirs; usually the spouse, minor children or dependent parents: on production of a legal heir or succession certificate.
  • Claims arising from the death of a worker registered under the board's normal registration rules: aged 18 to 60 years at registration and having worked as a building or construction worker for at least 90 days in the preceding 12 months, on private, government or panchayat construction work.

The following are not eligible and cannot apply:

  • Families of construction workers who never registered with the HPBOCWWB. There is no posthumous registration route.
  • Families of workers whose registration had lapsed because the three-yearly contribution or renewal was not paid, leaving the membership inactive on the date of death.
  • Persons who are neither the recorded nominee nor an established dependant or legal heir, for example a distant relative, an employer, or a contractor claiming to have met the funeral costs.
  • Workers registered with a different state's construction welfare board, who must claim from that board instead.
  • Supervisory, clerical, managerial or technical staff of a construction firm who are excluded from registration as building workers in the first place.

A practical point that costs Himachali families money every year: registration with the board is deliberately cheap, the portal lists a registration fee of Rs 1, a three-year contribution of Rs 9 and a renewal of Rs 15 for the next three years, but a lapsed renewal is exactly what disqualifies a death claim. A worker who lets registration go stale for the sake of Rs 15 leaves his family without a Rs 2,00,000 to Rs 4,00,000 entitlement.

How much is paid, and when?

Cause of death Amount
Accident during work Rs 4,00,000
Natural death Rs 2,00,000
Funeral assistance (separate) Rs 20,000
Widow pension (separate, monthly) Rs 1,500

The death benefit is a single payment made into the claimant's bank account. The Rs 20,000 funeral assistance is a distinct scheme meant to cover the immediate cost of last rites and should be claimed alongside, not instead of, the death benefit. Where the deceased leaves a widow, the board's widow pension of Rs 1,500 a month is a third, continuing entitlement and is claimed on its own form.

The distinction between the Rs 4,00,000 and Rs 2,00,000 rate turns entirely on whether the death was accidental and occurred during work. Families should therefore ensure that a post-mortem is conducted and an FIR or employer accident report is registered where the death happened on or around a construction site; without that paper trail the board has no basis to sanction the higher rate.

How to apply for the HPBOCWWB death benefit online

  1. Open the board's portal at bocw.hp.gov.in on a computer or phone.
  2. Select Apply for Benefits from the online services menu.
  3. Choose the Death Benefit scheme from the list of board schemes.
  4. Enter the deceased worker's beneficiary ID and date of birth, then click Search so the portal pulls up the registration record. If you do not know the ID, use the portal's Find Beneficiary ID service first.
  5. Fill in the claimant's details β€” name, relationship to the deceased, Aadhaar number, mobile number and bank account details.
  6. Upload the death certificate, the claimant's identity proof, the bank passbook and, for an accidental-death claim, the post-mortem report or FIR.
  7. Click Submit Application and save the application number shown on screen.
  8. Track the file later through the portal's Check Application Status service using the same application number.

How to apply offline

  1. Visit the office of the district Labour Officer or the Labour Welfare Office in your district with the deceased worker's registration card.
  2. Ask for the claim form for payment of death benefit under the HPBOCWWB schemes and fill it in the claimant's name.
  3. Attach the death certificate, identity proof, bank passbook, photograph and, where the death was accidental, the post-mortem report or police report.
  4. Submit the form and collect a dated acknowledgement or diary number.
  5. Follow up with the same office quoting that diary number.

Assistance is also available from the board's head office at Old SDM Office, Hamirpur 177001, telephone 01972-222411, email hpbocwwboard@gmail.com.

How do I check the status of a claim?

The board portal carries a Check Application Status service under its online services menu. Enter the application number issued at submission, or the beneficiary ID of the deceased worker, to see whether the file is pending with the district office, has been returned for want of documents, or has been sanctioned. The portal also publishes running counts of applications received and approved, as of the board's own dashboard update dated 4 August 2026, 1,91,608 applications had been received across all board schemes and 76,215 approved, with an average registration processing time of about 287 hours.

Those numbers are worth reading honestly: a large gap between received and approved reflects both pending files and rejected ones, and a claimant should assume active follow-up is needed rather than a silent automatic sanction.

Why do death benefit claims get rejected?

  • Registration not active on the date of death, the single most common reason. The three-yearly contribution or renewal had lapsed.
  • Aadhaar verification pending on the deceased worker's record. The board runs a separate Aadhaar verification service precisely because unverified records stall benefit claims.
  • Claimant is not the recorded nominee and has not produced a legal heir or succession certificate.
  • Accidental death claimed without supporting evidence, the claim is then usually sanctioned at the lower Rs 2,00,000 natural-death rate rather than rejected outright.
  • Name mismatch between the death certificate, the registration record, the Aadhaar card and the bank account.
  • Bank account details wrong or in someone else's name, so the transfer fails.
  • Continuity certificate not uploaded, where the board has asked for proof that the worker was still engaged in construction work.

Most of these are curable. A returned file can be resubmitted with the missing paper through the same portal or district office; there is no penalty for a second submission.

Key dates and time limits

Payment of Death Benefit has no fixed application window. The claim is filed after the worker dies and the board portal accepts benefit applications through the year. What is time-sensitive is the deceased worker's own registration cycle: contributions run in three-year blocks and lapse if not renewed, so the relevant date for a family is the renewal date on the worker's card, not any scheme deadline. Where the board has notified a limitation period for filing a particular claim, the district Labour Officer will state it; that period is not published on the board's public pages, so families should file promptly rather than assume an open-ended window.

Frequently asked questions

How much does the HPBOCWWB death benefit pay?

Rs 4,00,000 is paid if a registered construction worker dies in an accident during work, and Rs 2,00,000 is paid on natural death. Both rates are published on the board's own portal at bocw.hp.gov.in and are paid to the nominees or dependants named in the worker's registration record.

Who can claim the death benefit under HPBOCWWB?

The nominee, dependant or legal heir of a worker registered with the Himachal Pradesh Building and Other Construction Workers Welfare Board can claim. The worker's registration must have been live on the date of death, which in practice means the three-yearly contribution or renewal was paid up.

Is the death benefit different from the funeral assistance?

Yes, they are two separate benefits. The board pays Rs 20,000 as funeral assistance to meet immediate cremation and last-rites costs, and pays the death benefit of Rs 2,00,000 or Rs 4,00,000 separately. A nominee should claim both.

Can the family of an unregistered construction worker claim this benefit?

No. Families of unregistered workers are not eligible. The benefit is tied to the deceased person's own registration with the HPBOCWWB, so a labourer who never registered, or whose registration had lapsed, leaves the family without a claim under this scheme.

How do I apply for the HPBOCWWB death benefit?

Open bocw.hp.gov.in, choose "Apply for Benefits", select the death benefit scheme, search using the deceased worker's beneficiary ID and date of birth, fill the form and upload the death certificate and supporting papers. The same claim can be filed on paper with the district Labour Officer.

What decides whether Rs 2,00,000 or Rs 4,00,000 is paid?

The cause of death decides the rate. Death caused by an accident during work attracts Rs 4,00,000; any other death attracts Rs 2,00,000. A post-mortem report, FIR or employer accident report is what usually establishes the accidental cause.

What is the widow entitled to after the worker's death?

A widow of a deceased registered member is separately entitled to a widow pension of Rs 1,500 a month under the board's schemes, in addition to the one-time death benefit. Ask the district Labour Officer to record the pension claim at the same time as the death claim.

Where do I complain if the claim is delayed?

Contact the HPBOCWWB office at Old SDM Office, Hamirpur 177001 on 01972-222411, or email hpbocwwboard@gmail.com. Claims are processed through the district Labour Officer, so the district office is the first place to chase a pending file.
